Bender Pleads Guilty To Using, Dealing Drugs By Rick Murphy
The topsy-turvy world of Southampton Town politics took an unfathomable turn last week with the abrupt resignation of Councilman Brad Bender. More shocking was the reason why: Bender admitted in court to illegal conspiracy to distribute oxycodone pills, a powerful narcotic opioid alkaloid to which scores of overdose deaths on Long Island have been attributed. Bender also acknowledged he has become addicted to the drug. He was released on $100,000 bond. The Southampton Town Board will hold a special election to fill the vacated seat on January 26. Michael Troyan, a Riverhead physician’s assistant, was arrested on November 4 – Election Day -- by Drug Enforcement Administration agents and charged with illegally obtaining and conspiracy to distribute oxycodone. In the course of the investigation agents became aware that Bender was one of Troyan’s distributors and had obtained “several thousand

pills” over three years, according to Assistant U.S. District Attorney Allen Bode. Bender acknowledged in federal court he resold the pills, sometimes trading them for steroids. He faces up to 20 years in prison but will likely settle for two to three years, court observers said, with the condition he cooperate with the
investigation. Troyan has pleaded innocent. “DEA and our law enforcement partners will continue to identify the diverted painkiller suppliers, be it an oxy street dealer, a rogue doctor, or a greedy physician’s assistant,” DEA Special Agent in charge, James J. Hunt said. Troyan, according to sources, was mentioned in the probe of the Southampton Town Police Officer Eric Sickles, who became addicted to drugs and was ultimately suspended. He has since been reinstated. The Democrats and Republicans clashed over the fate of Lieutenant James Kiernan, Sickles’ boss who ran the Street Crimes Unit and was also a Republican Party committeeman. In a hastily called emergency meeting of the town board November 24, Southampton Town Supervisor Anna Throne-Holst announced Bender’s resignation, submitted by letter. She said the town board had no inkling of what was happening. “We do not know any more than anyone else and we are waiting for word from the authorities,” she stated from the podium. Bender’s involvement in a
widespread ring to distribute the dangerous painkiller brings into question how long party loyalists have been aware of his problem and whether cover-up was involved. Bender, an Independence Party member, is a favorite of Frank MacKay, the controversial head of that party, as well as Southampton Town Democratic Party boss Gordon Herr. Both men allowed Bender to run on their tickets in 2013 though he had lost in 2011 and alienated more than a few party loyalists with a post election diatribe – during which he appeared to be under the influence. Damon Hagen, who lost a bid for the town board in November, noted that Bender admitted he’s been an addict for some time. “Bender screened in 2013. I’m concerned the Democratic Party put a drug dealer on the streets in the Northampton, Riverside, Flanders community that is fighting drug related crime.” “I certainly had no idea [Bender was an addict]” said Jay Schneiderman, who will take over the supervisor’s seat in January. “I didn’t know him well but he must have been highly functioning to CONTINUED ON PAGE 22.

LEAVE THE GUN, TAKE THE CANNOLI Why was I so happy that Vincent Asaro, the 80-year-old reputed mobster charged in connection with the 1978 six-million-dollar Lufthansa robbery, walked out of federal court in Brooklyn a few weeks ago a free man after a jury cleared him? To begin with, the Lufthansa case is 35 years old. The money has been spent. Almost all the people involved are dead — most of them murdered by James (Jimmy the Gent) Burke, the mastermind behind the heist. Burke’s killing all his associates brings to mind a great quote attributed to mobster Bugsy Siegel in the 1930s, when a woman seated next to him at a fancy dinner party expressed shock that she was sitting next to this stone-cold killer. Bugsy smiled and said, “Relax, lady, we only kill each other.” The Vincent Asaro case was a joke. The amount of money – taxpayer money – that was spent trying to send this old geezer to prison is shocking. He got the last laugh when he walked out free when the jury refused to believe the words of killers that the government produced as witnesses against him. As Mr. Asaro, surrounded by
reporters and well-wishers, climbed into the passenger seat of a white Mercedes outside the courthouse, he got the last laugh when he turned to his driver and said, “Don’t let them see the body in the trunk.” That wise-guy laugh line reminds me of the sign that Mafia leader Carlos Marcello had on a wall in his New Orleans office. It said: “THREE PEOPLE CAN KEEP A SECRET IF YOU KILL TWO OF THEM.” In the end, something great came out of the Lufthansa heist. In 1990, the talented writer Nick Pileggi and director Martin Scorsese used it as part of the plot in the film “Goodfellas”, one of greatest films of all time. I should know, I’ve seen it at least 200 times. Like “The Godfather” and “The Godfather Part II” If they’re on TV, I’m watching them. For me, you can say, it’s an “Italian” thing. “Leave the gun, take the cannoli.” That one line from “The Godfather” sums up the Italian sense of life. It’s never what people think it is. The simple, happy, mandolinplaying people never existed. Italians like the Mafia for the

same reason Wasps admired Microsoft. Guys who “coulda been contenders” always identify with guys of the same ethnic persuasion who got to the top of the heap – no matter how ugly the heap may be. Before Rudy Giuliani (an Italian) put the skids on and eventually crushed the Mafia – utilizing RICO laws that had the gangsters informing on each other to stay out of jail – the parallels between the Mafia and Microsoft were there. The Mafia had been around longer than Microsoft. Both were winning, efficient organizations that were merciless with their competition. In the early days, before Steve Jobs and Apple, Bill Gates crushed competitors economically and left them the walking dead. The Mafia, on the other hand, went that little extra step and actually whacked its competitors and left them the very dead – often wedged in the trunks of cars. Both organizations had to put up with government interference. Bill Gates and his executives had to duke it out with the government and then paid a few billion-dollar fines here and there and went on their way. The wise guys did their stretch in the slammer and came back to the old neighborhood the better for it. So the Mafia didn’t have a website and wasn’t listed on NASDAQ. Big deal! The Mafia had something that Microsoft will never have – its own television show, and everybody loved it: “The Sopranos.” “The Sopranos” did for Italians what “The Goldbergs” did for Jews

and “I Remember Mama” did for the Norwegians. The truth of the matter is 99.9 percent of Italian-Americans are hardworking, completely honest and would never even jaywalk, but that doesn’t keep them from enjoying the tough killer reputations of the 0.1 percent who belong to the Mafia. For honest Italians, this grudging admiration comes to them with a certain amount of paranoia. Here’s how it worked out for me: Many years ago, my advertising agency received a call from a large corporation telling us they were interested in our handling their advertising account. I checked into the company and found the chairman was Italian and from my old neighborhood in the Avenue U section of Brooklyn. “Nothing doing,” I told my staff. “If he comes from my old neighborhood, he’s got to be connected and I’m not going to deal with anyone who is connected to the Mafia.” My associates persisted. “You’re not being fair,” they said. “Okay, let’s investigate this guy before we take his account.” So we hired a private detective to tell us all about the company chairman. The report came back: “He’s clean. An upstanding member of the community. Straight as they come.” So we took the account. We did a lot of good work for the company and both our firms prospered. One day the chairman invited me out to his home in Greenwich, Connecticut for dinner. We talked about the old days in Brooklyn. He was older than I was and I got up the nerve to say, “You know, when you wanted to hire us, I knew you were from the old neighborhood and I had you investigated.” He looked at me and laughed. “”You jerk,” he said. “What do you think I did before we called you?” We spent the night laughing about the Mafia. Oaks For Oakland By Kitty Merrill
Concerned volunteer Sag Harbor residents and a number of local businesses planned to rally together on Monday and yesterday as The Independent went to press, to kick off a rehabilitation and restoration of the historic Oakland Cemetery. The community-driven initiative Oaks for Oakland was conceived, and is being led by Sag Harbor residents landscape architect Edmund Hollander, a member of the Sag Harbor Tree Fund, and Neil Slevin. “Although East End architectural landmarks have long been acknowledged and celebrated, historic landscapes haven’t enjoyed the same reverence and attention,” commented Hollander. “What we’re doing together for ‘Oaks for Oakland’ will shine a muchdeserved spotlight on an important
example of our civic responsibility to maintain and perpetuate an important example of local lore . . . and of American history.” With full sanction and support of Sag Harbor Village Mayor Sandra Schroeder and members of the Oakland Cemetery Board of Directors, and advocacy groups such as his own Sag Harbor Tree Fund, Save Sag Harbor and the Sag Harbor Partnership, Hollander has mobilized area tree care, landscaping and excavation companies – all of which are donating their time and expertise, to cut down all the dangerous dead and dying trees that now pose a threat to the sanctity of the 10-acre non-denominational cemetery. The Oaks for Oakland project will also remove dangerous dead limbs and branches from the remaining healthy trees in the

cemetery. Starting in spring 2017, new oak trees will be planted on the grounds, insuring that Oakland Cemetery will have healthy oaks for generations to come. “Sag Harbor is a successful community not only because of our diverse citizenry, but the willingness of so many different groups of people from members of old time families to newer residents to devote their time and to work together to improve our village and its important public spaces,“ observed Mayor Schroeder. “We are nothing without our volunteers.” Oakland Cemetery, which was
officially established in 1840, tells the tale of the community’s historic whaling industry that was the village’s original cornerstone. In earlier times, Sag Harbor rivaled New York harbor for its abundance of whaling vessels. There are more 18th and 19th century sea captains buried in Oakland than in any other Long Island cemetery. They include Stephen Howell, scion of one of the village’s leading whaling families, plus Captain David Hand . . . and all five of his wives. The cemetery contains ancestors from many of the founding families of Sag Harbor with still-familiar Continued on page 9.

Push For Disabilities Office By Kitty Merrill
Looking at members of the East Hampton Town Board up on the dais in Town Hall, Glen Hall asked, “What if any of you had to be in a wheelchair? How would you get up there? This is against the law. It’s been against the law since 1992.” . . . “How would you feel if you were in a wheelchair?” he continued. “Would you have someone carry you to get up there? It’s not right.” Hall is the chair of the East Hampton Town and Village Advisory Board. Recently, he appeared before the board, asking members to reinstitute a town disabilities office. In 1993, shortly after the American Disabilities Act passed, the town set up a disabilities office to help inform the public and facilitate compliance with the new law, Richard Rosenthal informed. Rosenthal worked in the office for about 10 years before he retired. The office was closed under the Wilkinson administration (20102013). A good part of the job, Rosenthal said, was talking with local store owners and institutions and finding out how much they wanted to cooperate with the implementation of ADA. “People were really for it,” he recalled. But, over time, the political climate changed, and enforcement of requirements lagged. Hall experienced a sense of déjà vu speaking to the town board on November 5. Twenty years ago, when he was appointed chair of the advisory board, Hall spoke to lawmakers in the building that used to house town hall. He told them the front door wasn’t compliant. A person in a wheelchair couldn’t get in.
“Here I am 20 years later saying ‘The front door. You can’t get in,’” Hall exclaimed. A self-opening door should have been designed when the new Town Hall building was constructed. “Why wasn’t it?” Hall asked. It’s embarrassing when a person is disabled and can’t get where he wants to go, he said. There are examples like the door “all over town,” Hall informed. East Hampton needs to get the disabilities office back up and staffed with a person focused on ADA compliance. Tom Lawrence, the former building inspector for East Hampton Village, agrees. Hall read a letter of support from Lawrence. As East Hampton’s base population ages, the likelihood of either temporary

or permanent disabilities increases considerably. A disabilities officer would reinforce the town’s commitment to protecting the rights of citizens to access. A d d i t i o n a l l y, a d e d i c a t e d disabilities officer could serve as a full time expert, relieving other enforcement officers of the burden of becoming versed in the
complexities of ADA law. Hall and Rosenthal proffered their request during a public hearing on the proposed 2016 budget, asking a line be added to cover the cost of re-opening the office. The line was not added, nor was the request discussed before a vote adopting the budget was taken.

New Life, And Roof For Fort Pond House By Kitty Merrill
Independent / Kitty Merrill
Councilman Peter Van Scoyoc offered a tour of the newly-renovated Fort Pond House, located at Carol Morrison Park in Montauk. Quaint cedar shingles, a new roof, and a sweeping water view are highlights of the site.
Five years ago, it was at the epicenter of a political battle between a beleaguered Republican administration struggling to dig East Hampton out of a multi-million dollar financial hole and impassioned Democrats and environmentalists determined to preserve a part of Montauk’s history. Five years ago, then-supervisor Bill Wilkinson included the Ford Pond House on a list of assets that could be sold to help reduce a massive deficit incurred by his predecessor, disgraced former supervisor Bill

McGintee. At the time, Fort Pond House was a ramshackle cottage used by local civic groups for meetings. Former super visor Jay Schneiderman (2000-2003) purchased the waterfront property for $890,000. By 2010, it was reportedly appraised at twice that price. The sale was so vehemently opposed by hamlet residents, some of who launched lawsuits against the town and Wilky to quash the move. The idea died a quick death, and Fort Pond House stayed as it was . . . which was seriously dilapidated. Enter a new administration, and a new push towards rehabilitating Fort Pond House at the newlychristened Carol Morrison Park. This week, Councilman Peter Van Scoyoc, who spearheaded the project, offered a tour of the restored four-acre site and comely cottage. Work began about year ago, the councilman reported. First on the agenda was a new roof for the 1925 bungalow located on the water off Second House Road. Van Scoyoc reported finding an old aerial photo taken right after White’s drug store was constructed on Main Street. Fort Pond House was the only visible building on the water back then. The “bones” of the house were in pretty good shape, informed Van Scoyoc, who is a professional builder when he’s not undertaking town board duties. The interior, he said, was “really gross, mostly because of the roof,” which set the 1200 square foot cottage up as a hang out for raccoons. Original heartwood pine floors were uncovered and restored, rustic cabinets and an old farm sink in the tiny kitchen were salvageable, as was the massive stone fireplace. Entrances were crafted to comply with the Americans With Disabilities Act. Invasive species were cleared from the rolling, overgrown yard. Local nurseries -- Fort Pond Native Plants and Warren’s – lent a hand identifying plants and clearing the site. “We want to find how to bring this back to public use and manage it going forward,” Van Scoyoc said. Later this month, the town board will review a management plan for the property. “The idea is to cover maintenance costs through user fees,” he said. The councilman envisions modest rates for local organizations, say, $50 for two hours. After the first of the year, the town can start booking users. The park is open during daylight hours now . . . just keep off the freshlyplanted grass.

EDITORIAL About Credibility
In our business credibility is THE essential asset. Our job is to inform the public, to relate what is happening. We are lucky to have veteran reporters, arguably the best in the business, on staff. The last time The Independent was accused of misreporting was during the Bill McGintee administration. McGintee, the East Hampton town supervisor, Bill Taylor, a town employee and the head of the Democratic party, and several suckups and never-wases accused us of fabricating our story: that the Suffolk County District Attorney and the Office of the State Comptroller were investigating the town’s fiscal machinations and millions of dollars were missing. In fact, as Suffolk District Attorney Tom Spota publicly stated soon afterwards, the party insiders knew McGintee was in hot water and deliberately hid it from voters. By the way, Spota and New York State Comptroller Tom DiNapoli acknowledged it was The Independent’s coverage that brought the matter to their attention. David Betts, the East Hampton Town Public Safety Administrator, told our News Editor Kitty Merrill last week that a proposed rental registry law won’t work the way supporters believe, that it wouldn’t make it any easier for investigators to gain entry into overcrowded houses or pursue excessive turn over. No surprise, there – he said the same thing in public before. Betts should know – he was in charge of the Southampton code enforcement office back in 2008 when that town passed a rental registry law. By the way Michael Sendlenski, a Southampton Town attorney who championed the plan then, is an East Hampton Town attorney now, and he’s still pushing for it, even though both men know damn well it’s been a flop in Southampton. At a public hearing the night after The Independent was published, Betts stood in front of 300 people and backpedalled. A few days later at an event at the East Hampton Library he publicly accused this newspaper of misquoting him.
Independent VOICES
Wanton Destruction
Letter to the Editor, As I write this, it is a week since a sadness has been visited upon the many regulars of Sammys Beach; those who take their daily strolls along the Bay, or walk their dogs on the dirt road to the jetty. Quite a different feeling from the one
everyone experienced about a year or so ago, when suddenly a beautiful teak bench, bearing a family inscription, inviting the public to join them in their enjoyment of Sammys Beach, appeared at the top of the Beach on Sammys Beach Road, adjacent to the parking lot. But during the evening of Friday the 20th, people in a pickup truck, with six-packs and bottles of beer came to the Beach and wrenched the bench, cement plugs, and heavy chain from its resting place. They pulled the bench a few hundred feet down the beach and lit it on fire,
Let’s get one thing straight: The Independent doesn’t misquote people, and we don’t turn the other cheek, either. We don’t allow career bureaucrats to question our ethics. Here are the facts: After The Independent article came out Betts was apparently told by a superior to distance himself from his original statements. You would think a former cop would have the gumption to stand up for himself. Not this one -- word is he outlived his welcome in the Southampton Village Police Department after an ugly incident. This is a man who has been sucking off the public teat for decades. In fact, he double-dipped for two years beginning in 2011, accepting his police pension in addition to his fat salary as head of Code Enforcement in Southampton Town. He ran out his welcome in that job too, at one point drawing a suspension. Then Dave Betts ran for Southampton Town Highway Superintendent, looking for yet another fat salary. He had a lot to say about his opponent, the incumbent Alex Gregor, usually off the record and behind Gregor’s back. That’s the way he rolls. Gregor stands up for himself, doesn’t take any guff from higher-ups who know nothing about his job, and does the right thing by his employees. He’s a stand-up guy with a backbone, and that’s the kind of person you want in charge of a department. Betts got clobbered in the election. Betts still had a card to play – his wife works in the East Hampton Town budget office, and Betts secured his current position and as usual went about the business of pissing off subordinates and impressing no one with his nonexistent work ethic. This isn’t about a rental registry law. It’s about a subordinate who got caught mouthing off and had to backtrack to save his own ass, one who confuses “I was misquoted” with “I wish I hadn’t said that.” partying with their beer while the bench burned! Imagine the shock and dismay of the beach-going regulars when Saturday morning they saw what had happened. Who would do something like this? This is much more than a prank. It is the wanton destruction of public property offered, I am sure, lovingly, for people to sit and enjoy the wonderful surroundings and views of Sammys Beach. When I told my husband, a life-long resident of East Hampton, and a retired East Hampton Town police officer, his
Is it just me? You’re such a hypochondriac.
reaction, unfortunately based upon years of experience, was: Friday night, a pickup truck and beer -- it’s kids from the high school! We have no idea who it was, but it wasn’t the “summer crowd.” Sadly, these are people who live their daily lives amongst us; while having absolutely total disregard for the property of others. They probably think it’s a joke! There have to be people out there who know who is responsible for this uncaring, unthinking, selfish -- no actually stupid Continued on Page 16. © Karen Fredericks

JUST ASKING
By Karen Fredericks
Have you had your first Christmas decoration sighting yet? Kate Mueth Yes. There’s a place on the highway in Southampton. I think they sells boats. They’ve got tree lights and large blowup holiday things. I think they leave them up all year and then just turn on the lights each year when the holidays approach. Pamela Shulman Yes! The Empire State Building was lit up for the holidays when I was in the city. It’s amazing how fast this year went by. I can’t believe we’re so close to Christmas.
Marcia Grant I saw some lights and decorations were already up in Amagansett Square. My birthday is on Christmas Eve, on the 24th, so I always notice those first signs of Christmas. Make the Season Bright for a Homeless Pet! A Home For The Holidays is Cowboy's wish. This well trained boy just loves to be with people! This will be his 3rd Christmas here. Please adopt or foster Cowboy; don’t let another Holiday go by. Sponsor a shelter pet for $75.
Charlotte Peters My grandfather drove me by a house that had decorations and lights on the fence and then to another one that had decorations on the house.

It’s time for ho ho ho-liday fairs. Pierson High School in Sag Harbor and St. Michael’s senior housing complex in Amagansett were just two of the East End locales where shoppers could browse awesome handicrafts and festive décor over the weekend. Check the calendars in our Arts & Entertainment section for a listing of more chances to shop local and support area schools, churches, and civic organizations.

for the vacated seat — John Bouvier beat her by a scant 115 votes. After the 2011 election Bender lashed out at fellow candidate Christine Scalera and longtime board member Nancy Graboski as well as several other entities, including this newspaper, because he lost the race. Several onlookers noted he was slurring his words. He reportedly blamed it on having a bad reaction to medication afterwards. Should a Republican prevail in the upcoming special election, it will set up an interesting scenario – Police Chief Robert Pearce resigns in April, and Kiernan could be a possible candidate. Picking the police chief has caused major party riffs in recent years.

See the museum’s historic galleries come to life in a remarkable display of holiday arts and crafts, ornaments, home decor, rustic Santas and gnomes, wood carvings, and much more. Admission is free. • A Christmas Bazaar will be held at the Old Steeple Community Church on the Main Road in Aquebogue from 9:30 AM to 2 PM. Expect crafts, quilts, cookies, and a Chinese auction. Luncheon will be served. • The Riverhead Moose Lodge at 51 Madison Street will have a special guest for breakfast Saturday morning. Breakfast starts at 8:30 AM and Santa Claus arrives at 9:30. Adult breakfast is $7, children’s breakfast (age nine and under) is $5. If children bring an unwrapped toy for “Toys for Tots,” their breakfast is free. The message is “It’s better to give than to receive.” Santa will be available for photos, so bring your camera. This is open to the community, however reservations are a must! Call 631-591-3287 for information or reservations. • The Southold Historical Annual Holiday Fair takes place at the Peconic Recreation Center, located at 970 Peconic Lane from 9 AM to 4 PM. All proceeds from the fair will go toward the repair of the Merganthaler linotype machine which is housed in the Society’s Robert E. Long Print Shop. Specially selected vendors will have a variety of holiday gifts and cards available for purchase. The Railroad Museum of Long Island will erect an elaborate model train display, sure to please old and young alike. For children, there will be face-painting, a craft room, and the most exciting part – Santa Claus will be on site – distributing small gifts to the children. Children can have their photo taken with Santa and will receive a print free of charge. The day’s activities will be rounded out with a bake sale of homemade delicacies and a café

for those who get hungry during their visit. A raffle of prize items and baskets will feature goods donated from variety of local merchants, farmers, and local artists. Among the raffle items are gift certificates to local restaurants and stores, baskets of Long Island wine, selections of hand-made candies and treats, as well as specially prepared items from local farms, including Catapano’s and Krupski’s. • Talmage Farm Agway on Osborn Avenue in Riverhead welcomes Santa. It wasn’t the prettiest night, but the result is one pretty lighthouse. Saturday the annual “Light the Light” event saw the historic Long Island icon ablaze with hundreds of lights. The festive illumination is a sight visitors to Montauk State Park can behold every night until January 6.

By now you know where you stand. If you have five or six wins, you probably have to win this week to get into the playoffs and a shot at the money.
Even if you do win, you may need help. That is, there are probably several teams in your league with a shot at the last remaining playoff spot. Here are few tips on beating

the odds. A lot of team owners stop paying attention once their team is eliminated. It makes sense when you think about it – why waste time on a losing team? The answer is it’s the ethical thing to do. You owe it to the other owners to play hard from the first until the last game. Case in point, last week I went into a critical matchup with a 5-5 record. There were two other team with identical records, and one had an opponent with three empty slots in his lineups – the players were either injured or on bye week. He just didn’t care. So I emailed him, nicely. I told him who I was, that he’d been in leagues with me before, and that I needed him to put a competitive lineup out there. I offered some friendly advice: “You can pick up Whitten off the waiver wire to play tight end.” Naturally, nothing is free, I promised him I wouldn’t forget his favor and that some day the shoe would be on the other foot. My gambit worked: he changed his lineup Sunday at noon; his opponent, who assumed he’d be getting an easy win, didn’t even field his best lineup, and he lost. Now, I’m playoff bound and he’s not. Go through the lineups of every team. Whenever a team with a losing record is playing a team with a winning record, email the owner of the lesser team and give
him a little pep talk; Let him know if you see a move that will improve his team. You’ll be surprised how it works. If you are facing elimination this week, fire all your cannons (bet everything you have on free agents you may need (save a buck just in case you need a kicker down the road). Check the projections carefully: you may have a good running back facing a very tough defense, and a lesser running back who figures to get the ball a lot. Go with the guy with the most upside. Think out of the box: Peyton Manning is a legend, but he’s washed up. A lot of players picked up Mark Sanchez last week even though he hasn’t started a game all year until now. Ditto Brock Osweiler, Manning’s replacement. He may be an unknown quantity, but if the guy you have is stinking up the place, what are you waiting for? If Marcus Mariota is available and you need a QB grab him – he may be a rookie, but you are desperate. Check your kicker. If he’s playing in an outdoor environment, and it’s windy, cold, or raining, consider replacing him. Remember, it’s always easier to kick in a domedstadium, and the ball carries farther, meaning longer field goals. Injuries occur every week. If you see a guy go down, check to see who his backup is. Sometimes the only difference between a star and a scrub is playing time. Ideally, you’ve been fine-tuning your team for a playoff run and you’ve clinched a spot. If you haven’t that becomes your only priority — you have to be in it to win it.

It’s The Most Scammiest Time Of The Year This time of year, a time of giving, is, unfortunately, “a p r i m e o p p o r t u n i t y f o r cyber thieves and scammers to take advantage of unsuspecting shoppers,” said Governor Andrew Cuomo in a release this week. “I encourage all New Yorkers to remain vigilant and exercise caution while shopping this holiday season in order to avoid becoming a victim of these unscrupulous practices.” Fraudsters will take advantage of the holiday shopping season to scam consumers and steal their money and identity. The Federal Bureau of Investigation’s Internet Crime Complaint Center received reports from more than 14,000 New Yorkers in 2014, who reported over $47 million in losses due to cybercrime. In New York State, there were over 3000 identity theft complaints reported by consumers during last year’s holiday season from November 2014 to January 2015. To avoid scams and ID theft, the New York State Division of Consumer Protection and the New York State Office of Information Technology Services offer the following tips: • Only buy from merchants and websites you know and trust. • Beware of misleading ads. Make sure you understand the offer and read the fine print. • Think twice before clicking on email links or pop-up advertisements. To protect your personally identifiable information: • Secure your computer and mobile devices. Keep your anti-virus and anti-spyware software current, along with your firewall. Be cautious about free downloads; free can be costly. Screen savers, e-cards, or other free seasonal downloads can carry viruses. • Don’t use public Wi-Fi for personal banking or online shopping. Personal information should never be sent through unsecured wireless connections in public places. • Secure your home Wi-Fi. • Secure your purchase. Look for the “https” at the beginning of the URL. The “s” stands for secure and indicates that communication with the webpage is e’\\crypted, thus protecting your information. • Take precautions with the passwords you use for online accounts. Use different passwords for different online accounts, especially for those accounts tied to your financial information. Create long, complex passwords using upper and lower-case letters, special characters and numbers. A password with at least 10 characters is generally recommended. Consider
changing your passwords after the holiday shopping season ends. Be sure to log off a website after completing your online transaction. • Avoid unsolicited offers. When shopping online, type in the name of the site you are visiting instead of clicking offers in emails or pop-ups since they carry the risk of identity theft and fraud. • If any email asks for your personal or financial information, it’s most likely a scam. Do not respond to unsolicited emails requesting your password, PIN or other sensitive information via email. A legitimate organization will never initiate contact with you via social media or email to request personal or financial information. If the email appears to be from
your bank or credit card company, contact them directly. • Pay with a credit card. When shopping online or in a store, be sure to use a credit card, not a debit card. Credit cards are covered by the Fair Credit Billing Act, giving you greater protection against fraudulent charges, and allowing you to more easily dispute an item on your bill if you don’t receive it. Consider using a separate credit card for online shopping, so only one card is affected if the online retailer or credit card processor gets breached. If you pay by cash, keep your receipts. Monitor your accounts: • Keep a paper trail. Save records of your online transactions, including the product description,
December 2, 2015
price, conditions, warranties, the online receipt, and the emails you send and receive from the merchant. • Beware of small charges on your bank statements. Hackers use small charges as a validation test. Any unknown charges could be a sign that a card has been compromised. If you think you are a cybercrime victim: • Contact your financial institutions. Immediately notify your bank, credit card company and anywhere else you have accounts to let them know that someone may be using your account fraudulently. • Reset your passwords. If you’ve been hacked, there is a chance that passwords to your other accounts have been stolen. Reset your passwords for your critical accounts first, starting with your email account, followed by financial and other critical accounts. Continued on page 31.

A hand very similar to this one was played recently at the Water Mill Bridge Club. It is an example of a game bid in a minor suit. Very few hands end up at 5C or 5D, but this is one that was correctly bid to 5D. When West led and dummy came down, South noted that he would lose the ace of diamonds and one or two spades. He definitely did not want to have to lead spades because he feared that West held both the ace and queen. How to avoid that? South’s plan was to eliminate hearts and clubs from dummy and his hand. Then he could lead a diamond, which West could win but then West would have no safe lead. If he led a spade, South’s king becomes a winner. If West led a club, South could ruff in dummy and discard the 4 of spades. If West decided to ruff the third heart with the ace of trumps, South would discard the last club in dummy and West had no safe lead.

Continued from page page 29. It is important to start with email accounts, since password resets for all of your other accounts are typically sent to your email. • Put a freeze on your credit accounts. Contact all three major credit bureaus — Experian, Equifax, and TransUnion — to request a credit report, and have a fraud alert and a credit freeze placed on your account. • Contact your local police. File a report so there is an official record of the incident. For more information or to file a complaint against a business, visit the New York Department of State’s Division of Consumer Protection website or contact the Division’s hotline at 800-697-1220. The Consumer Assistance Hotline is open Monday to Friday, excluding federal holidays, 8:30 AM to 4:30 PM.
