o okay this September, Palestine stole the media light, quite unexpectedly, from the usual mundane issues that are discussed at the United Nations General Assembly each year. Pardon my condescension, but when I say 'mundane' issues, I refer to issues of poverty, hunger, relief from natural calamities and so on and such, because, however pertinent these issues might be, they remain issues for discussion for these world leaders, and little for implementation. For some time now, these issues have been clubbed under the Millennium Development Goals, making them achievable only on paper while nations continue to witness an ever-widening gap between the rich and the poor. Terrorism, in the decade since 9/11, 2001, has been high on the UNGA agenda, but, despite the big noise that member nations, especially those severely affected like India, make in the general debates during the annual UNGA, terrorism has been thriving and becoming a phenomenon beyond the control of civilized societies. So okay, the UNGA provides a relevant platform for countries to arrive at broad consensus on common international issues, but of what use, say, is an 'Outcome Document' of a special meeting of the Counter-Terrorism Committee commemorating the adoption of the Security Council resolution adopted ten years ago condemning the 9/11 attacks on the World Trade Centre buildings that at best 'urges' member countries to ensure zero-tolerance towards terrorism? So okay, I did infer that the UN was a relevant body, in that the very convergence of the heads of state of so many countries every year is recognition that it matters. At 193 members, it is the single largest representative body of the comity of nations. But, unfortunately, the structure and functioning of this body both theoretically and practically, is so ineffective that no single aim for which it was formed is being achieved. The UN aims at facilitating cooperation in international law, security, economic development, social progress, human rights, prevention of wars and world peace. Hmm... if only these goals were not about people, but about political leaders alone, the world would have been a different place today.

And that, with disruptive vehemence, some of the most successful among South Asians in American media, marketing and entertainment business will have you believe, is what makes for path breaking innovations that shape the future. Carrying forth on the theme of creative disruption at the 2011 South Asians in Media Marketing and Entertainment Association (SAMMA) Summit held at the Time Warner Center in New York recently, leading industry professionals convinced participants and attendees that disruption works. "We are all disruptors," declared session curator Rishad Tobaccowala, Chief Innovations Officer, Vivaki/Publicis Worldwide, considered one of the world's foremost thinkers on digital, social media and marketing and one of Time Magazine's 'Top Marketing Innovators'. Laying the grounds for his own personal sense of disruption, Tobaccowala said, "The future does not fit in the container of the past." And in order to bring about change as a way to move forward, one has to either change the mindsets of the people or "change the people". "Change sucks," he said. "Change is not necessarily good. But the more you want things to remain the same, the more you have to change." Giving out the three words that an innovator should describe his/ her niche as - words that he has himself lived by - are future, change and innovation. "My one word for everything is Re-inventing," he told the raptly attentive audience. Speaking in the context of money, Deepak Masand, Cofounder and President of Global Medical Education - aptly described as one who brings a mindset of creative restlessness and insatiable curiosity to the world around him - said the future of money is money with IQ or "Intelligent Money". Historically, money has evolved only through six platforms of innovations over the last 10,000 years, Masand laid out, whether it was sheep as currency (9000 B.C.), or stone (800 B.C.), coins (640 B.C.), IOU's (100 B.C.), Flying money, as is currently in use - between the government and individuals (800), or credit cards (1958). The next linear innovation of money, if creatively disrupted,

would be "nothing", he said, "Nothing being intent." In general, Masand advised those on the path of innovation to not be afraid of the "how" of things, but of the "what". "Don't be afraid to be the black sheep," he says further. "Embrace the idea of failure, but not failure itself; don't be afraid to piss people off because the notion of 'elegant disruption' is a misnomer; and go big or go home." Another in-your-face speaker on this theme was Cultural entrepreneur Rohan Oza, the former

Oza, who was a partner at Glaceau where he built the powerhouse brands of vitaminwater and smartwater, which were later bought by Coca-Cola for $4.1 billion, went on to form Idea Merchants Capital that is currently pushing the popchips brand. Based on his corporate experience, Oza said big corporate giants rarely create 'disruption' because they are already doing well. And that, he says, gives entrepreneurs an opportunity to lead creative disruptions. "Don't feel bad about going by your gut," he said by way of giving some pearls of his multi-billion-dollar wisdom. "Don't be afraid to defy the experts. If you have an original idea, defy the experts; become a student of the industry; have the right ingredients; be different; do it better than the rest." Oza, however, adds that being different in a corporate set up can

get one fired, whereas if an entrepreneur is not different, he is dead. "You have to create the future, not participate in it," Oza said for all those who want to disrupt the present and shape the future. Panel discussions Simultaneous panel discussions throughout the day saw several industry leaders sharing their knowledge and stories of personal experiences as South Asian professionals in mainstream America. Panels discussed topics on bringing South Asian content and entertainment to the US; South Asian marketing; social media in-

SAMMA Awards The SAMMA Awards event on Sept 17, with leading professionals and celebrities from both the South Asian and mainstream American community well represented, was a glitzy and star-studded affair. Top honors went to Bollywood actress Priyanka Chopra for blazing trails in the US by pushing herself beyond Bollywood and becoming the first Indian Actress to secure a music recording contract in the US and CNN's Medical Anchor, Dr. Sanjay Gupta, who has become a household name for his contribution in advancing the

positive image of South Asians in the US and serving as a role model for South Asians in the media and entertainment industry. In his acceptance speech for receiving the 2011 Trailblazer Award, Dr. Sanjay Gupta of CNN said, "With so many trailblazers in the room, I am truly humbled by this award. Sometimes it takes a setting such as the one you are in, to truly be recognized as an individual. Otherwise often times I'm just "that Indian guy". I am so proud of all of you at this event and proud to be a part of this remarkable group at this astonishing time in history. If my Mom was here she'd tell you that I once wanted to change my name to something else, because I thought a name like "Steve" would perhaps draw less atten-

tion. She refused, and I relented. And I'm glad I did. Nowadays when asked if it was tough to land a job in television with a funny sounding name, I tell them that I'm quite sure that I didn't get a job in TV despite Sanjay being my name, I got the job because Sanjay is my name." The evening closed with a performance by breakout comedic actor/singer of Aamir Khan's recent critical hit 'Delhi Belly', Anusha Dandekar who gave a sneak peak to her upcoming US single followed by a special tribute celebrating Indian Cinema based on her critically acclaimed final item piece performance with Aamir Khan in the movie's closing sequence. World economy is in trouble: Manmohan Singh Prime Minister Manmohan Singh addressed the 66th session of the United Nations General Assembly's high level segment on Sept 24 - his first since 2008 - where he clearly referred to the deepening world economic crisis; India's unstinted support for Palestine; and the need for UN reforms. Excerpts from his speech:

W

e meet at this session of the United Nations General Assembly at a time of great uncertainty and profound change. Till a few years ago the world had taken for granted the benefits of globalization and global interdependence. Today we are being called upon to cope with the negative dimensions of those very phenomena. Economic, social and political events in different parts of the world have coalesced together and their adverse impact is now being felt across countries and continents. The world economy is in trouble. The shoots of recovery which were visible after the economic and financial crisis of 2008 have yet to blossom. In many respects the crisis has deepened even further. The traditional engines of the global economy - countries such as the United States, Europe and Japan, which are also the sources of global economic and financial stability, are today faced with continued economic slowdown. Recessionary trends in these countries are affecting confidence in world financial and capital markets. These developments are bound to have a negative impact on developing countries which also have to bear the additional burden of inflationary pressures. Declining global demand and availability of capital, increasing barriers to free trade and mounting debt pose a threat to the international monetary and financial system. Questions are being asked about the efficacy of the Bretton Woods institutions. There has been unprecedented social and political upheaval in West Asia, the Gulf and North Africa. People of these regions are demanding the right to shape their own future. Energy and food prices are once again spiraling and introducing fresh instability, especially for developing countries. The Palestinian question still remains unresolved and a source of great instability and violence. India is steadfast in its support for the Palestinian people's struggle for a sovereign, independent, viable and united state of Palestine with East Jerusalem as its capital, living within secure and recognizable borders side by side and at peace with Israel. We look forward to welcoming Palestine as an equal member of the United Nations. Terrorism continues to rear its ugly head and take a grievous toll of innocent lives.

Iniquitous growth, inadequate job and education opportunities and denial of basic human freedoms are leading to growing radicalization of the youth, intolerance and extremism. We have no choice but to meet these challenges head-on. We will succeed if we adopt a cooperative rather than a confrontationist approach. We will succeed if we embrace once again the principles on which the United Nations was founded the principles of internationalism and multilateralism. More importantly, we will succeed if our efforts have legitimacy and are pursued not just within the framework of law but also the spirit

affairs as it is within countries. Societies cannot be reordered from outside through military force. People in all countries have the right to choose their own destiny and decide their own future. The international community has a role to play in assisting in the processes of transition and institution building, but the idea that prescriptions have to be imposed from outside is fraught with grave danger. Actions taken under the authority of the United Nations must respect the unity, territorial integrity, sovereignty and independence of individual states. Correspondingly, governments are duty bound to their citizens to

create conditions that enable them to freely determine their pathways to development. This is the essence of democracy and fundamental human freedoms. There are many other things that we can and we must do. We must address the issue of the deficit in global governance. We need a stronger and more effective United Nations. We need a United Nations that is sensitive to the aspirations of everyone - rich or poor, big or small. For this the United Nations and its principal organs, the General Assembly and the Security Council, must be revitalized and reformed. The reform and expansion of the Security Council are essential if it is to reflect contemporary reality. Such an outcome will enhance the Council's credibility and effectiveness in dealing with global challenges. Early reform of the Security Council must be pursued with renewed vigor and urgently enacted. We should not allow the global economic slowdown to become a trigger for building walls around ourselves through recourse to protectionism or erecting barriers to movement of people, services and capital. Effective ways and means must be deployed to promote coordination of macro-economic policies of major economies. The reform of governance systems of international financial institutions ought to be pursued with speed and efficiency. The development agenda must be brought firmly back to the centre stage of the United

Nations' priorities. We need a much more determined effort to ensure balanced, inclusive and sustainable development for the benefit of vast sections of humanity. Each of us can contribute to this task, but we can achieve far more if we act in partnership. In the last few decades India has lifted tens of millions of its people out of abject poverty. We are in a position to feed our population better, to educate our people better and to widen their economic choices. But we still have a very long way to go. We wish to accelerate the pace of India's transformation in partnership with the international community. A fast growing India can expand the boundaries for the global economy. A democratic, plural and secular India can contribute to tolerance and peaceful co-existence among nations of the world. Developing countries need investment, technology and market access for their products. They need assistance in the areas of education, health, women's empowerment and the development of their agriculture. We have to pay particular attention to Africa. At the second India-Africa Forum Summit in Addis Ababa earlier this year India offered lines of credit worth five billion US dollars and an additional 700 million US dollars grant assistance for human resource development, transfer of technology and building new institutions. NEW YORK: Coinciding with the Indian Prime Minister Manmohan Singh's visit to New York for the United Nations General Assembly session, India's Finance Minister Pranab Mukherjee was also on a five-day visit to the US, working through a schedule that was busier than that of the prime minister. During his visit, between New York and Washington DC, Mukherjee attended the Annual fund Bank, G-20, G-24, BRICS and IMFC meetings; asked for more investment in India from foreign investors and business leaders; and took over, as India's representative, the Presidency of G-24 Group. During his first leg of visit in New York, Sept 21, Mukherjee delivered the keynote address at the 8th Annual India Investment Forum Meeting on the theme of India's continuing growth story; following which he addressed the US-India Business Council (USIBC)-FICCI Round Table meeting. During his second leg of visit, Sept 22, Mukherjee addressed the India-US CEOs Forum Meeting in Washington. The same day, Mukherjee attended the BRICS Finance Ministers' Meeting which has been convened by India on the sidelines of the Fund Bank and G-20 Meetings in order to explore the manner in which this group consisting of Brazil, Russia, India, China and South Africa can coordinate in addressing the evolving economic and financial situations in various countries of the world. The main objective of the meeting was to discuss the concerns regarding the current situation of the global economy and the policy response by BRICS member countries.

The next BRICS Summit is to be held in India next year for which a very large economic agenda is being worked out. All the BRICS members are currently members of the UN Security Council, and they have a convergence of views on a number of issues which are on the agenda of the Council. In this context, they discussed Libya, Syria and the Palestine issue. The BRICS members agreed that they should promote cooperation among other emerging economies and they support the early accession of Russia to the World Trade Organization. The BRICS members also had a discussion on climate change, and they supported the Common but Differentiated Obligations to deal with this challenge. They also believe there is need for greater financial and technological transfer to the developing countries and they will cooperate for a successful conclusion of the Rio+20. In the afternoon, Mukherjee attended the 86th Meeting of G-

24 Ministers, which discussed the issue of recovery, growth and development especially relevant given the current global economic environment. It also discussed the strategy and action plan for en-

The nuclear liability regime, which has become a sticking point in the full implementation of the India-US civilian nuclear deal, figured among one of the major topics of discussions between Clinton and Krishna, when the two leaders met last afternoon, a senior Obama administration official said requesting anonymity. "The Secretary urged India to ensure that its nuclear liability regime conforms with the Convention on Supplementary Compensation for Nuclear Damage," he said on the talks that lasted 40 minutes. The two leaders held discussion on a wide range of bilateral, regional and global issues. Both Prime Ministers noted the progress on major bilateral projects including the Dedicated Freight Corridor (DFC) and the Delhi-Mumbai Industrial Corridor. They agreed to continue discussions on nuclear cooperation after noting that all countries are conducting safety reviews. The discussions also took in the reform of the Security Council and it was agreed that the G4 consultations should continue. Singh told Prime Minister Noda that he was keenly looking forward to receiving the Japanese Prime Minister in India at the end of the year. It was agreed that the dates would be finalized through diplomatic channels. During 2012, Japan and India would be marking the sixtieth anniversary of the establishment of diplomatic relations. The two sides would further deepen political dialogue, their economic relations, ties in the field of security, cultural and people-to-people relations. The two Prime Ministers noted with satisfaction that the close and constructive bilateral relations between the two countries were supported by a very strong political consensus across the board in both countries. The two Foreign Ministers have been charged with taking this forward. Singh invited President Kiir to visit India, and the President said he would be happy take up the invitation as soon as the immediate priority of setting up the political institutions of the new country was completed.

Capitol Hill briefing focuses on Kashmiri Hindus India Post News Service

NEW YORK: The human rights of the nearly 400,000 original inhabitants of the Kashmir Valley, the Hindu Pandits, forced from their homes in 1989, was the focus of two days of meetings on Capitol Hill this week, as nearly fifty leaders and major supporters of the Hindu American Foundation (HAF) met with many key congressional offices. The two days of meetings on Capitol Hill culminated with a Capitol Hill reception in the Rayburn House Office Building where two Hindu American soldiers and five congressmen were honored with HAF's service awards. The HAF delegates inaugurated the Foundation's Eighth Annual Washington, D.C. Advocacy Days on Sept 19, with a twohour congressional briefing attended by delegates and a large number of congressional staffers and human rights organizations. The briefing, hosted by the Foundation with the assistance of Rep. Ileana Ros-Lehtinen (RFL), Chairwoman of the House Foreign Affairs Committee, surveyed the contemporary history of unrest in the Indian State of Jammu and Kashmir, largely fueled by neighboring Pakistan that claims the state as its own. "The briefing [hosted by the Foundation Monday] appropriately called attention to the fact that the Kashmiri Pandits have become, as one scholar notes, 'victims of one of the most successful, though little-known, campaigns of ethnic cleansing in the world'," said Rep. RosLehtinen, at the Foundation's evening reception. "The Hindu American Foundation is a valuable resource for Congress as well as powerful voice for freedom, mutual understanding and tolerance." The next day, the delegates swarmed the Hill in several small groups for intensive meetings throughout the House and Senate. House Resolution 387, introduced by Rep. Frank Pallone (DNJ), and strongly supported by HAF, formed the basis of discussions as delegates urged members of the Foreign Relations Committees in both chambers to support the resolution. The human rights of Hindus, Christians, and Buddhists in Malaysia were also discussed in the wake of the recent HAF-sponsored visit by exiled Malaysian human rights leader, Waytha Moorthy. The Foundation is working toward a Capitol Hill briefing later this year focused on the systematic discrimination of minority religious

groups in Malaysia. Heightened Islamist terror campaigns led to the killings of thousands of Kashmir's Hindu Pandits and forced their exodus in 1989, Kalra said during his address. Kalra highlighted House Resolution 387 introduced by Rep. Frank Pallone (D-NJ) that recognizes the human rights violations against the Hindu Pandits in Kashmir and demands that the terrorist infrastructure in the region be dismantled. "While the United States should continue to closely watch developments in Kashmir, it should resist the temptation to pursue a direct role in mediating the crisis as such a move could exacerbate tensions and raise false hopes among Kashmiri separatists," said Curtis during her address. She also rejected the claim that continuing Pakistan-sponsored terror attacks in India are motivated by the unrest in India's Kashmir. "The Mumbai attacks, for example, only demonstrate that Pakistan-based terrorists are more interested in trying to sabotage India's emerging power status rather than making any statement on Kashmir," she added. Tracing the history of the Kashmiri Hindu Pandit population as the original inhabitants of the valley prior to Islam's introduction in the fourteenth century, Dr. Pandit described the religious traditions and culture of the Pandits and the conditions of refugee camps in Jammu nearly twenty years on. "Though Pandits can trace their history in the Kashmir Valley back nearly five millenia, today's reality is that less than 3,000 remain there and between 70,000 to 80,000 Pandits continue to live in squalid refugee camps in Jammu, 20 years after their forced migration from their homeland." NEW YORK: On Wednesday, Sept 14, when Dr. Sameer Sharma, the Municipal Commissioner of the city of Hyderabad in India, walked up to deliver his speech at the School of International and Public Affairs' (SIPA) Global Mayors Forum, few from the audience had heard or known of Hyderabad as a model for India's urban development. Yet, fifty minutes later, few were left with any doubt. Global Mayors Forum is an exciting series featuring leaders of the world's most dynamic cities, and is sponsored by the Urban and Social Policy concentration at SIPA. Prior participants at the Forum have included Mayor Michael Bloomberg of New York City, Mayor Boris Johnson of London and Mayor Syed Mustafa Kamal of Karachi. Dr Sharma used this opportunity to blend his prior experiences as a Municipal Commissioner (for the cities of Vijayawada and Vishakapatnam) in Andhra Pradesh with the theories he came across in his doctoral program, to initiate a variety of unique and innovative programs in Hyderabad. One of these initiatives was the use mobile phones to increase government accountability. In a first-of-its-kind deployment anywhere across the world, the city of Hyderabad has built a web based Off Site Real Time (OSRT) monitoring system which relies on the inbuilt camera of a mobile phone and GPRS technology to match pictures of field level staff and their street locations with preset data, and register attendance. An anywhere, anytime accountability mechanism, the OSRT provides real-time information in solid waste management, urban planning, public works and street lighting to municipal man-

agers and the citizens. Another key initiative was the decentralization of local governance in Hyderabad to Ward Committees (similar to Community Boards in New York City) and Area Sabhas, or neighborhood associations. In determining which functions would be devolved, Dr. Sharma referred to the "Principal of Subsidiarity" - a commonly used concept in the theory of local governance. Given that participatory democracy is a new concept to India's urban citizens, Dr. Sharma relied on 2009 Noble laureate Elinor Ostrom's theory of "Rules in Use" when formulating the procedures through which these local participatory structures would function. The result has been a significant shift to bottom up decision making where public interest is constructed through local discourse. About 20% of the city's annual budget is now decided through these new bodies. While the community level decentralization project has been welcomed by citizens and NGOs, Dr. Sharma cautioned that the initiative is facing resistance from the city councilors, who are averse to sharing power and having citizens ask them questions about their work. The true test of Dr. Sharma's initiatives will lie in the duration that they survive without being diluted or subverted by elected representatives, and whether if Hyderabad's model inspires other cities across India to adopt similar programs. Nevertheless, this interaction with Dr. Sharma showed SIPA students how individual leaders with creative ideas can influence far reaching policies. The Chicago Partnership Walk is an initiative of Aga Khan Foundation U.S.A (AKF USA) to raise awareness and funds that reduce poverty, hunger, illiteracy and poor health in Africa and Asia. Chicago's 2011 Walk raised over $400,000. All the funds raised at Partnership Walk go directly to projects sponsored by the Foundation; not a cent is spent on administration. They were the youngest first timers who participated in Paryushan Mahaparva's fasting since the beginning of Jain Center in Los Angeles. Paryushan Mahaparva is a religious Jain event held yearly at the Jain Center in Buena Park wherein Tapascharyas, a name for the act of fasting for body, soul and heart purification is observed for a number of days. The event surpassed all expectations for celebrating the Sikh identity and raised over $55,555 for the Sikh Coalition. The walk/run was followed by food, fun and entertainment. A musical tribute to Shammi Kapoor JS BEDI India Post News Service

LOS ANGELES: LA Sargam, the San Fernando Valley based musical organization sponsored Avtar Chadda's 8th annual Mohd. Rafi Night, Friday, September 16 at the Venus Banquet Hall Winnetka. Avtar Chadda started the evening off by singing a shabad and a bhajan, but the bulk of the program was dedicated to the memory of the late Bollywood screen idol, Shammi Kapoor, who passed away on August 14. The emcee for the evening, Dr. Parvin Syal, explained that Shammi Kapoor had carved a unique niche for himself in the Indian film industry, essaying the portrayal of a happy-go-lucky character in feel-good movies. Most of the playback songs for him were sung by Mohd. Rafi, and thus the perfect opportunity for Avtar Chadda's tribute to Shammi Kapoor. In a tireless display of his art, Chadda sang mesmerizing numbers that included a range of foottapping tunes from films like , "Kashmir ki Kali," to the sublimely poignant lilts of ,"Brahmchari," which garnered for Shammi Kapoor the Filmfare Best Acting award. Chadda said that he had grown up listening to such music and had performed in Delhi during his college days. Local audiences have described him as being gifted with a rich voice that resembles Rafi's pristine range of singing. Chadda was ably supported by other members of LA Sargam, Hosi Amroli, Supriyo Chakraborty and Aslam who performed a number each. Guest artiste Aman Kaur performed a solo number whereas her sister, Lakmeen Kaur, joined Chadda in a couple of duets. In recognition of Chadda's contribution to the performing arts, L.A. County Supervisor Michael Antonovich sent a certificate of appreciation, which was presented by his representative, L. A. County Commissioner, Mahesh P. Parekh. The capacity audience of about 200 people, Indian, Pakistani, Bangaldeshi and Afghans were treated to a sumptuous meal, catered by Moksha. The event was organized by a committee headed by Avtar Chadda and also included Nirmal Sandhu, Dr. Parvin Syal, Mobin Khan, Supriyo Chakraborty, Hosi Amroli and Sunny Singh. The show lasted well past midnight with the boisterous audience asking for more.

The journey from Om to Ek Onkar BHAWNA MALIK

T

hough born in a Hindu family, Sikhism has always fas cinated me. For one thing there is the novelty of having a sacred scripture as a guru, since the Sikhs consider the Guru Granth Sahib to be a living guru. Plus, there is the sweetness of Gurubani, or the nitnem banis (daily prayers), the colorful and vibrant ambience of the gurudwara interiors, and the partaking of langar. All aroused in me an inexplicable desire to learn more about Sikhism. I reached the end of my quest at a book fair held at the Gurudwara Bangla Sahib, Delhi. Forms were being filled for a short-term course of the Guru Granth Sahib for a fee of just Rs 100. I asked what the focus of the course would be. "How to think like a Sikh, look like a Sikh, and behave like a Sikh," said a man standing next to me. Dressed in a beige safari suit and starched black turban, he introduced himself as Sardar Harinder Pal Singh, the chairman of the Gurmat College and the brain behind this course. Among other topics, the course dwelt on concepts like Naam Simran, environment, woman empowerment, the concept of the ideal man, and a study of the daily prayers. The course also had sessions on

guess every game has a Tiger of its own. Some found in the woods, some on the golf course. And then there's the royal Tiger of cricket. It is January 5, 1952. A little boy and only son of his parents, is all excited about celebrating his 11th birthday party later that evening, when his sister tells him that their father has had a heart attack while playing polo and has died. Now, at that tender age, not only is he responsible for his family's fate being the sole male member, he is also responsible for the welfare of 15,000 people of the State of Pataudi. He is the new Nawab. The boy, Mansur Ali Khan Pataudi, was lovingly called Tiger at home because, as an infant even when he had learned to walk, he often preferred to crawl. Little did he know then that he would end up carrying that name for the rest of his life, for reasons that destiny was to unfold. He was sent to school in England, while his family remained in India. Several close relatives including his paternal uncle General Sher Ali Khan and his family, including Liaquat Ali Khan (later Prime Minister of Pakistan) and others had opted to cross the new border into Pakistan. In 1961, Pataudi was preparing to return home after college. By this time his prowess at batting at Oxford and Sussex had already

Punjabi grammar and the Gurumukhi script. The session began with an introduction on the relevance of Guru Granth Sahib and Naari Chetna by Dr Beant Kaur. She explained that the message of Guru Granth Sahib was eternal. If love, honesty, peace, morality and tolerance are relevant today then indeed its message is relevant. Dr Beant Kaur also introduced us to the progressive view of Sikhism towards women. Women were treated with disrespect before the advent of Guru Nanak (founder of the Sikh religion). They were not allowed to participate in religious ceremonies and had no say even in family matters. Social systems were corrupted by child marriage, purdah and sati system. What began with a small bunch of students is now a full-fledged professional course with 500 students in each batch. Exams are held at the end of each session and the first three students are awarded cash prizes. "To some, we also give books," explained Harinder Pal Singh. "These are the three pillars of Sikhism. Nam japna (meditating on the name), kirat karna (earning your own bread) and vand chhakna (sharing with others). These three concepts of commu-

"The gurudwaras actually came to be known as temples of bread," explained Sardar Aaya Singh, who used to be with the Ministry of External Affairs. He shared with me how the course helped him. He traveled extensively and communicated with dignitaries across the world. For him, religion was confined to the mere recitation of the banis. "The Gurubani guides us on every aspect of our life. I lived my life in contrast to what our gurus preached. I regret coming so late for this course," he exclaimed poignantly. Two sessions completely transformed me: Siddha Goshti and Anand Sahib. Siddha Goshti is a dialogue between Guru Nanak and contemporary saints of the time. It encourages the peaceful co-existence of different viewpoints and also inculcates the virtue of patient listening. Guru Nanak encouraged the saints to speak first while he listened without being judgmental. Kich suniye kich kahiye' (Some listening, some speaking). A piece of advice all of us could benefit from! Every single religion and its scriptures have their concept of the

ideal man. The Gita talks of the Sthithpragya, Buddhism extols the Bodhisattva and Sikhism advocated the Gurmukh or Sachiar. They must be same, I think aloud. No, smilingly explains Dr Jodh Singh, a doctorate on Siddha Goshti. "The Gurmukh is not a recluse or hermit, but a householder. He attains moksha while living, not after death. My `aha' moment occurred during a lecture on Anand Sahib. Anand means bliss. This is the ultimate and the climax of every single religious philosophy. Slowly and subtly, the divine and celestial world of Guru Granth Sahib enveloped me as I heard 42 illuminating lectures on the book's message. I gained spiritually not just from its timeless message but from the noble souls I happened to meet during these lectures. I realized that studying and understanding religious philosophies of other faiths does not make you a convert. It facilitates the unfolding of hidden aspects of one's own personality by lending it a broader perspective. For me, these lectures were a journey from Om to Ek Onkar (God is one). Fifteen years and 46 Tests later, Tiger had taken his country to a completely new level. Sikhs join prayers for world peace India Post News Service

ORANGE COUNTY, CA: The Sikh Center of OC joined the worldwide Sikh community in conjunction with other faith communities in praying for world peace as part of the initiative of the UN's International Day of Peace. This year about 8 million prayers have been recited by Sikhs in more than 50 countries worldwide. The "Sukhmani Sahib" is a composition written by the 5th Sikh Guru, Guru Arjan Dev Ji, which describes the path to peace for all individuals. Humans progress towards enlightenment through the stages of spiritual progress, and achieve liberation and self-realization by their actions. Sikh congregations have participated enthusiastically worldwide, generating a number of different approaches to their own local programs. Congregations have hosted interfaith events, involved their local neighbors, and formed unique ways of sharing the experience of Sikh prayer with their wider communities. Sikh temples

or Gurdwaras were decorated with emblems of peace and harmony, and a special langar, or community meal was served to all who attended. At the Sikh Center of OC, "peace balloons" decorated the Gurdwara, and a number of children from the Guru Nanak Children's Academy participated in reciting the paath as well. Bhai Sahib Jaswant Singh did a beautiful ardaas, asking for Waheguruji's blessings on all of mankind. The OC organizers noted, "The success of our Sukhmani Sahib Paath project lies in its being done on a wide scale. Our Gurus' baani is very powerful and profound in its message. Although we ourselves appreciate it, we have not done a very good job in sharing that beauty with the world community. Mrs. Rajinderjit K. Singh, the organizer, feels "the energy from this prayer, being recited by so many Sikhs together at the same time, radiates a peaceful light which permeates the entire earth and all its people".

She could have hardly expected a more liberal life partner. Pataudi's highly successful concept and exploitation of the spin quartet of Bedi, Chandrashekhar, Prasanna and Venkataraghvan are now legend. That was many years before the arrival of Kapil Dev, when a few overs were given to gentle medium-pacers, just to remove the shine from the ball, before the spinners took over. Pataudi often used to roll his arm himself with his medium pace and once even surprised the opener by indulging himself to the solitary wicket credited to him in Test cricket. Tiger later apologized to the batsman, as that appeared more of a sorrow than a joy for him. Diplomacy, of course, ran in the family. Father I.A.K. Pataudi had served the Indian Foreign Service after partition. His cousin Shahryar Khan became Foreign Secretary in the Pakistan Foreign Service and Chairman Pakistan Cricket Board (PCB), while another cousin, Major General Isfandiyar Ali Pataudi is being talked about as the next chief of the Inter-Services Intelligence (ISI). Tiger himself always remained a great cricket diplomat for cross-

border peace. After the 1965 war, when cross-border cricket was banned, Tiger spoke openly stressing the need to "keep sports clean of politics". He actually tried to use cricket towards reigniting relations, but without luck. Much later, once while doing commentary at one of the Sharjah matches, he told Imran Khan that one of his greatest regrets was not having played against Pakistan in his entire career. By the time the revival of India Pakistan cricket took place in 1978, Tiger had already decided to hang up his gloves (1975). His amazing accomplishments were not confined to batting and captaincy. He will surely go down as one of the best cover fielders that the game has ever seen. Pakistan's past captain Javed Burki once remarked that in his career, Pataudi must have prevented as many runs in that position as he scored as a batsman. There are stories of cricket commentators watching batsmen smash a perfect cover drive assuming the ball would race to the boundary, only to find Tiger dart to stop the ball, pick it up and toss it back to the bowler. The crawl of his childhood had turned into an elegant prowl. Tiger was not just a name, it was an attitude. Siraj Khan is a Boston-based world citizen who lives a life without boundaries. NEW YORK: The 2nd Annual South Asian Music Festival hosted by Desi Alternative Music (DAM) was held over two nights of scintillating live music in New York City Sept 9-10. Talented South Asian bands and solo artists converged from all across the United States, showcasing their performance and songwriting skills with strictly original material before a packed audience. Eleven artists played a blend of eastern and western music, displaying a broad range of musical talent from pop, rock, folk, and jazz, to electronic dance music. Diversity was also evident in the form of lyrics in Urdu, Hindi, Punjabi and other languages. The festival was a testament to the growing South Asian alternative music scene that has taken storm over the past decade across the United States, and indeed the world, particularly in urban centers like New York City. The first night of the festival was an intimate groovy affair in the Upper West Side at the Underground Lounge. Singer and songwriter Advani backed by a group of soulful and versatile musicians kicked off the festival rocking the house with tracks off his debut album "Breaking Boundaries". Multitalented singer Nawed Khan followed with his blend of ballads and pop infused South Asian folk while jamming on keyboards. Punch for Zero, a trio led by Amit Gulati kept their fans wanting more with a combination of acoustic guitar, caj贸n drum, and bass guitar. The festival continued the following night with eight artists setting the stage on fire at the jam packed sold out Off Broadway Theater located in the Times Square Arts Center. W

hat used to be true about film entertain ment originating from South Asia, especially Pakistan, was that it took its sweet time reaching California. We were usually the last to catch up (unless it was available online) but still remained no less appreciative or critical than the people say in New York, London and Dubai. This time however, Shoaib Mansoor's movie "Bol" was released throughout the US and Canada around the same time. But not too many reviews have surfaced here, possibly because of the seriousness of the film and its grim subject matter. Is it because members of the Diaspora in North America try to ignore our grim social realities and just prefer more entertaining films? The answer to that may be a qualified "yes" but reminders like "Slumdog Millionaire" from last year just cannot be ignored. And in the same vein neither can one ignore "Bol" (Speak or more accurately Speak Out) because rarely does such a bold film originate from Pakistan. My wife and I were the only two people seated in the theatre in the Sacramento, California suburb of Elk Grove to see this film so we can even boast of a "private showing". Salman Khan's latest film "Bodyguard" was playing next door and the number of people coming out of there was far larger than the two of us. But if one can make such a statement, it is that "Bol" is a more realistic movie and thus has had fewer people viewing it! And this is not another attempt to incite India-Pakistan ten-

character as she continues with her story told from the scaffold in front of the media (per her last wish). Zainub and her father the Hakeem are the two main characters on which the story focuses. Humaima Malick's acting is good but that of Manzar Sehbai as the father, who we come to hate in this film, is superb. Two others that stand out are Shafqat Cheema as the pimp Sahka Kunjar from Lahore's "Heera Mandi" (Diamond Market) and last but not least the stunning Iman Ali as the courtesan Meena in a role that leaves one speechless. If one is not from amongst the Urdu-Hindi-Punjabi speaking realm, the nuances built into the "Bol" script will not be easy to pick up. The story as written is good but the symbolism which the Urdu language is famous for is plentiful here and that makes it memorable. If "Bol" just had to have another name, it would be "Bold" in English. Shoaib Mansoor has really pushed the envelope here. This movie is not a masterpiece of direction and the sets and cinematography although adequate, could have been better. But "Bol' in my opinion is the best movie to come out of Pakistan since Sabiha Sumar's Partition film "Khamosh Pani" (Silent Waters). It is also perfectly timed for silent Pakistanis worldwide to speak out, denounce injustice and violence especially against women and minorities there. Speak up before it is too late. Looking back, there was a time when some of us predicted that Slumdog Millionaire was heading to the Oscars and were somewhat ridiculed. Although "Bol" cannot be a contender for best picture, one should not be surprised if it is considered for the "Best Foreign Film" category. It certainly deserves such recognition. There is no doubt that this is a very grim movie. Some of the worst aspects of Pakistani society are exposed in it. Hypocrisy rules the roost here but the message that comes out is that claiming helplessness is no longer an option. Fair minded Pakistanis, women and minorities need to fight back and raise their voice. To conclude, some people were not happy that I circulated information about how to see this movie to them. I have to admit that we were as shaken as they were as we were after watching it. But like Saifi and his questionable gender, the truth cannot be hidden forever. "Bol" may not be too entertaining but watching it is certainly a learning experience.

Q. You've come a long way since your first movie Jism (2003). Can you describe your journey?

John: However clichĂŠd this may sound, each day is really a new day with a range of experiences, ups and downs, high and lows - it's life. But you just got to keep going and with the grace of God I'm still here and revving to go even further. I have given my level best to my profession and will keep doing so. My family and fans are my biggest inspiration and I will continue to aspire to meet their expectations. At the end of the day, I have grown as an actor, which is a big achievement for me.

Q. Your jaw dropping eight pack physique is the talk of the town. What tips can you offer (mainly our male readers) on how to achieve the perfect abs? John: Well, a lot of hard work went into preparing for this role as my character required a very rough and tough look, I went through eight s t r e n u o u s months of rigorous training to build the eight packs and look sturdy. But more than anything else I had to feel stronger and be prepared for some serious action. I am quite particular about my fitness regime which is quite simple - eat healthy and exercise well! Q. How does it feel to be approached by Hollywood's ace stunt director JJ Perry, who trained Sylvester Stallone, to offer to train you? John: It's been an absolute honour to get such encouraging comments from a Global Stunt Icon himself! Mr. Perry's compliments have motivated me all the more. Q. When shooting action movies there

are always accidents or incidents on set. Were there any for you whilst filming for Force? John: Force is a very high action packed film, hence it required a lot of stunts. Although we took great precautions, some accidents did happen. I recall there was the stunt that required me to jump from one moving goods train locomotive to another. Instead of landing on my feet I lost my balance and fell on my back over a heap of stones. I remember I had 40 injury marks on my back! And then there are a few others this has been a film where I've endured the most injuries but it was certainly worth it. Q. You've been paired opposite Genelia D'Souza for the first time. When you are working with an actor for the first time, how do you break the ice? John: Genelia is so full of life - she brings so much energy on the sets, it's amazing to work with someone like her. At the same time she is a thorough professional. I had the most wonderful time working with her and look forward to the opportunity again. I think we make a great on screen couple. Q. Would you class 'Force' among a contemporary genre of Indian films? John: Force belongs to the classic action romance genre, but with some unique,

state of the art action sequences, topped with some extremely exciting music the presentation has been modernized. It is also a very engaging narrative and plot line, with a strong romantic undertone set in today's times. ajgir is located in the Indian state of Bihar about 60 km southeast of the capital Patna. Rajgir is famous for rock-cut caves, forts, Buddhist ruins, shell inscriptions, Hindu and Jain temples and Muslim tombs. The place is well connected to other parts of Bihar and eastern India through railway and roads. Best time to visit: The climate of Rajgir like the other parts of the Gangetic plains is extreme. The summer months from April to July are hot and humid here and the average temperature can reach approximately 45°C and the relative humidity can go up to around 80 percent. Winters are cold with the average night temperature at around 10°C. Normally, the average temperature stays around 20°C. Monsoon touches this region in July/August and continues till September. History: Now a small town, Rajgir was once the capital of the kingdom of the mighty Magadh Empire and was known by various names such as Vasumati, Barhdrathpura, Girivraja, Kusagrapura, and Rajgriha. The great Hindu epic Ramayana says that the mythical king Vasu, a son of Lord Brahma, founded this town and named it Vasumati. According to the Mahabharata, Jarasandha who was killed by Bhima in a duel, ruled over this area and his capital was at Barhdrathpura. Though nothing is known about the other names Kusagrapura, Girivraja and Rajgriha, they figure regularly in Buddhist and Jain texts. The last Rajgriha is the one from which the present name Rajgir has been derived. During the sixth century BC, Rajgir was the capital of the powerful kingdom of Magadh. It was also the centre of great religious and intellectual activity. The Buddha made several visits to this town and stayed here for a considerable time to propagate his doctrine. Jain texts, on the other hand, say that their last apostle, Mahavira, passed 14 rainy seasons in Rajgir and Nalanda. Cont’d on page 31

It was also the birthplace of Muni Suvrata, a predecessor of Lord Mahavira and the center of the Ajivika sect. Tourist attractions Rajgir, though small area wise, is an important pilgrimage center for three of the great religions of India, Hinduism, Buddhism and Jainism. There are pilgrimage sites of each of these religions in the town. On the Vaibhava hill are the Saptkarni caves where the first Buddhist Council was held. The Saptkarni cave is also the source of the Rajgir hot Sulphur springs that have curative properties and are scared to the Hindus. From the foot of the Vaibhava Hill, a staircase leads up to the various temples. Separate bathing places have been organized for men and women and the water comes out from spouts through the Saptadhara or seven streams believed to find their source behind the Saptkarni Caves up in the hills. The hottest of the springs is the Brahmakund with a temperature of 45°C. On the Griddhakuta or Vultures Peak, the Buddha set in motion his second Wheel of Law and for three months every year during the rainy

Baithak after the name of the King Jarasandha, a contemporary of Lord Krishna described in the epic Mahabharata. The Swarna Gufa is around six km from the railway station. It is believed that there is a treasure house of gold still hidden here. It is said that if one can decipher the inscription engraved here, the doors to the golden vaults would open. Places around Bodh Gaya, the place where Buddha got enlightenment, is around 34 km off Rajgir and connected through a good network of roads. Campaign to prevent unethical practices in tourism NEW DELHI: With the aim of preventing crime against tourists, government has decided to launch an intense awareness campaign for safe tourism in places like Pahargunj in Delhi and Goa with the active participation of service providers. The decision was taken by the Ministry on the occasion of World Tourism Day. To begin with, five most vulnerable areas for tourist exploitation in the country would be selected for spreading awareness among guides, tour operators, hoteliers, auto and taxi drivers. "The five places which are more prone to crime involving tourists are drug abuse, immoral traffic, child abuse, cheating and other similar crimes, to be identified for

launching a sustained campaign promoting safe and honorable tourism," said a senior Tourism Ministry official. Places like Pahargunj and certain tourist spots in Goa, Kerala and North-East are likely to be identified in the first phase for a focused awareness campaign involving service providers. Seeking a proactive role of service providers, the Ministry decided to involve auto and taxi drivers, guest house owners, policemen, guides and tour operators to prevent unethical practices in tourism sector. "We have decided to conduct a short-term five-day training programs for service providers to sensitize them about the safe and honorable tourism," said the official. -PTI

Announcing this, Tourism Minister Subodh Kant Sahai, currently on a weeklong visit to CIS countries, has stated that a Joint IndiaRussia Tourist Trade Forum will be formed under the aegis of Indian Embassy in Moscow to promote

John has sported a muscular look in 'Force' where he plays a role of a no-nonsense cop who does not play by the book but always ensures that justice is served. Ohio City considers whether to woo immigrants DAYTON, Ohio: A shrinking Ohio city is considering whether to actively woo immigrants to help rebuild its population. The Dayton Daily News reports that what's called the ``Welcome Dayton Plan'' would portray the city as immigrant-friendly. The plan could lead to a new ``international marketplace'' in Dayton and a new city identification card for residents who can't get a driver's license or a state ID. Dayton Human Relations Director Tom Wahlrab says the city can either welcome immigrants or let old stereotypes and fears hinder its success. -AP

Mass. bill would crack down on illegal immigration BOSTON: Illegal immigrants would face stiffer penalties for driving without a license and higher hurdles when looking for a job or trying to find public housing in Massachusetts under a bill unveiled here. The renewed push comes after a handful of cases involving illegal immigrants, including a traffic death in Milford that police said was caused by a person in the country illegally. Perry immigration strategy may help woo Hispanics MIAMI: Rick Perry is calling his Republican rivals ``heartless'' and using ethnically charged language to defend moderate parts of his immigration record. That strategy may endear the Texas governor to Hispanics and their allies even as it angers others the presidential candidate must woo to win the nomination to challenge President Barack Obama. His in-your-face approach to addressing what many non-Hispanic conservatives consider a black mark on his record underscores the difficult politics at play for Perry. He's a border-state governor who for a decade has taken great care to avoid alienating the nation's fastest-growing minority group. Now he finds himself running for president in a Republican primary whose core supporters are staunchly opposed to illegal immigration, much like George W. Bush did when he ran for the White House. he DHS has commendably issued policies urging prosecutorial discretion in recent months recognizing its inability to deport all undocumented immigrants, and designating certain deportable deserving discretion immigrants under a low priority status. Especially noteworthy is the June 17 Morton Memo on prosecutorial discretion, which urges against enforcement of individuals who came to the US as children, and who have successfully graduated from high school or are pursuing college or advanced degrees. Although DREAM Act legislation failed in December 2010, the DHS has nevertheless announced policies that would stay or terminate the deportation of those who came to the US as children and would otherwise have qualified

under this legislation to gain legal status. While the DHS has been using administrative action to ameliorate the hardships for DREAM kids, why can't it reinterpret a provision in the Child Status Protection Act more consistently with

llinois law expressly allows for the limited liability in Illinois of foreign limited liability companies - those formed under the laws of other states or countries - - by providing that they "may not be denied admission by reason of any difference[s]" between Illinois' LLC law and the laws of the other jurisdictions in which those entities are domiciled, and that their "organization and internal affairs and the liability of [their] managers, members, and‌transferees" are governed by the law of the respective foreign jurisdictions. If such foreign companies engage in any sort of recurrent business in Illinois, they must, however, file the necessary application and supporting documents with the Illinois Secretary of State to "Qualify To Do Business" in Illinois and pay the same filing and renewal fees as an Illinois LLC. Illinois also permits the direct "conversion" of partnerships or limited partnerships into limited liability companies, without change in the entity. Finally, Illinois expressly permits mergers of LLCs "with or into one or more limited liability companies, foreign limited liability companies, corporations, foreign corporations, partnerships, foreign partnerships, limited partnerships, foreign limited partnerships, or other domestic or foreign entities" if permitted under the law governing the (other) domestic or foreign entity.

Other Limited Liability Entities

1. Limited Liability Partnerships As of August 11, 1994, Illinois began allowing existing general partnerships to elect to become limited liability partnerships by registering as such with the Secretary of State. At first, the asset protection of this election was extremely limited because it merely shielded a partner from various forms of vicarious professional malpractice liability for the actions of other partners and employees of the partnership. However, since the enactment of the Uniform Partnership Act (1997), there has been much broader liability protection: "An obligation of a partnership incurred while the partnership is a limited liability partnership, whether arising in contract, tort, or otherwise, is solely the obligation of the partnership. A partner is not personally liable, directly or indirectly, by way of contribution or otherwise, for such an obligation solely by reason of being or so acting as a partner." Although limited liability part-

nerships are certainly a great improvement in terms of asset protection over general partnerships that have not so registered, they share with general partnerships at least the following important asset protection risk. All the partners' business assets all their investments in their present and future benefits from the firm remain fully subject to any liabilities created by the other partners or the firm's employees in the conduct of the firm's business. Every partner is an agent of the entire firm with apparent authority (under the Uniform Partnership Act's default rules) to act for the entire firm. Moreover, again under the Act's default rules, partners who voluntarily withdraw from the partnership can thereby cause a dissolution of the partnership. For these reasons, strictly from an asset protection standpoint, even limited liability partnerships, with their express statutory protection from personal liability, are inferior to limited partnerships and limited liability limited partnerships. 2. Limited Partnerships and Limited Liability Limited Partnerships: The two formerly significant asset protection disadvantages of limited partnerships, as compared with limited liability companies, have recently been eliminated. First, under the Uniform Limited Partnership Act (2001), limited partners are no longer in danger of losing their express statutory protection from personal liability if they participate in the management and control of the limited partnership. Second, it is now possible under the same statute for the general partners of limited partnerships to receive the same statutory protection from personal liability as do the limited partners and the general partners of registered limited liability partnerships, merely by causing those limited partnerships to file a statement in their respective Certificates of Limited Partnership that they elect to become "limited liability limited partnerships." It remains desirable for asset protection purposes for the general partners of all limited partnerships and limited liability limited partnerships to be limited liability entities. This is essential to avoid possible personal liability in the case of a general partner of a limited partnership, and it provides important backup asset protection in the case of general partners of limited liability limited partnerships. The use of a limited liability entity general partner or even better, two of them also reduces the chance that a limited partnership or limited liability partnership might be dissolved because of the dissociation of a general partner. Reinterpreting automatic conversion provision of CSPA Cont’d from page 36

Retention of priority date -If the age of an alien is determined under paragraph 1 [which sets forth the age protection formula] to be 21 years of age or older for the

purposes of subsections (a) (2) (A) and (d), the alien's petition shall automatically be converted to the appropriate category and the alien shall retain the original priority date issued upon receipt

of the original petition. Like the facts in the latest 5th Circuit decision in Khalid v. Holder, which sensibly interprets the automatic conversion provision, assume that a non-citizen child is 11 years old when his mother's sister, a US citizen, files an I-130 petition for his mother on January 12, 1996. By the time that the priority date becomes current under the Family Fourth preference in February 2007, the child is 22 and cannot unfortunately avail of CSPA's age protection formula. His mother, who has now become a Lawful Permanent Resident (LPR) files an I-130 petition on November 23, 2007 for her 22 year old son under the Family 2B preference. It makes no sense for the son to wait another 8 years or longer for the Family 2B date to become current. Under the plain meaning of the automatic conversion provision, §203(h)(3), the earlier priority date of the mother's sister's I-130, January 12, 1996, can be retained under the new I-130 petition filed by the mother on behalf of her 22 year old son. If the priority date is retained, her son will not need to wait and can potentially adjust his status immediately under the current January 12 1996 priority date. Under the broad "grandfathering" provision of INA §245(i), since he was the derivative beneficiary of his mother's I-130 petition filed long before April 30, 20001, he can file an application to adjust status even though he is no longer maintaining status presently. While it is beyond the scope of this blog to explain the detailed holding behind Khalid v. Holder, and the government's counter arguments, it is worth mentioning that the 5th Circuit cited with approval an earlier unpublished decision of the Board of Immigration Appeals in Matter of Garcia, No. A79 001 587, 2006 WL 2183654 (BIA June 16, 2006) with identical facts: In this instance, the principal beneficiary of the original petition was the respondent's mother, who became a lawful permanent resident of the United States once a visa number became available to her in 1996. The respondent was

(and remains) her mother's unmarried daughter, and therefore the "appropriate category" to which her petition was converted is the second-preference category of family-based immigrants, i.e., the unmarried sons and daughters of lawful permanent residents. Furthermore, the respondent is entitled to retain the January 13, 1983, priority date that applied to the original fourth-preference petition, and therefore a visa number under the second-preference category is immediately available to the respondent. If Matter of Garcia was followed by the DHS in 2006, there would have been no need for such expensive and needless litigation, and many thousands of children who aged out due to delays in the burgeoning backlogs under the family and employment preferences would have been permanent residents today. Unfortunately, three years later, in Matter

It makes no sense for the son to wait another 8 years or longer for the Family 2B date to become current of Wang, 25 I&N Dec. 28 (BIA 2009), the BIA reached the opposite result and disregarded Garcia under the rationale that the automatic conversion provision, §203(h)(3), only affirmed limited conversions acknowledged by regulation. For instance, 8 C.F.R. § 204.2(a)(4) provides for "retention" of a priority date for a minor child who was accompanying or following to join a principal beneficiary parent on a second-preference spousal Family 2A petition but then turned 21 before the mother could become a LPR. Under 8 C.F.R. § 204.2(a)(4), if a child ages out prior to the parent being issued the immigrant visa, a separate I-130 petition for that son or daughter is then required, although the original priority date is retained if the subsequent petition is filed by the same petitioner. Khaled v. Holder correctly rejects Wang's strained interpretation since §203(h)(3), reading it in conjunction with subparagraphs (1) and (2), makes reference to both second preference family petitions and derivatives of all family and employment petitions. It is thus illogical to only consider the reference to the second preference petitions, where minors have been able to retain the original priority date, and to ignore

derivatives of all other employment and family petitions, even though explicitly mentioned in §203(h)(3), who can also automatically convert to the "appropriate category" and "retain the original priority date." Admittedly, two other circuits have come out differently. The Ninth Circuit in Osorio v. Mayorkas decided that §203(h)(3) was ambiguous and paid Chevron deference to the BIA's constricted interpretation of this provision in Matter of Wang. The Second Circuit in Li v. Renaud, on the other hand held that the provision was unambiguous, but nevertheless reasoned the provision would only allow someone to retain the priority date to a petition that was filed by the same petitioner. Thus, in the example in Khalid v. Holder, the original petitioner was the child's aunt, and the new petitioner is his mother, and according to the Second Circuit in Li, which David Isaacson has critically commented on in a prior blog, there could be no automatic conversion. While it is not the purpose here to discuss the merits of the various holdings, from a policy perspective and in the spirit of the Morton memo on prosecutorial discretion, it would make sense if the Administration withdrew its opposition to a broader interpretation of §203(h) (3) and followed Khaled v. Holder across the country. Currently, Khaled v. Holder is only binding within the 5th Circuit, which comprises Mississippi, Texas and Louisiana. To achieve this, Attorney General Holder would have to issue a new decision reversing Matter of Wang, and consistent with Matter of Garcia and Khaled v. Holder. The Attorney General, through the BIA, has done this before and can do it again if there is truly a will to implement policy consistent with the Morton memo. For example, in Matter of Silva, 16 I&N Dec. 26 (BIA 1976), the BIA acquiesced in Francis v. INS, 532 F.2d 268 (2d Cir. 1976), and allowed 212(c) relief for LPRs in deportation proceedings who had not previously departed and returned, despite its earlier contrary holdings in Matter of Francis and Matter of Arias-Uribe, 13 I&N Dec. 696 (BIA 1971). "I believe the Chinese side is aware of our market access concerns," said Planning Commission Deputy Chairman Montek Singh Ahluwalia at the first Strategic Economic Dialogue (SED) between the two countries here. Praising the giant strides made by China in its economic development, he said that India looks to China to open its markets for IT and Pharma. "Legislations have been introduced in the Parliament to address some issues in the financial sector including insurance, banking, and pension sectors," Mukherjee said. "We have set up Financial Sector Legislative Reforms Commission to review financial sector laws with the objective of bringing them in tune with current requirements and global best practices. An apex-level Financial Stability and Development Council has also been established to strengthen and institutionalize the mechanism for maintaining financial stability." Mukherjee further added, "We are working to build a policy con-

sensus on a number of pending issues such as introduction of Goods and Services Tax, a new and facilitative National Manufacturing Policy, further liberalization of FDI, including in retail, deepening and strengthening financial markets for long term investments." "Our new foreign trade policy is ambitious and aims at doubling exports to $500 billion in the next three years," Mukherjee said. "The policy is backed up with a range of progressive measures including facilitation of investments, simplification of administrative procedures, streamlining of clearances and customs duty systems to name a few. As the Indian export sector continues to transform from low-value added goods to capital and skill intensive and technology rich manufactured products, doubling of exports in three years is not only attainable, but is well within our reach. Mukherjee referred to a recent study by McKinsey, which estimates that by 2030, 65 Indian cities will have a population of more

than one million and would account for 600 million of India's population. The share of GDP from these cities could rise to 70%. Over the next 20 years, cities would require a capital expenditure of $1.2 Trillion, opening up huge opportunities for investment for foreign investors and capital equipment manufactures. The installed power capacity is expected to increase by five times over the next two decades to maintain a growth rate of 8 to 9%, he said. When asked about the recent moves by Government of India on transparency, Mukherjee expressed significant optimism. "Recent events and decisions made by Government together with civil society will result in greater transparency, with tremendous benefit to civil society and industry alike," he said. Sharma also elaborated on the need and importance of the early signing of the India-US Totalization Agreement. He said that India has signed totalization agreements with several European countries, whose social security systems are different from the Indian system, and from the US system. The United States has also signed bilateral social security agreements with the same European countries. As such, the differing systems of social security should not be an impediment in signing of the India-US Totalization Agreement, he said. Minister Sharma acknowledged the important role played by the CEO Forum in policy advocacy that has resulted in tangible policy changes on both sides. He informed the Forum about the positive feedback he had received in his interaction with CEOs in Chicago and Dallas before the CEO Forum meeting. Norovirus outbreaks up in Montana HELENA, Mont.: The state says it is getting more reports of norovirus affecting schools, day cares and nursing homes. The Montana Department of Health and Human Services says several hundred people have been hit with gastroenteritis symptoms since early September. Symptoms include vomiting, diarrhea, and nausea lasting 24 to 48 hours. Norovirus was found to be the cause in those outbreaks where laboratory testing was performed. The state says there is no specific treatment for this illness and most people recover within a few days. It is highly contagious and can spread rapidly, especially in group settings. Norovirus was blamed for the sickness of more than 200 students earlier this month at a Billings elementary school. -AP

FDA halts Immunomedics trial after incorrect dose MORRIS PLAINS, N.J.: Immunomedics says federal health regulators have halted a study of the company's experimental pancreatic cancer drug after one patient received an incorrect dose of the medication. The company said the Food and Drug Administration placed a clinical hold on the study after investigators discovered the patient received a higher-than-prescribed dose. The patient ``remains on study with no critical toxicity,'' the company said in a statement. The company is working with the FDA to file the necessary paperwork to resume the trial. -AP

The administration's decision makes it more likely that the U.S. Supreme Court would hear a case on the health care overhaul in the court's term starting next month, and render its verdict on the law in the midst of the 2012 presidential election campaign. Over 1.4 billion at risk of rabies in South-East Asia India Post News Service

NEW DELHI: A combination of large human and dog populations in congested habitable areas combined with widespread poverty has led to more deaths due to rabies in WHO's South-East Asia Region than in any other part of the world. More than 1.4 billion people are potentially at risk of rabies in this region. Children aged 5-15 years represent 40% of people exposed to dog-bites in rabies-endemic areas. Dog bites are the primary source of human infection in all rabies-endemic countries in the region and account for 96% of human rabies cases. On World Rabies Day (28 September) , WHO urged Member States to ensure access to modern tissueculture rabies vaccine, promote cost-effective intradermal vaccination and control rabies at the source through mass dog vaccination and animal birth control. The WHO Regional Office for South East Asia has developed a regional strategic framework for elimination of human rabies transmitted by dogs. The strategic framework will provide technical leadership, encourage national health authorities in Member States to develop consensus among major stakeholders for a comprehensive rabies elimination program and implement national strategies for elimination of human rabies considering the epi-

demiological situation, technical feasibility and socio-cultural context. "Rabies is a fatal disease, but it can and must be prevented," says Dr Samlee Plianbangchang, Regional Director, WHO South-East Asia Region. "Rabies is a serious public health problem in South-East Asia, and countries must develop and implement comprehensive national rabies control programs through partnership in

In India, intradermal rabies vaccination has been promoted at the state level, and anti-rabies vaccination and birth control of dogs have been carried out by animal welfare and nongovernmental organizations. The elimination of human rabies in South-East Asia is feasible with intersectoral coordination, technical, political and public support. Prevention, promotion and partnership are strategic tools for elimination of human rabies; • Prevention: Introduce cost-effective public health intervention techniques to improve access, affordability and availability of rabies vaccine and serum. Develop and implement mass dog vaccination programs.

Agency wants to boost scrutiny of health insurance SALEM, Ore.: Oregon officials want to give the public more of an opportunity to comment on proposals to hike health insurance rates. The Oregon Insurance Division, the state's insurance regulator, is asking state lawmakers for authority to spend a $4 million federal grant that would pay for better scrutiny of proposed rate hikes and public hearings that would allow consumers to weigh in. Officials explained the idea to a panel of legislators. The Insurance Division is responsible for reviewing proposals to set health insurance rates on plans offered to individual consumers and small businesses, which represent about 12 percent of the market, said spokeswoman Cheryl Martinis. ``People want to know what we're doing, how closely we're looking at rate requests,'' Martinis told The Associated Press. ``We're trying to make sure everything is open so they can see we're grilling insurance companies regularly and we're doing it in depth.'' For the first time in decades, the agency held public hearings this year to scrutinize rate hike requests by two insurers, Regence BlueCross BlueShield of Oregon and ODS Health Plan. Regulators cut Regence's rate hike from a requested 22.1 percent to 12.8 percent. The ODS proposal is still pending.

Taking on tradition, baseball seeks tobacco ban WASHINGTON: Always a hidebound sport, baseball has accepted interleague play, the wild card and even video replay in the last 20 years. Now a campaign backed by members of Congress and Commissioner Bud Selig is taking on something that's been a part of the game's culture for well over 150 years chewing tobacco on the field. Public health groups have gained traction with a classic argument: When ballplayers are seen chewing a wad of tobacco or using dip-products collectively known as smokeless tobacco they set a bad health example for kids who look up to the athletes as role models. To which Milwaukee Brewers outfielder Mark Kotsay replies: ``I've seen the president drink a beer, right? I don't know. I don't get all the rules and regulations.'' The problem, anti-tobacco advocates say, is the increasing use of smokeless products by young people and the health risks that go with the habit. The Centers for Disease Control says that smokeless tobacco can cause cancer, oral health problems and nicotine addiction,

and stresses it is not a safe alternative to smoking. Despite the risks, the CDC's most recent survey found that in 2009, 15 percent of high school boys used smokeless tobacco a more than one-third increase over 2003, when 11 percent did. The sport's current collective bargaining agreement expires in December, and Selig, who endorsed the ban in March, has said he will propose it in the new contract. Union head Michael Weiner said in June that ``a sincere effort'' will be made to address the issue. Neither side would comment on the status of a tobacco ban in negotiations. "I believe that'll be a really tough sell,'' said Kotsay, a tobacco user. Nonetheless, Major League Baseball is so keen on scrubbing tobacco from the sport that it asked Sony Pictures to remove scenes depicting its use in the movie ``Moneyball,'' though the studio declined to do so. I'm not promoting it and I understand kids look up to us. I think we're grown-ups.'' The Campaign for TobaccoFree Kids, one of the groups leading the effort for the ban, counters that baseball players have a responsibility beyond themselves. ``What we're talking about here is baseball players as role models for young adolescents who don't appreciate the risk, and don't understand the power of addiction,'' said the group's president, Matthew Myers. ``Baseball players are free to do what they want when they're not at the ballpark, when they're not on television. cern is that their behavior is affecting another generation of children.'' t was in England that I first discovered the futility of mere religious knowledge. How I was saved on previous occasions is more than I can say, for I was very young then; but now I was twenty and had gained some experience as husband and father. Portsmouth is a sea-port with a large naval population. It has many houses with women of ill fame, women not actually prostitutes, but at the same time not very scrupulous about their morals. We were put up in one of these houses. Needless to say, the Reception Committee did not know anything about it. It would have been difficult in a town like Portsmouth to find out which were good lodgings and which were bad for occasional travelers like us. We returned from the Conference in the evening. After dinner we sat down to play a rubber of bridge, in which our landlady joined, as is customary in England even in respectable households. uman life is meant for more than just indulging in pleasures. Though eating, drinking and enjoying are a part of life, we cannot say that this is all there is to life. The human being is distinguished from other creatures because he possesses an intellect, the faculty of understanding and thinking. The purpose of the intellect is to know the truth or essence of things that are perceived by our senses. Pasu and Manusya In Sanskrit, two words make this distinction between animal and a human being very clear. The Sanskrit word for animal is Pasu, derived etymologically from Pasyati iti pasuh that which "sees" only externally, which takes things at face value, giving no thought to what the truth of a thing is. For the animal there is no need to look deeper, for an object is generally useful only in so far as it is edible. The English word "man", however, is derived from the Sanskrit word Manusya, from the root man, meaning "to think". Manusya suggests that for the human being it is not enough to merely see an object physically, but that he should think about

Why is the Haqqani network so important? D SUBA CHANDRAN

W

hy is Pakistan, in particular the ISI, willing to risk its relations with the US and worsen its already tarred international image by continuing the linkages with the Haqqani network? Is supporting the Haqqani network more important for Pakistan than US-Pak relations and the ensuing American aid? What can be the possible explanations for such a behaviour exhibited by Pakistan? Explanation 1: Why blame only Pakistan? Gen. Kayani, the Chief of Army Staff, recently responded to Admiral Mullen's testimony accusing the ISI for using the Haqqani network as its "proxy" and a "veritable arm." He said, "Admiral Mullen knows fully well which all countries are in contact with the Haqqanis. Singling out Pakistan is neither fair nor productive." The CIA is concomitantly engaging the Haqqani network as part of its efforts to find the "moderate Taliban" with whom the US and the rest of international community can reach an understanding on power sharing after 2014. So, Islamabad may rightly justify, why blame only Pakistan, when everyone is playing a double game in dealing with the Haqqanis? The Pakistanis also feel that perhaps everyone is in touch with the Haqqanis, including the Americans, so blaming Islamabad alone for doing so is unfair. What Islamabad fails to understand is that while there may be many other actors who are willing to negotiate with the Haqqanis, none of them is providing either safe havens or using them as proxies in their gameplan. Neither are they making the Afghans and the international troops a target. Explanation 2: Did not realize you will call my bluff Also, Pakistan, especially its ISI elements, has always been playing a double game in dealing with the multiple Taliban groups. So far, Afghanistan and the US have pretended to ignore this double game considering their larger interests in Pakistan, although making some accusations ostensibly. More prominently so as the US believes that support from Pakistan is essential for the American war efforts; Pakistan remains the primary artery for taking war and aid materials through sea and land into Afghanistan.

While Afghanistan also has multiple complaints against Pakistan, including the Haqqani network, it has come to terms with the reality that it has no option but to work with Islamabad. In the last two years, there have been significant agreements signed between Pakistan and Afghanistan including one on transit and trade (excluding India). The recently concluded Dushanbe summit and the agreement on a gas corridor from Turkmenistan to Pakistan via Afghanistan are other major bilateral developments between the two countries. India, Afghanistan, Russia, US and now even China (at least the Xinjiang government) have been accusing Pakistan of supporting militant groups. Neither is the ISI new to the accusation that it has been supporting militant groups and using them as proxies. But, perhaps Pakistan did not expect that its bluff would ever be called. So it is now becoming increasingly defensive.

So far, Afghanistan and the US have pretended to ignore this double game considering their larger interests in Pakistan, although making some accusations ostensibly Explanation 3: Strategic Interests outweigh the Costs? Three primary strategic interests explain Pakistan's behaviour in Afghanistan. First, a friendly government in Kabul, which is actually a euphemism for a proxy in Afghanistan, playing by Islamabad's rule will be to Pakistan's advantage. Pakistan is afraid to have any another country, which is believed to be hostile to its interests to develop close links with Afghanistan. As Pakistan does not share a good relationship with India on its east-

ern side, it does not want yet another hostile neighbour. The fact that the Durand Line between the two countries is not fully settled and agreed upon by successive Afghan governments (including that of the Taliban's) only increases Pakistan's anxiety. Second, Pakistan does not want any Indian foot print in Afghanistan. Preventing Afghanistan from developing any substantial relationship with India is a primary objective. Widely referred and explained (and now refuted) as the "strategic depth", this objective is based on the premise that a friendly government in Afghanistan would help Pakistan to restrict India. Finally, the "pashtun" factor across the Durand line is an important strategic calculation for Pakistan. Despite the last six decades, a section within Pakistan even today fears a pashtun nationalism cutting across the Durand line. The pasthun communities across the Durand can be considered as Siamese twins given their historical linkages. Perhaps, the strategic elite and the ISI in particular consider the Haqqani network (and the Quetta Shura) as Pakistan's strategic tool to achieve their larger interests in Afghanistan. If there are any hidden costs to achieve the above interests, then so be it. Explanation 4: Who are the Haqqanis? Strategic Depth - Total Nonsense Perhaps, Pakistan as a state and as a nation lives and thrives in self-denial. Does a substantial section within Pakistan not believe the al Qaeda and Osama bin Laden as American inventions and Mumbai attacks as a handiwork of the Indian intelligence agencies? In fact, many within Pakistan believe today that Osama bin Laden may not have been shot dead within Pakistan and the al Qaeda truly has a thriving network. In their refusal to accept the reality, the majority seems to believe there is a global conspiracy against Pakistan, led by the US, India and perhaps even Israel. So who are the Haqqanis? Are they not American agents supporting the TTP to destroy Pakistan? Welcome to Pakistan; self-denial is a national ideology here. aving burnt its bridges with the US, Pakistan now wants a defense pact with China, the rising military and economic power of the world. The arranged marriage between the US and Pakistan has weathered many a storm. This time the spat looks a bit more serious with things headed for a divorce. The marriage was based on mutual dislike, mutual suspicion and mutual convenience. The US wanted Pakistani land, space and port facilities to carry out its so called "war on terror" in adjoining Afghanistan. Pakistan wanted American money, arms and silence, if not support, for its policy of using terrorists as a foreign policy weapon against its neighbors. Finding the US position weakening at home and abroad, the adventurist Pakistani army has started actively masterminding attacks on US interests in Afghanistan, culminating in the recent assault by its proxy Taliban faction, the Haqqani group, on US embassy in Kabul and the assassination of a former Afghan President Burhanuddin Rabbani, who was leading peace negotiations with the Taliban. The US cannot be expected to take this lying down and has threatened to cut off aid and take unilateral military action in Pakistan. Interestingly, Pakistan has not denied ISI hand in the attack nor has it promised to end support to the Haqqani network. For more than a year, the US had been pressing Rawalpindi to take action against the Haqqani network. Instead of complying, Rawalpindi has boldly supported the latest terror attacks on US targets in Afghanistan. Instead of being contrite, Pakistan is singing rhetoric about sovereignty and has intensified efforts to seek the help and support of friends China and Saudi Arabia in order to continue its foreign policy goals as well as receive extensive financial and military aid. And it seems to be succeeding. China may not immediately agree to a defense pact with Pakistan but less than that it is doing everything to shore up Pakistan. While Beijing has reacted cautiously to Islamabad's appeals for a defense pact, it has also at the same time advised it to mend fences with America and with New Delhi. Indeed, given its present predicament, Pakistan may not be averse to taking the peace process with India seriously as it cannot be expected to be fighting on so many fronts. This can be an opportune moment for New Delhi as the US is veering round to India's oft-repeated assessment that Pakistan is the hub of state-sponsored international terrorism under an unaccountable, untrustworthy and reckless military leadership. What keeps the US from abandoning Pakistan is the fear that the nuclear armed nation might slip into the hands of the various brands of terrorist elements. Indian policy makers who despair at the historic US support for Pakistan should give up that fear and seize the present opportunity to shape the US regional policy in India's favor. Strategic affairs expert C Raja Mohan has pointed out the folly of India's continued anti-west stance at the United Nations and international fora when its interests warrant otherwise. Recently, during his address to the United Nations General Assembly, Prime Minister Manmohan Singh came down against Western interventions in the Middle East undertaken in the name of promoting democracy and protecting innocent civilians from oppressive dictators. Raja Mohan says, "The immediate challenges to India's national security, however, stem less from the current Western interventions, legitimate or otherwise, in Libya, Syria and other parts of the Middle East. They arise from the potential failure of the Western intervention in Afghanistan. It was certainly one Western intervention that served India's interests." Now that intervention seems to be failing, India has to be concerned about its consequences which look forbidding enough.
