he year is closing fast, and for some homeowners considering foreclosure, short sale or loan modification, this is an important year. Time is not your friend, as the Mortgage Forgiveness Debt Relief Act expires Dec. 31, 2012.
Nasty Surprise
This comes as a surprise to many: Under IRS regulations, any amount borrowed that does not have to be repaid becomes income on your tax return. On a foreclosed home, the bank will calculate the difference of what the home sold for and how much you owed on your home loan, and report that difference as “Cancellation of Debt” or “Acquisition or Abandonment of Secured Property,” which can result in taxable income to you. The Mortgage Forgiveness Debt Relief Act passed in 2007 eliminated the tax consequences of that “income” for homeowners over the last four years.

With all the creative financing going on during the past 10-plus years, it gets complicated. Some things to keep in mind: • Up to $2 million of debt can be excluded from income ($1 million for a married individual filing separately). • The Forgiveness Act applies to secured debt that was incurred improving, building or buying a primary residence. • Refinanced debt also qualifies as long as it was used to fix up the house. • The Act does not protect debt on rental properties, second homes, business properties, car loans or credit cards.
Get Organized and Get Going
To take advantage of the Mortgage Forgiveness Debt Relief Act, you need a lot of documentation—particularly the closing docs from when you purchased the home, refinancing documents and receipts for any improvements made to the home,
to name a few. (These documents need to be held on to and accessible for a period of no less than seven years.) If the Mortgage Forgiveness Debt Relief Act is not extended by Congress, you need to close on your short sale or loan mod before the end of the year. If you foreclose or close after Dec. 31, 2012, the consequences could be severe. Consider, for example, if your home is upside down by $100,000, you could owe 20–35 percent of that—yes, $20,000–$35,000 in income tax. This could saddle you with a tax bill you really cannot afford. There are some options and exceptions that could lighten this tax burden for those in financially bad circumstances or those who have outstanding tax debt. And, of course, the U.S. government has payment plans available. There is a lot of planning that needs to be done before making a final decision in order to understand the consequences and how to best deal with them. Work with a qualified tax professional who can guide you through the process, make sure you understand what you are about to do and prepare you for what lies ahead. The laws keep changing and you need to understand how they will affect your specific circumstances—so keep asking questions. Fast Fact Going through a short sale or foreclosure? he state swimming age group championships revealed lots of strong young swimmers on the Dolphins, and a couple stand-out performers. “They all did really good,” said Coach Scott Newell of the 30 or so Dolphins who traveled to Chandler for the four-day meet ending Sunday, July 22. “They’ve been training really hard; Everybody dropped time.” Quite a few swimmers made it to the finals, said Newell, with Dylan Melin bringing home the most medals.

Melin’s spectacular contribution came when he, as anchor for his relay team, above, brought them from sixth place to third. He also took silver in the 200-meter individual medley. “We’ve anointed him the fastest 10-year-old in Anthem,” Newell said. Melin’s times qualified for the Western Zone Championship Tuesday, Aug. 7 in Grand Junction, Colo. Eight-year-old Mason Edmunds won the 200-meter freestyle with a time that missed setting the U.S. record by just a few hundredths of a second. “It’s a 10-and-under age group, so to do that at 8 is a big deal,” Newell said.

Anthem Prep Leads Offense Against Head Injuries The charter school is first in the state to use new device to prevent football concussions, and at the front of a paradigm shift in youth football culture.

T
he NFL has changed. Instead of defending the sport against critics who call it too violent, it is now encouraging all 50 states to legislate protection for kids against concussions on the field. Pop Warner, the largest youth football organization, followed suit with changes to the rules of contact to lessen the risk of head injury.
Now, Anthem Prep is leading Arizona teams with an even more aggressive game plan. The charter school’s football program is first in the state to equip players with Pro Cap, a helmet shell designed to absorb the impact of concussion-causing hits. Pro Cap spokesperson Tom Woodward said, “With Anthem Prep leading the way, a lot of other teams will be moving to this technology.”

How the Pro Cap Works
The Pro Cap is a soft foam shell that fits over the existing football helmet and is held in place with Velcro. Its goal is to absorb most of the impact force of a head hit, keeping the brain safe from concussion. At only 12 ounces, the Pro Cap adds no noticeable weight, according to the manufacturer’s website. It is designed to match the helmet so the visual difference from the sidelines is minimized. Other helmet designs are being developed, such as the Gladiator—a one-piece helmet with a soft outer shell which, the manufacturer says, “eliminates the helmet from being used as a weapon.”

Anthem Prep coach Mark Huston’s own football career ended due to a series of concussions, the last of which was during college play. “I want our Anthem Prep football players to have the latest technology available to them in order to best protect them against the risk of concussion,” Huston said. Huston adheres to the no helmet-to-helmet rule, educating players on proper tackling technique.

NFL player Mark Kelso believes in the Pro Cap technology and used it while playing for the Buffalo Bills. A testimonial by Kelso appears on Pro Caps’ website. In a one-year study of three football teams, Dr. Ken Fine of George Washington University Hospital found players wearing Pro Cap experienced no concussions, while six players who weren’t wearing the device suffered concussions, according to the manufacturer’s website. A Change in Practice
Nationally, Pop Warner’s youth football organization now limits contact drills— such as one-on-one blocking, tackling and scrimmaging—to 40 minutes per practice, or no more than a third of the total weekly
practice time. The league now also prohibits fullspeed head-on blocking or tackling from more than 3 yards apart. Full-speed drills may occur only when players approach each other from the angle. Mayo Clinic Provides Free Baseline Screenings to Thousands of Athletes
Following the passage of Arizona Senate Bill 1521 in 2011, rendering high school athletes who have sustained a concussion ineligible to play until cleared by a licensed health care provider, Mayo Clinic began offering free baseline concussion screenings. More than 40,000 computerized baseline evaluations were performed last year; the free program continues this year. The test takes 8–15 minutes to complete, and results can be shared with health care providers. Following an injury, the baseline test is compared to a repeat test to look for change in cognitive abilities. A third test, along with a neurological evaluation, can determine whether the athlete has recuperated to pre-injury baseline.
