Library Renovation a Disappointment
I
just went into the [North Valley Regional Library] at Boulder Creek [High School] and I was so disappointed. The library just went through a month’s worth of renovation... which should have been labeled “downsizing.” I never thought my local library needed the book version of liposuction. I walked into the lobby, up to the librarian’s desk and was shocked that I could see the entire back wall. Prerenovation, the only visible part of the wall was high up near the ceiling. The only way to accomplish this wallrevealing feat had to be by removing 60–80 percent of the books.
When I asked a librarian to help me find books on bird watching, I was further disappointed that she struggled to locate the books, that no map of the new configuration existed, and that when she did locate the section, there were only four relevant books on the shelf. I find myself missing Dewey Decimal like a long, lost lover. What a shame.

T
he 2013 AIMS results are in just in time for the new school year. Adams Traditional Academy topped the chart among schools in our area, with remarkable gains in writing and math. Gavilan Peak and Boulder Creek posted improvements in all subject areas—math, reading, writing and science. But after the 2013-2014 school year, the pencil and paper exam will be
erased by the state. Arizona has joined a consortium of 20 states that will administer a national exam starting in the 2014-2015 school year. The new assessments will be developed by the Partnership for Assessment of Readiness for College and Careers, or PARCC, and will reflect the Common Core Standards Initiative. The more rigorous academic standards have been adopted by 45 states and Washington, D.C. io

H
ere’s something you probably didn’t know: Anthem Parkside Community Association uses satellite and aerial imagery from the Maricopa County Tax Assessor’s website and Google Earth to check your backyard for non-compliance issues. But before you start crying “big brother!” ―know they’re not necessarily monitoring your yard. With 7,000 homes in Parkside, Annette McCarthy, community manager of Anthem Parkside, said her office doesn’t surf websites all day looking for compliance issues, although she said she knows of smaller communities that do exactly that. “We use those sites when we receive complaints about violations we can see, but we don’t micromanage everyone’s backyard,” said McCarthy. Of course, no one is doing a satellite-assisted weed check in your backyard. Compliance agents are checking against such complaints as above-ground pools or structures too close to walls. A formal complaint, including the name of the complainant, must be submitted for violations the HOA cannot easily verify, such as a

That’s all Parkside compliance needs to launch Google Earth or the tax assessor’s site to take a peek. That’s just what happened to Donny Fiant. Fiant was issued a violation for his above-ground pool, he said, after an anonymous complaint spurred the HOA to check satellite imagery on the county assessor’s website. Fiant cried foul, claiming the issuance of the violation was illegal as satellite imagery is inconclusive. “There was no way the HOA could definitively know if the image was current or what exactly was in the image,” said Fiant.
Is it Legal? According to Kimberly Garde of the Garde Law Firm, it’s kind of a moot point. Anthem Parkside agents don’t have to use satellite images to peer into your backyard. Governing

documents give HOA agents the right to inspect your yard as long as they give you adequate notice. So, why didn’t Parkside agents just notify Fiant, and head on over to check his yard? McCarthy said a backyard inspection just won’t happen under her watch, without permission. “We do have an easement to go into the yards and, as long as I work here, we will never, ever go into the backyard without permission. We want to respect people’s privacy.” So, verifying a violation can become tricky business. The assessor’s site warns
it does not guarantee the images are accurate or current. “If the association browses the assessor’s website to discover compliance issues, it still needs to verify those issues independently of the website,” Garde said. “It has to give notice unless it’s an emergency. And, they’re never entitled to enter the dwelling,” she said. Fiant ultimately ceded Parkside’s repeated requests for inspection. Know Your Rights • If you receive a violation notice, you have 10 business days after the date of the notice to send a response by certified letter. • Once the association has received the certified letter, it has 10 business days to respond to the member with a written explanation of the violation with the following information unless it was provided in the first notice: 1. The provision of the community documents that has allegedly been violated. 2. The date of the violation or the date the violation was observed. 3. The first and last name of the person or persons who observed the violation. 4. The process the member must follow to contest the notice.

Fish the Little Colorado River which runs through Greer, or make the half-hour drive to Big Lake. A Potentially Fatal Mystery (with a really simple solution…) By Chris Prickett cprickett@anthemnews.com
S
moke detectors and CO2 alarms have lifespans. Not the batteries, the actual units. And, it’s time for many of Anthem’s homeowners to replace them. Question Why do smoke and/or carbon monoxide alarms only make that obnoxious low battery chirp at 2 a.m.? Answer Like sock-eating dryers and the papal conclave, it’s one of those universal mysteries that are to be accepted and not questioned. Do you know what’s worse than a rogue smokie mocking you during sleepy time? Waking up to a fully engulfed house fire or, worse, not waking up during a fully engulfed house fire. It’s so easy to just yank those plastic sirens off the ceiling when they chirp at ungodly hours (and I know you’re doing it because I spend most of my time in other people’s houses). But you need to resist the temptation as though your life depends on it... because it really does. Just do this: 1. Replace the battery. Removing the dead battery without a fresh replacement will only make the chirping worse. Your smoke detectors are hard-wired, meaning they are powered by your electrical system. The batteries just serve as back-up power—great for when your power is out and you have to light a bunch
of candles… The chirping tells you the battery is dying. Tip: Write the date of replacement on the battery itself. And, replace them all at once. It’s recommended that you test the batteries monthly and replace them every six months. If you replaced the battery and it’s still chirping… 2. Clean it. Suck the spider carcasses and airborne Doritos dust out with the crevice tool of your vacuum and/or shoot some canned air into it. As a last resort... 3. Replace it. Smoke detectors have a lifespan of about 7 to 10 years. Of course, so do guinea pigs, and we all know how that goes. A new smoke detector is about $14 and eats less than your average guinea pig, so if changing the battery or cleaning it don’t work, go to the store or online and order up a few. ennar Homes is working on a 201-home development on the west side of I-17 on a 78-acre parcel just north of the Daisy Mountain Post Office. About two dozen residents attended an open house Thursday, July 25, at the Hampton Inn to hear more about the builder’s preliminary plans. Neighbors were notified of the open house by a letter from Lennar’s attorneys. The homes would be one- and twostory, single-family homes ranging from 2,000-3,500 square feet, and priced between $250,000-$400,000. But before it can build, Lennar needs
the City of Phoenix to approve its application to rezone the land for residential use. Approval could take up to eight months, according to Todd Skoro, land acquisition manager for Lennar. And, he said, it could take another eight months for the engineering process. So, it could be up to two years before construction begins. Like Anthem’s west side, homes would have a Phoenix mailing address and would be served by the City of Phoenix for water, sewer and garbage, Skoro, said. Anthem access was a question posed repeatedly during the open house, said Skoro. “And in our public report when we make offers to sell houses, we’ll make that clear,” he said. The development would have its own HOA and its own pocket parks, with a ramada, barbecue area, tot lot, grassy space and pedestrian connections within the community, said Skoro. Lots would average around 6,000 square feet, and approximately 34 acres of the site will be reserved for drainage and for a noise buffer along I-17 that would include a sound wall. The site plan reveals two points of access to the development. Lennar plans to extend 43rd Avenue slightly to the north for entry to the community, and develop Circle Mountain Road

Next Steps Neighbors will have additional opportunities to weigh in on the development as Lennar continues to meet with the Phoenix Planning Commission and City Council.
