More Hoopla… Editor’s Note A letter about a basketball hoop violation in a cul-de-sac [“Family Friendly Anthem Denies Neighborhood Hoops,” In&Out, June 13] drew a response letter [“No Need for Hoop,” In&Out, July 4], which prompted an unusually large response from readers. Below is a sample:

I

agree Anthem does offer a lot for our family community, but it doesn’t offer the same in every pocket park. The only thing located in our nearby park is a slide, unprotected from the sun which can seriously burn my children. Why doesn’t the HOA concentrate on street parking? They seem to have no control over that. Or better yet, the pet owners who are not cleaning up after their pets. Or even trash enforcement for folks who place their trash cans on the sidewalk forcing mothers with babies to walk in the street. Hmm... let’s evaluate the importance here, “FAMILY.” Anthem is NOT only a 55+ community.

“We are a family-oriented community, right? Where families can step out their front door and socialize with each other and let their kids run around and play a little bit of ball.... Oh, wait... That’s not allowed.”

Ariail Berkeley Buntyn “Think if they called [and asked] before they just put the hoop out. It might have been a different outcome...”

Ilyssa Epstein “Hoop nowhere near Anthem Way and only visible to the few houses on the very secluded cul-de-sac.”

NEWS » COMMUNITY Thermal Galvanic Corrosion (TGC) has created a pinhole in this copper pipe and a big problem for the homeowner. The pipe ran beneath the foundation slab.

Trial Finally Set for Pipes Class Action IN&OUT STAFF PHOTO

By Nadine Shaalan nshaalan@anthemnews.com

T

he “slab leak” class action lawsuit involving some 3,000 Anthem homes (including one owned by the author), has been ordered to a jury trial to begin May 6, 2014. The case

and it causes the hot-water pipe to eventually fail. The class action was filed in 2009 after several homes were discovered to have under-slab leaks. According to court records, Del Webb sought to decertify the case as a class action claiming, among other things, that the conditions of a few sample homes cannot be extrapolated to all homes in the class.

Anthempipes.com, run by the legal team for the plaintiffs, claims more than 100 cases of TGC in Anthem. claims that in some homes built by Del Webb Coventry Homes, hot and cold copper water pipes were laid parallel to each other beneath the concrete slab foundation with insufficient insulation, creating an environment prone to corrosion. The condition is called thermal galvanic corrosion (TGC) 12

IN&OUT

| THURSDAY, JULY 18, 2013

But on Jan. 17, Judge J. Richard Gama ruled, “Plaintiffs’ theory is premised on proof of the many (as a scientific certainty) illustrated by a few. Plaintiffs are ‘all in’ on a theory of a universal design defect causing TGC that has caused and/or will cause a hotwater pipe leak in all class homes.”

Del Webb settled a similar TGC class action for $24 million involving more than 5,000 homes in Sun City developments in Las Vegas in 2004. If the case makes it to trial, several homeowners are expected to testify along with several expert witnesses. Anthempipes.com, run by the legal team for the plaintiffs — Fenton Grant Mayfield Kaneda & Litt, LLP and Davis Miles Mcguire Gardner, PLLC—, claims more than 100 cases of TGC in Anthem. The class would seek to obtain a monetary recovery, pro rata, for each homeowner so that repairs could be made, according to the complaint filed Dec. 28, 2007. The cost to replumb an Anthem home would be several thousand dollars, according to Tom Ford of Liberty Plumbing who has performed some inspections for the law firm. “The cold water is in good condition,” Ford said, so no need to reroute that. On a threebathroom, single-story home, Ford estimated repiping the hot water will cost around $4,000–$5,000. The cost to repair the drywall and stucco would add an additional couple thousand to that price, he said. io I S YOUR PROPERTY INCLUDED IN THIS CLASS ACTION LAWSUIT? anthemnews.com/class-action

Signs You May Have an Under-Slab Leak • Warm spots in the floor. • A dramatic increase in your water and gas bill. • Moisture in the floor. • Sound in your walls conducted through copper pipe.

How to Test for Leaks

1. Shut off all water in your home, including automatically filling water purification systems, ice makers, pool levelers. 2. Check your water meter. This is usually in a ground-level box under a metal cover near the street-edge of your property. If the dial on your water meter is moving, you may have a leak. (Liberty Plumbing offers slab leak analysis at no charge: 623-551-9156) If you suspect an under-slab leak in your Del Webb home… • Del Webb Warranty Service pulte.com/ownersentry/owners. aspx?open=serviceRequest and click “Submit Service Request.” • Fenton Grant Mayfield Kaneda & Litt, LLP at 1-800-238-0625 From Pulte’s New Home Limited Warranty: “Plumbing Leaks in the event that water leaks are found in any supply lines, drain lines, piping, faucets, bathtubs, or showers that will cause damage to the home if not corrected, the Builder, for a period of five years, will repair as necessary. e never heard that name used until those ads starting running on local TV this spring. “Visit Utah’s Mighty 5!” So, like all good TV-watching consumers, we decided to pack up Ms. Gypsy and see for ourselves what these Mighty 5 national parks of Arizona’s sister state were all about. During a 14-day road trip, we lived in rock splendor as we explored and photographed Zion, Bryce, Capitol Reef, Canyonlands and Arches National

We began at the Driftwood Inn in Springdale, Utah—Gateway to Zion National Park. We ended at the Gonzo Inn in Moab, Utah—Gateway to both Canyonlands and Arches National Parks. Both inns and both towns were absolutely delightful. But it was the national parks that were the true stars of this road trip. Here is the skinny on each:

Zion National Park is a land of towering cliffs of red and tan sandstone carved by the Virgin River into a multitude of canyons and valleys. Maj. John Wesley Powell, after exploring Zion Canyon in 1895 and seeing the sculpting effects of water through sandstone, said “all of this is the music of water.” Zion is a hiker’s paradise with more than 50 trails rated from easy to strenuous. An efficient shuttle bus system quickly moves thousands of visitors in and out of the canyon each THURSDAY, JULY 18, 2013 |

day. The famous, 16-mile Narrows Trail leads the ambitious hiker up and often through the Virgin River into a slot canyon, where one walks beneath 2,000-foot canyon walls which are often just 30 feet apart. Incredible! Zion can be hot during the summer, but the park is always a favorite destination for summer vacationers. Driving through the 1.1-mile Zion Tunnel cut through a solid rock mountain in 1930, is one of the many more memorable experiences of Zion.

Bryce National Park is a land of the hoodoos, those spires of limestone that look like an ancient army turned to stone while marching through this southern Utah landscape. Some have suggested it is a landscape created by Dr. Seuss himself. Most visitors experience Bryce by gazing down into the canyon from overlooks surrounded by ponderosa pine trees. Horseback and hiking trails do exist where park visitors can travel into the canyon and pose next to one of those ancient hoodoos for a “hoodoo-picture.” More than 10 miles of paved bike trails surround Bryce National Park, making this the mountain biker’s favorite of the five. 16

Capitol Reef National Park is the most remote and least known of the Mighty 5, located near the small community of Torrey, Utah. This land of multihued rock layers with redrock canyons and mesas has been shaped and carved by the Fremont River. Like all of the Mighty 5, hiking, biking and camping are common activities. Early Mormon pioneers came to this land in the early 1900s. The Gifford Homestead farmhouse is used today as a cultural demonstration site, museum and small gift shop which sells the best homemade mixed-fruit pie. Most visitors to the Gifford farm leave marveling at the courage and skills of these early pioneers in forging a living from this majestic, but harsh land.

Canyonlands National Park is best described as a wilderness of rock.

GET OUT

Utah’s largest park reminds us of a miniature Grand Canyon. The Green and Colorado Rivers have carved this land into three sections. Few roads have been cut into the 527-square-mile park, and those that have are mostly unpaved. Canyonlands is a modern version of untamed America. Park overlooks allow visitors to gaze into the vast chasms and enjoy the towering mesas and adjacent valleys. The work and power of the tools of erosion are on glorious display here. Canyonlands is a desert environment and so is hot during the summer months. Short walks and long hikes lead to continual landscapes of unique rock formations.

Arches National Park is a special land with the largest gathering of natural stone arches in the world—more than 2,500 having been discovered and documented. The paved scenic road leads to a short walk to many of the massive sandstone arches. Arches is a favorite of hikers who walk the many trails that lead into the more remote areas of the park. Wildlife such as Bighorn sheep, mule deer and many varieties of lizards, are abundant. We visited the Mighty 5 in the spring and the wildflowers in all five parks were spectacular.

Canyonlands and Arches are very warm in the summer, so a fall or spring trip is advised. Capitol Reef and Bryce are at higher elevations, so summer temperatures are moderate. Zion is warm in the summer and very crowded with visitors from all around the world. If you love to discover the beauty of nature, plan your own road trip to Utah’s Mighty 5.
