CITY OF PENSACOLA SUNSHINE CENTER The agency in charge of handling

public record requests has been plagued with long delays and charging citizens exorbitant fees for city records. Two years ago, Mayor Ashton Hayward bragged in his budget message that the center was delivering most records in less than six days. Today, it's not unusual for a request to take three weeks to be fulfilled. Recently, Inweekly was given a partial response to a request because the volume of documents and extensive personnel time to complete it, only to be told later there were no records. Huh?

BEULAH SECTOR PLAN For six years, the plan has hailed as being the first step towards a massive planned development in Beulah that would essentially become a new city. Last week, the Board of County Commissioners appeared ready to ditch it after Commissioner Wilson Robertson, who voted for the plan in 2010, asked to have eight acres of his property removed from the plan. In the end, the Commission voted to table the matter until Nov. 22, after Robertson is off the board.

WHY PUBLIC RECORD REQUESTS Citizens’ access to the records of their government is critical to open government. Public record requests are the check that we all have over elected offi cials and government bureaucracies. It’s why Inweekly has, over the years, pushed for Mayor Ashton Hayward and his administration to release records. In 2013, we fought for weeks for the City of Pensacola to release all of its documentation regarding its contract with The Zimmerman Agency. When we finally received the documents and emails, we discovered a concerted effort to keep the agency's work hidden from the public before the “big reveal” in July 2012. The State Attorney’s Office eventually recommended a revamping of how the Hayward Administration handled public record requests. A year later, Inweekly asked the State Attorney’s Office to intervene when the City refused to release the documents a federal grand jury had subpoenaed for its apparent investigation of Mayor Hayward. The City finally had to release the information. Last year, we disagreed with City Administrator Eric Olson’s executive order that city staff was not to respond to emails sent from federal and other government email accounts. The First Amendment Foundation agreed with our position. The State Attorney’s Office made a phone call to City Hall, and Olson rescinded the order.

This year our record requests have revealed the city made major changes to its grievance appeal process and HR manual without telling the employees. We found that no city employee, outside maybe fire and police, has had a job performance evaluation since early 2012, even though some have been given substantial raises. We discovered the mayor’s office staff has turned over more than three times in less than six years. We found that former City Administrator Colleen Castille and Chief Operations Officer Tamara Fountain were paid hefty severance checks after the public had been told they left the city voluntarily. We discovered Mayor Hayward settled a lawsuit brought against the City of Pensacola by his former City Administrator William Reynolds for over $95,000 without the knowledge or approval of the City Council. None of this information is readily available on the city’s website or its “Transparent Pensacola” page. His Chief Financial Officer Dick Barker gives the Council a monthly report on all expenditures over $25,000. The payments to Castille, Fountain, and Reynolds were not included in those reports. Mayor Hayward doesn’t hold town hall meetings that would give the public an opportunity to address issues and ask questions. Only one way to find out how the City is operating remains. PENSACOLA'S BROKEN SUNSHINE CENTER

By Duwayne Escobedo Mayor Ashton Hayward said three years ago that transparency is critical to the success of Pensacola. The city website even includes a "transparency" page. But try getting public records from the city today and you will find little transparency exists. What does exist is a broken City of Pensacola Sunshine Center that provides incomplete results, false or misleading statements, long delays, and high-priced bills for the retrieval of even the most routine requests. The city created the Sunshine Center in 2013 in the wake of two top members of Mayor Ashton Hayward's staff being charged with non-criminal violations. In July of 2013, State Attorney Bill Eddins charged the two with non-criminal violations of Florida's public record laws for allegedly withholding branding and logo information. The mayor revised the city's public record request policy, bought software to help track and fulfill requests, and had the First Amendment Foundation's Barbara

Peterson, an expert on public records, conduct a mandatory public records seminar for city staff. "Transparency is critical to the success of our city," said Hayward in a written statement. "It is my goal to reinforce excellence as a part of our culture when it comes to fulfilling public records requests, and I remain steadfast in my insistence on transparency in my administration." Fast-forward to today and little, if any, "sunshine" comes through. In one of the latest incidents, Inweekly asked for documentation of Hayward's authority to settle a lawsuit filed against the city by his former city administrator for over $95,000 September 2015, without city council knowledge or approval. Reynolds alleged wrongful termination. The paper received copies of the City Charter and FY2015 Comprehensive Annual Financial Statements (CAFR) and a link to the city's code of ordinances -- none of which expressly supported the mayor's decision. Public Records Coordinator Matt Shaud wrote Inweekly: "The volume and nature of your records request requires extensive use of personnel to process in a

timely manner. The City of Pensacola has completed part of your request, and we are providing that portion to you now." When Inweekly Publisher Rick Outzen pressed for the release of the rest of the information, Shaud responded, "After a review of our records, the City of Pensacola has determined there are no additional records responsive to your request." The reply came after Inweekly had asked the State Attorney's Office to intervene on the public record issue, the third time since Shaud took over the Sunshine Center in late June. Need more examples? Consider the following. In August 2016, the Inweekly requested: "Any emails, reports, letters and other documentation regarding the Local Option Gas Tax, which also could be referred to as Local Option Fuel Tax, for the period Jan. 1, 2013 through Feb. 28, 2013." The weekly was charged $56.46 for the Monthly Financial Review Dec 2012; Financial Report-3 Months Ending Dec 30, 2012; Council Meeting Minutes; Proposed Local Option Gasoline Tax; and 26 emails. The emails included a draft of a white paper on the Local Option Gas Tax and a possible interlocal agreement with Escambia County that would have helped fund VT-MAE at the Pensacola International Airport. Chief of Staff John Asmar sent it to Chief Financial Officer Dick Barker on Feb. 21, 2013. The city sent the draft report but not the final report that had been sent minutes later to Mayor Hayward, his executive assistant, and Barker. The report revealed, among other things, the conclusion by Barker that the county would likely reduce the gas tax allocation to the city based on its declining funding of transportation projects. That's exactly what the county did this summer. Barker acted surprised about the lower allocation, and Hayward filed an appeal with the Florida Cabinet. Assistant Fire Chief Joe Glover, whom the mayor terminated in May along with

Fire Chief Matt Schmitt, submitted a public record request in January for documents related to his EEOC complaint against the city. The day the city put him on leave, Glover received a quote from the Sunshine Center for $15,234.79 for 810 hours of research, which is the equal to eight-hour days every weekday for about five months. Finally, former Pensacola City Council President Maren DeWeese has run into trouble requesting public records, too. She is now a city watchdog and reports her findings on Maren's Blog Dot Biz. DeWeese asked for routine information regarding the Southwest Airlines emergency landing at Pensacola International Airport on Aug. 27, which had made national news. She requested information on the fire engines that responded, manpower on each engine, ARFF units responding and manpower on each, response times, time on scene, and the name of the on-scene commander. The incident report included all but two of the items she requested. Pensacola Sunshine Center's Shaud sent DeWeese an invoice for $555.19. DeWeese speculated on her blog that it was done to "discourage her uncovering the failures of the City of Pensacola Fire Department's emergency responses and exposing just how unsafe our airport fire safety is?" Both the Inweekly and DeWeese have claimed that recent requests reveal that some public records may have been either destroyed or deliberately withheld. Both are violations of Florida law. "The SAO doesn't want to prosecute politicians. It's uncomfortable. I understand," DeWeese wrote. "But when do the repeated violations of the Mayor's office regarding public records reach the point where the SAO's filter is full?" Mayor Hayward may want to dust off the State Attorney's Office report in 2013 on the city's past public record failures. He could bring back the First Amendment Foundation to do an independent audit of the Sunshine Center and make recommendations. {in}

RAFFERTY HONORED On Sept. 29, the

Florida Justice Association presented the 2016 Perry Nichols Award to Levin, Papantonio Law Firm shareholder Troy Rafferty at the FJA Masters of Justice Convention in Orlando. The Perry Nichols Award is the highest award given by the FJA and is presented to an attorney whose perseverance, commitment and unmatched dedication to the civil justice system are at the forefront of their lives. "I certainly was honored and very humbled to receive the award when I found out that I had been nominated and was going to be the 37th recipient of it," said Rafferty last week on "Pensacola Speaks." Perry Nichols is regarded as a pioneer in the field of personal injury law and was a revolutionary figure in his time. He was the first attorney in the state of Florida to win a verdict more than $100,000. Soon after World War II, Perry spearheaded the organization of the Negligence and Compensation Lawyers of Florida, the predecessor of the Florida Justice Association. In 1954, he became one of the founders of the International Academy of Trial Lawyers and was elected president of

the organization in 1965. In 1977, the Florida Justice Association created the prestigious Perry Nichols Award in his honor. Rafferty said, "We've had five now out of the 37 have come from our firm, and that's the most of any firm in the state, and I think the closest firm would be two behind us. We're very proud of that, and we're very proud of the organization, our involvement in FJA, and protecting the civil justice system." The other Levin, Papantonio attorneys who have received the Perry Nichols Award are Fred Levin, Mike Papantonio, as well as late law partners Lefferts L. Mabie, Jr. and former Florida Governor Reubin Askew. Rafferty has been recognized numerous times for his tremendous legal talent, litigating mass tort, pharmaceutical, and major personal injury cases throughout the country. He has been with the Levin Papantonio law firm since 1994. "I've been fortunate here at the firm to be able to work on a number of cases that have had some far-reaching impacts because a lot of the pharmaceutical cases we do," he told Inweekly. "I think it's really all the pharmaceutical cases where we're able to effectuate the most change, and try to help protect the consumers from the dangerous drugs that are put out there in the system that does not protect the consumers a lot of times." Rafferty added, "We got the pharmaceutical industry who's constantly just trying to push drugs out on the market as quickly as they can, and the FDA who unfortunately doesn't have the resources to try and monitor them as well as they should." He said that even though it may seem the system makes it harder to fight for consumers, he's proud of what he, his firm and his profession has done to push back, "We keep fighting for the injured victims," said Rafferty. "We keep fighting for consumers."

HAAS CENTER CALLING Pensacola Mayor Ashton Hayward took to Facebook on Oct. 7 to announce the third annual Pensacola Community Survey by the UWF Haas Center. "One of the values I focus on as mayor is being responsive to the ideas, opinions, and needs of City residents," wrote Mayor Hayward. "Your responses will help us balance priorities and improve services so that Pensacola remains a great place to live, work, learn and play." In the past, the Haas Center conducted the survey over the phone. This year, researchers will also conduct live, in-person surveys of city residents at various weekend festivals and farmers' markets. The Pensacola Community Surveys have replaced the monthly town hall meetings that were Mayor Hayward's "Taking City Hall to the Citizens" initiative. From Jan. 2011 to Dec. 2013, Mayor Hayward conducted 23 town hall meetings to listen to his constituents. While he touted the town halls in his campaign materials, Hayward held no town halls in 2014 while he was seeking re-election. During his second term, he hasn't brought back the meetings where citizens could address issues face-to-face with the mayor and his leadership team. The first Pensacola Community Survey was done in July 2014. Pensacola residents gave Fire Department Services the highest mean satis-

faction score (4.26). Respondents were also highly satisfied with Waste Collection Services, which received the only other B+, with a mean satisfaction score of 4.19. On the other end of the spectrum, city residents were most dissatisfied with Pensacola's Economic Health, which received a grade of C and a mean satisfaction score of 2.74. Public Works received a mean satisfaction score of 3.24, or C+, which followed closely behind Housing Options (3.28) and City Communication (3.30). The second survey was conducted in last quarter of 2015. Again Fire (A-, 4.46) and Waste Collections (B+, 4.20) were the highest rated services, followed closely by City Parks

(B+, 4.08). Police and other Parks & Rec services–Community Centers, Rec Opportunities, and City Athletic Facilities–received B ratings. Public Works was subdivided into several categories. Of those, only street lighting and city appearance & cleanliness were rated a B-. "Communications" was changed to "Ease of Obtaining Info on City Services," and it was again rated low (3.27), despite the emphasis the mayor had placed on social media, Constituent Services (which he formed in 2014), and the city's 3-1-1 automated service. A Garden, a Concert, and a Good Cause by Shelby Smithey

If you missed the first one, don't fret. There are still plenty of chances to pull up a chair and relax under the stars for a concert at ‘From the Ground Up' Community Garden this fall. As part of the "Music Under the Stars" concert series, guests are invited to bring their own chair and drinks for a night of music in the garden. Those attending should come prepared to listen to the soulful sounds of New Orleans talents Colin Lake, David Jordan, and Chris Mulé of Honey Island Swamp Band. Innisfree Hotels, the folks behind From the Ground Up, are hosting the events for a good cause. All proceeds benefit the Community Garden, as well as the Dixon School of the Arts, which is a Pensacola-based K-8 school offering fine arts programs.

This Thursday's concert will feature soulful singer-songwriter Colin Lake. The Seattle native moved to New Orleans to pursue his passion of roots music. Lake has opened for acts like Dr. John and Gary Clark Jr. and has just released his latest album "One Thing That's For Sure" this summer. Make sure to come early, as the food truck rally portion of the event starts at 5 p.m. This go-round, local food trucks Cajun Cravin's, Pancho's Burritos, and The Beachy Barista will be on-hand.

Next Thursday, roots rock singersongwriter Dave Jordan & Friends take over the garden.

"This will be a stripped down, acoustic version of my band," Jordan said. Dave Jordan and the Neighborhood Improvement Association started as a solo project but developed into a five-piece band over time. His "Music Under the Stars" show will include a smaller band for a more intimate performance. "The band in its current state is just a natural progression of what I was doing as a solo songwriter," Jordan said. "This is a fleshed out, rock and roll, Americana version of my previous sound." As a seasoned New Orleans musician and founder/frontman of the long-running funk/ roots band Juice, Jordan has produced or co-produced six albums. He has also, played, performed or recorded with some of the most esteemed musicians in New Orleans and across the country including Art Neville, Anders Osborne, Joe Krown, Bill Summers, and Widespread Panic. Jordan has been in the New Orleans music scene for 25 years now and said that the city is a constant inspiration. "Living in New Orleans affects us so much as musicians," Jordan said. "We're surrounded by top-shelf music all the time, so we try to soak it all in. We soak up all these funk, jazz and rhythm and blues influences, all this great songwriting and try to distill it into what we do but with a rock and roll base." Throughout his career, Jordan has played over 2,000 shows nationwide and keeps a busy touring schedule. "There's been times when the road was more daunting," Jordan said. "But right now

we're having a good time putting this music out. I try to tour a little smarter than when I was younger. We don't want to burn ourselves out." Recently, Jordan took a small break from playing shows to move his son into college at Louisiana State University. DIFFERENCE MAKERS FOUNDER AND CEO OF INNISFREE HOTELS RECEIVES PRESTIGIOUS HOTELIER HALL OF FAME AWARD Last month, Founder and CEO of Innisfree Hotels Julian MacQueen was celebrated by the Florida Restaurant & Lodging Association with its highest honor – the Hotelier Hall of Fame Award – during the FLRA Installation & Awards Gala at the Hyatt Regency in Orlando, Fla. The Hall of Fame Award recognizes an industry professional with a personal record of achievement over at least 20 years, attainment of career distinctions and distinguished service to the industry, community, charitable organizations and family. MacQueen got his start in hospitality at the age of 15, as a busboy at a beachside hotel. He never left the industry. Since its founding in 1985, Innisfree Hotels has built a strong portfolio of beachfront hotels, restaurants and spas along the Gulf Coast of Florida, most recently expanding to own and manage hotels in Michigan and Vermont. With a current total of more than 2,400 hotel rooms and 1,200 employees, the Northwest Florida based company is expected to grow by 50 percent over the next three years. “To be recognized at this level celebrates Innisfree as a whole,” MacQueen says. “This is a collective award that I accept on behalf of my wife and my family and the amazing people at Innisfree.” One hallmark of Innisfree Hotels is the culture MacQueen has created, both for employees and guests.
