T
he coronavirus pandemic has taken its toll on just about everyone in today’s workforce, but younger employees may be facing the greatest burden when it comes to stress. Gen Z employees – those born starting in 1995 – were three times more likely than all other employees since the pandemic started to have sought professional help for stress, burnout or other mental health reasons, according to a new MetLife report. Millennials – those born between 1981 and 1995 - have also been hard hit. It turns out that using virtual interactions instead of in-person communication has been a big part of the problem. The survey found that close to four in 10 workers blamed reduced in-person interaction with friends, family and co-workers for harming their mental health. Fifty-six percent of millennials said they felt the same way. The biggest challenge of working from home, cited by 41%, is the isolation from co-workers. Distractions of the household is the next biggest challenge, cited by 34%. Other challenges include inadequate workspace (19%) and lack of office equipment (19%). Some 47% of Gen Z employees dealing with stress and anxiety said that not being able to connect with co-workers in person as much as they used to played a significant role in their mental health issues. Overall, 34% of employees felt similarly. According to the study, just one in 12 workers who reported not having good mental health in the wake of the pandemic have sought help. About 37% of respondents blamed a stigma relating to seeking treatment, and nearly one in 10 said they were concerned about discrimination from managers and colleagues. Younger employees were most worried about the stigma, according to the report, with 48% of them reporting concerns. Nearly half of Black and Hispanic respondents were most likely to recognize employer stigma about seeking mental health help. What makes a resilient employee in pandemic times? According to the survey, 51% pointed to wellness programs as helping, and 50% said mental health coverage made a difference. About 48% credited relaxation initiatives, and 47% said employee assistance programs helped them in their pursuit of wellness. About 45% said stress management programs helped them stay mentally well. About 70% of employees said that financial stability also helped their mental health. Nearly half said their mental health stress stemmed from long-term savings, medical and other unrelated expenses and stock market volatility. The responses are part of MetLife’s 18th annual U.S. Employee Benefit Trends Study, which the insurer said has been updated with a new “Mental Health Deep Dive.” The report, conducted in July 2020, surveyed 1,000 employers with at least two employees and included interviews with some 2,000 full-time employees, ages 21 and older, at companies with two employees or more.

ven before the coronavirus crisis hit, the reinsurance industry was in a period of significant rate hardening, which will likely continue over the next two years, or even longer, according to Munich Re. Such price increases became necessary after 10-plus years of eroding prices and weakening terms and conditions, which has led to a “significantly reduced profitability [for] the whole industry,” said Torsten Jeworrek, CEO of Munich Re’s 8 | INSURANCE JOURNAL | SEPTEMBER 21, 2020
reinsurance business. He spoke during a virtual Monte Carlo media conference, held in lieu of the Rendez-Vous de Septembre, which was cancelled this year as a result of the COVID-19 pandemic. A second driver of the hardening market has been the higher loss activity seen over the past few years in a number of markets and segments and lines of business, which include both large losses and catastrophe losses, Jeworrek said. He pointed to events such as Hurricanes Harvey, Irma and Maria (also known as “HIM”) in 2017, wildfires
in the United States and manmade claims from satellite losses and various aviation losses, including the grounding of the Boeing 737 MAX in 2019. Social inflation, particularly in the United States, is also pushing higher casualty losses for the industry. Jeworrek said the industry has seen a significant increase in the basic loss ratio since about 2014 – first affecting insurers and now also reinsurers. News & Markets continued from page 8 Thierry Léger, said: “On the back of several years of claims deterioration and premium declines, the situation for the reinsurance industry has gotten worse again in 2020.” Léger also cited social inflation as a major contributor to the industry’s worsening results this year, although social inflation has been around for many decades, and comes and goes in waves. Over the past few years, it has worsened again, he noted. “Social inflation is actually fueled by a general anti-corporate environment. This really pushes plaintiff bars to develop psychology-based strategies to trigger juries,” he said. “As a result, we can see that particularly the higher plaintiff awards, those above $5 million, have been increasing at quite a rapid pace over the last years,” Léger added. “And if you go beyond $100 million, those settlements … in the hundred millions or even billions, you can see an even stronger increase.” Another driver of the hardening market
“is significantly lower interest rate levels, which we see in most major markets, particularly now, after the COVID events and development,” Jeworrek said. Léger blamed declining interest rates for worsening the industry’s loss ratio by 5% during the first half of 2020. “This really means that the timid price increases we have seen have been offset by that further decline in interest rates.” While there have been increases in premiums, they have been hardly enough to offset the interest rate decline of the first half of this year, he said. “Also, these premium increases have … not been able to compensate for many years of premium decline before. And they have in no way been able to compensate for the increased claims load that we are observing around us. As a result, we see a real need for strong price increases to get back to underwriting profits,” affirmed Léger. Although property catastrophe rates have been rising since the HIM losses in

.S. commercial property/casualty insurance prices rose during the second quarter of 2020 by almost 10% compared with prices charged during the same quarter of 2019. Excess/umbrella and directors’ and officers’ liability data indicated the largest price increases, with prices for both growing by over 20% for the second consecutive quarter These findings are based on insurance broker Willis Towers Watson’s Commercial Lines Insurance Pricing Survey (CLIPS). The survey compared prices charged on policies underwritten during the second quarter of 2020 to those charged for the same coverage during the same quarter in 2019. Carriers reported that the aggregate commercial price change grew by almost 5% in the third quarter of 2019, over

6% for the 4th quarter of 2019 and first quarter of 2020, and then jumped to just under 10% in the second quarter. Commercial auto data indicated price increases near or above double digits for the 11th consecutive quarter. Property prices accelerated significantly in the past four quarters, now indicating increases well into the double digits. Only workers’ compensation showed price reductions, and they continue to slowly decrease in magnitude. Overall, price changes differed significantly by account sizes. Small commercial accounts grew by mid-single digits; mid-market accounts showed double-digit increases, and large accounts were well above this range. CLIPS is a retrospective look at historical changes in commercial property and casualty insurance prices and claim cost inflation.
2017, Jeworrek said, they are not back to the levels seen 10 years ago. “All these three factors: erosion of profitability and prices, loss activity, and interest rate levels lead to this hardening, which is I think undisputed at this time,” Jeworrek said. As a result, at least for the next one or two years, “I’m convinced we will see more hardening in reinsurance than on the primary side. And the market’s biggest drivers are Asia and North America.” And, of course, the COVID-19 pandemic is also having a major impact on the market, providing an impetus for further rate hardening. “Market estimations of the immediate impact related to COVID-19 are $50 billion to $80 billion in claims. So far, the industry has booked only $20 billion, so it looks like there is much more to come,” said Léger, noting that the environment continues to be uncertain with rising death and infection rates. “We also observe that whilst certain countries are still fighting the first wave, many other countries are now already fighting the second wave,” Léger continued. “We all wait for vaccines, but the uncertainty of when those vaccines will be available and whether those vaccines will be effective, is still very high. So COVID-19 not only had a very large impact already, it’s going to remain with us for quite a while.” Stefan Golling, head of Munich Re’s corporate underwriting, discussed the huge uncertainties that are still ahead for the industry with COVID-19. “First of all, we could expect some secondary impacts on classes, like for example, the credit business or liability classes like D&O.” Further, he noted, “we are still in the middle of the crisis, and the second or third wave could lead to an increased amount of losses.” Munich Re estimates COVID-19-related property/casualty losses will range from US$30 billion to $100 billion, coming from various lines of business, such as the travel business, event cancellation business, credit business and workers’ compensation. Munich Re has so far reserved €1.4 billion (US$1.6 billion) for its P/C claims in the first half of 2020. INSURANCEJOURNAL.COM

A hacker reportedly accessed a computer server for the university’s Ecampus online education program this summer, gaining access to records containing names and OSU email addresses.
NiSource Inc. will pay this amount to resolve a probe into Massachusetts gas explosions in 2018 linked to a utility it owns that killed one person and destroyed multiple buildings, State Attorney General Maura Healey said. Healey said the settlement with NiSource and its subsidiary Columbia Gas of Massachusetts will provide debt relief to low-income gas customers and pay for clean energy programs, according to a Reuters report.

On-site inspections found deficiencies at the companies that included a lack of health screenings, face coverings, employee training, cleaning measures and overall preparedness plans. A general duty clause citation carries a fine of up to $7,000.
The amount the North Carolina Department of Insurance fined Gerber Life Insurance Co. last month for what it said were numerous violations related to the insurer’s claims practices for accidental death and dismemberment policies. The company was also to pay out $2.5 million in additional recoveries in interest. The voluntary settlement comes after examiners with the department reviewed almost 300 claims over seven years that were either denied or settled improperly.

Under the guise of academic research, this report is nothing short of an attack on those who exercised their personal freedom to attend Sturgis.” — South Dakota Gov. Kristi Noem in a prepared statement disputed a study published by San Diego State University that ties the Sturgis Motorcycle Rally in August to a massive surge in COVID-19 cases and approximately $12.2 billion in public health care costs. The study, which analyzed virus case counts, as well as anonymized cellphone data, estimated that more than 250,000 new coronavirus cases in the U.S. could be linked to the 10-day event that hosted nearly 500,000 attendees.

chool officials and insurers across the country are facing questions about COVID-19-related insurance liability as classes begin, but answers remain elusive, according to A.M. Best. “Uncertainty about the plethora of issues involved with school liability abounds,” A.M Best said in a commentary. “Whether immunities are afforded, pandemic liability suits prevail, or additional states extend presumptive clauses to teachers, there is the potential for significant expense, and possible losses, for school insurers,” the rating analyst said. School insurers themselves are also at risk of employment practices liability as well as cyber claims as schools resort to virtual learning in an effort to reduce COVID-19 risks. A.M. Best said that given these potential scenarios, some reinsurers have already indicated that they will be requiring COVID-19 and pandemic exclusions, as well as communicable disease exclusions, in their 2021 renewals.
It’s Complicated
The broader issue is whether a school can be held legally liable if students, staff
or others succumb to the coronavirus pandemic. The answer for school boards and administrators remains a complicated one. School districts typically have liability protection from “some form of a governmental or public entity tort immunity act” with provisions that vary by state. In theory, the ratings agency said, these acts would likely protect districts from liability if their reopening plans dovetail with local, state and federal laws, and also guidance from state board of education officials, the Centers for Disease Control or local health departments. That is except where there might have been negligence, and what could be considered negligent remains an open question. According to A.M. Best, there has been a push to strengthen immunity protections, although momentum has slowed. Some
unions and workers’ rights advocates have resisted immunity protections, arguing that they would lead to negligent behavior from businesses and schools, and ultimately more coronavirus cases. Workers’ compensation insurance is also an issue for schools. Teacher unions want confirmation that workers’ compensation coverage will address their medical bills and lost income if COVID-19 strikes. That remains an open question, as A.M. Best explains, because the coverage does not typically cover routine community-spread illnesses like the cold or flu (they can’t be linked to a workplace, typically). As for other insurance coverage itself, A.M. Best notes out that insurers that cover schools range from small-cooperatives to large commercial insurers. That means coverage standards vary greatly, and thus coverage guarantees can vary widely, even outside of the pandemic.
Reporting Who Gets It: Coworkers and Coronavirus
D
oes an employer have to say if a coworker has the virus? Employers are generally not required to tell workers when someone in the workplace has tested positive for the coronavirus. The U.S. Centers for Disease Control and Prevention recommends that companies monitor employees for symptoms and alert those who may have been in contact with an infected person. Some states may order businesses to follow such guidance. Employers have the right to take employees’ temperature and ask about INSURANCEJOURNAL.COM
symptoms or if they have been exposed to or diagnosed with the virus. If an employee doesn’t respond to those questions, they can be barred from the workplace. Businesses are required to provide a safe working environment. They also have to keep track of infections contracted on the job and report any hospitalizations or deaths related to the disease to the U.S. Occupational Safety and Health Administration. Some workers are unsettled by the lack of information. Amazon, for example, alerted warehouse workers when someone tested positive for the virus, but didn’t
disclose a tally of how many workers tested positive. So workers began trying to keep track on their own. There are also pending lawsuits against employers filed by workers who were exposed to or diagnosed with the coronavirus. In general, there’s a high legal bar for finding an employer at fault for endangering employees and most claims are resolved via workers' compensation settlements. Insurer Chubb announced the appointment of John Fielding as senior vice president, general counsel, Global Government John Fielding and Industry Affairs. In this role, Fielding will provide legal, regulatory and policy guidance and advice to Chubb’s state, federal and international government affairs team. He will work to ensure consistency in advocacy throughout the company’s government affairs activities and will represent the company in regulatory and industry settings. Fielding joins Chubb from the Council of Insurance Agents & Brokers (CIAB), where he served as general counsel for four years. He was also with law firm Steptoe & Johnson, where, for more than a decade, he represented CIAB as well as other insurance trade associations, carriers and producers before Congress, the National Association of Insurance Commissioners (NAIC), the National Council of Insurance Legislators (NCOIL) and state insurance regulators on policy and regulatory matters. From 1997 to 2003, he was a senior counsel at the National Association of Insurance Commissioners. Fielding, who is based in Washington, D.C., reports to Joe Wayland, executive vice president, Chubb Group, and general counsel. Upon Fielding’s departure, The Council (CIAB) announced that Gracie Gerlach will be promoted to associate general counsel. Currently serving as political action committee director, Gerlach joined The Council in
February 2019 after working at the National Federation of Independent Business Ohio. As associate general counsel, Gerlach will work with Chief Legal Officer Scott Sinder and the team at Steptoe & Johnson as she focuses on internal legal matters and the Council PAC. In this new role, Bernstein will spearhead SageSure’s ability to execute personnel investment programs and initiatives, leading the human resources, office operations, legal and administrative functions. Bernstein began her career as an employment attorney before transitioning to spearhead human resources functions for two organizations. Most recently, Bernstein was a senior partner and global head of human capital and administration for Apollo Global Management. At Apollo, she built the human resources department from the ground up and helped the firm grow from a small private equity shop to a publicly-traded, global alternative asset manager. Everest Insurance has hired Louis Manger as head of Casualty Claims. In this role,

cyber insurance and security company, has hired Marcin Marcin Weryk Weryk as head of Business Development. Weryk brings more than 15 years of insurance industry experience as a cyber and technology E&O underwriter to this role, managing teams at global carriers. He will be based in Coalition’s New York office. Coalition announced in May that it raised $90 million in equity capital to fuel its growth and expansion. As head of business development, Weryk will support this growth by driving the company’s distribution strategy. Weryk was most recently vice president and head of Cyber Risk for the Western and Southern U.S. at XL Catlin. He has also held cyber and technology underwriting positions at XL Catlin and CNA.

New York-based investment firm The Carlyle Group led a $150 million investment for Deerfield, Ill.-based Alera Group, the property and casualty, employee benefits insurance broker that is a privately-held company and backed by Genstar Capital and Alera employees. Alera plans to use proceeds from the investment to support ongoing growth and acquisition activities. Since inception in 2017, Alera has been one of the fastest growing companies in the insurance brokerage industry, according to Alan Levitz, Alera’s CEO. Alera opened its doors in 2017 with more than 20,00 clients, $158 million in annual revenues and 750 employees in 40 offices across 15 states. It was formed by 24 independent insurance firms with investment from Genstar Capital, a middle market private equity firm, and brokerage assistance from consulting and investment banking firm Marsh, Berry & Co. Today, Alera has more than 100 locations and 1,800 employees. Carlyle’s Global Credit segment made the investment with capital from its $2.4 billion Credit Opportunities Fund that closed last year. Alex Popov, Carlyle’s co-head of Illiquid Credit Strategies, said Carlyle leveraged its expertise in insurance brokerage and an existing relationship with Genstar to “structure a customized financing solution for Alera in an otherwise challenging economic environment.” 24 | INSURANCE JOURNAL | SEPTEMBER 21, 2020

Specialty insurance brokerages Ryan Specialty Group and All Risks have closed on the merger of the two firms into Ryan Specialty Group. The deal unites Chicago-based Ryan Specialty Group and its nearly $12 billion in premium, and All Risks, headquartered in Delray Beach, Fla., which has close to $2.6 billion in premium. The combination will have roughly 3,300 employees and more than 70 offices across the United States, the United Kingdom and Europe. Only AmWINS and CRC Insurance Services are larger than RSG and All Risks in the wholesale brokerage space. Both brokers have national footprints, while RSG also does business in Europe. Both have track records in wholesale distribution and managed underwriting businesses in the form of managing general underwriters, programs and delegated binding authorities. Details of the agreement to merge, which was first announced in June, were not disclosed. All Risks executives Nick Cortezi, CEO, and Matt Nichols, president, will continue in senior executive roles in the merged firm. RSG, which is celebrating its 10th anniversary, consists of RT Specialty, a wholesale brokerage firm, and RSG Underwriting Managers, a specialty underwriting organization within which there are 21 specialized managing general underwriters. All Risks, which started in 1964, is a
Hippo, an insurtech managing general agent focused on home insurance, has completed its acquisition of Spinnaker Insurance Co. with an expansion into additional states next on its plate. The deal, first announced in June, follows a multi-year partnership between the companies. Spinnaker is a New Jersey-based national property and casualty insurer, with a license to do business in all 50 states. Hippo noted at the time of its acquisition announcement that Spinnaker has been its largest carrier platform partner since 2017. With Spinnaker and its other carrier partners, Hippo provides home insurance policies in more than 31 states. Plans call for Spinnaker to join the Hippo “family of companies.” They include Sheltr, a San Francisco-based technology-enabled services startup designed to provide home wellness checkups. Hippo will continue as a managing independent agent. Spinnaker will operate independently under the Hippo umbrella while still serving third-party administrators and driving the growth of its program platform. After two acquisitions, Hippo is eyeing an initial public offering. The company closed a $150 million financing round in July. CEO Assaf Wand said the company will be ready to go public in 2021.

News & Markets Data of About 200K Nevada University Alumni, Donors May Have Been Stolen

niversity of Nevada, Reno alumni and donors may have had their information stolen in a data breach that occurred in May, university officials said. The school was told of the breach on July 16 by Blackbaud, a third-party fundraising technology provider. About 200,000 people may have had their contact information, addresses and giving history compromised from the hack, said university spokeswoman Kerri Garcia.
No social security numbers, credit card information or banking information was taken, Blackbaud said. The university informed alumni and donors of the breach on Aug. 31. Blackbaud said in its summary of the incident that the hackers made a copy of the data they received and the technology provider paid a ransom to ensure that the copy was destroyed. New Mexico Officials Say Teachers Are Safe from Legal Liability Amid Virus
N
ew Mexico officials have clarified that teachers won’t be on the hook for lawsuits that might stem from COVID-19 outbreaks as in-person classes began for some students. “In no way will teachers or school employees be held personally liable for litigation arising out of COVID-19,” said Richard Valerio, executive director of New Mexico Public Schools Insurance Authority. School districts can be on the hook for negligence that leads to students getting sick, however. The insurance authority sent a letter to districts urging them to follow safe COVID-19 practices to avoid getting sued. Valerio says it’s “wait and see” as to how much legal risk schools will face. No lawsuits have been filed in New Mexico, which has had some in-person learning for certain at-risk students. Teachers are immune from personal liability for virtually all lawsuits, such as a personal injury claim from a student who contracts a virus at school. administered by the agency. The letter to the districts didn’t mention teacher liability, leading some educators to infer that they might be at risk. “It’s important to clarify this fact after some unfortunate misinterpretation of NMPSIA’s (email) to superintendents,” Lt. Howie Morales said. “We will protect all of our educators and staff who are on the front lines of this pandemic today, and we are extremely grateful for their contributions to our students and our communities.” Plans for in-person schooling were pushed back after a spike in cases in July. Ex-Director Files Whistleblower Suit Against University of New Mexico
T
he University of New Mexico retaliated against the director of Africana Studies for demanding that his program be elevated to a department and later removed him when the program got state funding for the change, according to a whistleblower lawsuit. An attorney for Charles Becknell Jr. filed the whistleblower lawsuit in state district court last month alleging the school retaliated against him and failed to adequately investigate a series of racist and threatening emails he received. Becknell sought to elevate Africana Studies from a program to a department that would grant undergraduate and graduate degrees after Chicano Studies and Native American Studies had achieved department status, the lawsuit said. But a dean told Becknell that the University of New Mexico was focused on elevating Chicano Studies to a department and an upgrade of Africana Studies wasn’t in the immediate plans, the lawsuit claims. After Africana Studies got state funding to become a department, Becknell was told it needed a tenure-track professor to lead the new program and Becknell was removed. The University of New Mexico said Becknell remains the director of the Africana Studies program and will search for a new director when it becomes a department. rofessional liability insurance is a complex and interesting concept. As insurance professionals, or practitioners if you prefer, we are used to the concepts and terms of several different liability policies. We understand that an auto liability policy pays for bodily injury and property damage related to automobile By Patrick Wraight accidents. We get that a general liability policy pays for bodily injury, property damage, and personal and advertising injury related to business exposures (premises, operations, products, etc.). But what about professional liability policies? They aren’t concerned with bodily injury, property damage, or personal and INSURANCEJOURNAL.COM
advertising injury. They aren’t concerned about an auto accident. Allow me to quote one professional liability policy that I read.
Professional Loss Professional loss means: 1. A monetary judgment, aware or settlement of compensatory damages;
We will pay on behalf of the “insured” for “professional loss” in excess of the deductible that the “insured” becomes legally obligated to pay as a result of a “claim” caused by an actual or alleged negligent act, error or omission in the performance of “your professional services”…
This makes sense to us because we deal with compensatory damages in other liability lines. Compensatory damages are meant to compensate someone for injuries that happen. In this case, those injuries are tied to some sort of professional service. What’s a professional service? Let’s come back to that.
Without digging all through the whole policy, there are two sets of terms that we need to deal with: “professional loss” (defined in the policy) and negligent acts, errors or omissions (not defined in the policy). Since it’s defined for us, let’s look first at “professional loss.”

In several states, they are not insurable. That’s why this policy provides some limited coverage for these items. Punitive and exemplary damages are exactly what they sound like. This isn’t about whether or not they should be insurable, just whether or not they are. There’s one more part of this definition.

the care due to the situation. Error: a mistake that causes someone an injury. It could be that the professional provided the wrong advice to their client. Omission: something got left out that causes someone an injury. This is where the professional fails to do something that they ought to do.
So let’s get back to the coverage. What are we providing coverage for on this professional liability policy? If we could sum it all up in a very short sentence, it would be this: This is insurance for human professionals that are sometimes human. People make mistakes, and that includes professionals. These policies are going to have exclusions against intentional acts or illegal acts. They will have exclusions against unlicensed practice of the profession and other exclusions. Remember that these are the policies that cover the potential negligence, errors, and omissions of several different kinds of professionals: insurance agents, doctors, lawyers, architects, pharmacists and more. Because of the wide range of different professions, the policies will all read differently. So dig out the policy and read it to find all of the conditions, exclusions, and other language for that particular policy. I didn’t even mention that the occurrence policy that I read didn’t include defense costs within the limit, but the claims-made policy did. unicipalities, their insurers and risk pools should be heeding the current public re-examination of police and prosecutorial actions taking place across the country, according to an insurance policyholder attorney who works on civil rights cases. Attorney Alexander Brown sees the Black Lives Matter movement, actions by reform-minded prosecutors, increasing legal actions and calls for police reform resulting in more municipalities having to answer for law enforcement errors and misconduct. This, in turn, will mean closer scrutiny of law enforcement liability insurance policies by those seeking damages for victims of civil rights violations, according to Brown. However, while insurers now may be changing their policies, the cases being brought tend to go back awhile and thus involve policies issued years
and even decades ago. Brown, who is with the firm Lathrop GPM in its Kansas City office, is an insurance coverage specialist who represents policyholders, including municipalities facing civil rights complaints from victims of wrongful conviction and incarceration. Brown is a member of the Lathrop GPM Civil Rights Insurance Recovery Practice along with Mike Abram and

Bill Beck. In an interview with Insurance Journal, Brown offered his legal and policyholder perspectives on civil rights claims and some insurance ramifications. Not all persons who have been wronged by law enforcement or the civil justice system are in a position to pursue a liability case against the government. In fact, strong liability claims are relatively rare, in part because of the qualified immunity doctrine
for police officers and the absolute immunity doctrine that protects prosecutors while performing prosecutorial functions. “I would say that a majority of people exonerated do not have strong liability claims because of these immunities. If qualified immunity is weakened for police officers, it follows that more liability claims will be brought,” Brown said. Once exoneration is secured, the Lathrop GPM team moves to obtain compensation for the exonerees, who are disproportionately Black men. The settlements, which can sometimes be costly, are most likely to happen where there is insurance. “[I]n these cases where you’re trying to come to a resolution outside of a verdict, the existence of insurance is critical. It’s the most critical part of the entire settlement process,” Brown acknowledges. INSURANCEJOURNAL.COM
According to Brown, obtaining insurer-funded settlements helps avoid trials, which can be risky for both the public entities and the plaintiffs because either could lose big. State caps on liability do not apply in these federal civil rights suits and jury verdicts can be $1 million to $2 million per year. The insurance deals help alleviate situations where a public entity that has no insurance or inadequate coverage may be forced to raise taxes to cover settlements or have to declare bankruptcy. The cases typically involve older insurance policies because the alleged violations stretch over long periods of time — 10, 20 or even 30 years. “The cases are treated and should be treated akin to long-tail liability claims for any kind of exposure to conditions, or illnesses, environmental contamination. It’s the same kind of thing, where you have a long period of time between the conviction and the exoneration,” he said. “So really the only win-win scenario, if there is one in these cases, is to make sure that the insurance that they bought specifically for these type of situations covers them.” The insurance settlements also help those who are exonerated and face being released back into society with little or nothing, especially in states without any compensation fund for wrongfully convicted persons. According to The Innocence Project, which works to free wrongfully convicted persons using DNA evidence, the federal government and 35 states have provisions to provide some compensation for exonerees. However, advocates for the INSURANCEJOURNAL.COM
exonerees believe the amounts states provide (often $50,000 a year for each year of wrongful imprisonment) are inadequate for the injuries suffered.
What’s Changing
To hold a municipality liable for a civil rights violation, a plaintiff has to show the violation was due to a policy, practice or procedure of the municipality, or that a decision-maker like a sheriff was involved in it. Forces now at play are likely to aid plaintiffs in their causes, according to Brown. “What I see now with the Black Lives Matter is that there’s going to be a whole lot of investigation into whether various municipalities or police entities have policies or practices that discriminate against African-Americans, and that’s going to be established with respect to numerous cities,” Brown said “Once it is established that they do have a pattern and practice of locking away Black men or of beating Black men, then suing those cities and municipalities is going to be a lot easier. Because then they can point to a policy and practice, and so you can hold the city and the municipality liable along with the individual defendant or officer who committed the misconduct.” Once a municipality gets hit with a verdict, not only is that verdict potentially crippling, but also it may signal the start of a pattern of practice for the next aggrieved person who sues. While it might behoove police departments and prosecutors to review their practices and patterns to see what has been going on, it’s not
that easy. “You might have a police officer saying, ‘Hey, let’s not look too deeply into this because we don’t want to create paper trails,’” Brown suggests. Similarly, district attorneys may fear legal and financial repercussions may lie ahead for the municipality if they start unearthing wrongful conduct by previous officeholders as they try to get innocent people out of jail, which a few reformist district attorneys across the country are trying to do. Brown is currently representing a prisoner in Missouri who is stuck in jail because of a dispute over a prosecutor’s authority to undo a previous prosecution. “If you’ve got a progressive reformist DA who’s working, as they should, to get people out of prison who were in prison because of wrongful conduct of their past offices, they know at some level that there might be liability at the end of the rainbow when these guys get out,” Brown said. “It’s a brave thing to do, and it’s a necessary thing to do.” Brown said that in addition to the current questioning of qualified immunity for police officers in light of several shootings of Black men, there has also been some shifting in case law that could limit prosecutors’ immunity if they commit misconduct while acting in a non-prosecutorial capacity, such as helping with the investigation or doing ministerial work. “Then they do not have absolute immunity; they only have qualified immunity. So that immunity is slowly degrading, while what cops can get away with in terms of qualified immunity is
also degrading. So you have situations where these lawsuits are going to be a serious focus and a serious concern for municipalities and public entities across the country,” he stressed.
Landmark Ruling
The 2010 movie Conviction starring Hilary Swank tells the story of how a determined sister secured her brother’s exoneration and release from prison after he served more than 18 years for a murder he did not commit. The movie ends with Kenneth Waters’ release and reunion with his daughter in 2001, but the real story — including the insurance effects — did not end there. What followed his release from prison were years of legal proceedings and negotiations with insurers to obtain compensation for Waters for the years of mental and physical injuries he suffered while in prison, as well as for his loss of freedom. Eight years after his release, in 2019, Waters’ estate eventually settled a wrongful conviction lawsuit against the town of Ayer, Mass. Five of the town’s six insurers paid $3.4 million to the plaintiff’s estate (Waters himself died in 2001 in an accident only six months after getting out of jail). However, a sixth insurer, Western World, argued that it was not obligated to defend the town under any of the six consecutive law enforcement officers’ liability policies it issued from 1985 to 1991, and it did not participate in that settlement. But four years later in a follow-up proceeding, a court found that Western World had breached its duty to defend and that its policies

did apply. The court awarded $1,000 per day that Waters had been incarcerated ($6.7 million), another $1 million “for physical illnesses and injuries incurred during and because of his incarceration” and another $3 million for “mental anguish, pain and suffering,” for a total of $10.729 million against Western World. Brown says the Ayer decision was significant for holding that insurance policies with unique language can be held accountable for acts during the tenure of a wrongful incarceration and not just at the time of a wrongful conviction. “The Waters case was the first decision to recognize that certain insurance policies issued in post-conviction years might apply to wrongful imprisonment cases,” Brown said. The Waters case was handled by Brown’s mentor, Bill Beck, of the firm’s civil rights division. It was Brown’s introduction to this field of insurance law.
Beyond Hollywood
The Waters case that garnered the attention of Hollywood was important. The ruling has helped get more insurers to come to the table and participate in settlements, according to Brown. Even more important is a case decided in May 2019 in which Brown and his firm were involved. Travelers Indemnity Co. v. Ethel Mitchell involved whether multiple insurance carriers had a duty to defend their insured, Mississippi’s Forrest County, which was sued by the estates of three wrongfully convicted men. The insurers had issued more than a dozen specialty law enforcement liability
policies between 1979 and 2010 (the year of the exonerations). “The Travelers v. Mitchell case is our firm’s most important civil rights case to date,” Brown said. From 2013 to 2019, Brown and his colleagues fought for compensation for the families of the three men in Mississippi who were wrongfully convicted in 1979 and spent a collective 83 years in prison for a rape and murder they did not commit. The men ultimately died from the injuries they sustained in prison. Brown and his colleagues successfully litigated the underlying rights matter against multiple carriers that resulted in a $20.5 million insurer-funded settlement for the families of the three men.
holding multiple insurers liable for bodily injuries sustained by our clients while imprisoned.” The result was a victory not only for the families of three men but also for the county, police officers and thousands of future exonerees seeking financial compensation for their wrongful imprisonment, according to Brown. “This is definitely a case that municipalities need to be aware of,” said Brown, noting that it has since been adopted and expanded in opinions in Missouri (Ferguson v. St. Paul Fire & Marine Ins. Co.) and Kentucky (St. Paul v. City of Newport Ky.). (The law firm also said it thinks the Travelers case may have even more widespread implications. “While the win

On May 29, 2019, the U.S. Court of Appeals for the Fifth Circuit, in a unanimous panel decision, upheld the lower court rulings in the case. According to Lathrop GPM’s reading, the Fifth Circuit judges ruled that insurers cannot utilize common law “coverage theories” such as “first manifestation” or “first exposure” or “continuous trigger” to sidestep the plain language of their policies. In Brown’s words, “This groundbreaking and precedent-setting decision rejected a so-called ‘single trigger’ theory advanced by the insurance lobby in favor of a plain language reading of the insurance policies, ultimately

Brown joined the Lathrop GPM firm in 2013, right after Western World settled in that landmark Waters case. It was a move that he says changed his life. “I never thought as an insurance coverage lawyer that I’d be looking at crime scene photos all day long, but it’s exciting. It’s a good feeling to help compensate those who have been destroyed by
society as well as protecting the current cities or entities,” Brown told Insurance Journal. Brown and other Lathrop GPM attorneys work pro bono with attorneys from the civil rights litigation firm Neufeld, Scheck & Brustin and The Innocence Project, which Neufeld and Scheck founded in 1992 to use DNA evidence to get innocent people out of jail. The Innocence Project receives thousands of requests for help per year. To date, 375 people in the U.S. have been exonerated by DNA testing, including 21 who served time on death row. These people served an average of 14 years in prison before exoneration and release. Overall, Lathrop GPM has been involved with more than 15 settlements totaling almost $200 million. Most recent was the case of Craig Coley, 71, who served four decades in prison for a murder that DNA proved he did not commit. The city of Simi Valley, Calif., and its insurers reached a $21 million settlement with Coley. The victories also include getting $25 million for an upstate New York man who in 1991 at age 16 was wrongly convicted and jailed by Putnam County for a rape that in 2006 DNA proved he did not do. Brown is now working with the legal team representing Lamar Johnson, who remains in a prison in Missouri for the 25th year even though there is evidence he is innocent. He has not been released or given a new trial because of a dispute over whether a current prosecutor — in this case, St. Louis Circuit Attorney Kimberly M. Idea Exchange: Construction Avoid Claim Pitfalls Related to 1099 Workers
W
hen the construction labor market tightens, employers fill the gap with independent contractors. A By Mike Freeman quarter (25%) of construction laborers are 1099 workers. While hiring 1099 contract workers helps keep projects on track, it can potentially create an entirely separate problem if their employment classification isn’t made clear for insurance purposes. If an insurer doesn’t know about 1099 workers from the onset, they are unable to fully account for what they are underwriting. This can cause issues down the road, whether related to coverage when claims arise or when it’s time for policy renewal. Brokers can do several things to help mitigate these issues. Using a 1099 form is not enough to settle the status of a worker. The two questions at issue: Does the individual essentially perform as an employee? And does the company manage and otherwise treat that person in the same way it would an employee? If yes, the 1099 worker may fall under the employee classification of the hiring company’s insurance policy — in which case, the best strategy for the
company could be to hire that individual as a W-2 employee instead.
Be Aware of Potential Claim Issues
If an insured construction company is using 1099 workers, policy forms can be written to clearly address coverages and exclusions — such as bodily injury — as related to those individuals. Brokers can help ensure these specifications are in place by asking their policyholders to identify the employment status of workers. Without this clarity, unintended claims issues can arise. For example (again, depending on the company, state, forms and circumstances): • A general liability policy excludes workers’ compensation for employees. But if a 1099 worker is injured on the job site, that general liability policy might pick up the claim because the worker does not fall under the definition of “employee.” • Some carriers may consider 1099 workers to be uninsured subcontractors, and they could be charged a penalty deductible at the time of loss.
Similarly, if 1099 workers are determined to be uninsured subcontractors during an audit, carriers may add an additional premium charge. • Carriers provide general liability coverage for damage but not for the actual work done by an employee. The policy could cover damage caused by a plumbing leak, but not the leak itself. However, if an identified 1099 worker performed the work, the employee work exclusion might not apply, and the policy could possibly have to cover both the leak itself and the subsequent damage.
Review Account for Correct Forms
To be able to confirm audits and to help avoid problems when renewal time comes around, brokers should review each account and compare forms on each policy. In particular, the forms should specify what is covered at the time of claim and clarify whether 1099 workers will be considered the same as W-2 employees (which can be done via endorsement). Construction has been affected by COVID-19, but as work begins to pick up, brokers will likely notice an increase in 1099 workers hired by their policyholders. Extra diligence and attention to policy forms will be particularly important to ensure coverage and exclusions are appropriate and well crafted. Idea Exchange: Product Recall Why Manufacturers Cannot Underestimate the Cost of a Recall Event
T
he latest recall by Nissan of hundreds of thousands of vehicles in North America in June to resolve a latch problem that may allow the hood to fly open while the cars are moving comes on top of three previous recalls for By Lucie Dean the same issue as well as numerous others, including one in 2019 to fix a brake fluid leak which could cause vehicles to catch fire. Whilst a significant event for Nissan, it is just one example of product recalls that occur in the manufacturing industry globally on a daily basis — the true impacts of which can often be underestimated by the manufacturer with potentially devastating consequences. No manufacturer can afford to ignore their product recall exposure, but this is particularly true in the small and medium-sized enterprises (SMEs) space where competition is high, profit margins are squeezed and customers can easily find an alternative supplier. It is important for brokers to ensure product recall options are presented as part of a full risk transfer proposal, and
the main thing to consider when thinking about a manufacturing client’s exposure to a product recall event is the true cost of a product withdrawal. There are many costs involved when a product safety issue is discovered, the most obvious being that to recall the product itself — what is needed to remove it from circulation, the costs to store and (if necessary) destroy that product and notify stakeholders. However, when a recall incident does occur, it sets off a chain of events and the true cost goes much further than many manufacturers think. It’s likely that a significant amount of rectification needs to be done. The manufacturing location may need a complete a clean down to be fit for use, and machinery may need to be repaired. The product may need to be remade and potentially redesigned. Staff may need to work overtime — all of which comes at a cost. Then there’s the business interruption that the manufacturer will undoubtedly suffer: production lines may have been stopped, interrupting sales, credits may have been issued to key customers, and contracts may have been canceled. Whilst the first party costs of a product recall often go ignored and uninsured, the
most underestimated cost is the impact that a recall can have on the reputation of the business. The most challenging and expensive part of a recall is often keeping the business operational while facing intense public scrutiny. A recall incident can stick in the mind of a consumer, potentially driving them to competitor products over quality concerns for a significant period of time. Where competition is high and profit margins are tight, the impact this could have on the survival of a business is significant in the SME manufacturing space. Customers might start looking elsewhere for their next purchase. Manufacturing clients may believe that a recall event will be covered by their more traditional insurance policies, such as general liability or products liability, so it’s really important that brokers review what — if any cover — these afford. Some may include an element of recall insurance, but coverage may be misleading. The business may be protected from third-party costs, but first party costs are generally not covered — or the cover is extremely limited. Recall sub-limits are usually small and can often leave companies underinsured. Triggering these sub-limits can also be difficult as the wordings are narrow. Only stand-alone product recall insurance provides the necessary first party indemnification to protect cash flow should the worst happen and allow a business to continue trading. Presenting this as part of a full risk transfer proposal is an important part of the conversation that brokers should be having with all of their manufacturing clients. Without this cover in place, these businesses could find themselves with mounting costs as they deal with the fallout of a product withdrawal, with declining sales and public perception stacking the odds against them. ear after year I have found that insurance agencies spend 60% of their recruiting activity on account management hires. This far overshadows the combined time spent hiring producers, managers and executives. With such a consistent need for experienced client managers, most firms have built a transactional model to handle a large volume of hires. While it creates some efficiencies, the downside is it can throw your recruiting into a rut. Do you feel like your account manager recruiting process is rote? Has it been several years since you’ve pumped new creative juices into attracting service talent? The fall is the perfect time of year to try new strategies. Now is when you make a big push to recruit experienced account 44 | INSURANCE JOURNAL | SEPTEMBER 21, 2020
managers. I urge you not to use the same old process. Try new things. Push different agendas. Tout benefits and perks that are important to your audience.
‘The fall is the perfect time of year to try new strategies.’ 1. Talk About Compensation Immediately. There are two reasons for this. First, as an agency you are comfortable discussing salary and variable commission because you do it all the time with producers. Second, account managers by and large have the complete opposite comfort level when it comes to discussing money. By initiating a conversation touting strong earning poten-
tial (now and as your career advances), you remove an obstacle the candidate has with their current employer. By Mary Newgard 2. Work-At-Home Is a Major Priority. If COVID-19 showed
agencies of all shapes and sizes one thing it’s that work-from-home is possible on a grand scale. You might be old school and hate the idea, but I can promise you will hate poor employee retention even more. Since June 2020, as agencies formulated return-to-work strategies, Capstone has had over 90% of all account manager applicants cite flexible work schedules, split 3:2 office/home working arrangements or INSURANCEJOURNAL.COM
100% remote as their number one search motivation. These candidates come from other agencies ... and it might be yours. When you don’t offer work-at-home schedules account managers find the benefit elsewhere. If you embrace a plan like this, then scream it from the rooftops to stand out among competitors during the recruiting process.
3. Virtual Office, Virtual Training. By extension of working from home comes the ease of making the job transition. Account managers don’t always get the luxury of an 8 am-5 pm job. They work early mornings, nights and weekends. They resent agency leaders who are unwilling to acknowledge their hard work and sacrifice. You can foster a culture of work/life balance while also still supporting client managers during times that aren’t conventional. In every job offer, I want you to provide a company issued laptop, cell phone (or reimbursement plan) and online, new hire training programs. This way, from day one of their employment to day 365, the account manager has the flexibility to learn, grow and be successful both in the office and outside of it. 4. Unlimited PTO. According to MetLife’s
2019 U.S. Employee Benefit Trends Study, which interviewed over 2,600 full-time employees, 72% expressed interest in receiving unlimited paid time off. If your reaction is, “No way. It’ll never work,” then you’re out of touch with how account managers feel and what benefits they value. Several Top 100 independent insurance brokers have unlimited or discretionary PTO policies. They use this as a major selling point in attracting and retaining client service talent. How do you put a price on time? Your answer could lie in unlimited PTO.
5. Titles = Career Progression. Have you

Producer Heroes I
received a nice email from a reader asking me to write about how important it is to support good producers and how good By Chris Burand producers should be heroes rather than grouping all producers as anti-heroes. He provided the context that good producers used to be thought of highly, whereas today, all producers are looked down upon. He asked if I’d write about this. I do not usually take readers’ requests to write about a specific subject, but this request stands out. He has a point on many levels. First though, I want to examine why producers are not as revered as in the past. Producers, relative to sales, follow the Pareto curve. This is known colloquially as the 80/20 rule. Eighty percent of the producers cannot sell and 20% make 80% of the sales. My personal database suggests the ratio is closer to 60% cannot sell period, 10% can sell a little, 10% can sell quite a bit, and 20% can sell a lot. Regardless, the vast majority of producers really should find another job. When the percentages are so skewed, everyone has a tendency to get painted with the same black brush. The negative energy consumes all the energy. Staff and managers have little energy left to share with the good producers. In and of itself, this may be one reason some agencies can never hire a quality producer while others seem to get more than their share. Good producers like positive energy. Another reason all producers are painted the same involves the definition of “good.” Good is subjective and producers usually have a definition that varies from most all other peoples’ definition. For example, I have had plenty of producers with only $100,000 in commissions tell me 46 | INSURANCE JOURNAL | SEPTEMBER 21, 2020
they were good producers because the quality of their accounts was so excellent. With only $100,000, the quality of the accounts should be excellent because they should have plenty of time to make them excellent, but excellent does not make up for the deficit of production. If we were addressing the difference between a $400,000 producer having high quality accounts versus a $600,000 producer with low quality accounts, then an equalization may exist. But at $100,000, such an equalization is impossible. Third, some “good” producers can out prima donna the worst actors. They are walking E&O exposures trying to hand cases to plaintiff attorneys on platinum platters. They are emotional basket cases. Every reader has their own story from innocent but bizarre clothing to huge mistreatment of co-workers. When the majority of people with a certain title underperform, a connotation gets attached to everyone with that title, whether fair or not. To answer the question as to why good producers are not held in high esteem today, I think everyone is just tired of dealing with the majority of producers. Good producers should be held in high esteem. Now, by “good,” I mean: • Dead minimum of $500,000 self-created commissions. • Quality accounts written correctly. • Generally, follows procedures. • Nice to co-workers. Quality people always deserve honor. Why are producers that meet these qualifications so rare in our industry? Many reasons exist including how difficult it is to find quality people that can sell, want to work in insurance and that agencies can afford. Other industries pay more for high quality young candidates. Insurance buyers are age discriminatory in that they do not like to make large purchases from people that are 24 INSURANCEJOURNAL.COM
years old. Bridging that gulf between being 22, just out of college, and 30, which is about the age buyers are more receptive, is difficult. Pulling them from other industries at that age is tough because they may be realizing some success then and yet, carrying them for five to eight years while they age is too expensive. While they, like cheese and wine get better with age, agencies just can’t store young producers and pay them while they age. Another factor is that insurance is not sexy. Lots of other industries are sexier to young people. Some of the insurtech firms have successfully addressed this point but they focus on marketing rather than sales. Producers are in sales, not marketing. Finding a relatively young, but not too young, person who wants to start their career over, initiate a sales career that is really hard work for many years, and in an industry with a drab reputation is a tall order. This is why the good producers really should be held in high esteem! Add to this the common, though not universal, owner psychologies. In the traditional and now constantly bought out agencies, many owners subconsciously did not want producers that could sell because they did not want to share the limelight. Many of these owners became owners so they would not have managers. They hate being managed and in their sense of fairness, using the Golden Rule to treat others as you would be treated, they won’t manage or train new producers. They fail to appreciate that the need to manage and train is more important to everyone involved. In reality, with absolutely no offense meant, these owners want to manage a book of business and build relationships with clients rather than building a business. Building a business is required for successful producer development. The former goal is not wrong. It just is not compatible with developing quality producers. Put the two factors together and is it any wonder the producer failure rate is so high? Or that producers are not held in high esteem? Do not think the big shops have this figured out either because most do not.

Next, if you run an agency of any size, do some honest soul searching. Do you really, truly want quality producers that will push the agency and maybe push you? Are you willing to make the leadership and management commitment to seeing them succeed? What I’ve observed is that good producers have a tendency to find homes in agencies with positive energy and that energy begins with the leadership commitment to develop quality producers and not sustain poor producers. This includes a formal and even rigid development plan and training course. It involves holding them accountable for

their activities from day one rather than looking at their production at year end. It involves making sure they actually learn coverages rather than just get CE. Almost no producer today is going to do everything on their own. They need leadership, management and mentorship. I only have a few clients where all the producers are held in high esteem. The owners are always great leaders and they always have strong systems in place. You might think those are horrible environments, but they are the most positive environments I visit because the poor producers are not dragging down energy levels. The producers in those shops are held in high esteem, as they should be. These agencies and their employees are the winners. Would you like to join the winners’ club? Questions to Ask Before Starting an Independent Agency
I
n the most recent Closing Quote in Insurance Journal, I wrote about why I believe this is the best time in history for entrepreneurial agents to create a new independent insurance agency. My reasons include lower costs, the increased need for insurance companies to appoint By Tony Caldwell new agencies, newly adopted technologies like Zoom that are expanding agency’s geographical boundaries and the current economic situation, which is putting unprecedented amounts of business on the streets. The last decade has seen more new independent insurance agencies created than any other time in history, and those start-ups will continue to grow. Some estimate that newly created agencies represent as much as 20% to 25% of all independent insurance agencies now in business. In this article, I’d like to explore some of the questions that agents ought to ask themselves when considering whether they should be an agency founder. tion is why you would want to take the risk and commit to the hard work of starting an agency from scratch when you’re already making a good living, perhaps have equity in your book of business and might potentially have the opportunity to buy the agency you already work for?
Accepting the Risks
It is important to recognize that starting a business entails risk. You might fail. And even if you do not, it’s possible that the investment required will be greater than you imagine or that the returns of ownership are less. When I started in the agency business, seven years before my partners, I took any profit out of the business. During those years, I paid taxes on the profits that we did make out of commissions. Your experience will likely be better than mine, but recognizing and accepting the risks based on a gimlet-eyed analysis is more useful than wishful thinking. The risks include whether you will be able to attract the insurance companies you need, whether your marketing and sales plans will work well enough to generate the income you need, and whether your savings will last long enough to carry you to success. In addition to
those risks, you need to ask yourself other questions, such as whether you will be able to become a skilled manager of people in order to grow the business and whether you can manage books of business effectively. Founders need to recognize that while they may have many strengths to contribute to their new enterprise, they will have much to learn. If you’ve never run a business before, you’ll not only have to learn in real-time, but you’ll likely have to pay for that education with some costly mistakes. This isn’t unsurmountable by any means, but it is a risk that should be acknowledged, and your business plan should be built to mitigate. Many of the risks faced by successful entrepreneurs are above and beyond the normal risks of just being in business. You will not have all of the capabilities you need to be successful at the start. You will lack many things. The challenge is daunting, and it requires courage to overcome.
Courage and Commitment
Many people have the dream of owning their own business but have not been able to garner the courage to start. The starting point of courage is commitment. INSURANCEJOURNAL.COM
Many people make light of commitment or don’t really understand what it means. Commitment means to “decide” upon a course of action, and the word “decide” comes from the same Latin root as homicide, fratricide and so forth. Deciding is literally to kill the options. It means to “burn the boats.” In 1519, Fernando Cortez, determined to conquer the Aztecs, literally burned the 11 ships he and his men had arrived in so they had no option but to succeed in their quest. This rather dramatic example is the kind of commitment that leads to success as a business founder. So the next question to ask yourself is: Do you have that kind of commitment? Commitment is scary and takes courage, but it is strengthened by having a clear sense of why you want to (or must) start your own agency. What are you trying to accomplish? Is it personal or business freedom? Or is creating a new and better way to build an agency driving your desire? Perhaps you want to improve the quality of people you work with every day or maybe you just want to create unlimited financial opportunity for yourself and your family. Whatever your reasons for starting your own agency, they must be explored, acknowledged and factored into your decision making or you will be taking the biggest business risk of all — not having Cortez-like commitment.
Support and Strengths
Another question founders should ask themselves is whether they have an adequate support system to make the effort. As a founder, you will work longer hours to become successful than you ever have before. Perhaps you will miss family events. Maybe vacations will become a distant memory for a few years. It’s possible that the stresses of developing a new business will impact personal relationships. So ask: Are the people in your life, including friends, family and work colleagues, committed to helping you not only start but persevere? Do you have enough capital to see you and the business through to the point of adequate cash flow that supports the business and you? Having worked with INSURANCEJOURNAL.COM
hundreds of agency founders, my experience is that most don’t think this question through as carefully and clearly as they should. Not doing so isn’t necessarily fatal, but it can result in broken plans, slower growth, limited opportunity and certainly unnecessary stress. Independent agencies are low capital businesses in general terms, but they do take money to start. Finally, ask: What are your unique strengths that your business should be founded on? Having a very clear idea about this will be of enormous value if you stay focused here. For example, I’ve seen wildly successful agencies started by gifted salespeople who never hired another producer but backfilled their agency with a strong support team. I’ve also seen gifted salespeople fail because they allowed themselves to be hopelessly distracted with service and administrative tasks while wasting time and resources hiring “producers” who couldn’t produce. Whatever your strengths are, making them the core of your business with plans to supplement in other areas will help guarantee your success. In my book, UnCaptive Agent, I describe all of these questions as a “gut check for founders.” My experience is that entrepreneurs are driven and will start their own agency. They cannot be stopped. They will find a way over, around or through every

nsurance organizations have had three reactions to the pandemic with their marketing communications programs. In my book, only one of them is acceptable. One reaction is comprehensive corporate paralysis. I can imagine the narrative on the April 1 video conference: “We don’t know how bad this is going to get, so let’s just coast along. Don’t pitch anything new. And watch your budgets.” Sorry. Not a smart strategy. A second reaction is worse, where the organization actually is going backwards. The July 15 call: “We already lost five months of 2020 – at this point, what does it matter if we hunker down for the rest of the year? Don’t spend money. Focus on the bare minimum. We’re certainly not launching new initiatives. Let’s reassess in December.” That sounds awful. If I worked there, I’d be on the hunt for a new job. The third reaction is brilliant. These organizations are doing the opposite of what you might think. They’re creating, reinventing, moving forward, communicating and having fun. Here are some examples.
Messaging Refresh
Now might be an excellent time for you to take a new look at your brand strategy — especially if it’s been a while since you examined the words in your mission, vision, core values, narrative, evidence, persona, unique market
positioning, target audience and brand essence. The pandemic might have caused some of your messaging to become obsolete. Or, pandemic aside, it’s just been a while and you’re not sure how pervasive the messaging is being used in the organization and the marketplace.
Employees
Find new ways beyond big Zoom calls to reach out to people. Individual thank-you emails for a job well done. Small group calls. One-on-one calls. Now is a great time to use your core values as a discussion point. And if your associates aren’t enthusiastically embracing the values, it’s time for an overhaul. You can’t expect your associates to take care of your business partners and customers if they aren’t feeling settled. I discussed Thimble’s core values with founder Jay Bregman, and when you see their list of values, it is so New York City. They might be perfect for workers there; they might not be authentic for your firm. But that’s the point.
Business Partners
Put your arms around your valuable stakeholders. Launch a video blog or a podcast. Since you likely won’t see people face-to-face at conventions this year, leverage the insurance trade media, bloggers, association sponsorship opportunities, and other centers of influence to keep your original content in front of your audience. A super regional insurance carrier that recently rebranded, doubled
down on insurance industry PR starting in April.
Experimentation
Take your unused travel budget and try something new. Practice “successful failure,” where you learn important lessons from something that didn’t go quite as planned. What about a new product, new partnership or new customer onboarding process? One firm launched a comprehensive thought-leadership program in the surety tech space, where nobody else apparently is doing anything. A carrier launched a webcast series to share marketing and sales ideas with independent agents.
Website Refresh
What’s a better time than now to address the customer experience on your most important office: the website? For some organizations, it never gets done because “we’re too busy.” Well, how about now? We know your team isn’t traveling to conventions. Ask some questions: Does the site follow your brand strategy? Is the content relevant to your customers? How do you know? One agency is updating the website as it takes on its first agency acquisition — again, the opposite of what you’d think during these times. Accept that this pandemic will end. Don’t wallow.
