Condizioni di vendita

1. I lotti sono posti in vendita al maggior offerente e devono essere regolati per cassa nei dieci (10) giorni lavorativi dopo la vendita all’asta. International Art Sale srl agisce quale mandataria con rappresentanza in nome e per conto di ciascun venditore.

2. Le stime riportate in catalogo o accanto ad ogni lotto on line sono solo indicative e possono essere soggette a revisione. I pesi delle gemme sono stimati, pertanto sono da considerarsi indicativi. Le gemme di colore prive di certificazione possono aver subito trattamento finalizzato a migliorarne l’aspetto.

3. Il prezzo di riserva corrisponde al valore stabilito con il mandante, al di sotto del quale non potrà essere venduto.

4. Un’esposizione pubblica dei lotti precederà ogni asta dove si potranno visionare i beni posti in vendita, chiedere informazioni al Direttore della vendita, delucidazioni e chiarimenti agli esperti dei settori ed esaminare lo stato di conservazione degli stessi. Eventuali errori ed inesattezze nella compilazione del catalogo devono essere contestati, pena la decadenza, a International Art Sale srl, prima dell’aggiudicazione.

5. La scheda descrittiva degli Orologi riporta lo stato generale di conservazione e di eventuali restauri, ed è fornita a titolo orientativo e non esaustivo e in nessun caso è da considerarsi una “Garanzia”. Lo stesso vale per l’eventuale Condition Report richiesto dal compratore. I lotti sono venduti nelle condizioni specifiche di come sono esposti, trattandosi di costruzioni meccaniche possono, negli anni, aver subito interventi atti al loro mantenimento International Art Sale srl non assume nessuna responsabilità riguardo lo stato di funzionamento, restauri o parti sostituite. L’acquirente è tenuto a visionare attentamente i lotti nei giorni che precedono la vendita e chiedere delucidazioni in merito all’esperto. Nessun reclamo sarà accettato dopo l’aggiudicazione. Gli orologi in Catalogo si considerano da revisionare e le spese sono a carico dell’acquirente. Viene garantito il funzionamento degli orologi al quarzo (batteria) sino al momento della vendita e del ritiro presso i nostri uffici. I cinturini ed i bracciali sono da considerarsi non originali, se non espressamente specificato nella descrizione Gli orologi impermeabili sono stati aperti per controllare l’originalità e lo stato generale pertanto non è più assicurata la impermeabilità.

6. Al prezzo finale di aggiudicazione del singolo lotto il compratore dovrà corrispondere a International Art Sale srl una commissione d’asta pari al 25% i.c. sul prezzo finale di aggiudicazione fino a € 200.000,00 che sarà ridotta al 20% i.c per la parte eccedente

7. Il Direttore della vendita può accettare commissioni d’acquisto con offerte a prezzi determinati, su apposita scheda sottoscritta e registrata prima dell’inizio della vendita. L’offerta in sala prevale sulla commissione d’acquisto scritta.

8. La partecipazione all’asta è subordinata alla registrazione preventiva, compilando l’apposito modulo con le proprie generalità, prima dell’inizio della vendita, allegando fotocopia di un documento valido di riconoscimento. Al partecipante sarà consegnata una paletta numerata da esibire al momento dell’aggiudicazione. Il Direttore della vendita può non accettare offerte da clienti non identificati precedentemente.

9. I partecipanti all’asta per conto del legale rappresentante di Società dovranno essere in possesso di una delega firmata e del documento del legale rappresentante della Società stessa, oltre il proprio

10. Il Banditore accetta offerte dai presenti in sala, per telefono e per iscritto, ma solo da coloro che si sono prenotati con apposita scheda e on line per offerte fisse con le modalità indicate. Le offerte devono pervenire a International Art Sale srl entro otto (8) ore prima dell’inizio dell’Asta, la Direzione si riserva di escludere le offerte incomplete o pervenute oltre il tempo stabilito.

11. I partecipanti che hanno lasciato offerte scritte saranno informati dell’esito della loro offerta con comunicazione scritta. Gli acquirenti che volessero sapere anticipatamente l’esito delle loro offerte, potranno telefonare alla Sede, se l’asta è stata effettuata a Milano, il giorno dopo la vendita.

12. International Art Sale srl si riserva la facoltà di ritirare dall’asta qualsiasi lotto. Durante l’asta il Direttore della vendita ha la facoltà di variare l’ordine di vendita e di abbinare o separare i lotti.

13. International Art Sale srl, ai sensi dell’art. 1704 Codice Civile, agisce in qualità di mandataria con rappresentanza, in nome e per conto dei proprietari delle opere poste in vendita; pertanto non acquista diritti né assume obblighi in proprio. Ogni responsabilità continua a gravare in capo ai proprietari delle opere, ex Articoli 1476 ss. Codice Civile.

14. Gli acquirenti dovranno effettuare il pagamento entro dieci (10) giorni dalla data della vendita. Decorso il termine di dieci (10) giorni senza aver ricevuto il pagamento, il contratto è da ritenersi risolto per grave inadempimento dell’acquirente senza necessaria comunicazione.

15. E’ inteso che gli oggetti acquistati devono essere ritirati presso i nostri uffici in Milano Via G. 16. Nel caso in cui l’acquirente incaricasse una terza persona al ritiro dei lotti già pagati, quest’ultima dovrà essere munita di delega del compratore una fotocopia del documento d’identità dello stesso, oltre alla ricevuta di pagamento.

17. International Art Sale srl non si assume nessuna responsabilità delle diagnosi riportate sulle analisi rilasciate da Laborato ri Gemmologici nazionali e internazionali allegate ai beni posti in vendita.

18. International Art Sale srl si riserva la possibilità di fare rivalsa, nelle sedi opportune, dei diritti d’asta non incassati dagli acquirenti che per qualsiasi motivo non ritirano il lotto aggiudicato in sala, per telefono, o con offerta scritta.

19. International Art Sale srl presenta le opere, sul catalogo e on line, corredate ognuna da una scheda tecnico-storica in cui si descrive l’opera nella sua integrità, riportando ogni imperfezione visibile, per quanto riguarda lo stato di conservazione. Dopo l’aggiudicazione International Art Sale srl non potrà essere ritenuta responsabile per eventuali vizi dei lotti, relativi tra l’altro anche allo stato di conservazione, all’errata attribuzione, all’autenticità, alla provenienza o alla mancanza di qualità dei lotti. I potenziali acquirenti e l’aggiudicatario rinunciano espressamente alla garanzia di cui agli artt. 1490 e 1947 c.c., liberando International Art Sale srl da ogni relativa responsabilità

20. Le opere descritte nel presente catalogo sono esattamente attribuite entro i limiti indicati nelle singole schede. Le attribuzioni relative a oggetti e opere di antiquariato e del XIX secolo riflettono solo l’opinione di International Art Sale srl e non possono assumere valore peritale Ogni contestazione al riguardo dovrà pervenire entro il termine essenziale e perentorio di 8 giorni dall’aggiudicazione, corredata dal parere di un esperto, accettato da International Art Sale srl. Trascorso tale termine cessa ogni responsabilità di International Art Sale srl. Se il reclamo è fondato, International Art Sale srl rimborserà solo la somma effettivamente pagata, esclusa ogni ulteriore richiesta, a qualsiasi titolo. In caso di contestazione le spese di spedizione relative alla restituzione del bene sono a carico dell’acquirente.

21. Le opere sono vendute con le autentiche dei soggetti accreditati al momento dell’acquisto. International Art Sale srl, pertanto, non risponderà in alcun modo e ad alcun titolo nel caso in cui si verifichino cambiamenti dei soggetti accreditati e deputati a rilasciare le autentiche relative alle varie opere. Qualunque contestazione, richiesta danni o azione per inadempienza del contratto di vendita per difetto o non autenticità dell’opera dovrà essere esercitata, a pena di decadenza, entro cinque anni dalla data di vendita, con la restituzione dell’opera accompagnata da una dichiarazione di un esperto accreditato attestante il difetto riscontrato.

22. Le etichettature, i contrassegni e i bolli presenti sulle opere attestanti la proprietà e gli eventuali passaggi di proprietà delle opere vengono garantiti da International Art Sale come esistenti solamente fino al momento del ritiro dell’opera da parte dell’aggiudicatario.

23. Gli Acquirenti sono tenuti all’osservanza di tutte le disposizioni legislative e/o regolamentari in vigore relativamente agli oggetti dichiarati di interesse culturale da parte del Ministero dei beni culturali ai sensi del D. Lgs. 22/01/2004 n.42 e ss. All’aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato, sarà reso quanto pagato e non potrà pretendere da International Art Sale o dal venditore alcun rimborso di eventuali interessi sul prezzo e sulle commissioni d’asta già corrisposte.

24. L’esportazione di oggetti da parte degli acquirenti residenti o non residenti in Italia è regolata dal D. Lgs. 22/01/2004 n.42, nonché dalle leggi doganali, valutarie e tributarie in vigore. Pertanto, l’esportazione di oggetti la cui datazione risale ad oltre settant’anni è sempre subordinata alla licenza di libera circolazione o licenze di esportazione rilasciata dalla competente Autorità, e potrebbero essere necessari fino a 3 mesi per la concessione della stessa. International Art Sale non assume alcuna responsabilità nei confronti dell’acquirente in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati La limitazione all’esportazione o il ritardo nel rilascio di qualsiasi licenza non costituisce causa di risoluzione o di annullamento della vendita o giustificato motivo del ritardo del pagamento da parte dell’acquirente. Il costo del rilascio dei necessari certificati di libera circolazione o licenze di esportazione è a carico dell’acquirente.

25. Il diritto di seguito verrà posto a carico del venditore ai sensi dell’art. 152 della Legge 22.04.1941 n. 633, come sostituito dall’art. 10 del D. Lgs. 13.02.2006 n. 118.

26. Per ogni lotto contenente materiali appartenenti a specie protette (Convenzione di Washinton 1975) come, ad esempio, corallo, avorio, tartaruga, coccodrillo, ossi di balena, corni di rinoceronte, etc., è necessaria una licenza di esportazione CITES rilasciata dal Ministero dell’Ambiente e della Tutela del Territorio che deve essere richiesta dal proprietario del bene prima della vendita. Si invitano i potenziali acquirenti ad informarsi presso il Paese di destinazione sulle leggi che regolano tali importazioni.

27. Le presenti Condizioni di vendita, regolate dalla legge italiana, sono accettate tacitamente da tutti i partecipanti alla procedura di vendita all’asta e restano a disposizione di chiunque ne faccia richiesta.

28. “Condizioni di vendita ulteriori” per la partecipazione a ASTA LIVE e ASTE A TEMPO con l’ausilio di dispositivi elettronici. International Art Sale srl mette a disposizione dei potenziali acquirenti la possibilità di fare offerte di acquisto dei lotti in Asta tramite il proprio sito www.internationalartsale.it e piattaforme internazionali a noi collegate come strumento aggiuntivo, e non sostitutivo, alle altre forme di partecipazione. Ogni offerta con i dispositivi elettronici è equiparata all’offerta in sala, telefonica e scritta ed è vincolante per l’acquisto del bene e non può essere revocata, modificata o ritirata. Ai potenziali acquirenti che utilizzano dispositivi elettronici è consigliato di visionare, su appuntamento, i beni nei giorni precedenti l’asta o richiedere “Condition report” dei singoli lotti interessati. International Art Sale srl non è responsabile per errori e/o malfunzionamenti relativamente alla presentazione di offerte tramite dispositivi elettronici. Ciò include anche la perdita di connessione internet e/o anomalie con i software dell’asta. Si rende noto che gli acquisti effettuati con l’utilizzo di dispositivi elettronici nell’Asta Live e/o Asta a Tempo non beneficiano del diritto di recesso, come previsto dall’ art. 59 lett. m del Codice di Consumo D. Lgs. 206/05.

29. International Art Sale srl si riserva il diritto di rifiutare offerte con i dispositivi elettronici di potenziali acquirenti non conosciuti, salvo che venga fornita una adeguata garanzia bancaria o che venga rilasciato un Deposito Cauzionale del 30% del valore dei lotti desiderati, senza oneri.

30. Ogni offerta con i dispositivi elettronici è disciplinata sia dalle Condizioni generali di vendita sia dalle Condizioni di vendita ulteriori (punto 26).

31. Ai sensi dell’art. 13 D. Lgs. 30.06.2003 n. 196 (Codice in materia di protezione dei dati personali), International Art Sale, nella sua qualità di titolare del trattamento, informa che i dati personali o aziendali forniti con mezzi cartacei e/o elettronici, verranno utilizzati per la stipula ed esecuzione del contratto avente ad oggetto i nostri servizi e per ottemperare agli obblighi di legge. Il conferimento dei dati si rende necessario per adempiere gli oneri contrattuali/legali, la mancata comunicazione degli stessi pregiudica la conclusione del contratto. Previo espresso consenso, i dati potranno essere utilizzati per l’invio di materiale informativo, pubblicitario e promozionale sull’attività di International Art Sale srl. 32. Il cliente prende atto e accetta, ai sensi e per gli effetti dell’art. 22 D. Lgs n. 231/2007 (Decreto Antiriciclaggio), di fornire tutte le informazioni necessarie ed aggiornate per consentire a International Art Sale srl di adempiere agli obblighi di adeguata verifica della clientela. Resta inteso che il perfezionamento dell’acquisto è subordinato al rilascio da parte del Cliente delle informazioni richieste da International Art Sale srl per l’adempimento dei suddetti obblighi. Ai sensi dell’art. 42 D. Lgs n. 231/07, International Art Sale srl si riserva la facoltà di astenersi e non concludere l’operazione nel caso di impossibilità oggettiva di effettuare l’adeguata verifica della clientela.

33. Per qualsiasi controversia inerente alla vendita è stabilita la competenza esclusiva del Foro di Milano.

Conditions of sale

1. The lots shall be offered for sale to the highest bidder and shall be settled in cash within ten (10) working days of the auction. International Art Sale srl acts as agent with representation in the name and on behalf of each seller.

2. Estimates given in the catalog or next to each online lot are approximate only and may be subject to revision. Gem weights are estimated, so they should be considered approximate. Color gems without certification may have undergone treatment aimed at improving their appearance.

3. The reserve price corresponds to the value established with the principal, below which it cannot be sold.

4. A public display of the lots will precede each auction where you can view the goods offered for sale, ask the Director of the sale for information, explanations and clarifications to experts in the fields and examine the state of conservation of the same. Any errors or inaccuracies in the compilation of the catalogue must be contested, under penalty of forfeiture, to International Art Sale srl, before the award.

5. The description sheet of the Watches reports the general state of preservation and any restorations, and is provided as a guide and not exhaustive and in no case is to be considered a "Warranty". The same applies to any Condition Report requested by the buyer. Lots are sold in the specific condition of how they are displayed, as they are mechanical constructions may, over the years, have undergone interventions designed to maintain them. International Art Sale Ltd. assumes no responsibility regarding the state of operation, restorations or replaced parts. The b uyer is required to carefully view the lots in the days leading up to the sale and ask the expert for clarification. No claims will be accepted after adjudication. Watches in the Catalog are considered to be in need of servicing and the costs are the responsibility of the buyer. Operation of quartz (battery) watches is guaranteed until sold and collected from our offices. Straps and bracelets are to be considered non-original unless specifically stated in the description. Water-resistant watches have been opened to check originality and general condition therefore water resistance is no longer guaranteed.

6. At the final price of each lot, the buyer must pay International Art Sale srl an auction commission equal to 25% VAT included on the final price of the lot up to € 200,000.00, which will be reduced to 20% VAT included for the excess part.

7. The Sales Director may accept purchase commissions with offers at fixed prices, on a special form signed and registered before the start of the sale. The offer in the auction room prevails over the written purchase commission.

8. Participation in the auction is subject to prior registration, by filling in the form with your personal details, before the start of the sale, attaching a photocopy of a valid identification document. The participant will be given a numbered pallet to be shown at the time of the award. The Sales Director may not accept offers from customers not previously identified.

9. Participants in the auction on behalf of the legal representative of the Company shall hold a signed proxy and the document of the legal representative of the Company in addition to their own.

10. The Auctioneer will accept bids from those present in the room, by telephone and in writing, but only from those who have booked themselves with the appropriate form and online for fixed bids in the manner indicated. Bids must be received by International Art Sale ltd. no later than eight (8) hours prior to the start of the Auction, Management reserves the right to exclude bids that are incomplete or received after the specified time.

11. Participants who have left written offers will be informed of the outcome of their offer by written communication. Buyers who wish to know in advance the outcome of their bids, may call the Head Office, if the auction was conducted in Milan, the day after the sale.

12. International Art Sale srl reserves the right to withdraw any lot from the auction. During the auction, the Sales Director has the right to change the sales order and to combine or separate the lots.

13. International Art Sale srl, pursuant to art. 1704 of the Civil Code, acts as agent with representation, in the name and on behalf of the owners of the works offered for sale, and therefore does not acquire rights or assume obligations of its own. All responsibility continues to be borne by the owners of the works, ex Articles 1476 et seq. Civil Code.

14. Buyers shall make payment within ten (10) days from the date of sale. If the period of ten (10) days has elapsed without receipt of payment, the contract shall be deemed to have been terminated due to serious breach of contract by the purchaser without notice.

15. It is understood that the purchased items must be collected from our offices in Milan, Via G. Puccini, 3. For any shipments a uthorized by the buyer, the cost of the courier is borne by the buyer. International Art Sale srl accepts payments only and exclusively from the holder of the invoice with:

16. In the event that the buyer appoints a third party to collect the lots already paid for, the third party must be provided with a proxy from the buyer for a photocopy of the buyer's identity document, in addition to the receipt of payment.

17. International Art Sale srl does not assume any responsibility for the diagnoses reported on the analyses issued by national a nd international Gemological Laboratories attached to the goods offered for sale.

18. International Art Sale srl reserves the right to make recourse, in the appropriate locations, to the auction rights not colle cted by buyers who for any reason do not withdraw the lot awarded in the hall, by phone, or by written bid.

19. International Art Sale srl will present the works, in the catalogue and online, each accompanied by a technical-historical sheet in which the work is described in its entirety, reporting any visible imperfections, as far as the state of conservation is concerned. After the adjudication, International Art Sale srl cannot be held responsible for any flaws in the lots, including the state of preservation, incorrect attribution, authenticity, provenance or lack of quality of the lots. The potential purchasers and the successful bidder expressly waive the guarantee pursuant to articles 1490 and 1947 of the Italian Civil Code, releasing International Art Sale srl from any relative responsibility.

20. International Art Sale srl presents the works, in the catalog and online, each accompanied by a technical-historical sheet describing the work in its entirety, reporting any visible imperfection, as regards the state of preservation, but is not responsible for hidden defects and failures due to the age of the goods offered for sale. Any complaints must be communicated to International Art Sale srl in writing within 8 (eight) working days after the date of sale and must be supported by a written report issued by a qualified expert in the matter of contending, are not accepted opinions of unqualified persons. International Art Sale srl reserves the right to open a discussion with a qualified expert of the auction house and a qualifi ed expert in the matter of the dispute appointed by the buyer. A claim recognized as well-founded will result in the refund of the amount paid, without any request for any damage caused, against the return of the work purchased. In the event of a dispute, the costs of returning the goods shall be borne by the purchaser.

21. The works described in this catalog are exactly attributed within the limits indicated in the individual cards. The attributions relating to antiques and nineteenth century objects and works reflect only the opinion of International Art Sale srl and cannot take on an expert’s value Any dispute in this regard must be received within the essential and peremptory term of 8 days from the award, accompanied by the opinion of an expert, accepted by International Art Sale srl. After this deadline, any responsibility of International Art Sale srl ceases. If the complaint is well founded, International Art Sale srl will reimburse only the amount actually paid, excluding any further request, for any reason.

22. The labels, marks and stamps on the works certifying ownership and any transfer of ownership of the works are guaranteed by International Art Sale srl as existing only up to the time the work is collected by the successful bidder.

23. Purchasers are required to comply with all legislative and/or regulatory provisions in force with regard to objects declared to be of cultural interest by the Ministry of Cultural Heritage pursuant to Legislative Decree 22/01/2004 n.42 et seq. The successful bidder, in the event of the State exercising its right of pre-emption, shall be returned what has been paid and shall not be entitled to claim from International Art Sale or the seller any reimbursement of any interest on the price and auction fees already paid.

24. The export of objects by purchaser’s resident or non-resident in Italy is regulated by Legislative Decree No. 42 of 22/01/2004, as well as by the customs, currency and tax laws in force. Therefore, the export of objects whose date goes back more than seventy years is always subject to the free circulation license or export licenses issued by the competent Authority, and it may take up to 3 months for it to be granted.

International Art Sale assumes no liability to the buyer with respect to any export restrictions on the lots awarded.

Export restriction or delay in the issuance of any license shall not constitute cause for termination or cancellation of the sale or just cause for delay in payment by the purchaser. The cost of issuing the necessary certificates of free movement or export licenses shall be borne by the buyer.

25. The right of resale will be charged to the seller pursuant to art. 152 of Law 22.04.1941 n. 633, as replaced by art. 10 of Legislative Decree 13.02.2006 n. 118.

26. For each lot containing materials belonging to protected species (Washinton Convention 1975) such as, for example, coral, ivory, turtle, crocodile, whale bones, rhinoceros’s horns, etc., a CITES export licence issued by the Ministry of the Environment and Territory Protection is required and must be requested by the owner of the property before sale. Potential buyers are invited to enquire at the destination country about the laws governing these imports.

27. These Conditions of Sale, governed by Italian law, are tacitly accepted by all participants in the auction procedure and remain available to anyone who requests it.

28. "Additional conditions of sale" for participation in LIVE AUCTION and TIMED AUCTION with the aid of electronic devices. International Art Sale srl makes available to potential buyers the possibility of making offers to purchase lots in Auction through its website www.internationalartsale.it and international platforms connected to us as an additional tool, and not a substitute for other forms of participation. Each offer with electronic devices is equivalent to an offer in the room, by telephone and in writing and is binding for the purchase of the asset and cannot be revoked, modified or withdrawn. Potential customers using electronic devices are advised to view, by appointment, the goods in the days preceding the auction or request a “Condition report” International Art Sale srl is not responsible for errors and/or malfunctions relating to the presentation of offers via electronic devices. This also includes the loss of internet connection and / or anomalies with the auction software. It is noted that purchases made with the use of electronic devices in the Live Auction and / or Timed Auction do not benefit from the right of withdrawal, as provided for by art. 59 lett. m of the Consumer Code Legislative Decree 206/05.

29. International Art Sale srl reserves the right to refuse offers with electronic devices from potential unknown buyers, unless an adequate bank guarantee is provided or a Security Deposit of 30% of the value of the desired lots is issued, without charge.

30. Each offer with electronic devices is governed by both the General Conditions of Sale and the additional Conditions of Sale (point 26).

31. Pursuant to art. 13 of Legislative Decree no. 196 of 30.06.2003 (Personal Data Protection Code), International Art Sale, in its capacity as data controller, informs you that the personal or company data supplied by paper and/or electronic means will be used for the stipulation and execution of the contract concerning our services and to comply with legal obligations. The provision of data is necessary to fulfill the contractual / legal obligations, failure to communicate them affects the conclusion of the contract. Subject to express consent, the data may be used for sending information, advertising and promotional material on the activities of International Art Sale srl. 32. For the purposes set out in current anti-money laundering legislation D. Legislative Decree no. 231 of 21.11.2007, as amended, the purchaser declares that he is paying with money that does not come from illegal activities.

33. For any controversy concerning the sale, the exclusive competence of the Court of Milan is established.
