Chairman’s Message Steve Schuster, Schuster Company - his parting speech at the 2013 IMTA Management Conference As I watched the images come across the screen it dawned on me just how quickly the last 12 months have gone by. I know that for those of you in the audience that have had Steve Schuster the honor of IMTA Chairman of the Board serving in this capacity…you can relate to what I am going through right now. There is a mixture of emotions that come into play as I make these remarks. A part of me is a little sad that this adventure is coming to an end, yet another part of me is also relieved that my tenure as Chairman went as smoothly as it did and

I can now focus all of my attention on running a trucking company. But that aside, I am probably feeling more pride and satisfaction than anything else right now. It was extremely gratifying to serve as the Chairman over the last year. It was gratifying in the fact that I was able to work with so many of you on a different level and the commitment and genuine support that all of you give to IMTA was really enjoyable for me to see. I am proud of the work that we have done at IMTA not only in the last year but the last several years. IMTA has grown into an organization that is truly supported by the membership and the level of involvement at the different events and activities of IMTA is a testament to its value and worth. I took great pride in that because in a small way, I believe I contributed to the

current direction of the association and now more than ever, after serving as the Chairman and viewing things from this vantage point, I am certain that some of the decisions we made four or five years ago were without question, the RIGHT DECISIONS. IMTA has always been the strong and effective voice of Iowa’s trucking industry. The principles that drove the founders to create IMTA still remain intact today and that gives me great pride too. Our primary mission is to advocate for the trucking industry and over the years, IMTA has continued to keep that mission in the forefront. But things have changed. The manner in which we are fulfilling that mission has changed tremendously. We, IMTA leaders…. now rely heavily on the input and insight provided by the members. We sincerely listen to the


Chairman’s Message needs of the membership and then we tailor our efforts based on those needs. It is that prevailing philosophy that has moved IMTA to a different level and it was satisfying to see all of this come together and as a result of this synergy, IMTA is truly moving in a positive and powerful direction. Over the last year, I saw a level of support that I had not seen before and remember, I had served as the Chairman prior to this term. I had the honor of being involved in every committee meeting held over the last year and believe me, the work that our standing committees do is nothing short of amazing. The volunteers that serve on these committees come prepared to work and they do just that. There isn’t an IMTA committee that is a waste of time and I am proud of all the great things the committees have done.

The members that are now involved with IMTA continue to grow as well. I participated in the membership outreach events and it was rewarding to see all the members that would show up to learn about our priorities and show their support of our work. In a lot of cases, the members that showed up at these events were folks I didn’t even know, but they were committed nonetheless and it was a pleasure to meet so many of the members. I traveled to Washington DC and to the Iowa State Capitol. I had meetings with the Governor, the Lt. Governor and members of Congress. It was enjoyable to be able to voice concerns, frustrations and share ideas with these decision makers…and it gave me great pride to see the respect that IMTA garnered from these folks.

Like many of you, I certainly hope that some major changes will take place when it comes to the legislative and regulatory areas, but at least we as members of IMTA have a seat at the table and are highly respected enough by lawmakers and regulators to be involved in the discussions. We all should take pride in that and never take that for granted. I would like to say THANK YOU to all of you for everything you have done for me personally as the Chairman of the Board but also for everything you have done for the trucking industry and IMTA. I hope you continue to show your support and stay involved because I promise you….there is nothing but good things on the horizon for IMTA.

President’s Message Brenda Neville, Iowa Motor Truck Association As our year ends, we always take time to look back over the previous year and identify what worked, what didn’t work, where can we improve and Brenda Neville what were the IMTA President real victories. In doing this important exercise, I reach out to the members and as always, I get some incredible feedback. Fortunately, the positives seem to outweigh the negatives and IMTA will continue to do its best to serve the membership. Once again, members were disappointed that the legislature continued to kick the can down the road as far as road funding in 2013. As our infrastructure continues to crumble, it has become apparent that this hot issue seems to lose steam once legislators are pressed on the issue and with re-election looming on the horizon, it doesn’t appear that much will be done this session either. Another concern and disappointment expressed by several of you as you look back over the last 12 months, was that the new Hours of Service rules were implemented despite overwhelming data, outcry, research and feedback highlighting the many downsides of these new rules. The growing frustration and mounting concern over the incessant and endless array of compliance and regulatory burdens that continue to be placed on the trucking industry is front and center with almost every member I spoke to. Unfortunately for all of us, there is no easy solution and while some hold out the hope that the rules will eventually be reversed, I wouldn’t get my hopes up. This is the environment that we will be forced to operate in for the foreseeable future and believe me when I say; our number one priority is to provide assistance and guidance to the membership as they

navigate through these continual changes and challenges.

When it comes to highlights, many different answers emerged. For some a trip to Washington DC or a spot in the 2013 leadership class roster was a treasured highlight. For others, participating in another rocking Truck Driving Championships or working at the state fair on behalf of the industry was a valued opportunity. While others felt that their time on a committee or being involved with a specific event like the golf outing or the convention was what they cited as a highlight of their year.

We are listening to some of the ongoing concerns with driver and technician shortages and developing strategies to address these concerns. We have evaluated all of our mainstream events and while most of them will return, some won’t and new efforts will be put in place that more fully meets the needs of the membership. Listening to the members will always be our priority and that will continue to be our area of focus.

However, everyone I reached out to agreed that the most important return on their investment came in the form of networking and getting better acquainted with other truckers. Providing opportunities for IMTA members to get together and learn from each other through simple conversation or networking is something that we can uniquely provide for the members. As we start our new year, we again, have an aggressive and full agenda of priorities. Volunteer leaders have already begun their jobs and planning sessions are underway to more fully identify priorities and goals for the upcoming year. We will continue to make our advocacy efforts a top priority. Providing a voice for the trucking industry in front of lawmakers, regulators and even the general public will always dominate our agenda. We want to beef up our image and outreach efforts. We want to provide even more

We anticipate it will be another exciting and of course challenging year but with the help of an outstanding group of volunteer leaders, a motivated and engaged staff and a foundation of dedicated and energetic members, we believe that anything is possible. Your support is always appreciated and valued. We recognize how tough this industry is and we are always here to help, assist, guide and of course lead the charge with legislators, regulators and the other usual suspects. Thank you for your outstanding support and please consider even more involvement in the upcoming year. I am confident that you will not be disappointed and together we CAN and DO make a tremendous difference and impact. Have a great holiday! Brenda

IMTA is pleased to welcome Jon Dill to the staff of the association. Jon began his duties as our new membership manager in late October. Jon is a native of Grinnell and a graduate of Coe College. After college he worked in the trucking industry first at CRST, Inc. and most recently at Jacobson Transportation. With 8 years experience in the trucking industry, we are excited about the skill set that Jon brings to the association and look forward to his work in the membership department. Jon and his wife Tina have two young sons and reside in Grimes.

New Chairman of the Board Ralph Arthur Steps Into IMTA Chairman Position

One company that was instrumental in founding the Iowa Motor Truck Association back in December 1942 was Ruan Transportation. The tremendous support and generosity the entire Ruan family and company have demonstrated towards the IMTA has been unwavering. However, never before in the association’s 71 years had a representative from Ruan served as Chairman of the Board (mostly because of Ruan’s historic responsibility as treasurer). But that changed on October 1 when Ralph Arthur took on this important role of leading the IMTA for the next year. “I am an instrument for (the membership),” said Ralph, who is president of Dedicated Contract Carriage for Ruan. “This is your association. You own it. It’s up to you to make it happen.” Ralph recognizes and embraces the history the Ruan company has with the IMTA, including all the years John Ruan served as treasurer since the day the IMTA came into existence. And like Mr. Ruan, Ralph will have a leadership approach within the association that aims to foster participation, education and unity. “I want to build on all the good work that been done in the last few years. A lot of progress has been made in a number of different areas,” Ralph said. “As an advocate for the trucking industry,

the association has a great deal of responsibility in many different areas and our number one goal will continue to be to serve the membership through our advocacy and outreach efforts.” A child of a military family, it was no surprise when Arthur joined the Corp of Cadets while attending Virginia Tech University. Upon graduating, he was commissioned into the military for seven years, which included one tour of duty in the Vietnam War as an infantry officer. After his military career, Ralph spent time in sales positions for a pharmaceutical company and then a wine company. But then he was lured away moved into the trucking industry. It was here that he found his home and has never left it. With more than 30 years in the trucking industry, Ralph is proud of his service in an industry that he recognizes to be extremely valuable to everyone. “We are so diverse and when you’re as large as we are, there’s always something happening,” Ralph said. “Every day is always very rewarding, interesting and full of adventures and challenges.” First elected to serve on the IMTA Board of Directors in the 2008, Ralph was quickly identified as a leader amongst his peers and was nominated as an officer in 2011. During this time as one of the IMTA’s elected leaders, Ralph has noticed the multiple layers of support the IMTA has for its members.


New Chairman of the Board “The association, with its training, leadership classes and regulatory assistance, the value they add is just tremendous.” Ensuring that value to the membership and asserting IMTA’s position as the voice of Iowa’s trucking industry are two things Ralph feels are paramount for the association to carry itself forward.

“IMTA is a valuable partner to anyone in Iowa’s trucking industry. The number of different ways that they (IMTA) are helping the members regardless of their size is impressive and is the reason that our association is one of the finest in the country,” said Ralph. “The association staff is always working to ensure that nothing gets overlooked as they keep a steady pulse on our industry,” added Ralph. The pulse Ralph speaks of currently revolves around Hours of Service, CSA (Compliance, Safety, Accountability), health care and driver shortage concerns – issues that Arthur himself deems a priority for trucking. But, as more and more regulations and laws are being

enacted through rulemaking rather than legislation, Ralph feels the true value of the IMTA lies within its ongoing education and guidance just as much as its advocacy. “We, at the IMTA, have the back of all the carriers in Iowa,” Ralph said. “There are so many things going on in the state and on the federal level that a small business owner can’t keep up with it – can’t afford to keep up with it, honestly.

“I look forward to my upcoming duties as the Chairman of the Board. I look forward to meeting the members and helping the association accomplish the goals of importance for 2014. This is an exciting time for the trucking industry and it is very rewarding to be involved with the association. I urge all the members to get involved, engaged and active with the efforts of this association. As many of my predecessors have said, the more involvement you put into the association, the more you will get out of it,” said Ralph.

Question of the Month Have the new Hours-of-Service rules affected your company? Harold Cornelison, Van Diest Supply - Webster City, IA The changes that came into effect on July 1 have not affected us too much. The change in the 34-hour restart has affected our productivity a little bit, but we usually only allow our drivers to work 12-hour days, so we don’t have too much problem with going over on hours. The 30-minute break requirement did not affect us, as we have been requiring our drivers to take a break after 6 hours for several years. CSA is affecting us more that hours-of-service, due to small issues on roadside inspections. This could affect our hazardous materials permit if it gets too far out of hand. If we were a long-haul over-the-road company I would be screaming about the changes. They just don’t make sense. Jeff Arens, Schuster Company - Le Mars, IA The restart changes have really hurt our long-haul California runs. Before the change the drivers could shut down for 34 hours en-route, if they ran out of hours, and then go again. The requirement for the two 1:00 – 5:00 am periods in a restart has hindered this, since the drivers now have to sit for a longer period of time. The 30-minute break requirement hasn’t affected us as much, as we felt like most of our drivers were taking a break at some point during the day anyway. We just impressed on the drivers to log the break that they were actually taking.

Mike Jensen, Anthony P & L - Le Mars, IA The change in the 34-hour restart affected our long-haul guys by cutting our productivity. The thing that bothers us the most is the 168 hour rule. It would be much simpler to manage if the verbiage stated that you could only use the restart provision once in 7 days instead of only once in 168 hours. After all, 34 hours off is 34 hours off. If the driver doesn’t get enough rest in 34 hours there’s something wrong. Our local drivers don’t have too much problem with the changes, because they’re normally off every weekend.

Dean Kloewer, Panama Transfer - Panama, IA Most of our drivers are 100-mile radius, multi-stop drivers, and are off every weekend, so the change in the 34-hour restart didn’t affect us too much. We were not happy with the 30-minute break requirement, because our drivers are in and out of the trucks all day long and shouldn’t need a break because they’re not sitting in the driver seat for hours-on-end. FMCSA has now exempted short-haul drivers so that will help us stay on schedule and service our customers.

Jon Linke and Lori McIntosh, Earl May Seed & Nursery - Shenandoah, IA We are not over-the-road so the effect on us has been minimal. We primarily service our own stores in Iowa and surround states. If we were over-the-road the effect would be a lot more drastic to us. The new hours-of-service rules are confusing to carriers and our drivers, especially the 34-hour restart requirement. The 168-hour provision is hard to understand and needs to be changed to once every 7 days.

Members in the News Decker Truck Barr-Nunn Named FedEx Carrier Line Hires of the Year Transportation has been New Safety Barr-Nunn chosen as Regional Carrier of the Year by SmartPost for the fiscal year 2013. were both recently hired by Decker Truck Line to join the Fort Dodge-based carrier’s safety department.

Evans became the company’s new director of safety on August 7 after working at Swift Transportation for Dave Zohner Decker Truck Line the past 11 years. While at Swift, Evans held the positions of transportation manager, terminal safety coordinator, operations manager and, most recently, regional terminal safety consultant. In his role as director of safety, Evans will implement safety programs; oversee compliance issues; handle accidents, cargo and work injury claims; and identify risks for Decker Truck Line; B-T, Inc.; Quality Truck Wash; and Transport Loading Services. Zohner, who started on August 12, will serve as Decker’s safety manager within the company’s western division. His responsibilities will include overseeing safety and compliance of the western division while also handling human resource matters. Previously, Zohner had worked as director of safety at Jim Palmer Trucking for 12plus years.

Performance Award. The Regional Carrier of the Year award is given in recognition of outstanding achievement in the areas of on-time service, product quality and customer contact. The On Time Service Award is in recognition for 100% on-time service with zero service failures while the Peak Performance Award, which recognizes superior performance during peak season by going above and beyond, was for increasing capacity by more than 50 percent. “These awards reinforce to others what we already know, that we have the best fleet of drivers out there,” said Rene Beacom, president of Barr-Nunn Transportation. “They perform at a very high level of service and safety and we appreciate it greatly.” This is the fourth carrier of the year award Barr-Nunn has received in 2013. The Granger, Iowa-based company was also recognized as Walmart’s Diversity Carrier of the Year; Gap’s National Carrier of the Year; and Kellogg’s KDOT National Carrier of the Year.

Hawkeye Trucks announced that effective today they are now Thompson Truck & Trailer, Thompson Tire & Retread, & Thompson Idealease. “As we set out to prepare our growth strategy within the next year and beyond, it has become evident that the name “Hawkeye” doesn’t fit in our plan. Why? We currently have markets in Iowa, Illinois, and Wisconsin. Our plans are to continue to grow our business outside of the “Hawkeye” market and a name change is key to our success today, tomorrow and beyond.” Said Dennis Thompson, Chairman and CEO In addition to these changes, executive changes were made as well. Travis Thompson will be named President of Thompson Truck & Trailer and Thompson Idealease, effective November 1. As President, Travis will have complete management responsibility for our Truck Dealership and Idealease Operations. Dennis Thompson, will become the Chairman and CEO of the total organization, and will remain President of Thompson Utility Trailer Sales, Thompson Tire & Retread and Premier Parts. Customers will see a seamless transition and receive the same quality service that they have come to expect and deserve. “We are excited about these changes and what the future holds. There are two very important assets within our organization, our employees and our valued Customers,” said Travis Thompson, President

training and roundtables, and provides leadership for the safety council.

The safety council of the American Trucking Associations meeting in September was one to be remembered. As you know, the regulatory Don Egli, CDS IMTA Director of Safety climate today is filled with uncertainty, concerns, and displeasure. The topics discussed at this meeting covered all of the above.

The focus of the second day was centered on committee meetings and training sessions. The session of most interest was the Safety, Regulatory, and Legislative update, which was chaired by Rob Abbott, Vice President of Safety & Regulatory Affairs for ATA and William Bensmiller, Nevada Division Administrator for FMCSA. Rob discussed the new hoursof-service regulations and a proposed sleep apnea rule that could be coming out sometime soon.

The ATA Safety Management Council is comprised of many different committees. These committees meet at least two times per year to determine where we, as an industry, need to focus our attention and establish policies or recommendations on regulatory issues.

Other meetings on Wednesday included: “Successfully Influencing Driver Behavior”; “Newest Approaches and Tools to Developing a Safety Culture”; “Getting to the Truth” (knowing how to read applicants and employees”, “Sleep Management”); “You’ve Been Served” (Being organized and intentional for responses in a hearing or trail situation); and “Hours of Service: A 12-Month Snapshot.” In addition, the Regulations, Allied, and Hazardous Materials committees met to discuss current issues on their agenda.

The September meeting began with a full day of Trucking “Best Practices” training. This training was pretty much basic training for newer safety professionals, including; driver qualification, drug and alcohol testing requirements, hours of service, vehicle inspection, load securement, defensive driving, and CSA monitoring and compliance. One of our IMTA Safety Management Council steering committee members, Lisa Gonnerman, Safety Director for Ruan Transport Corp, was one of the co-leader of the drug and alcohol testing session. The second day began with the Management Advisory Board meeting, which is comprised of current committee chairpersons. Don Egli, Director of Safety & Security for IMTA, is presently on this board and represented the State Association Committee at the board meeting. This board determines locations for future meetings, suggested topics for

Also discussed was the new Safety Fitness determination, which will tie a carrier’s rating to their CSA scores. This should be announced sometime in early 2014.

The Hours of Service session was one of the most informative sessions of the day.

The session was led by Thomas DiSalvi, of Schneider National, and Sam Faucette, of Old Dominion Freight Line. The ATA Regulatory Committee has recommended to FMCSA that they change the verbiage in the new Hours of Service rules to allow the 34-hour restart “only once in seven days” rather than the current verbiage that says “only once in 168 hours.” The 168 hours rule is extremely hard for carriers to manage, especially if a driver gets in at different times every weekend. One carrier present stated that their drivers took a 15-17% pay cut due to the new 34-hour restart. This was not because they were previously running over 70 hours, but because at times they were allowing their local drivers who were not working a lot of hours to run on Saturdays on extra runs. Now with the new 34-hour rules that require two periods of 1:00 to 5:00 am, they require drivers to work only five days. One of the larger carriers in the room said that even if the new rules only cut each of their trucks by one hour per week that amounts to over 1,300,000 hours of lost productivity per year for their company. Another large carrier stated that they have seen a large increase in the number of times a driver logs off duty at their stops, in an effort to save hours on their 70-hour clock. He also cautioned other carriers to watch for the same thing, and to make sure that it is a situation where the driver can be legally logging off duty vs. drivers just trying to save some hours.

There were fifty-five vendor exhibitors present for the event, and one day and evening were set aside for visiting their booths, getting to meet their representatives, and establishing relationships with them. They showcased many fine products and services.

The last day also brought the National Truck & Industrial Safety Awards & State Association Recognition Awards Luncheon and the Awards Banquet. Solar Transport won a safety award for “Most Improved.” Solar Director of Safety, Bridget Nixon, accepted the award. The Iowa Motor Truck Association’s Iowa Council of Safety Management won a State Association Summa Cum Laude award for excellence in activities of a State Safety Management Council. Iowa Council of Safety Management members Bridget Nixon, Director of Safety for Solar Transport, and Lisa Gonnerman, Director of Safety for Ruan Transport, joined IMTA Director of Safety Don Egli in accepting the award. The ICSM has won this prestigious award for many years. We are proud of our ICSM members and the effort they put forth in attending monthly meetings, volunteering for numerous

events, and their safety knowledge which is recognized by the industry. The value of attending these meetings, learning new updates on issues, staying in touch with current issues, and networking with other safety professionals from across the country is unparalleled in the industry. This is a great venue for safety professionals and I encourage any ATA members to get involved in this Safety Management Council. The next day of the meeting brought roundtable discussions. The roundtables were led by members of the ATA Safety Management Council and were very informative, as members got to experience what other members are doing in specific situations. Dubbed “Food and Feedback” sessions, IMTA members highlighted a variety of issues that were impacting their businesses and IMTA discussed ways in which the issues are being addressed. “There are a number of challenges facing the industry and majority of them are the regulatory and compliance obligations that every trucking company is forced to deal with. Talking about these challenges and sharing information with one another is the value of the association and these member outreach events highlight that value,” said IMTA Chairman of the Board Ralph Arthur. Ralph traveled to all the events and enjoyed meeting the members and seeing parts of Iowa that he had not seen before.

Awards & Recognition West Side Transport Driver Reaches 4 Million AccidentFree Miles

West Side Transport honored one of their outstanding professional drivers, Thornton Dixon for reaching a milestone rarely reached by a driver. Affordable Care Act

IMTA Affordable Care Act Update As the law continues to be implemented and regulations released, as purchasers of health insurance coverage, we are all seeing the final picture very slowly becoming clearer. Though not nearly clear enough to eliminate many points of uncertainty. Even the administration continues to have unanswered questions resulting in new and ongoing delays of major provisions of the law. 22

Health Care/Part II Sean entered the human resources outsourcing industry shortly after being honorably discharged from the US Army. Sean has worn many hats throughout his career, working in the areas of human resources, employee benefits, payroll administration, legal compliance, workers’ compensation, risk management and information technology. Recently, Sean has closely followed healthcare reform to ensure his clients are both aware of the regulatory impacts and prepared to comply with applicable requirements on their behalf. Following his military service, Sean earned his B.A. from Eckerd College and has been certified as a Senior Professional in Human Resources (SPHR) since 2003. Non-Discrimination Testing

At this point, it almost seems forgotten, but the ACA required testing for nondiscrimination purposes for all plans renewing on or after September 23, 2010, six Sean Yolish months after Vice President the ACA was Insurance Operations signed into law. The language of the Act was vague, but clearly indicated this new testing requirement would be similar to Section 105(h), a three decade old provision of the US Code applying to self-funded plans. Like non-discrimination testing for retirement plans, the intent is to ensure Highly Compensated Employees (HCEs) are not more favorably treated than Non-Highly Compensated Employees (NHCEs). There is a dramatic difference in the definition of an HCE under 105(h), which is anyone in the top 25% of earners within an organization as opposed to the stated dollar amount for retirement plans, which is currently $115k. Without explanation, in December of 2010, the administration released a Notice indicating this provision of the Act would not be enforced until regulations are released providing guidance. This will be another onerous testing and, potentially, reporting requirement once, if ever, the administration releases regulations. Perhaps, as important,

is how this provision will change total compensation strategies for small businesses that have historically used richer benefit packages to compete for technical, management, and executive talent with much larger organizations.

Out-of-Pocket (OOP) Maximums

It was late in the summer when the media took hold of a provision of the Affordable Care Act (ACA) as it relates to OOP maximums being delayed. In fact, the administration announced the delay back in February of this year. This delay is an example of the confusion within the administration regarding provisions of the ACA and the subsequent requirements carriers and employers will have to administratively accomplish to comply with the Act. In this specific instance, numerous carriers appealed to the administration explaining many within the industry outsource prescription plan administration to Pharmacy Benefit Management (PBM) companies. In these arrangements, it’s not atypical for these relationships to be predicated upon some level of aggregated reimbursement, inclusive of fees, and not purely “pass-through” claims. In those instances, the carrier does not receive a covered insured’s specific claim level information. Consequently,

the carrier has no way to determine whether any individual or family has reached their own OOP. In response, the administration is requiring both the carriers and PBMs and/or other similar arrangements to have separate OOPs through 2014. The result, in many cases, is an individual could have two OOPs, both of which would be $6,750 ($12,700 for families), essentially doubling what the ACA was supposed to limit.

Employee Exchange Notice

This requirement, according to the law, was supposed to be implemented and effective as of March 1st of this year. However, and one can only speculate, without more clarity regarding the “Public Marketplaces”, outlining the specific

Health Care/Part II requirements would have posed a challenge for those in the administration tasked with developing the regulations. Literally, just days prior to the effective date, the administration indicated they would be delaying this provision until further notice. Late this summer proposed regulations were released and Model Notices posted on the Department of Labor’s Employee Benefits and Security Administration’s website (www.dol.gov/ ebsa). From the time the Model Notices were posted through most of September there were dire warnings of non-compliance penalties of as much as $100 per day for each violation. However, late in September through the posting of a FAQ on the EBSA site, the question was posed as to whether there would be penalties and the answer appears to be an emphatic “no”. Most legal advisors, though, are recommending compliance as there may be penalties available under other sections of the Fair Labor Standards Act (FLSA), which was amended by the ACA to incorporate this provision.

Employer Mandate

Another example of confusion for the administration was just how employers were to report the following data for each employee, per the Act’s explicit language: • the name, date, and employer identification number of the employer (FEIN), • the number of full-time employees for each month during the calendar year, • the name, address, and TIN of each full-time employee during the calendar year and the months (if any) during which such employee (and any dependents) were covered under the employers health plan, • certification as to whether the employer offers to its full-time employees (and their dependents) the opportunity to enroll in minimum essential coverage under an eligible employer-sponsored plan,

the length of any waiting period, the months during the calendar year for which coverage under the plan was available, the monthly premium for the lowest cost option in each of the enrollment categories under the plan, and the employer share of the total allowed costs of benefits provided under the plan.

• Such other information as the

Secretary may require.

The administration recognized the complexity and understands employers have historically not maintained or tracked this level of granular details on employees and is seeking ways to simplify this new reporting requirement. Regardless of political benefit or harm, it was the postponement of this new reporting requirement which ultimately led to the postponement of the employer mandate until January 1, 2015. Absent


Health Care/Part II the reporting, the administration is unable to effectively enforce the employer mandate, though they have requested voluntary reporting and compliance through 2014. This September the administration released proposed regulations requesting comments on “simplified” reporting methods. However, the proposed “simplified” methods will only be applicable to a very narrow band of businesses, such as those offering a Qualified Health Plan whereby 100% of the premiums for employees and their dependents are paid for by the employer. There is some indication there will be a consolidation of these data sets with the annual reporting Form W2, but there remains an enormous technology obstacle to build and/or update systems to track and report on the required data sets.

Small Business Health Option Plan (SHOP)

As these words are being written, another announcement has just been made regarding the postponement of web enrollments for SHOP plans. What does this mean? Well, inasmuch as the effective date for coverage would not be until January 1, 2014, probably not too much from a practical point of view. Further, agents and brokers may see this as an opportunity to continue in their capacity for some of their clients as they assist those who wish to enroll during the October.

Continued Unknowns

There are a host of other questions yet to be answered, mostly as it pertains to defunding, further delaying, and further modifications of the law. For example, there is bipartisan support for changing the definition of a full-time

employee from 30 hours a week to a more traditional 40 hours per week. With both national labor organizations and business pushing for this change, it appears there is some likelihood it might happen. What of the employer mandate, itself? The many pieces related to compliance, as previously mentioned, it place an enormous burden on small and large employers alike; many labor organizations are concerned about the adverse impact this may have on their members and some have requested this provision be struck, as well.

Conclusion

Three and a half years after the enactment of the law it remains even less popular than it was upon passage. The political and legal environment will continue to shape this Act now and long into the future unless, of course, it is repealed all together, which at this point seems highly unlikely.

Randy VanZee TanTara Transportation Corp - Muscatine, IA Our health insurance costs have increased by 32% in the past two years. With the new Affordable Health Care Act, who knows where we will be looking at by next year? The marketplace is unpredictable, so we can’t predict our costs going forward. We do know that it is going to greatly affect our health insurance plan for our employees. We formerly had two different options for our employees. One plan had a low deductable and one plan had a higher deductable. We are going to move to one plan, with a higher deductable. Also, by next year (we renew in August) we will be changing our program, due to costs. In next year we will have to go to a policy where if an employee’s spouse has health care available through their employer they will not have coverage on our insurance program. We hate to have to go to that length, but that’s what we must do to keep our costs in line. Heath Richards Panama Transfer - Panama, IA We will see a rate increase of 40% next year. Our insurance provider also is mandating that we provide a wellness program and require annual physicals for those covered by our health insurance. Up to now our company has absorbed most health care premium increases. We will no longer be able to do that, so this will raise the cost to our employees. We’ve talked about looking at other insurance options, but everyone is raising their price as well.

Management Conference 2013 Impacting Today and Leading Tomorrow Kudos to the – 2013 Management Conference Another Success volunteer For the 300 plus people that traveled to Okoboji for the 71st committee, the annual IMTA Convention, they certainly had a positive and powerful impact as part of another successful event. As in the past, the 2013 Management Conference had many high points and despite bad weather once again on the opening day of the event, everyone felt that is was yet another successful conference. “You can tell the level of thought, planning and organization that goes into the conference. The speakers were once again of the highest level especially Colonel Tillman and each event is loaded with the special touches and little details that really make every attendee feel very much appreciated. I always look forward to the convention and always leave in amazement because they somehow top the year before. Kudos to the

We are very lucky here in Iowa to be able to be a part of such a great annual tradition,” wrote one convention attendee on their evaluation form. Matt DeSchepper, Great West Casualty Company Dave Manning/Tennessee Express Inc., served as the Chairman of spoke on behalf of the ATA during the the 2013 IMTA Management IMTA Annual Meeting. Conference and through his involvement and leadership, the committee once again pulled together a schedule that was second to none. The speakers and the topics covered were very timely and appropriate for an industry that is always in a mode of constant change. “We spend a great deal of time discussing the goal and objective of the conference and also identify the topics that will attract carriers of all sizes to the conference. The entire committee gets involved at various levels and the success of this conference rests in the committee members that take this job seriously and the members who recognize the value of attending the conference. Because of that, I think Iowa has one of the best conferences in the nation. I was very pleased and proud to be a part of it,” said Matt DeSchepper. Bill Roth, Truck Country of Iowa served as the Co-Chairman of the committee and echoed Matt’s remarks. Bill will serve as the 2014 Chairman as the conference moves to Cedar Rapids. A good mix of vendors and carriers were in attendance and the while the industry continues to face its share of challenges, the mood and atmosphere at the 2013 Management Conference was upbeat, positive and a poignant reminder that IMTA members are truly a very special group of people.

In addition to her genuine and sincere loyalty to the company, IMTA and the trucking industry in general...Donna has always kept her family her number one priority.

On May 6, 1994, Iowa’s trucking industry lost a dear friend and a fierce leader ...when Bill Weinrich was killed in a tragic plane crash.

She is very proud of her daughters, sonin-laws, 11 grandchildren and 11 great grandchildren. AND because of all that Donna has done for them over the years, many of these beloved family members are in the audience this evening and are equally as proud of Donna.

Bill and his beloved brother Mike had a successful trucking operation in Hinton Iowa. Bill was involved in every organization affiliated with trucking and was a leader of the Hinton community and the proud father to his four beautiful daughters, Pam, Terri, Renae and Brenda.

Donna NEVER missed an important event in the life of her family and grandchildren and as many as possible were going to be here tonight as a testament to their love and appreciation to Donna for her continued support.

However on that early spring day in 1994, things changed dramatically and the COURAGE demonstrated by a relatively quiet and soft spoken woman by the name of Donna was nothing less than amazing. It was through Donnas determined perseverance that she navigated the company through some of its darkest days after Bill’s untimely death. Days filled with challenges, struggles, tears, heartaches and many moments when Donna

2013 Award Winners “Best In Class” 2013 Dispatchers of the Year Award

John Dickson, BTI Special Commodities, Inc.

John began as a company driver and then operations manager for Waggoner’s Trucking based out of the Casper, Wyoming terminal. Prior to starting at BTI Special Commodities in 1986, John was in the operations department for a Des Moines based flatbed carrier. John has been a stable force in the BTI Special Commodities dispatch office for 25 years. He has run all three of the dispatch areas that are currently operating, in addition to the van division for a few years. John is currently managing the logistics portion of the companies’ operation, taking it from the ground floor to being a very successful part of BTI, which has contributed to him receiving the 2013 IMTA Dispatcher of the Year Award.

Gene Olson Schuster Company

Gene has been in the trucking industry for 38 years. Initially starting as a driver and in 1983 began working for Schuster Company. In 1992 Gene moved from his driving position to a dispatcher position. Currently Gene handles a specialized fleet consisting of grain hoppers and van freight for a dedicated customer. Gene handles booking the freight through dispatching the drivers. Gene and his wife Sharon have two grown children and six grandchildren. In his spare time Gene enjoys NASCAR and annually travels to racing events in Las Vegas. His outstanding commitment to Schuster Company and the trucking industry has led to Gene’s acceptance of the 2013 IMTA Dispatcher of the Year Award.

The 2013 Leadership Class was once again comprised of some of the brightest and best you will find. These future leaders represented an array of different companies from trucking to suppliers and once again illustrated that the future is bright for the industry. “This group was energetic, engaged and very interested in all aspects of the program and IMTA. It is extremely rewarding to be involved with the leadership program because it highlights the great talent that is making this industry what it is today and in the future,” said 2013 IMTA Chairman of the Board Steve Schuster.

Like classes before them the leadership class participated in several different sessions and also had many opportunities for networking as well. The group was honored at the 2013 IMTA Management Conference and vows to stay involved and active with IMTA and its many activities and events. “I found the program to be extremely valuable and it not only enabled me to learn more about the association but I also learned things about myself and found the interaction with others in the class to be a big highlight,” said Tyler Todd, Thompson Trailer. Details for the 2014 IMTA Leadership Class are being finalized and will be made available to the membership after the first of the year.

Clay Shoot/Spouse Activites IMTA Sporting Clay Shoot Competition

IMTA members and guests ventured to the Okoboji Game Farm in Milford, Iowa, for the annual shooting competition that was held in conjunction with the IMTA annual management conference. The group of 20 participants enjoyed a brisk afternoon of friendly, yet competitive, shooting competitions that even the amateurs to the event were able to enjoy. This annual event always welcomes anyone interested in learning the sport of clay shooting. A special thank you to Doug Huitink with Wilson Trailer Company for coordinating the course details with the Okoboji Game Farm. We look forward to yet another great outing next year!

Verne Simpson Memorial Golf Outing Verne Simpson Memorial Golf Outing

The 2013 IMTA Management Conference officially kicked off with the start of the Verne Simpson Memorial Golf Outing at the beautiful Brooks National Golf Club in Okoboji, Iowa. Over 100 golfers from across the state of Iowa and the surrounding states, took part in this annual tradition on a rain soaked day on the lake. While the weather could not be controlled, the golfers still managed to get their swings in and enjoy the event. A special thank you to the golfers who graciously donated to the Foundation fundraiser that IMTA Chairman, Steve Schuster/Schuster Company led out on the course. And also, a thank you to Truck Country of Iowa for being the official host and sponsor of the golf outing.
