VILLAMAS ORGANISES SJK (C) UNION RELOCATION FUNDRAISING DINNER Villamas Group of Companies recently organised a fundraising dinner for the purpose of collecting funding for the relocation of SJK (C) Union, a Chinese primary school established in Taiping, Perak in 1952, to Cyberjaya on behalf of the Board of Governors of SJK (C) Union. Prior to the dinner, the group’s fundraising efforts garnered RM684,200 out of its targeted RM700,000, with RM484,200 coming from its business associates and RM200,000 from its own coffers. Several other developers also chipped in, an example being Setia Haruman Sdn Bhd, Cyberjaya’s master developer, which donated the 6-acre piece of land that the new establishment will be built on. The fundraising dinner generated RM34,688 through the sales of tickets to the dinner itself as well as souvenirs and other items, bringing

the grand total of funds collected to RM718,888 which exceeds the group’s targeted amount. The school is expected to cost at least RM10 million to construct, and RM7 million had been collected prior to this. Construction is scheduled to begin this year and it will be ready for a new students’ intake by January 2016.

EUROMONEY HONOURS MAH SING GROUP’S CORPORATE PRACTICES Mah Sing Group Berhad was recently named ‘Best Managed and Governed Companies – Asia Poll 2014’ by Euromoney magazine. The poll is based on replies received from a total of 93 of the leading equity analysts at the largest investment banks and research houses in the Asia Pacific region who are responsible for nominating a total of 214 different companies. Analysts were asked to name which companies were the most impressive based on factors including management accessibility, accounting transparency and corporate governance procedures. Mah Sing Group was praised for its leading role in promoting transparent communications with investors, stating that “the company has a clear strategy and good visibility”. Analysts also noted that “Mah Sing Group’s senior management continues to demonstrate prudent gearing, transparency, good governance and a clear articulation of strategy”.

Dato’ Sri (Dr) Vincent Tiew: One of Scott Towers @ Larkin’s main selling point is what I call the ‘high-middle-low’ model. The ‘high’ aspect refers to the development’s

high-end nature, which can be seen in its sense of luxury in terms of concept and space. The ‘middle’ aspect is indicated by how fair our prices are especially when compared to the market prices seen in Iskandar Malaysia’s Zone A, while the ‘low’ aspect is showcased by the 5.651-acre project’s low density of only 352 units as well as its low investment risk levels due to its location in a mature area. LAr. Lee Choong Hong:: The two largest influences of Scott Towers @ Larkin’s design are landscape engineering and Feng Shui, so we worked hard to synchronise our expertise with and incorporate the Feng Shui advice we received. We faced a few challenges when it came to blending the existing slope and land profiles into the landscape, as well as transforming the required on-site detentions into ponds and water features, but managed to overcome these obstacles without too much trouble.

One challenge we welcomed was the planning of the eight thematic gardens which we first tackled by expanding on the initial concept and developing each garden’s theme based on the landscape and types of plants that are suitable for our local climate. We also decided to only utilise local plant species which add value to the development. Based on these factors, we came up with Orchid Farm, Fruit Garden, Bougainvillea Garden, Scented Garden, Rose Quarter, Aquatic Garden, Hibiscus Garden and Leisure Garden. The end result, as Dato’ Sri (Dr) Vincent Tiew puts it, is that Scott Towers @ Larkin could be seen as more of a home villa project instead of a simple apartment development. iP: Is landscape engineering a new or existing trend in Malaysia’s property industry and will any of Andaman’s future projects incorporate it as well? LAr. Lee Choong Hong: Landscape engineering is something that has been in practise for some time, although it is not a phrase that has been used that much until

Teh Chin Guan: We have many projects set for launch soon. We have recently acquired land banks in Bangi (Bandar Baru Bangi) and Dengkil (Kota Warisan). As you know, we

also have our most recognised development areas – Bandar Puchong Jaya, 16 Sierra and Bandar Puteri Puchong. Quite possibly our two biggest developments in Bandar Puchong Jaya are the upcoming Parc Ville Condominiums and Skyz Residences. Skyz Residences is one of our more unique developments, situated 200m above sea level at the highest floor with a 4 acre clubhouse complete with Olympic sized lap pool, 10 sky lounges and 3 podium gardens. iP: It was recently announced that IOI Properties has set up an estimated investment of SGD3 billion in Singapore and RMB5 billion in China. Can you tell us a little bit about the developments there? TCG: We were lucky to have won the bid for development in Singapore, thanks to our design. South Beach Singapore is set to be a landmark development, and has already won two Building & Construction Authority Platinum awards. It is designed by the world-renowned Foster+Partners.

We already have great access to highways, and the LRT will now complete Puchong as a city. That is why Puchong draws crowds. Now as the city matures, so does its population.

In China, IOI Properties are currently developing Xiamen’s IOI Park Bay. It is a mixeddevelopment that comprises a shopping mall, luxury high-rise residences and a five-star hotel. iP: Puchong is rapidly developing into the Klang Valley’s must-have investment. Why do you think Puchong has experienced its recent boom? TCG: Over the last two decades, Puchong has become a township in its own right. The important aspects of a township are good residential areas, schools, hospitals and public services, and entertainment. Puchong has all of that and more. We also have parks, a public library and many leisure activities such as the 32 court badminton hall. The Ayer Hitam Forest Reserve has a trekroute you can take with park rangers, for those who like the

iP: What are you predictions on density in Puchong once the LRT Star Line is up? TCG: I hope more people see the benefit of living nearby public transportations. There will be four LRT stations, along the Bukit Jalil line, in Puchong’s surrounding areas – one in front of IOI Mall, another in front of Tesco, one in front of Bandar Puteri and the fourth, slightly in front of row of one of IOI’s shop offices.

Some townships are planned in a great fashion, but never follow through because sustainability and organic growth is not an aim. If you look at Hong Kong, as an example, they have a great public transportation infrastructure. Combined with their knack for high-rise developments, the areas that remain undeveloped are all surrounded by greens. By using public transportation, you not only lower your carbon footprint and save on fuel expenses but also allow space for greenery. iP: IOI Group is arguably one of the most successful developers in the country. What is your philosophy when it comes to approaching a new development? TCG: We never target accolades when we approach a development. We don’t aim to be the “Number One Developer” or

PUTTING HIS BEST FOOT FORWARD After years honing his skills abroad Harmit Singh headlines iProperty.com’s progress in 2014 as the company’s new Chief Information Officer.

Ushering in the New Year, iProperty.com is poised to rise to new heights in 2014. One of the driving forces behind this pending journey will be Harmit Singh, the company’s new Chief Information Officer (CIO). Harmit, who joined the company in early January 2014, boasts more than a decade’s worth of experience in the field of information technology. He obtained a Masters degree in Telecommunication Systems from California State University, Bay Area in the US. Harmit’s extensive resume includes tenures at Malaysia Airlines (MAS), Capgemini Services and the global multinational company, Satyam Computers. The newly-minted CIO took some time off to share his experience, goals and plans with iProperty.com. How would you define the role of a CIO? A CIO is someone who provides leadership, guidance and ultimately, sets the bar for his team. It is not someone who has only

mastered technology inside and out. First and foremost it is about leadership, as the IT team is a key asset in any company. The team looks up to you in terms of where the organisation is headed, and what the priorities should be. A key quality of a good CIO is definitely being able to empower your team. What determines whether a CIO succeeds or fails? There are some key traits that a CIO must have in order to succeed. Firstly, you need to know how best to interact with your front office. And by ‘front office,’ I mean the end-customers. It is about keeping up with trends and behaviours, and knowing what it is that they seek. Secondly, you need to know your businesses very well. You need to be well-versed with what it is you are providing. Lastly, you have to be able to work with the new generation, which I refer to as ‘Generation V’ – as in Generation Virtual. The actual term, of course, is digital natives. These are people who have been brought up on technology. They have


different needs and habits from previous generations, and it’s important to be able to adapt to that. Of course, it is also vital that the CIO ensures that the IT team contributes to the overall growth of the company. Describe a situation in which you succeeded? What did you do specifically to make it successful? One example is when I was working with MAS. When I joined the company, only a small portion of their transactions and business were conducted online. The system was somewhat clunky, and e-tickets had not been implemented yet. People were able to purchase tickets online at that time but still had to collect the tickets from the MAS office or have them delivered. When I came on board, the MD aimed to go online in a big way. We implemented a new e-commerce system, which was well embraced. And as a result, we saw exponential growth within a short period of time. With fierce competition from low cost carriers at that time, MAS had to step up to the plate. One of the major challenges came in the form of having to make the changes that were crucial to benefit the company’s growth. There were a lot of hurdles to overcome as we were changing how the company did business in order to succeed online. Fortunately, everything worked out eventually. Having spent a few years in California, what are some of the differences you found adapting to technology in Malaysia? I have been back in Malaysia for about 10 years now, so I cannot speak for present day differences but back then the biggest difference was the accessibility and availability of broadband. The dot com boom before the early 2000s can be attributed to that, and it is something we did not really have readily available here. In the US, and California specifically, tech culture is huge. Some argue that it is recession proof. Despite economic strife, tech industries seem to keep growing. Malaysia is not quite there yet, but I am confident that it is on the right track.

With the nature of technology evolving every day, what are some of the challenges that a CIO may face? The biggest challenge would be filtering through hype and noise. Vendors will pitch new technologies to you all the time, and even your business executives may have some ideas. It is about zooming in on what makes sense for your company, and being able to realise potential game-changers. One important measure is also to keep track of your competitors, and even parallel industries. For example, if you work for an airline company, it is beneficial to stay upto-date with the technologies being used by railway companies and bus companies as well. These may result in some really great ideas. Are there any new technologies trends that you would like to see iProperty.com embrace? In general, there are four major trends – mobility, cloud technologies, social media and big data. I am very happy to say that iProperty.com utilises all four trends very well. We have a mobile-first strategy, and we are slowly moving into the cloud in a big way. Social media engagement is fantastic, especially when you look at the success of projects such as Rumah123 and Rumah Gratis. It’s great that the company has fully-embraced innovative technologies. Some bigger companies struggle to stay ahead of even one trend, so that is something that is pretty impressive to me. What are some of your goals as the new CIO of the iProperty Group? We are the market leaders of online property portals in Malaysia, and we are a close second in many other countries. My job is to maintain and continue that positive growth. There are some ongoing projects that the team has been working on over the past few months, and I hope to see those over the line. We are doing great in Malaysia, so I hope to help achieve the same level of success across all our platforms. Lastly, is there a motto that you live by? I like to put my best foot forward, and give everything I do my 100%. I guess you could say that is my mantra.

KLANG’S BANDAR BUKIT TINGGI & BANDAR BOTANIC A public transport overhaul, offset by rising cost of living. Will Klang’s growth remain steady? Bukit Tinggi and Bandar Botanic are located in the southern parts of Klang, surrounded by schemes known as Taman Melati Ehsan, Pandamaran Klang, Bandar Puteri Klang and Taman Klang Jaya. The townships are predominantly residential in character, with commercial and industrial activities being carried out around the townships. Bandar Bukit Tinggi generally consists of three major developments, namely Bandar Bukit Tinggi 1, Bandar Bukit Tinggi 2 and Bandar Bukit Tinggi 3 (also known as Bandar Parklands), while Bandar Botanic is a residential, self-sustainable freehold township developed by Gamuda Land, the property arm of Gamuda Berhad. One of the most famous landmarks is the AEON Jusco Bukit Tinggi along Jalan Langat where entertainment, shopping and leisure are in abundance. Currently, the KTM commuter is the only rail system available within Klang. Approximately seven KTM stations are placed within Klang from Bukit Badak towards Port Klang, connecting it to the comprehensive rail system available in Klang Valley. The LRT extension interchange

station will be sited in Subang upon completion, linking the two rail services. Sources revealed that the third light rail transit (LRT 3) line connecting Kelana Jaya to Klang through Shah Alam is in the process of obtaining approval from relevant authorities. The project is expected to cost between RM8 billion and RM9 billion, and some of the main stations include Glenmarie, Stadium Shah Alam, i-City, UiTM, Bandar Baru Klang, South Port and Bandar Sultan Sulaiman. Other than the new rail services, the existing Klang Sentral KTM line and the freight relief line have been proposed for an upgrade to enhance service quality, frequency and journey time. Most of the dwelling units in Bandar Bukit Tinggi and Bandar Botanic are landed low-rise residential units; thus, an analysis has been done on the terraced houses to indicate the price trend of the selected schemes from 2010 to 2013. As seen in the table, 2011 recorded the highest number of transactions (approximately 31.3%) and like many other residential schemes, 2013 recorded the lowest number of transactions (17.8%). year 2012 and 2013 is not as significant when compared to many other residential schemes (merely different by 10.5%). Transacted prices remain at a steady, growing pace with no sign of a drop or slow-down. The increase between 2010 and 2013 both excites the homebuyer as well as gives them a potential migraine. As the centre of Klang is getting congested and high in density, the new developments are spread around the edges. Some of the noted ongoing developments are included on the next page:From the table, it is noted that WCT Holdings Berhad has been very active in recent years and most of the developments are focused on the residential and commercial sectors. Landed properties are a favourite for developers and new products are mostly tilted towards luxurious goods except for the required affordable houses. An example would be the 2-storey superlinks by WCT Holdings Berhad with a size of 24’ x 75’. It is retailing at approximately

RM774,000 onwards, while the 2-storey bungalows with a size of approximately 6,790 sq ft is selling at RM2.24 million upwards. Proving that low- to medium-cost products are a favourite among buyers, lower-end and more affordable units are grabbed very quickly. At the moment, empty lands can still be found in Klang as it is large in size and not fully established; therefore, the availability of land is yet to be an issue. However, if the growth rate continues at the same pace in the coming decades, empty lands will decrease and new products might lean towards high-rise properties. As parts of Klang have already been built with higherend properties, it will not be surprising to see new, well-designed luxurious serviced apartments built in Bandar Bukit Tinggi and Bandar Botanic. As the density and population increases, the current shopping centres and hypermarkets may not be able to fulfil the people’s needs. This will develop the drive to construct more retail elements around the townships.

WHAT THE DEVELOPER DID NOT TELL THE PURCHASER BEFORE, BUT MUST NOW Trade secrets have long been held locked in box, but that may not be the case anymore The National House Buyers Association (HBA) seems to have finally succeeded in persuading the Housing Ministry to enforce the duty of the developers to provide purchasers with a full set of detailed, approved documents of the property that is purchased. The fact is that this has long been a legal requirement. As far as landed properties are concerned, the approved layout plan and approved building plan are required to be included in the Sale & Purchase Agreement (SPA), as the first and second schedule respectively. These legal requirements have, until now, been honoured more in the breach rather than in the observance by the developers. It is perfunctory – more to the letter of the law rather than spirit – and adds to the purchasers’ difficulty in visualising his nonexistent property, with only the show house to aid his imagination. The Housing Ministry has now agreed with HBA that the detailed dimensions of the property and its facilities are to be given to the purchaser right at the outset as part of the building plan attached to the statutory SPA. These may take the form of copies of the approved plan on paper, no matter how thick the SPA may be, or in electronic forms such as compact discs that are readable on regular computers. INTERNAL FEATURES: THE BUILDING PLAN, MEASUREMENTS, MATERIALS & SETTING Developers have taken advantage of the lack of knowledge of purchasers to engage in corner-cutting such as making unauthorised alterations in the measurements, or using sub-standard or alternative materials. Other measures to cut costs on the developer’s side that could have possibly been taken include changes in wiring, plumbing and

plugs. This is all done with the hope that the purchaser may not discover it in the duration of the Defects Liability Period. Without detailed knowledge to challenge the product, purchasers have been handicapped in their fight with developers. EXTERNAL FEATURES: PLAYGROUND NOT PART OF YOUR PROPERTY? Though important, the SPA gives the purchaser the impression that they are entitled onto four-walls-and-a-roof-andhandkerchief-sized open space in front of their houses. A purchaser does buy only the four-walls-and-a-roof of his property. The purchaser may have been seduced by the external features as well. As house purchasers, especially young couples intending to raise their families in their new homes, are vulnerable to advertised features such as playgrounds, open spaces or a green lung, they may be blindsided by the existence of an ‘active’ graveyard nearby, or the location of an oxidation pond. The purchaser buys into the atmosphere or concept of living of the whole housing estate. So what is the purchaser entitled to? Is the developer entitled to mislead the purchaser with pictures of a spacious housing estate, only to later dig up the children’s playground in favour of a condominium? If the developer promotes such features as the playground at the time of sale in answer to your questions, take down the answers and the name of the developer’s staff and designation, and have your solicitor confirm this in writing. It may constitute what is known in law as ‘a collateral oral warranty to the transaction’ and may be read into the SPA to make it binding on the developer. These matters are not provided for in the SPA because the SPA is a standard form to be used in a whole range of property transactions where the details vary. However,


it does not mean these details cannot be added; the law allows it (Tun Suffian in Lee Poh Choo v SEA Housing Corp.) but rare is the developer who would allow it. That is why the purchaser must have his own lawyer, not the legal worthy chosen for the purchaser by the developer, and build up his own legal documents for future use. Even with the new requirement, the purchaser may still have to rely on the collateral warranty argument in respect to things not mentioned in the SPA which the developer does not include in the approved layout plan but may still try to give the impression that it is meant to be part of the housing estate. The density of the area is the number of houses allowed to be built in the housing estate; it makes all the difference between spaciousness and over-crowdedness. Developers, seeing that the houses are selling well, sometimes add more houses than was approved. As this affects the quality of life the purchaser, having bought his house believing that only a certain number of houses were going to be built, has a cause of action against the developer. He can no longer be told by the developer to talk only about what he has paid for in the SPA or shut up. The quality of a housing estate may also be affected by the mix of types of houses and other buildings in a housing estate. A matter of particular concern may be the number and types of houses and shop houses, again, another form of temptation to developers. Their distribution is also to be taken note of, as it may affect the convenience of the occupants. ADVERTISEMENTS: NOT AFFECTED BY THE NEW DISCLOSURE RULES As houses are rarely built and then sold by developers, the non-existent nature of the houses requires developer’s to make use of artists’ impressions. If these impressions are

seen as art pieces, they may take a flight of fancy. Hence, the actual dimensions of the property and the purchase price should be given. Developers are required to submit mock-ups to the Ministry for its approval. This enables the Ministry to check on the likely advertisements of developers, and also, if they are minded to easily prove the deviations from the approved versions. However, it is the accompanying verbiage which is seriously misleading. Some advertisements fall into a grey area, such as those which give the amazingly short travelling time to important places without mentioning the mode of travel, proximity to the upmarket Mont Kiara even if the place is closer to Segambut, or that it is within sight of famous landmarks such as the Petronas Twin Towers to get a higher premium. How long would we want to gawk at it anyway? Even guarantees of return on investment (ROI) are promised, provided you spend more money on furniture and fittings. Advertisements calculated to mislead, and which have misled purchasers, may give purchasers a private right to a civil suit against the developer when the Housing Ministry cannot be moved to act. In a Singaporean case, where the developer’s brochure had boasted of ‘a panoramic view of the sea’, the court held that it gave the purchasers a right to sue if they had been induced. The law, as usual, is clear and strict. Under the 1989 Regulations, developers are required to give “accurate and true particulars” in the advertisements of their housing schemes or on conviction be fined a sum not exceeding RM 20,000 or face imprisonment not exceeding five years or both; if ever there is a prosecution. So far there have not been any prosecutions, not that there have been no violations for advertisements that misled buyers.

Recently, Puchong South has been receiving much attention, because of several factors, which are making it an attractive destination for businesses and home buyers. The district’s location is strategic, as it is surrounded by thriving communities such as Seri Kembangan, Putrajaya and Cyberjaya.

This has created a spillover effect into Puchong South, where people and businesses are settling down. Puchong South also has the advantage of being close to Putrajaya, which is located south of it. As the federal administrative centre of Malaysia, it is home to several government ministries and public administrative offices.

Within the heart of the Klang Valley, population density in districts such as Petaling and Subang Jaya is increasing, as there is a lack of development land to support demand by residents in the area.

ENSURE YOUR HOME INVESTMENT IS PROTECTED How do you tell if your insurance coverage is working in your best interest?

Five years ago, James had invested most of his savings to purchase a RM250,000 home, and sank another RM60,000 to furnish his home. To facilitate the purchase, he took an 80% housing loan from a local bank. As one of the bank requirements is to buy fire insurance to cover the amount of the loan, James let the bank decide on the value and the insurance company.

Unfortunately many of us, like James, are unaware if we have bought adequate cover for our home investment, and whether we have taken up the appropriate insurance cover that best meets our needs and requirements. To help us in our decisions, it would be best to understand the different types of


property insurance covers that are available to us and under what circumstances can we be underinsured. TYPES OF PROPERTY INSURANCE In Malaysia, there are three types of property insurance covers available for house owners to select from: • Fire insurance • Houseowners’ Insurance • Householders’ Insurance or content insurance Fire insurance is designed to provide protection against material damage to properties such as buildings, contents such as household equipment, fixtures and fittings. The policy covers the loss or damage caused by fire and lightning, or damage caused by explosion of domestic boilers, or gas used for domestic purposes. However, the policy may be extended to cover other perils such as:1. Riot and strike 2. Malicious damage 3. Aircraft damage and articles dropped there from

4. Impact damage (excluding own vehicle) 5. Bursting and/or over flowing of water tanks, apparatus and pipes 6. Earthquakes, volcanic eruption, hurricane, typhoon, cyclone, windstorm 7. Flood 8. Subsidence and Landslip The Houseowner’s Insurance cover is a comprehensive insurance policy specially designed for owners of residential properties. It covers the building against loss or damage caused by all the perils covered by the fire policy except riot, strike and malicious damage, and subsidence and landslip, except as a result of earthquake and volcanic eruption. In addition, the policy also covers: 1. Theft, but only if accompanied by actual forcible and violent entry 2. Loss of rent if building is damaged and rendered uninhabitable 3. The insured’s liability to the public in respect of bodily injury and damage This policy may also be extended to cover: 1. Riot, strike and malicious damage

2. Subsidence and landslip The Householders’ Insurance cover is almost identical to Houseowners’ Insurance, but the protection is meant for the contents and not for the building. This policy would also be appropriate to renters as the landlord’s policy only covers the building and not the possessions of the renters. While it is true that one of the basic principles of insurance is indemnity i.e. one should not profit from an insurance claim, insurers have introduced the Reinstatement/ Replacement Value Clause to meet the needs of consumers to conveniently replace or reinstate loss or damaged properties covered under a fire, houseowner or householder policy. The clause provides payment of claim due to an insured peril without deduction for depreciation for age, or wear and tear. 72 |

In other words, the full cost of repairs or replacement will be met subject, of course, to the condition that the sum insured of the properties is adequate to cover the total cost of repairing or reinstating the building or insured properties at the time of the loss. If the properties are underinsured, the insured will be compensated only in the proportion of the sum insured to the actual value applied to the full repair or replacement cost. In insurance terminology, the insurer is applying the principle of ‘average’ when this takes place. WAYS YOU CAN BE UNDERINSURED You have underinsured on your property insurance if:• The insured value of your house is less than the market value or rebuilding cost of the house, excluding the cost of land.


• Current insurance policy does not reflect increases for inflation. • If you have not taken into account and reported any recent renovations or improvements to your home over the years (such as an additional room or remodelled kitchen, etc.), thus adding to the insured value. • You have not taken a periodic inventory of all your possessions. When renewing your householders’ insurance, it is advisable to take an inventory of all your possessions. This list will adequately reflect how much coverage is needed to replace all the contents in your home. • You may also be underinsured if you did not take up additional coverage for valuable items such as artwork, jewellery, antiques or collectibles. In this instance, an ‘All Risks’ insurance policy can be effected to cover the valuables on an indemnification, or more usually on an

‘agreed value’ basis against any loss or damage. The ‘All Risks’ cover has a list of specified exclusions. Most insurers will demand a valuation before agreeing to insure any items of high value. To avoid being under-insured, a yearly review of your property and possession should be done before renewing your policy, to ensure adequate coverage. On the other hand, take into account any depreciation cost to your household items as you do not want to pay more than necessary. If you have a claim, the more information you have about the damaged items - a description of each item, the date of purchase and purchase price - the faster the claims can be settled.
