Catering contract

CATERING CONTRACT
This contract is between MKIC Limited hereinafter referred to as the Company and ________________________ & ________________________ (hereinafter referred to as the Client). It is hereby being agreed that the Company shall provide the Client with Catering facilities and services on the ________________________, at the ________________________ (Montekristo Estate) for an event under the following terms and conditions:
GENERAL CONDITIONS 1.
The Company shall make the premises available to the clients booked for a morning event from 09:00 hours on the day of the event. The premises shall be vacated by 18:00 hours of the same day, unless otherwise agreed in to writing. For evening events, the Company shall make the premises available at 18:30 hours, on the day of the event, unless otherwise agreed in to writing.
2.
The Company shall provide a changing room. However, the Company shall not be held responsible for any loss or damage to items left therein.
3.
All entertainment shall be discussed prior to the event, and shall be approved by the Company.
4.
Unless otherwise agreed, any unconsumed food shall be taken away from the premises by the Client immediately after the event. The Company shall be free to dispose of any remaining food which is not taken away by the Client.
5.
All prices quoted are inclusive of VAT. Prices do not include any other taxes which are not in force at the date of signing of this contract. Any such future consumer taxes or changes in the current rate of VAT (18%) will be charged to the client.
6.
The menu selection is attached and shall be confirmed by the Client by not later than one month prior to the event, or at time of booking, if this is less than one month prior to the event.
7.
The Client shall be responsible for any damage caused to the venue where the event is being held and/or any other area (inside and/or outside) belonging to the Company or is being used by the Company for the purposes of the event; and for any annoyance, harassment or injury to the Company’s guests or employees, whether caused by the Client and/or by any of his/her guests. Any breakages will be invoiced accordingly

SMOKING. Smoking is strictly prohibited within all indoor premises. It is only permitted in the outdoor venues.
9.
OVERTIME. Overtime is incurred after 5hrs of service. For all weddings of up to 300 pax, staff overtime is charged at €180.00 per hour. For all weddings over 300 pax, a charge of € 240.00 per hour will apply. It is to be noted, however, that overtime will only be calculated up to the time the bride and groom leave the premises.
10. POLICE OFFICERS. For events with over 100 guests, a police presence is required throughout the function. This service can be booked through Qormi police station a couple of weeks prior to the event 11. P ERSONAL ITEMS. The Company is not responsible for drinks, flowers or other items left behind after the event, and it is highly recommended that all such items be removed from the premises at the end of the event. 12. MINIMUM AND MAXIMUM GUARANTEED. The guaranteed numbers must be submitted at least 72 hours prior to the event, after which, the Company reserves the right not to accept any amendments to such numbers. Should these guaranteed numbers not be given within the stipulated time, the last number of guests communicated to the Company by the Client will be taken as the guaranteed number of guests for the event. Food and beverage preparation, as well as invoicing, will be based on the final guaranteed number of guests. Should the guests attending the event be less than those guaranteed by the Client, the charges will still be based on the guaranteed numbers. 13. C ANCELLATION OF AGREEMENT BY FORCE MAJEURE, ETC. If the event cannot take place due to circumstances beyond the Company’s control, such as: government intervention, strike, labour disputes, accidents, act of God, local disasters or war; then the Company’s liability towards the Client shall be no greater than the deposit paid by the Client to the Company. 14. No verbal representations or arrangements are recognized by the Company, and only a written notice can modify the Conditions of the contract. 15. The bride and groom, or the event organizer as the case may be, hereby designates Mr/Mrs/Ms ______________________________________, ID Card No. ________________________ to sign a declaration, on their behalf: i.
Accepting liability for the duration of the event, and
ii.
Accepting liability for any damage to the Company, its property, guests and/or employees, or the event venue as the case may be.

Catering contract
16. Payment Terms are agreed as follows: i.
A deposit of € 1000.00, shall be paid on confirmation of the order, this being the _______________________ day of ________________________ of the year _____________.
ii.
A further deposit, bringing the total prepaid amount up to 75% of the contracted amount, shall be paid one month prior to the event, this being the ________________________ of the year __________. The Company reserves the right to cancel this contract without any obligations, if the 75% pre-payment has not been affected by this due date.
iii. The remaining balance of the contracted amount shall be settled in full within 7 days after the Event. iv. Any outstanding balances on invoices issued by the Company to the Client, regarding the actual value of the order plus any additional charges, shall be settled by the Client within 30 days from date of invoice. Interest at the rate of 9% per annum, or any higher rate of interest allowed by Law from time to time, shall become due by the Client to the Company on any balance which remains unpaid after the lapse of 30 days from the date of invoice. 17. After an order has been placed by the Client and accepted by the Company, no cancellations may be made by the Client except by written agreement between the Company and the Client. The cancellation of an event by the Client, for whatever reason, will entail the forfeiture in favour of the Company of all deposits paid by the Client as liquidated damages. 18. CHANGE OF VENUE. In the unlikely event of approaching stormy weather, and should the Clients’ venue be an outdoor one, the Company will assist by offering an indoor alternative. Clients with an anticipated morning wedding will be asked to give a final decision on their preferred venue by 07:00hrs of the same day. Clients with an anticipated evening wedding will be asked to give a final decision on their preferred venue by 10:00hrs of the same day. Should stormy weather force the entire set-up to be moved hastily indoors, and this after Clients have elected to have the wedding outdoors (after the 07:00hrs or 10:00hrs deadline, as the case may be), an additional lastminute set-up charge of €1,500 will be incurred by the Clients.
