Whether you realise it or not, you have great affection for your own house, you know every wall, crack, anomaly and nuance. You remember all the good times you have had within those walls, and the bad. Therefore, it is really hard to distance yourself from those emotions when showing your property to prospective buyers. Buyers can be very critical, even derogatory if the house isn’t quite what they are looking for, or even to try and negotiate a better price. They will try and negotiate a better price if you are selling your own property. They won’t see you in a ‘professional’ light, and will therefore assume you are not skilled in the art of negotiating and will try to take advantage of that. It is also really inconvenient to have to show your house at all hours, as typically you won’t be able to rush home from work to show it during the day. are ‘just looking,’ the people who are looking for something else, and the nosy neighbours. That’s why it pays to work with a professional realtor. The chief reason that sellers choose to sell their own home is that they do not want to pay a fee or commission, however it has been proven that a professional can often negotiate a better price. For many people who have tried unsuccessfully to sell their own home, their main complaint was that it was much more ‘onerous’ than they anticipated, particularly in this soft market where homes can take 6 – 12 months to sell, and can be shown to 30 or 40 people before a suitable buyer is found. Sellers also stated that they under estimated the amount of paperwork, and difficulty of understanding and performing the necessary legal and financial procedures that were required to complete the transaction. A professional realtor can assist you with staging your house, pricing it correctly for the market conditions and all the complex legal and financial issues. Among recent sales over 88% of sellers used a real estate professional who provided a range of services and managed most aspects of their home’s sale transaction; the amount of people who successfully sold their home themselves was less than 12%. It may take a little longer to transact than for Bermudian buyers and because more is involved in the process it pays to align yourself with 2 key partners; your Realtor and your Attorney if you wish to ensure a successful result. First and foremost, find yourself a knowledgeable realtor with a successful track record of facilitating sales with overseas purchasers. Inventory that is available to Sharon Cranfield Non-Bermudians is restricted by legislation so ask your realtor to discuss what’s currently on the market for international buyers and what they can do to help guide you through this slightly more complicated buying process. Your second contact should be a local attorney who is well versed in property conveyance and who has had a successful track record with sales to overseas buyers. In addition to the general transfer of property title your attorney will need to assist you with your application to the Bermuda Government, for an Alien License to Acquire Land. Because Bermuda is a small land mass with a finite quantity of real property the Bermuda Government has put measures in place to ensure that the majority of Bermuda’s Land and Real Property remains in the hands of Bermudian nationals. This aims to curtail foreign speculation in Bermuda Real Estate. Based on The Bermuda Immigration and Protection Act 2007 these are some of the restrictions currently applied to the purchase of property by non-Bermudians

• The property must be owned by a non-Bermudian.

• The property cannot be vacant land or commercial property.

• The ARV must be over $32,400 for a Condominium and over $153,000 for a house.

• The non-Bermudian must apply for an Alien License to Acquire and own Land.

• The applicant is required to pay a license fee to the Bermuda Government of either 25% on the price of a house or 18% on the price of a Condominium or 6.5% on a property in Developments zoned Tourism.

• There is a license application fee of $1,375.

• Banker’s references as well as personal references are required to be submitted with the application.

• The property may not be rented except with express permission from the Minister of Immigration and rent is taxed at 7.25 %. Permission is rarely granted for more than 1 year.

• A non-Bermudian is not permitted to own more than one property at any time however allowances are made to accommodate the sale of one property to enable the purchase of another.

• The property should only have one assessment number

Perhaps the best way to consider these restrictions are like those of a condo development, however onerous they appear at first glance, the intent is to protect each individual’s rights and, at the same time, maintain a standard of living and create a harmony in which neighbours can live together.
