A RECORD OF BUILDING WORK The purpose of the Memorandum (Record of Building Work) is to confirm that the RBW was carried out or supervised by a LBP and to identify which LBPs were involved At the completion of Restricted Building Work, Licensed Building Practitioners (LBPs) are required to provide the owner and territorial authority (council) with a Memorandum (Record of Building Work). The Memorandum (Record of Building Work) typically consists of four sections. The first section lists details of the building and the building owner. All of the information such as building consent number, building owners name and address can be found in the consenting documents on site. The next two pages cover both the primary structure and external moisture-management systems that can be found in a residential build. LBPs are not required to go into detail of construction methods or materials used but are merely required to state what part of the Restricted Building Work they either carried out or supervised. Memorandum example: The example below shows the Restricted Building Work recorded by a Carpentry LBP. The Carpentry LBP has enlisted the services of an unlicensed foundations specialist and has therefore indicated on
the Memorandum (Record of Building Work) under ‘Foundations and subfloor framing’ on the Primary Structure page that they ‘supervised contractor’ and ticked the ‘supervised’ box. 1 2 The Carpentry LBP has carried out all of the framing and bracing including the roof, however a Roofing LBP and an External Plastering LBP 3 have been called in to carry out the roof and wall cladding as indicated 4 on the External-Moisture-Management part of the form. Separate Memorandums (Records of Building Work) would also be completed by the Roofing LBP and External Plastering LBP. The final page of the Memorandum (Record of Building Work) is about the LBP. It asks the LBP to state their name, LBP number, what licences they hold and their mailing address and contact details. The Memorandum (Record of Building Work) also requires that the LBP completes a declaration to confirm that they either carried out or supervised the Restricted Building Work recorded on the form. It is an offence under the Building Act 2004 for a LBP to make a false declaration. Continued on page 4

KIWIS FIRED UP FOR PERFORMANCE AT ITM400 RESULTS TO DATE SHOW THAT THE KIWI DRIVERS WILL BE HITTING PEAK FORM FOR THE ULTIMATE V8 SUPERCAR SHOWDOWN IN HAMILTON New Zealand drivers Shane van Gisbergen and Fabian Coulthard both made strong starts to the season with top-10 finishes in the opening races of the V8 Supercar Championship in Adelaide. They lie sixth and seventh respectively on the championship points table after the Clipsal 500 and both believe they have made the starts they wanted to ensure a strong crack when the championship comes to Hamilton for the final time. Top 10 placing New beginnings have proved no hurdle for Coulthard, who moved to the Lockwood team run by Brad Jones Racing. The Kiwi qualified well and rarely fell outside the top 10 despite his cool-suit failing with temperatures over 50C deg in the cockpit at Adelaide. The result was beyond even Coulthard’s own expectations so he is now fired up for a top performance in Hamilton next month. “The car wasn’t particularly strong but it was strong in areas that stopped us from being vulnerable to being passed, which gave me the breathing space when we needed it. It didn’t have an outright lap time in it but consistency is the key in this game. “I thought the learning process would have been a bit longer; at least a couple of rounds! But what we’ve achieved in the first race and qualifying has
been above my expectations. It’s an incredible start. Nothing would be better than to do really well at home, especially for the final time in Hamilton.” Standout performance It was the same for the Stone Brothers Racing team of New Zealand owners Ross and Jimmy Stone with all three of their cars in the top-10 at Adelaide, led by The Giz who produced the standout performance after starting ninth on the grid, to climb into sixth position. “Last year we had a good year with fourth on the points. This year we want to put it all together. The key to the championship is that you have to qualify well and you can’t make any big mistakes. If we can do those things, we will be up with the points. I hope we have the right ingredients to get a good result. “I am always excited to come home to race. It’s a bit sad that it’s going to be for the last time in Hamilton but hopefully we can put a good round together. It’s not far away now. Getting another good result there will be just awesome.” The ITM400 Hamilton is on 20-22 April.

BUILDERS URGED TO BEWARE ® ® OF FAKE PINK BATTS PINK GLASS WOOL INSULATION DISCOVERED IN AN AUCKLAND HOME RECENTLY WAS NOT THE GENUINE ARTICLE SPARKING A NATIONWIDE WARNING ABOUT CHEAP IMPORTED KNOCK-OFFS A Pink® Batts® label, cut from a pack of genuine New Zealand made product, was found on a building site in Auckland where unbranded pink glass wool insulation had been installed in place of the genuine article. The presence of the Pink® Batts® label on site suggests that the suppliers of the unbranded insulation were attempting to mislead the homeowners about the authenticity of the insulation.

Tasman Insulation’s factories are AS/ NZS ISO 9001.2000 certified and are independently audited as part of compliance with their Environmental Choice licence.
Suspect quality Tony Te Au, the general manager of Tasman Insulation which manufacturers Pink® Batts® in New Zealand, confirmed that the installed product in the Auckland home was manufactured in China.
Pink® Batts® insulation is also BRANZ appraised giving independent assurance of the 50 year durability requirement under the New Zealand Building Code.
He said that builders and insulation installers should be extra cautious about where they source their insulation and to avoid substituting any other product when Pink® Batts® have been specified.
Guaranteed R-values Without confirming that the product is genuine Pink® Batts® insulation, installers run the risk of installing a lower quality product and not achieving the desired R-values required for the structure they are building, says Mr Te Au.
According to Bruce Kohn, chief executive of the Building Industry Federation, the case “appeared to be a further example of an imported building product seeking market penetration while avoiding customary New Zealand quality assurance programmes.” Consistent standards Mr Kohn said that colour is not necessarily an indicator of quality and builders and installers need to take care that when seeking to install Pink® Batts® insulation, they confirm it as the genuine

The important things to remember Memorandums must be completed by EVERY LBP carrying out or supervising Restricted Building Work - even if working on the same part of the building. They must be handed over to the owner and territorial authority (council) at the end of construction – even if there is a dispute about payment. Failing to provide a Memorandum (Record of Building Work) at the completion of RBW is an offence under the Building Act 2004 which may result in a complaint to the Building Practitioner Board. It is good practice for a LBP to keep their own copy of the Memorandum (Record of Building Work) and to take photographs to record their start and 4
stop points. This may assist in early resolution of disputes – for example if at the completion of the RBW another practitioner came along, installed a heatpump and there were issues with the penetrations not being properly sealed. Photos could be used in this scenario to show that the heatpump penetrations were not present when the LBP completed the RBW should responsibility for checking the sealing be questioned. WHAT IS A producer statement? One of the ways that Building Consent Authorities (who are usually Councils) can satisfy themselves that a building has been constructed or altered in accordance with the Building Code, is to ask for a producer statement

A Producer Statement is a written statement by an architect, builder, or some other specialist in the construction industry who has been involved in the project, that they have done their work to the required standard. This allows the Council to avoid the expense and delay of hiring someone with the necessary expertise to second-guess the work that has been done. It reduces the red tape that would otherwise be required.
There is no Act of Parliament that gives councils the right to insist on a producer statement.
Councils have adopted this practice merely for the sake of convenience. There is no Act of Parliament that gives them the right to insist on a producer statement. The previous Building Act (1991) gave Councils the option to accept producer statements if they wanted. But regardless of what the producer statement said, they still had the ultimate duty to satisfy themselves on reasonable grounds that consented building work complied with the building code. Both the Department of Building & Housing (“DBH”) and the Hunn Report on Weathertightness in 2002 have criticised Councils’ over-reliance on producer statements, which is probably why the current Building Act (2004) doesn’t even mention the term. However, they are still widely used. Standard forms The Institute of Professional Engineers, Institute of Architects, Association of Consulting Engineers and the Building Officials Institute put out standard forms known as PS1 (design), PS2 (design peer review), and PS4 (construction peer review) that are accepted by most Councils. There is also a standard form known as a PS3 (construction) that is put out by Standards NZ or the Institute of Architects. Some Councils have their own forms that can substitute for these standard forms. The design forms are 6
submitted with the building consent application, whereas the construction forms are submitted with the application for the Code Compliance Certificate (“CCC”). Anyone who applies for a building consent can generally offer to provide producer statements as part of the approval process. This will speed up the process and possibly reduce the fees payable. But what if the applicant doesn’t offer them? Can Councils insist on producer statements regardless? Councils sometimes make it a condition of the building consent (or amended consent) that the applicant provides producer statements, but it is questionable whether they have the power to do this under the Building Act. The Act only contemplates the Council imposing conditions where it waives or modifies the building code, or where there are natural hazards, or the building straddles two or more allotments, or the building has a limited intended life, or building work is to be covered up or closed in. So in any normal situation the owner or the builder could theoretically refuse to provide producer statements, and insist that the Council relies on its own investigations and expertise.
Councils sometimes make it a condition of the building consent (or amended consent) that the applicant provides producer statements, but it is questionable whether they have the power to do this under the Building Act. Bear in mind that the Council’s overall duty is to satisfy itself on reasonable grounds that when a building consent is applied for, the building work will comply with the code, and when a CCC is applied for, that the building work does comply with the code. How they go about doing that is their own business, but they can’t make anyone else do their work for them.
Council responsibilities The Council cannot refuse to issue a CCC unless it has reasonable grounds to believe that the work does not comply with the building consent, and it normally has 20 working days to decide (or 2 years from the issue of the building consent). Just “guessing” that the work doesn’t comply - because there is no producer statement and the Council hasn’t been willing or able to inspect - should not be sufficient. The Council cannot act arbitrarily and without justification. If they did, you could hold them to account through a DBH determination, or failing that, judicial review in the Courts. Of course, a builder, subcontractor or supplier might be obliged to hand over a producer statement if their contract, subcontract or terms of trade say so. But that is not an obligation that is owed to the Council. It is an obligation owed to the party they have contracted with (the owner or the head contractor), and it is not something that the Council can enforce. If the builder, subcontractor or supplier does agree to provide a producer statement, will they be liable under it? Certainly the standard form producer statements (PS1-PS4) contemplate that the “producer” will be liable, but these forms specifically state that the producer will only be liable to the Council (not the party they have contracted with) and their potential liability is capped at $200,000.
Of course, a builder, subcontractor or supplier might be obliged to hand over a producer statement if their contract, subcontract or terms of trade say so.
Using other forms If you use some other form, it may not have quite the same wording. In that case the Council might struggle to enforce it against you, but you might not have the benefit of the cap on the liability either. However it’s in the interests of the builder, subcontractor or supplier to avoid giving a producer statement if they can. If they have done faulty work without fixing it, they will generally be liable to the owner, but it will be harder for someone like a Council to hold them responsible. The producer statement would increase their exposure by potentially making them liable to the Council as well. That is an exposure that they shouldn’t undertake voluntarily, at least without reasonable compensation in return.

When handling chemicals, always use appropriate personal protective equipment (P.P.E.), and should a chemical spill occur, take the following action: Chemical Spill Checklist 1. Raise the alarm, evacuate people if necessary and call emergency services (111) if there is serious risk to people or property. 2. If you intend to deal with the spill yourself, make sure you have suitable personal protective equipment. 3. Do whatever is necessary to stop the spill if it is safe to do so eg close valve, plug the leak or return the container to an upright position. 4. If you are unsure about anything, call on specialist advice by phoning 0800 CHEMCALL (0800 243 622).
5. If you or anyone on the worksite experiences any adverse health symptoms after being exposed to the chemical, immediately call the National Poisons Centre – 0800 POISON (0800 764 766). 6. Clean up the spill using the correct method and equipment. Recover product and/or dispose of waste safely. 7. Do not leave the area unattended if there is a risk of a further spill. 8. If the spill is likely to enter a waterway, notify the local regional council. 9. Advise your manager or supervisor of the incident. All of the product information for the chemicals should be included on the product label of accompanying Chemicals Data Sheets. It was an action packed weekend in Whitianga for 106 anglers determined to fish their way into prizes. Working around dire predictions of atrocious weather the anglers hauled in both game and sports fish over the 2 days of fishing. Though the big Marlin proved elusive the addition of the sport fishing category meant the weigh station was kept busy processing an exciting array of snapper, kingfish, kahawai and tuna.
