Council, Planning meet about rentals BY CAROL BROOkS FreeLANCe WrIter cab1hp@gmail.com The television comedy “Seinfeld” is known to be a show about nothing. The outcome of the Jamestown Town Council and Planning Board joint meeting June 27 could be called nothing as well, as in nothing can be done. Right now, at least. Several people joined the audience to hear how short-term rentals have increased with offerings by such companies as Airbnb and VRBO. The meeting’s discussion was about what legal jurisdiction the Town
of Jamestown has over these rentals. Town planner Anna Hawryluk noted that in late2017 and early 2018, shortterm rentals were discussed by the Planning Board, but in order to learn more information, no decision was made. She noted that North Carolina laws prohibit registration for short-term rentals. The Town’s land use attorney, Tom Terrell, gave a PowerPoint presentation entitled “Short-Term Rentals: The Cans and Can’ts — Mostly Can’ts.” He noted that short-term home rentals have been
going on forever, pointing to our love of renting homes at the beach, mountains and even during the International Home Furnishings Market in High Point. Airbnb rentals amounted to a $5 million profit in 2021. The North Carolina General Assembly got into the discussion when the city of Asheville tried to regulate short-term rentals. Then the city of Wilmington adopted an ordinance requiring registration of short-term rentals and a lottery. The Court of Appeals case of Schroeder vs. the City of Wilmington sided against the city, referencing state
laws prohibiting a registration requirement but also ruled the laws allow for general zoning and development standards for shortterm details. The General Assembly laws have precedence over local government laws. Terrell recommended and assisted in a recodification, or modernization, of Chapter 160 of the N.C. General Statutes into what is now Chapter 160D. One section refers to rental property. Local governments may not “require any owner or manager of rental property to obtain any permit or permission under Article 11 or
Article 12 … to lease or rent residential real property or to register rental property with the local government.” A portion of 160D, however, does allow for registration for residential property in very limited circumstances based on prior violations. He admitted there are current bills before the General Assembly challenging Chapter 160D. Councilmember Martha Wolfe appeared disheartened after Terrell’s report. “I was hoping we could get some answers as to what we could do, not what we can’t do,” she said. Town Attorney Beth
Koonce noted some homeowners associations have short-term rental regulations or restrictive covenants. In her opinion, this is the best way to regulate the situation. “I don’t see the government stepping in and doing anything,” Koonce said. Terrell agreed. He added that the state tax law doesn’t apply to renting. “So what can we do,” asked Planning Board Chair Sarah Glanville. “There’s not much room left for government to step in,” Terrell replied. “Most SEE RENTALS, PAGe 3
Diamondback works with D.R. Horton BY CAROL BROOkS FreeLANCe WrIter cab1hp@gmail.com As Jamestown’s Land Use Attorney Tom Terrell spoke about the status of the development agreement between D.R. Horton and the Town concerning the property along Guilford College and Mackay roads, a perhaps littleknown piece of information came out. “Diamondback was (and still is) a preferred developer for D.R. Horton,” Terrell said. “This was a D.R. Horton project even when Diamondback was involved.” Diamondback sold the property to D.R. Horton on July 30, 2021, making a $3.5 million profit over its purchase from the previous owners, the Johnson family. At least two points should have tipped off interested parties: both com-
panies have been represented by Isaacson Sheridan law firm and both Diamondback and D.R. Horton petitioned the Guilford County delegation to the General Assembly to have the property changed from Jamestown’s jurisdiction to that of Greensboro. Both petitions were denied. In an email, Terrell outlined how the companies work together. “There are developers and there are builders and occasionally there are builder/developers,” Terrell said. “D.R. Horton is typically a builder that works through selected developers to find sites, entitle them, put in the roads and utilities, and then [the developers] sell the lots to D.R. Horton at a contracted price. In this instance, D.R. Horton is acting as its own developer.” Part of the holdup with all parties agreeing to the development agreement is the high standard Jamestown
is placing on the quality of construction. The Town wants a variety of designs and no “cookie-cutter” development. “Keeping costs low and sales rapid is key to their business model,” Terrell added. “Part of keeping costs low is using the same design house to house to house. In any given model, a company like D.R. Horton knows pre-construction exactly the number of nails it needs, exactly the amount of linear feet of wiring, exactly the board feet of 2 x 4s, and so forth. Changes to its design change the cost calculations and create chaos in local management and design that is irritating to them.” Whether the development gets off the ground is still a question, but Terrell admitted with all the problems associated with the development agreement, “D.R. Horton is not a bad company.”
tire store could come to Adams farm area BY CAROL BROOkS FreeLANCe WrIter cab1hp@gmail.com The Greensboro Planning and Zoning Commission unanimously approved a rezoning request on June 23 for the possible location of a new tire store at 5701 West Gate City Blvd., across the street from Adams Farm Shopping Center. The site is at the corner of Anson Road and is considered to be on the edge of Sedgefield. Mavis Discount Tire applied for the approximately 1.6-acre property to be rezoned from County Residential Single-Family to City Conditional District — Commercial Medium. Land Use Attorney Marc Isaacson, representing Mavis, recognized conditions originally stated in the
request but added several more, including orienting the garage bay doors toward West Gate City Blvd., no access from Anson Road, addition of a minimum 6-foot high fence or wall between the parking lot and the adjacent residential property at 5705 Anson Road, installation of an evergreen landscape buffer adjacent to the Anson Road residence, a vegetative buffer between the buildings and parking areas and Anson Road, and, finally, business hours for the tire company to be between 8 a.m. and 8:30 p.m. There is an average of 8-15 customers per day at the tire store so no traffic analysis was needed. The rezoning request along with an annexation request will go before the

The basement was closed for two months so in addition to Choice books, which were published from 2019-2021, the sale will include many other hardback and paperback books. LILLIAN CONGDON TRANSITIONAL REHAB CENTER OFFICIALLY OPENS An Open House and Ribbon Cutting ceremony celebrated the opening of the Lillian Congdon Transitional Rehab Center at Pennybyrn June 27. “The center will provide short-term rehab services in a wonderful environment and in a special way that reflects Pennybyrn’s clinical excellence and unsurpassed hospitality as we build upon our 75 years of service,” said Rich Newman, Pennybyrn president. Vonda Hollingsworth, Pennybyrn vice president, called the rehab center a standalone luxurious sanctuary of healing. The 25,000 square-foot facility includes 24 large private suites with in-suite baths, a commercial kitchen and an 1,800 square-foot therapy gym featuring state-of-the-art equipment. There are large inviting common areas that include a living room, dining room, den and sunroom, as well as covered porches and a therapy garden. Pennybyrn also plans to expand their services to provide outpatient therapy. The transitional rehabilitation program serves patients throughout North Carolina, as well as other states.

Participants at A Moment in Time, a monthly program hosted by Jamestown United Methodist Church for those facing memory challenges and their caregivers, can always count on plenty of fun, fellowship and surprises. The June 21 meeting featured a word puzzle, safety Jeopardy game and theme songs from movies and shows about disaster or those responding to trauma. But it also offered practical insight to safety concerns. Firefighter Stephen Arnold, fire prevention coordinator with the Pinecroft–Sedgefield Fire District, discussed various devices and other ideas that could aid in keeping people safer in their homes. The program provided practical guidelines, resource information and hands-on equipment to help create safe environments. Gayle Lancaster, head of the Senior Resources of Guilford Family Caregiver Program, arranged the program. It was created specifically to help those in a caregiving position be better prepared for all situations. Lancaster chose to enlist the help of a firefighter due to her various connections with them. “Caregiving can be very challenging and thinking about how to handle emergencies can make it all the more difficult,” she said. Senior Resources received a grant that provided special emergency kits for each participant. They included a first aid kit, flashlight and batteries, emergency radio, touch-less thermometer, blood pressure monitor, all-seasons blanket, reusable hot and cold pack and a brochure that contained information about preparing for 50 types of disasters and emergencies. Arnold discussed each item in detail,
explaining how it is used. He also talked about the importance of medical identification bracelets and having updated written medical information readily available that lists medications and other relevant health issues that could help those providing treatment during an emergency. Information should include a list of medications used, along with pertinent information such as types of illnesses, medical history, primary care doctor(s), allergies including to any medicines and power of attorney contact if applicable. When quick action is needed, this list can be invaluable. A Moment in Time meetings are held on the third Tuesdays of each month at Jamestown United Methodist Church. They are the only local meetings of their kind and are open to all Guilford County residents. Although the themes vary, they all include a non-judgmental atmosphere and an element of fun. “Our hope is that the A Moment in Time programs will let caregivers come together for support and realize others are going through the same thing,” Lancaster said. “Caregivers and recipients can feel comfortable and enjoy being together.”

Background In 2011, the Planning Board and Council approved an amendment to the Land Development Ordinance allowing bed and breakfast uses in the singlefamily zoning district. In 2017, the Town learned a Havershire Drive resident in the Yorkshire subdivision used his former residence as a short-term rental. Neighbors complained that this was a business operating in a residential area, thereby breaking zoning regulations. Planning Board members discussed whether this was similar to renting
a home for a few weeks a year for something like the Furniture Market in High Point. “We can’t regulate who occupies a structure,” said Matthew Johnson, then planning director, at the October 2017 Planning Board meeting. He added that it’s difficult to enforce unless there is advertising for the property. “It is a residential land use, except the people are being paid for the right to allow someone to be able to use their residence,” Johnson said. “So, the land use is not different. It’s not clear cut.” Johnson added that this is different from a regular rental home, where people rent for longer periods of time. Current residents would be able to rent their homes for a long term. He also pointed out that High Point, where many homes are rented for the Furniture Market, has no such regulation. Jamestown currently has an ordinance regarding bed and breakfast establishments found in Land Development Ordinance Article 10.1-9. A bed-and-breakfast inn is described in the Land Development Ordinance as a private residence that offers sleeping accommo-
dations to lodgers in eight or fewer rooms for rent, is the innkeeper’s (owner or operator) principal residence while renting rooms to lodgers, and serves breakfasts at no extra cost to its lodgers. For the purpose of this definition, a lodger means a person who rents a room in a bed-and-breakfast inn for fewer than seven consecutive days. The owner did not reside at the property so the ordinance does not apply to the Havershire situation. Discussion was tabled until May 2018. At the May 2018 Planning Board meeting, Johnson advised tabling any discussion on short-term rentals until the North Carolina League of Municipalities makes a decision. He and then Town Manager Kenny Cole had spoken with the League but didn’t come away with an answer. “The State [of North Carolina] is still wrestling with it. It doesn’t have a clear direction for us yet,” Johnson said at the time. The League had just started developing a model ordinance that will have local options, but implementation is still several years out. He recommends the Board and Council table any discussion at the present and wait for the League’s decision.

So, in the end, the Town of Jamestown will do nothing to prohibit short-term rentals but staff will continue to keep abreast of the situation. The Council and Planning Board will have more joint meetings in the coming months. This is one of the goals set out in the town’s Strategic Plan. One way is to reduce the amount of meat you purchase. Here are some tips to serve less meat (chances are your family won’t even notice). When you make your family’s favorite meaty meals, use less meat than the recipe calls for and bulk up recipes with veggies. You can add beans to chili, zucchini to lasagna, and celery, onion and carrot to meatloaf. Serve dishes centered around familiar non-meat protein, like bean and cheese enchiladas (recipe below), vegetable lasagna, macaroni and cheese or grilled cheese sandwiches with tomato soup. Breakfast for dinner is always a hit. When you reduce the meat in casseroles, soups, sauces and pasta, ensure the meat you use is flavorful. Items like ham, bacon and sausage are great examples of a little bit going a long way. Remember, there are sausages made from turkey, chicken and vegetables. Plan meals around their favorite vegetables. Does your family like corn? Make corn chowder. Like broccoli? Serve broccoli and cheese casserole. Like potatoes? Serve loaded baked potatoes with cheese and veggies. Save dough with dough. Everyone loves pizza with lots of cheese and veggies. Fill calzones with tomato, spinach and mozzarella. Make pot pies or hand pies with vegetable-based fillings. Embrace the bean. Explore recipes that use garbanzos, black beans or lentils as the protein source. Beans don’t have to look like beans when you make falafel or bean burgers.
