MINUTES OF THE MEETING OF COMMITTEE CONSTITUTED BY GOVERNING BODY OF QDA VIDE ITS MEETING DATED 21-04-2016. A meeting of committee constituted vide minutes of meeting of Governing Body dated 2104-2016 was held on 04-08-2016 at 02:00 pm regarding issues of the QDA City Housing Scheme at Takatu area. The matter regarding ownership of land was thoroughly discussed and DG QDA briefed the the committee by presenting the genuine record of land and stated that QDA city Housing Scheme has been planned on 231 acres which is property of QDA. The Chair and other worthy members asked many relevant questions and QDA officials clarified the matter in light of record.

Decision "The Committee unanimously decided to announce the QDA City Housing Scheme without further delay in order to overcome the problems of shortage of housing and congestion in the main city areas. Meanwhile the QDA may open it's doors for redressal of any grievance of the community of the area" The meeting ended with vote of thanks to and from the chair

INTRODUCTION The most eective development strategy to solve the multidimensional problems of Quetta City is to disperse the residential and commercial activities from the present congested centers over; the vast open valley of Quetta, "QDA City Housing Scheme" is yet another ambitious venture, embarked upon by the Quetta Development Authority in this verydirection, spread over an area of 230 acres, amidst the beautiful landscape of Takatoo Hills. The scheme would oer fully developed plots for Residential and Commercial purposes. QDA City Housing Scheme would certainly enable Quetta City to play an important role in the international business.


SALIENT FEATURES Location QDA City Housing Scheme is ideally located at a distance of 3 km from airport road on the northern foothills of Takatoo Range in the close vicinity of Chiltan Town and BUITMS with abundant ground water potentials. The location offers calm, tranquil and peaceful environment which makes the scheme socially and technically feasible. Quetta City was originally planned for 50,000 population after devastating earthquake of 1935 but unfortunately the Population growth rate of more than 7%, Rural-urban migrations, Afghan influx and growth of Kachi Abadis have encouraged uncontrolled and Unplanned growth of Quetta Urban area Keeping in view the compatible land use recommendations, provision of Social and physical infrastructure to the people, Quetta Master Plan 1985 has recommended these areas for provision of housing facilities and development of Commercial Centers. The pressures of Urbanization and traffic congestions will be decreased up to some extent and environment hazards will be lessened. QDA is also bound not only to develop residential and commercial areas but also set new trends of developments. The Housing Schemes of Satellite Town, Chaman, Chiltan, Samungli and, Zarghoon are explicit proof of the same claim while Commercial Schemes of Hazarganji etc are reflections of same trends.

Water Supply According to reports and surveys of WAPDA and Quetta Master Plan 1985, the Takatoo and Saraghurgai areas are rich in ground water potential leading up to 300-500 feet depth. Therefore, there will be no scarcity of drinking water in QDA City Housing Scheme.

CHAPTER 1 Definitions

Allotment : Means allocation of a plot to an individual by an allotment order.

Application: Means the application form prescribed for seeking allotment of plot.

Authority: Means Quetta Development Authority.

Ballot / Draw: Means assignment of plots by lots to be conducted.

Chairman: Means Chairman of Quetta Development Authority.

Director General: Means Director General of Quetta Development Authority.

Officer Concerned: Means the officer of the relevant wing of QDA dealing with the allotment proceedings.

Authorized Officer: Means the officer of QDA authorized to do some specific assignment, such as collection of forms etc.

Delivery of Possession: Means handing over the physical possession of a plot with or without the title of ownership.

Family: Means and includes applicant's wife/ wives or husband as the case may be and their children below the age of 18 years.

Notified Date: Means the date notified by the Authority indicating that the plots are ready.

Payment: Means partial or full discharge of all liabilities or dues by the allottee.

Plot: Means a piece of land with specific dimensions or area earmarked for the : Ÿ Residential buildings exclusively. Ÿ Commercial buildings exclusively. Ÿ For public utility services exclusively.

Re-Allotment: Means allotment of plot after cancellation from the name of first or second allotted.

Cancellation of plot: Means to withdraw allotment orders due to violation of agreement i.e non-payment of installment or any other reason.

First come-first serve: Means applications directly submit their applications in QDA and competent authority allots or re-allots plots to those who come and apply before other Applicants. Means a specific ratio or number of Plots allocated to particular group of persons for the purpose of allotment.

CHAPTER 2 General Information Residential Plots: Ÿ The size of Residential Plots is 600, 400, 300, and 200 Sq Yds or any other size which maybe adopted

subsequently but not declared earlier.

Locality: Ÿ The site is located at a distance of approximately 3 km from Quetta Air Port, also near to Baluchistan

University of Information Technology & Management Sciences. The location is surrounded by beautiful Takatoo Hills with healthy environment.

Eligibility: Ÿ Person(s) having Pakistani Nationality shall be eligible for allotment of one plot in each category. Ÿ Only one application in each category will be entertained for allotment as per criteria fixed by the Authority. Ÿ A person below the age of 18 years will not be eligible to apply for allotment of plot, and any application if

received will be rejected forthwith. Ÿ It shall be the responsibility of applicant to provide correct Postal Address, Contact Numbers i.e Landline Telephone, Cell & Watsapp Numbers & Email ID. The applicant/allottee may convey any change in Address and Contact Numbers and Authority shall not be responsible for Provision of incomplete and incorrect address & numbers etc. NO excuse shall be accepted in this regard.

Allotment and Cancellation Policy: Ÿ Plot will be allotted through ballot to the eligible applicants. In case some plots are left or later on created due

to minor changes in plans, these will be allotted by Chairman QDA and Director General QDA on first come first serve basis on a single application received time to time. Ÿ That if the allottee fails to pay the installments in time, un paid cost and surcharge remain in arrears for more than six months (whether formally demanded or not), the Director General will have the full powers to cancel the allotment without any notice, resume the possession of the plot and forfeit 5% of the total cost of plot along with the security amount. However it shall be prerogative of DG QDA and Director Estate Residential to serve notices to defaulting allotees if required. Ÿ All the applications submitted in the bank for participating in ballot shall be included in the balloting process on transparent bases and a list of successful applicants will be issued accordingly .All the unsuccessful applicants will cease their candidature for future plotting of said scheme or any other. Scheme or for left over/remaining / created plots. Unsuccessful applicants will not be treated as waiting list candidates. Allotments after balloting will be on first come first serve (Single Application) bases.

Re-allotment of Cancelled Plots: Ÿ Cancelled plots will be re-allotted by the Director General QDA in order to expedite the recoveries and make

the payment system effective. Ÿ Cancelled plots will be re-allotted on first come first serve basis, by obtaining fresh applications received time to time from interested persons.


Powers of Allotment. Ÿ Chairman QDA is empowered for allotment of plots measuring 600 Sq yds up to Rs.6.00 million, in QDA

City Housing Scheme. Ÿ Director General QDA is empowered for allotment of plots below 600 Sq yds up to 4.50 million in QDA City Housing Scheme.

Submission of Applications: Ÿ The Authority reserves the rights to arrange collection of applications for allotment of plots in the scheme

through any scheduled Bank(s). The person(s) interested to purchase a plot will be required to submit application(s) (without 10% advance cost) on prescribed form shown as Annex-"A". Ÿ Cost of applications form including processing fee is. RS.10,000/- (Non Refundable) for each size of plot. Ÿ All the applications received will be scrutinize: before the draw to determine the eligibility of the applicants. The Authority reserves the right to reject any application before or after draw or to cancel the allotment of plot any time due to ineligibility of the applicant or any other reason whatsoever. Ÿ Those applicants of previous balloting i.e Zarghoon Housing Scheme may be considered on first come first. Serve bases who have still not refunded their advance amount subject to deposit Rs. :10000/- (nonrefundable) as application fees.

Public Utility Plots: Ÿ The public utility plots for educational institutions /clinics / hospitals / social welfare institutions etc shall be

disposed off throughout-right sale 'with price / cost fixed by the Governing Body of the Authority and payable by the allottee, department, Body or professional(s) as the case may be. Plots earmarked for Mosque will be designed / planed and constructed by QDA. The Mosque will remain under the administrative control of QDA. Plots earmarked for Clinics / Hospitals, will be sold out to the Doctors / Medical professionals/Private Practitioners on the rates approved by the Governing Body of QDA and construction will be made,as per approved design of QDA. Plots earmarked for Schools / Colleges will be sold out to the Education Department or Private Educational Firms on the rates approved by the Governing Body of QDA. The Education Department or Private Educational firms will develop / constructs the building as per plan approved by the QDA. Use of other amenities like Parks, Community Halls, Playgrounds etc will be decided by the Governing Body of QDA later on.

Ÿ An allottee who deposit 10% of the cost of plot along with security shall be issued an allotment order book Ÿ

containing schedule of payment. The due dates of payment of installments shall be fixed in the schedule of payment annexed to the allotment order book. In case an allottee fails to pay any installment on due date even for a single day, a surcharge at the rate of 5% on unpaid installment(s), subject to revision (from time to time), shall be levied upon him by the Authority. The amount of surcharge so calculated, shall be recovered in addition to the installments from the allotted by the authorized bank. If the unpaid balance and surcharge thereon remains in arrears for more than six months after it becomes due (whether formally demanded or not) the Authority shall have the right to cancel the allotment of the plot and resume its possession and forfeit 5% of the amount so deposited along with security amount. If an allottee pays the full cost of plot (lump sum) in advance then he / she is entitled for rebate @ 10% on full cost. OR If an allottee pays in advance cost of plot not less than 10 installment: then he / she will be entitled for rebate @ 5% on the amount so paid.


CHAPTER 4 General Conditions Possession of Plot: Ÿ The allottee after payment of full cost of plot will request in writing for grant of possession of the plot which

Will be handed over to him / her as per laid down procedure i.e after verification. by the Estate branch from its record by Town Planning Branch.

Execution of Agreement: Ÿ The allottee shall execute an agreement in respect of the allotted plot with the QDA and the cost of the Stamp

paper of Rs.100/ shall be borne by the allottee (Agreement form will be produce to the allotted on payment of Rs.100/- separately).

Construction Period: The allottee shall: Ÿ Take possession of the plot within a specified period as may be intimated by QDA through press / electronic media and failing which 'the possession shall be deemed to have been taken over by him / her immediately on the expiry of the period so specified. Ÿ Submit to QDA the design and building plan prior to cont, commencement of construction work of a house duly prepared by a qualified Architect registered with the Authority. The plan / design of the proposed building shall be prepared in accordance with QDA Building Rules and shall be available for scrutiny and approval by the Authority. Ÿ Complete the building in all respect, in accordance with QDA Building rules and fit for occupation within three years from the date of possession of the plot OR when the possession is deemed to have been handed over to the allottee as provided under Section -11(a) failing which Non-Utilization Fee of the plot @ (5%) per annum of total cost of plot will be recovered.

Transfer of Plot: Ÿ The allottee after having paid up to date cost of the plot and on his / her written request shall be allowed to

transfer his / her plot by gift, sale exchange or otherwise subject to the condition that a transfer fee at the rate of Rs.90/- per square yard, and Rs. 10/-Per Sft shall be charged from the allottee according to the standard size of plot OR actual demarcation and measurement of the plot, the possession whereof has been handed over to him / her, provided that the terms and conditions on which the plot was allotted to the original allottee shall stand good and applicable to transferee (purchaser) also. The transfere will give an undertaking to this effect. Ÿ Transfer of plots of deceased allottee will be effected as per prescribed rules / regulations and procedure in vogue. No transfer fee will be charged in such cases.

Transfer on Completion: Ÿ That after the building has been completed by the allottee and completion certificate issued by the concerned

branches of QDA, the allottee can transfer by sale his / her proprietary rights in the properly built (free from all encumbrances) on 'payment of Rs. 45/- Per Syd.

Variation in Size of Plot: Ÿ The actual cost of the plot payable by the allottee will be determined on actual demarcation and measurement

by the concerned surveyor of QDA which will be carried out in presence of the allottee at the time of handing


over the possession of the plot, if the area of the allotted plot become short or it is not rectangular according to the size / area given in the allotment order. The claim of the allottee for full size rectangular plot or for a change of plot on account of any other reason will not be entertained and the allottee shall have no claim for having the size and area as specified in the allotment order.

Loan Facility: Ÿ In case any allottee desires to seek loan from any loan giving agency, the QDA may issue a Non Encumbrance

Certificate (NEC) and Final Transfer Deed on such request from the allottee.

Issuance of Duplicate Documents: Ÿ In case, an allottee applies in writing and shall also files an affidavit to the officer concerned that he / she has

lost the original Allotment Order Book and requests for a duplicate copy of the same, the request will be considered, after charging a fee of Rs.1000/- as its cost to be deposited in the QDA's Account (Non refundable), if the allottee has subsequently found the Allotment Order Book, he / she shall return the duplicate copy to the QDA without claiming refund of fee so deposited.

Facilities to be Provided: Ÿ The Authority shall not provide facility other than provided in the plan.

Compliance with Regulations and Standing Instructions: Ÿ The allottee shall observe the regulations and standing, in vogue and those which may be issued from time to

time by the Authority with respect to the land comprising the plot, sanitary conditions, maintenance of building(s) and recovery of dues and Iocal taxes or in respect of other matters connected with the plot so allotted.

Breach of Regulations, False Information and Frauds: Ÿ In case the allottee commits breach of the regulations / terms and conditions of allotment order or instructions

issued, or those which may be issued from time to time or if it is subsequently found that the allotment of the plot had been obtained by the allottee by giving false information in his / her application for allotment or through fraud or mis presentation of facts, the allotment shall be liable to be cancelled and the Authority acting through the officer concerned shall have the right to forfeit the whole or any part of the payments so made by the allottee (s) and to resume the plot with full title together with the building(s), if any; thereon, without paying compensation what so ever and without prejudice to the rights of the Authority to enforce any legal liability arising out of the default in the nature of fine or penalty recoverable from the defaulting allotted.

Proprietary Rights: Ÿ The proprietary rights in the land comprising the plot shall be transferred to the allottee only after he / she has

paid full price / cost of the plot and completed the building in accordance with Building Rules / approved plan and drawings. Although plots are allotted for residential purposes however the allottee is free to sale his / her plot to any citizen of Pakistan at any stage of payment (even after payment of first installment) in case of Plots allotted through balloting or on first come first serve basis. QDA is a self-financing entity and functioning without Govt grant in aid and will not discourage the sale & purchase of allotted plots and receive the transfer fees and other charges at top priority basis to strengthen the financial position.

Any Errors / Mistakes in Allotment Order: Ÿ Any errors or mistakes in allotment order of plot will neither by itself vest any right in the allotment to claim

any compensation nor any compensation shall be paid to the allottee in respect of such an error / mistake.

Transfer Cost and Expenses:


Ÿ The entire cost and all expenses of stamp duty and registration of the sale deed or any other requisite amount

in this regard for the transfer of the proprietary rights of the plot shall be paid by the allottee.

Land Revenue and Other Charges: Ÿ All arrears of land revenue or any other tax / fee imposed under any Law for the time being enforce in respect

of the land comprising the plot, shall be payable by the allottee.

Joint Application: Ÿ Joint application for plot(s) shall not be entertained.

Appeals: Ÿ Any person feeling aggrieved by an order or decision of the officer concerned of QDA may, within one month

of such order or decision, may refer an appeal to DG QDA who, if found reasonable, shall dispose off at his own level or place that same before the Chairman for its decision. Ÿ DG QDA may refer any appeal to Governing Body of QDA for decision. Ÿ DG QDA or Chairman or the Governing Body (Appellate Authorities) of QDA in its meeting shall take a decision and convey t applicant/appellant. Ÿ Decision of the Appellate Authority on such appeal shall be final / binding upon the allottee and cannot be changed anywhere.

Relaxation: Ÿ The Authority reserves the right to relax, modify, alter, add to or omit any of the rules or regulations in their

application on any person or class of persons concerned with the allotment of plot(s) or in relation to matters concerning the scheme.

Miscellaneous Ÿ If any dispute of similar nature arises between the allottee and the officer concerned in respect of allotment of Ÿ Ÿ Ÿ

plot, the Authority, through its Governing Body, will settle the issue, which will not be challenged any further. An officer of QDA authorized in this behalf shall have the right to enter upon and inspect the plot or building thereupon at reasonable hours. The allottee will not bifurcate the plot or alter its dimensions in any manner. Maintenance fee in accordance with the rates levied from time to time shall be charged from the allotted for providing municipal facilities in the area by the designated officer with function of maintenance from the date of building construction thereon. The allotted shall not change the purpose and nature of the allotted plot for which the Authority allotted it originally. That an extra or minor piece of land should be sold to the allotted attached to the piece according to the. notified delegation of powers / rules of QDA giving a certificate: that it cannot be planned as a separate plot.
