William S Paley was the chief executive who built Columbia Broadcasting System (CBS) from a small radio network to one of the foremost Radio and Television network operations in the United States. Born in 1901, he was the son of a cigar manufacturer. In 1927 as their business expanded, they bought a struggling Philadelphia radio network, Columbia Phonographic Broadcasting System, primarily for use as an advertising medium for the family cigar business. Within a year sales had doubled, and within a decade the original network of 16 stations had expanded to 116. Paley quickly grasped the potential advertising earnings, and that a mixture of good programming was the key to attracting advertising revenue. Expanding into records and television brought further growth and the company boomed in the post war years, remaining one of the largest of its type. Other interests included owning a racing stable as well as building a significant collection of modern art. At one point he owned the New York Yankees baseball team. He died in 1990.

The gun was subsequently converted to ejector by Boss & Co. and also fitted with their single trigger. It is well documented that Payne-Gallwey had a disagreement with Purdey over a game counter he invented, so it is likely that when it was time to re-barrel the gun he chose to approach Boss instead. Likewise Boss were well known for their single trigger and ejector conversions at this time. Sir Ralph Payne-Gallwey Born in 1843, he was educated at Eton and was the cousin of Lord Walsingham, perhaps the best shot of the era. He kept the company with the most accomplished shots of the day and had been a keen shot from an early age. His Grandfather had published “Cautions to Young Sportsmen” in 1800, one of the first manuals on safe gun handling.. He inherited the Thirkleby estate at the age of 43, which was one of the very best sporting estates in Victorian Britain. An accomplished author he is probably best remembered for his three volumes of “Letters to Young Shooters” published between 1891 and 1896. A prolific inventor his name is still known for the many shooting accessories that he designed, including Payne Gallwey pattern cartridge bags, cleaning rods and brushes, shooting sticks and game counters. Many of these items remain in production to this day. As a renowned wildfowler, he invented a double barrel punt gun that was built by Holland & Holland, and was the first president of WAGBI, which is today known to shooters as BASC. His last work was “High Pheasants in Theory and Practice” and he died in 1916.

Lot 93 “THE PHOENIX GUN” A MAGNIFICENT MALCOLM APPLEBY-ENGRAVED 12-BORE SELF-OPENING SIDELOCK EJECTOR GUN, NO. 7420 28-inch chopper-lump barrels with 2 3/4-inch chambers, about full choke borings, the tubes signed beneath the fore-end, ‘M. Appleby, Engraver’ and ‘M Lingard, Gunmaker’, the breeches and rib with fine feather details, the frame and locks engraved in typical Appleby style with flowing plumage, talons and highly detailed stylised themes around the mythical phoenix, the trigger plate with golden flames, the action base with beak and eyes, the fences carved in a similar manner, the safety catch with further golden flame detail, gold lined cocking indicators, 14 3/4-inch highly figured stock, 6lb. 10oz., nitro proof The gun retains all of its original finish and appears virtually unused. Other Appleby commissions included “The Scottish Lace Gun”, “The Woodcock Gun”, “The Raven Gun” (for the Royal Armouries) and “The Pike Gun” (sold at Sotheby’s, Gleneagles in 1994). “I have always had my own ideas about how a gun should be engraved, so that the engraving is in harmony with the the colour and the form and the use of the gun. The concept gradually developed in my mind until the late 1970s and it was not until 1980 that I could afford to purchase guns ‘in the white’ to engrave and so be free of the gunmakers’ influences. The first to be engraved in 1981 was a sidelock by John Wilkes which was engraved with woodcock feathers. The first gun actually finished was “The Crocodile Gun”, a round action by David McKay Brown, followed by “The Pike Gun”, which was engraved with fish scales, and then “The Raven Gun” for the Royal Armouries. These guns form a series of surface textured decoration that naturally blends with the form of the gun so that the artist’s work does not dominate the total object. Careful attention to each part of the gun was taken, sometimes subtly reforming a lever to remove sharp points.

3. EXAMINATION OF LOTS

5. BIDDING AT AUCTION

(a) The contractual relationship of Gavin Gardiner Limited and Sellers with prospective Buyers is governed by:(i) these Conditions of Business for Buyers;

(a) GGs knowledge of lots is partly dependent on information provided by the Seller and GG is unable to exercise exhaustive due diligence on each lot. Each lot is available for examination before sale. Bidders are responsible for carrying out examinations and research before sale to satisfy themselves over the condition of lots and accuracy of descriptions.

(a) GG has absolute discretion to refuse admission to the auction. Before sale, Bidders must complete a Registration Form and supply such information and references as GG requires. Bidders are personally liable for their bid and are jointly and severally liable with their principal, if bidding as agent (in which case GG’s prior and express consent must be obtained).

(b) All oral and/or written information provided to Bidders relating to lots, including descriptions in the catalogue, condition reports or elsewhere are statements of GG’s opinion and not representations of fact. Estimates may not be relied on as a prediction of the selling price or value of the lot and may be revised from time to time at GG’s absolute discretion.

(b) GG advises Bidders to attend the auction, but GG will endeavour to execute absentee written bids provided that they are, in GG’s opinion, received in sufficient time and in legible form.

Property shall not be considered Counterfeit solely because of any damage and/or restoration and/or modification work (including, but not limited to, recolouring, refinishing or rebarreling). Please note that this Guarantee does not apply if either:(i) the catalogue description was in accordance with the generally accepted opinions of scholars and experts at the date of the sale, or the catalogue description indicated that there was a conflict of such opinions; or

(ii) the only method of establishing at the date of the sale that the item was a Counterfeit would have been by means of processes not then generally available or accepted, unreasonably expensive or impractical; or likely to have caused damage to or loss in value to the Property (in Gavin Gardiner Limited’s reasonable opinion); or (iii) there has been no material loss in value of the Property from its value had it accorded with its catalogue description. To claim under this Guarantee, the Buyer must:(i) notify Gavin Gardiner Limited in writing within one (1) month of receiving any information that causes the Buyer to question the authenticity or attribution of the Property, specifying the lot number, date of the auction at which it was purchased and the reasons why it is believed to be Counterfeit; and

Gavin Gardiner Limited has discretion to waive any of the above requirements. Gavin Gardiner Limited may require the Buyer to obtain at the Buyer's cost the reports of two independent and recognised experts in the relevant field and acceptable to Gavin Gardiner Limited. Gavin Gardiner Limited shall not be bound by any reports produced by the Buyer, and reserves the right to seek additional expert advice at its own expense. In the event Gavin Gardiner Limited decides to rescind the sale under this Guarantee, it may refund to the Buyer the reasonable costs of up to two mutually approved independent expert reports, provided always that the costs of such reports have been approved in advance and in writing by Gavin Gardiner Limited.

(ii) return the Property to Gavin Gardiner Limited in the same condition as at the date of sale and be able to transfer good title in the Property, free from any third party claims arising after the date of the sale. PHOTOGRAPHY
