Firearms (Amendment) Act 1997 Lots marked with a will not be delivered without the Authority of the Secretary of State under Section 5 to purchase or acquire prohibited weapons to which section 5(1)(aba) of the act applies.

PROOF OF FIREARMS The term ‘proof exemption certificate’ indicates that a firearm has been examined at a Proof House but not proved, as either (a) it was deemed of interest and not intended for use, or (b) ammunition was not available. In either case, the firearm must be regarded as unsafe to fire unless subsequently proved. Firearms proved for Black Powder should not be used with modern smokeless ammunition. The term ‘Certificate of Unprovability’ indicates that a firearm has been examined at a Proof House

and is deemed both unsuitable for proof and use. Reproof is required before any such firearm is to be used.

GUNS SOLD AS PARTS Barrels of guns sold as parts will only be made available for sleeving and measurement once rendered unserviceable, according to the Gun Barrel Proof Act of 1868 to 1978 and the Rules of Proof.

CONDITION OF FIREARMS Comment in this catalogue is restricted in general to exceptional condition and to those defects that might affect the immediate safety of a firearm in normal use. An intending buyer unable to make technical examinations and assessments is recommended to seek advice from a gunmaker or from the specialist in charge. All prospective buyers are advised to consult the lists of bore and wall-thickness measurements posted in the saleroom. Potential buyers should note that guns are stripped only where there is a strong indication of a mechanical malfunction. Stripping is not otherwise undertaken. Guns intended for use should be stripped and cleaned beforehand. Hammer guns should have their rebound mechanisms checked before use. The safety mechanisms of all guns must be tested before use.

SPECIAL NOTICE TO OVERSEAS BUYERS Firearms under 100 years of age, in addition to any other Export Licence requirements, need a DTI strategic licence in order to leave the U.K. Gavin Gardiner Limited will upon request, arrange through his nominated shipper and the appropriate Government agencies for the relevant Export Licence application. Shipping Instructions should include the nature of the consignees business, and the ultimate intended use for each firearm. In most cases an Import Licence or General Undertaking will be required before an Export Licence is granted. Prior Import Consent is required from the consignee (obtained from the issuing authorities in that member state) before a U.K. Export Licence will be granted. Trade Buyers within the E.E.C. are reminded that Gavin Gardiner Limited hold an open Dealer to Dealer licence, the Import consent requirements remain the same.

Lionel Nathan de Rothschild (1882-1942), scion of the famous banking family, is best known today for the creation of the famous Exbury gardens in the New Forest, a 200-acre woodland garden filled with rhododendrons and azaleas, camellias, magnolias and rare specimen trees. He was also a keen pioneer in the early days of motoring, briefly held the world water-speed record and was a fine amateur photographer. This set of three Purdeys was given to him on his birthday and have been in the family ever since, being used first by Lionel’s older son Edmund and then by Edmund’s sons, Nicholas and Lionel on their family run shoot at Exbury.

THE JOHN BUNNEY COLLECTION The following lots are from the collection of John F. Bunney. John Bunney has spent his whole life collecting and enjoying fine vintage firearms. As a child he was introduced to air rifle shooting whilst at school and soon joined the Cadet force to shoot the .303 Bren and No.4. Having taken up pigeon shooting, and living in Covent Garden, he was just around the corner from the emporium of Thomas Bland and was inspired by the collection of vintage hammer guns displayed in the showcases there. His many visits to purchase ammunition inspired him further and he soon purchased his first hammer gun, a 12-bore live pigeon gun by W & C Scott. This gun saw success in many sporting competitions. Over a forty year period his collection evolved, with a special passion for guns that were made for Royalty and Nobility. A good selection of these were sold in these rooms earlier this year. The time has come to pass on the remainder of the collection, to be enjoyed by a new generation of collectors and enthusiasts.

Lot 267 EZEKIEL BAKER A RARE 15-BORE DOUBLE IGNITION FLINTLOCK SPORTING GUN, BUILT FOR HIS ROYAL HIGHNESS THE PRINCE OF WALES, THE PRINCE REGENT 33-inch damascus twist barrels with gold lined breech and maker’s stamp, engraved “Gunmaker to His Royal Highness the Prince of Wales”, ramrod with horn tip, gold lined touch holes, engraved tang, the Baker patent locks constructed to cock in unison, frizen springs with rollers, rainproof pans, the half length well figured stock with silver mounts, the steel trigger guard with engraved pineapple finial, chequered grip, leather covered cheekpiece and engraved steel butt plate, the hand inlaid with gold Prince of Wales feathers above a presentation inscription “Gift to My Friend Bob”, 14 1/2-inch pull, 6lb. 2oz., London black powder proof The Prince Regent was born on August 12, 1762, the eldest son of George III and Queen Charlotte. He was crowned George IV on January 29, 1820, having been made Prince Regent in 1811 due to his father’s insanity. When he was only 15 years old, his tutor said of him that he would become “either the most polished gentleman or the most accomplished blackguard in Europe - probably both”. During his life he had a great reputation for extravagance - a cause of considerable concern within Parliament during what was a period of great economic distress. He built up a considerable personal debt and by 1783 owed £160,000. He then undertook a costly extension of Carlton House, London, adding an Ionic portico and redesigned the gardens; while in Brighton he started to build the Royal Pavilion, the epitome of 18th century opulence. He married Princess Caroline of Brunswick in 1794 and only two years later £600,000 worth of his debts were liquidated by Parliament. This affected the gun trade considerably as he owed Durs Egg £1,837, John Manton £113 and Henry Nock £281. The majority of the Prince’s creditors were asked to prove their claims to the Commissioners of the Prince Regent’s Accounts and luckily the gunmakers received debentures payable over two or three years. At the end of the 18th century, he showed a great deal of interest in the work of Ezekiel Baker, one of the leading London gunmakers, following the success of Baker’s infantry rifle which had been adopted by the British Army in 1800. Baker sold many guns to the Prince, including some elaborately engraved silver mounted flintlocks and it appears he spent a great deal of time shooting with the Prince. In his book, “Remarks on Rifle Guns”, Baker illustrates three targets shot by the Prince at Brighton in 1805 using a pair of pistols and a rifle. In 1828 Baker won a silver medal from the Society for the Encouragement or Arts and Manufacturers. The Prince Regent formed a considerable collection of guns, firearms and armour, many of which are housed at Windsor Castle. £10000 - 15000

Born in Brooklyn in 1854, she was the second daughter of financier, sportsman and speculator, Leonard Jerome. Long considered one of the most beautiful women of the time, she married Lord Randolph Churchill at the British Embassy in Paris on 15th April 1874. The couple had become engaged within three days of their initial meeting, though the marriage was delayed for some months. Their first son Winston, the future Prime Minister, was born that same year.

It is recorded as a “small rifle, maple stock” and was sold to Joseph Lang and that he further purchased a new mahogany case for £2 4s. The case label is the rare 315 Oxford Street example that has later been corrected in ink to 314½. The barrel of the rifle has been reengraved with the address as 315½. It is highly likely that this was originally 314½ or 315 Oxford Street and that during restoration the incorrect number has been engraved. James Purdey moved in to the former Manton premises at 315 Oxford Street during the course of 1826/7. It appears that very few guns were sold bearing this address as Purdey very quickly changed this to 314 1/2 Oxford Street and all guns sold from those premises subsequently bore that address. £3500 - 5000

5. BIDDING AT AUCTION

(a) The contractual relationship of Gavin Gardiner Limited and Sellers with prospective Buyers is governed by:(i) these Conditions of Business for Buyers;

(a) GGs knowledge of lots is partly dependent on information provided by the Seller and GG is unable to exercise exhaustive due diligence on each lot. Each lot is available for examination before sale. Bidders are responsible for carrying out examinations and research before sale to satisfy themselves over the condition of lots and accuracy of descriptions.

(a) GG has absolute discretion to refuse admission to the auction. Before sale, Bidders must complete a Registration Form and supply such information and references as GG requires. Bidders are personally liable for their bid and are jointly and severally liable with their principal, if bidding as agent (in which case GG’s prior and express consent must be obtained).

(b) All oral and/or written information provided to Bidders relating to lots, including descriptions in the catalogue, condition reports or elsewhere are statements of GG’s opinion and not representations of fact. Estimates may not be relied on as a prediction of the selling price or value of the lot and may be revised from time to time at GG’s absolute discretion.

(b) GG advises Bidders to attend the auction, but GG will endeavour to execute absentee written bids provided that they are, in GG’s opinion, received in sufficient time and in legible form.

(ii) the Conditions of Business for Sellers displayed in the saleroom and available from Gavin Gardiner Limited; (iii) Gavin Gardiner Limited’s Authenticity Guarantee; (iv) any additional notices and terms printed in the sale catalogue, in each case as amended by any saleroom notice or auctioneer's announcement. (b) As auctioneer, Gavin Gardiner Limited acts as agent for the Seller. Occasionally, Gavin Gardiner Limited may own or have a financial interest in a lot. 2. DEFINITIONS "Bidder" is any person making, attempting or considering making a bid, including Buyers; "Buyer" is the person who makes the highest bid or offer accepted by the auctioneer, including a Buyer’s principal when bidding as agent; "Seller" is the person offering a lot for sale, including their agent, or executors; “GG” means Gavin Gardiner Limited, Hardham Mill Business Park, Mill Lane, Hardham, Pulborough, West Sussex, RH20 1LA, company number 5703551. "Buyer’s Expenses" are any costs or expenses due to Gavin Gardiner Limited from the Buyer ; "Buyer’s Premium" is the commission payable by the Buyer on the Hammer Price at the rates set out in the Guide for Prospective Buyers; "Hammer Price" is the highest bid for the Property accepted by the auctioneer at the auction or the post auction sale price; "Purchase Price" is the Hammer Price plus applicable Buyer’s Premium and Buyer’s Expenses; "Reserve Price" (where applicable) is the minimum Hammer Price at which the Seller has agreed to sell a lot. The Buyer’s Premium, Buyer’s Expenses and Hammer Price are subject to VAT, where applicable.

4. EXCLUSIONS AND LIMITATIONS OF LIABILITY TO BUYERS (a) GG shall refund the Purchase Price to the Buyer in circumstances where it deems that the lot is a Counterfeit, subject to the terms of GG’s Authenticity Guarantee.

(c) When available, written and telephone bidding is offered as a free service at the Bidder’s risk and subject to GG’s other commitments; GG is therefore not liable for failure to execute such bids. Telephone bidding may be recorded. 6. IMPORT, EXPORT AND COPYRIGHT RESTRICTIONS

(i) is liable for any errors or omissions in any oral or written information provided to Bidders by GG, whether negligent or otherwise;

GG and the Seller make no representations or warranties as to whether any lot is subject to import, export or copyright restrictions. It is the Buyer's sole responsibility to obtain any copyright clearance or any necessary import, export or other licence required by law, including licenses required by law under the 1968 Firearms Act and Convention on the International Trade in Endangered Species (CITES).

(ii) gives any guarantee or warranty to Bidders and any implied warranties and conditions are excluded (save in so far as such obligations cannot be excluded by English law), other than the express warranties given by the Seller to the Buyer (for which the Seller is solely responsible) under the Conditions of Business for Sellers;

(a) The auctioneer has discretion to refuse bids, withdraw or re-offer lots for sale (including after the fall of the hammer) if (s)he believes that there may be an error or dispute, and may also take such other action as (s)he reasonably deems necessary.

(b) Subject to Condition 4(a), neither GG nor the Seller :-

(iii) accepts responsibility to Bidders for acts or omissions (whether negligent or otherwise) by GG in connection with the conduct of auctions or for any matter relating to the sale of any lot. (c) Without prejudice to Condition 4(b), any claim against GG and/ or the Seller by a Bidder is limited to the Purchase Price for the relevant lot. Neither GG nor the Seller shall be liable for any indirect or consequential losses. (d) Nothing in Condition 4 shall exclude or limit the liability of GG or the Seller for death or personal injury caused by the negligent acts or omissions of GG or the Seller.

7. CONDUCT OF THE AUCTION

(b) The auctioneer will commence and advance the bidding in such increments as (s)he considers appropriate and is entitled to place bids on the Seller’s behalf up to the Reserve Price for the lot, where applicable. (c) Subject to Condition 7(a), the contract between the Buyer and the Seller is concluded on the striking of the auctioneer's hammer. (d) Any post-auction sale of lots shall incorporate these Conditions of Business.

10. FAILURE TO COLLECT PURCHASES

(a) Unless otherwise agreed in advance, payment of the Purchase Price is due in pounds sterling immediately after the auction (the "Payment Date").

Without prejudice to any rights that the Seller may have, if the Buyer without prior agreement fails to make payment for the lot within 5 working days of the auction, GG may in its sole discretion exercise 1 or more of the following remedies:-

(a) If the Buyer pays the Purchase Price but does not collect the lot within 20 working days of the auction, the lot will be stored at the Buyer's expense and risk at GG’s premises or in independent storage

(b) Title in a lot will not pass to the Buyer until GG has received the Purchase Price in cleared funds. GG will generally not release a lot to a Buyer before payment. Earlier release shall not affect passing of title or the Buyer's obligation to pay the Purchase Price, as above. (c) The refusal of any licence or permit required by law, as outlined in Condition 6, shall not affect the Buyer’s obligation to pay for the lot, as per Condition 8(a). (d) The Buyer must arrange collection of lots within 10 working days of the auction. Purchased lots are at the Buyer's risk from the earlier of (i) collection or release to a nominated carrier (ii) 10 working days after the auction. Until risk passes, GG will compensate the Buyer for any loss or damage to the lot up to a maximum of the Purchase Price actually paid by the Buyer. GG’s assumption of risk is subject to the exclusions detailed in Condition 5(d) of the Conditions of Business for Sellers. (e) All packing and handling of lots is at the Buyer's risk. GG will not be liable for any acts or omissions of third party packers or shippers.

(d) reject future bids from the Buyer ; (e) charge interest at 4% per annum above NatWest Bank Base Rate from the Payment Date to the date that the Purchase Price is received in cleared funds; (f) re-sell the lot by auction or privately, with estimates and reserves at GG’s discretion, in which case the Buyer will be liable for any shortfall between the original Purchase Price and the amount achieved on re-sale, including all costs incurred in such re-sale; (g) Exercise a lien over any Buyer’s Property in GG’s possession, applying the sale proceeds to any amounts owed by the Buyer to GG. GG shall give the Buyer 14 days written notice before exercising such lien; (h) commence legal proceedings to recover the Purchase Price for the lot, plus interest and legal costs; (i) disclose the Buyer’s details to the Seller to enable the Seller to commence legal proceedings

(b) If a lot is paid for but uncollected within 6 months of the auction, following 60 days written notice to the Buyer, GG will re-sell the lot by auction or privately, with estimates and reserves at GG’s discretion. The sale proceeds, less all GG’s costs, will be forfeited unless collected by the Buyer within 2 years of the original auction.

(a) GG will use information supplied by Bidders or otherwise obtained lawfully by GG for the provision of auction related services, client administration, marketing and as otherwise required by law. (b) By agreeing to these Conditions of Business, the Bidder agrees to the processing of their personal information and to the disclosure of such information to third parties world-wide for the purposes outlined in Condition 11(a) and to Sellers as per Condition 9(i). 12. MISCELLANEOUS (a) All images of lots, catalogue descriptions and all other materials produced by GG are the copyright of GG. (b) These Conditions of Business are not assignable by any Buyer without GG’s prior written consent, but are binding on Bidders' successors, assigns and representatives. (c) The materials listed in Condition 1(a) set out the entire agreement between the parties. (d) If any part of these Conditions of Business be held unenforceable, the remaining parts shall remain in full force and effect. CONDITIONS OF BUSINESS All lots are offered subject to gavin Gardiner Limited’s Conditions of Business.

ESTIMATES AND RESERVES Estimates are published as a guide only and are subject to review. The actual hammer price of a lot may be higher or lower than the range of figures given and there are no predetermined starting prices. Estimates may be subject to revision. Published estimates are exclusive of buyer’s premium and VAT. All lots are subject to reserves. The reserve price is never higher than the low pre-sale estimate.

BUYER’S PREMIUM AND VAT A buyers premium of 22.5% is applicable to all the lots in this sale. The buyer’s premium is subject to VAT at the current standard rate (20%). Lots are normally offered for sale under the auctioneers margin scheme and VAT is payable on the buyers premium by all buyers. Lots marked with a dagger symbol † will be offered under normal UK VAT rules and VAT will be charged on both the hammer price and the buyers premium.

Lots marked with a ‡ or Ω symbol has been imported from outside the EU to be sold at auction under temporary importation. VAT is applicable on the hammer price at the following rates: ‡ @ 5% Ω @ 20%

All auctions are on public view for at least two days prior to the sale.

Payment is due in sterling immediately after the sale and before purchases can be released. Payments in person can be made in the saleroom on the day of the auction. After this payments must be made by post, card transactions by telephone or electronic transfer to our bank. Gavin Gardiner Ltd. welcome the following methods of payment:

CONDITION REPORTS All prospective bidders are encouraged to attend the pre-sale exhibition and view the lots in person. If this is not possible, we will be pleased to provide a condition report where practical. All condition reports are provided in good faith. Buyers are reminded that it is their responsibility to satisfy themselves over the condition of lots. Please refer to Conditions of Business for further information.

BIDDING IN PERSON To bid with us you must register to obtain a bidding number. You will be asked to provide proof of identity. All lots sold will be invoiced to the name and address in which the paddle has been registered and will not be transferred to other names or addresses. If you instruct an agent to bid on your behalf, you will need to provide a letter of authority to this effect.

CREDIT/DEBIT CARD We are pleased to accept major credit cards (regrettably we are unable to accept American Express card payments), for which a surcharge will be made of 3% of the transaction total. This is to cover the charge made to us by our bank. There is no charge for payments made by debit card.

GAVIN GARDINER LIMITED’S AUTHENTICITY GUARANTEE If Gavin Gardiner Limited sells an item of Property which is later shown to be a “Counterfeit”, subject to the terms below Gavin Gardiner Limited will rescind the sale and refund the Buyer the total amount paid by the Buyer to Gavin Gardiner Limited for that Property, up to a maximum of the Purchase Price. The Guarantee lasts for one (1) year after the date of the relevant auction, is for the benefit of the Buyer only and is non-transferable. “Counterfeit” means an item of Property that in Gavin Gardiner Limited’s reasonable opinion is an imitation created with the intent to deceive over the authorship, origin, date, age, period, culture or source, where the correct description of such matters is not included in the catalogue description for the Property. Property shall not be considered Counterfeit solely because of any damage and/or restoration and/or modification work (including, but not limited to, recolouring, refinishing or rebarreling). Please note that this Guarantee does not apply if either:(i) the catalogue description was in accordance with the generally accepted opinions of scholars and experts at the date of the sale, or the catalogue description indicated that there was a conflict of such opinions; or

(ii) the only method of establishing at the date of the sale that the item was a Counterfeit would have been by means of processes not then generally available or accepted, unreasonably expensive or impractical; or likely to have caused damage to or loss in value to the Property (in Gavin Gardiner Limited’s reasonable opinion); or (iii) there has been no material loss in value of the Property from its value had it accorded with its catalogue description. To claim under this Guarantee, the Buyer must:(i) notify Gavin Gardiner Limited in writing within one (1) month of receiving any information that causes the Buyer to question the authenticity or attribution of the Property, specifying the lot number, date of the auction at which it was purchased and the reasons why it is believed to be Counterfeit; and

Gavin Gardiner Limited has discretion to waive any of the above requirements. Gavin Gardiner Limited may require the Buyer to obtain at the Buyer's cost the reports of two independent and recognised experts in the relevant field and acceptable to Gavin Gardiner Limited. Gavin Gardiner Limited shall not be bound by any reports produced by the Buyer, and reserves the right to seek additional expert advice at its own expense. In the event Gavin Gardiner Limited decides to rescind the sale under this Guarantee, it may refund to the Buyer the reasonable costs of up to two mutually approved independent expert reports, provided always that the costs of such reports have been approved in advance and in writing by Gavin Gardiner Limited.

(ii) return the Property to Gavin Gardiner Limited in the same condition as at the date of sale and be able to transfer good title in the Property, free from any third party claims arising after the date of the sale.
