• Clearing Title allows you to be certain that you fully own and can utilize your property.
• You can title the property in your personal name(s) or in trust, etc
• The Seller always provides a Seller’s title policy to the buyer
• The Buyer always provides their lender with an Owner’s title policy
• In a cash deal the buyer does not need to pay for an owner’s policy
STEP 8: POLICY PREP
The Policy Examiner prepares the title insurance policy in accordance with the closing instructions and terms of the closing.
Step 1: Process Started Contract received, order entered, process started.
STEP 7: DOCUMENT SUBMISSION
After closing, the recording clerk submits the appropriate documents to the Recorder of Deeds office. After the documents have been recorded, they are mailed to the customers.
STEP 6: PREP FOR CLOSING
The Escrow Agent/Closer reviews the contract, processing package, title commitment, and written closing instructions in preparation for settlement and real estate closing.
Step 2: Abstracting
The Abstracting Team researches the history of the real estate title and collects information regarding ownership, liens, encumbrances, etc. Records researched include documents with the Recorder of Deeds, Circuit Court, County Assessor, and Collector of Revenue.
STEP 3: EXAMINING
The Examiner receives the research package from the Abstracting Team and reviews the chain of title for the purpose of preparing a Title Insurance Commitment. The Title Insurance Commitment will show current ownership and legal description of the real estate. It will also show matters that will be exceptions to the title insurance coverage, unless the matters are resolved.
STEP 5: PROCESSING
STEP 4: DATA ENTRY Title Commitment and invoice are prepared and distributed to necessary parties.
The closing Processor receives the title commitment and begins the process of gathering and organizing information for the closing.
