COMMITMENT TO THE CLIENT Upon receiving a property to list, TEAM EKUS, at its own expense, will faithfully, expeditiously, and thoroughly perform the following duties: 

Perform an in-person, on-site visual inspection of the property.

Place an approved “for sale” sign on the premises.

Obtain and provide complete information required for proper MLS data entry.

Enter the property in the MLS that will provide best exposure for the property among the selling brokers and agents in the local market.

Occasionally provide Broker Price Opinions (BPO) electronically in an acceptable format, as requested.

Provide all human resources, MLS memberships, real estate licenses, materials, technical equipment, office facilities, and data retrieval services for county records, as necessary to perform this Scope of Services, which shall be part of the real estate Listing Agreement.

Maintain all necessary computer equipment, technology, and software to receive orders and return information to our contractors electronically and to communicate frequently by e-mail, phone and in person as necessary.

Date and time stamp when received all information provided by the client.

At Listing Agreement commencement, complete the required tasks in the Scope of Services for the initial list of properties assigned to TEAM EKUS within five (5) calendar days from receipt of the list. MLS printouts confirming entry will be transmitted to the client as necessary.

Subsequently, enter property listing and status update information into MLS within 24 hours from receipt, or by close of business Friday, whichever is sooner.

On the listings, deliver written or electronic proof of MLS listing to the client by the close of business Friday, or within eight (8) hours of MLS entry, whichever is sooner.

In cases where a lockbox is required, the TEAM EKUS will make certain a functioning key is contained in the MLS required lockbox at all times, replacing any missing keys immediately.


RE/MAX COMMITMENT 

TEAM EKUS agrees to monitor and maintain for itself and all its associates the highest professional standards. It is essential that everyone associated with the TEAM EKUS, always show courtesy and take pains to be responsive to every call regarding the properties, including without limitation: a. Providing current information as to each property’s availability, status, access, and other information that may assist a broker or agent to sell the property to his or her customer. This information will be available on our website. b. Supplying a current, working key to any real estate licensee or to other eligible persons when the client, makes a specific request. TEAM EKUS will track the contact information of all key recipients. c. Explaining the process of electronic submissions. d. Detailing the requirements to submit a complete, accurate, and timely contract package. e. Answering questions about procedures. f. Supplying contact information for the client g. Providing appropriate forms needed by selling brokers, or to other eligible participants, especially those who may qualify for direct sales programs. h. Maintain open office hours at least six (6) days per week, Monday through Saturday, from 8:00 AM to 5:00 PM local time. During these hours the telephone number for TEAM EKUS on signs and in ads must be answered by a live person knowledgeable about the property.

 Provide an on-call agent number for evening and Sunday showings or inquiries.  Advertise a toll-free telephone number for 24/7 access, with a live person answering

during business hours.  Install an informative recording on the TEAM EKUS answering device for after hours calls

received on the office and toll-free numbers that advises callers to acquire additional information after hours by visiting the TEAM EKUS web site, or leave a message for a return call during the next business day.


RE/MAX COMMITMENT 

Process “change in status” information posted on the TEAM EKUS’ Web site listings regarding each property. This includes making such changes in the corresponding MLS listing within eight (8) business hours. Changes in status may include, without limitation: a.

Remove from and hold off the market (HOM)

b.

Contract pending

c.

Sale closed – remove from the market

d.

Contract failed – place back on the market

e.

Price changed (Reduced)

f.

Buyer or selling broker incentives offered

g.

Property disposition status changed, such as repair escrow added, or repair escrow amount modified

Deliver written proof by uploading to the client the MLS listing data sheet showing that changes have been made timely by TEAM EKUS.

Supply all Home Owners Association (HOA) or condominium documents to the client and to potential purchasers or their agents that are required by state or local law.

Alert the client regarding local municipal inspection requirements where the listed property is located, and assist the client to obtain the proper inspections. TEAM EKUS is not required to pay any such inspection fees.

Prepare and deliver to the client any disclosure statements required of the seller by state or local laws.

Communicate immediately to the client, team members AND to the property maintenance subcontractor’s emergency number whenever TEAM EKUS receives any information regarding adverse or deficient property conditions, unauthorized occupancy, vandalism, criminal trespass, or other situations that may have a negative impact on the condition or marketability of the property.

Maintain professional and courteous working relationships with sub-contractor’s team members.

Attend training sessions designated by local and state law, and ensure that TEAM EKUS agents, staff, and fellow licensees are strongly encouraged to attend.

Keep current on all announcements affecting homes sales.


RE/MAX COMMITMENT 

Maintain current insurance coverage at a minimum level of $1,000,000 for Comprehensive General Liability, and $500,000 for motor vehicle liability, and $500,000 for property coverage. In compliance with state and local laws, TEAM EKUS must also maintain Worker’s Compensation and Errors and Omissions insurance. Documentation of these policies must be provided to the client as they are updated so that TEAM EKUS file is kept current at all times.

Ensure that all MLS listings include: a.

Disclosures regarding known hazards or defects.

b. Notice to selling brokers that Seller will pay a commission of up to the required amount upon a successful closing. c.

A reference that more information is available and offers may be submitted on the TEAM EKUS Web site.

Perform any other duties and responsibilities required of the client.

“START UP ” PLAN Small business owners often overlook the value of taking the time to write a comprehensive business plan at start-up. At first glance, it can seem like a daunting task but there are a number of reasons why it was worth the effort. TEAM EKUS have developed and implemented a comprehensive plan that has given us a clear objective to strive towards which is used as a „roadmap‟ to refer back to during any obstacles. TEAM EKUS as described on our financial page is self-financed and foresees no issues with it‟s cash reserves to finance any part of a HUD Agreement. In addition, set fourth has been our successful plan in this ever changing market. 1. Penetrate your existing market. The first thing that comes to mind when thinking of growing your business is getting new customers. But the customers you already have are your best bet for increasing your sales; it‟s easier and more cost-effective to get people who are already buying from you to buy more than to find new customers and persuade them to buy from you. 2. Ask for referrals. Getting new customers is another approach to growing your business. One of the easiest way to do this is to ask your current customers for referrals. But notice the verb. Doing a great job and just assuming that your customers are passing the word about your business isn‟t going to do much to increase your customer base; you have to actively seek referrals. During or after every sale, we ask our satisfied customers if they know anyone else who would be interested in buying or selling a home. 3. Innovate our service. Discovering and promoting new sales techniques for promoting our services and assets has been a great way to both get existing customers to buy more and attract new customers to understand the buying process. 4. Extend our market reach. There are several ways of growing our business by making our services available to a new pool of customers. The most obvious is to open new locations, such as opening a kiosk in a new area or shopping center. New locations can also be virtual, such as a website with an online store. Another approach is to extend our reach through advertising. Once we‟ve identified a new market, we will advertise in select media that targets that market.


“START UP ” PLAN 5. Participate in trade shows and community education events. Trade shows and community education events have been a great way of growing our business. Because trade and community education events draw people who are already interested in the type of product and service we have to offer, they powerfully improve our bottom line. The trick is to select the trade and community education events that we participate in carefully, seeking the right match for our product and service. 6. Conquer a niche market. Remember the analogy of the big fish in the small pond? That‟s essentially how this strategy for growing our business works. The niche market is the pond; a narrowly defined group of customers i.e. REO or first time home buyers. We think of them as a subset whose needs are not being met and concentrate on meeting those unmet needs. 7. Contain our costs. Surprised? Bear in mind

that when we‟re talking about growing our business, we‟re actually talking about growing our business‟s bottom line. And the difference between pre-tax and post-tax money has made this a very effective growth strategy. There are two main approaches to cutting costs; liquidating your “losers” via competitive marketing and advertising and improving our inventory turnover time. 8. Diversify products and services. The key to successfully growing our business has been through diversification in the marketplace. We focus on the related needs of our already established market segments with similar needs and characteristics. We continue to reach out to minority owned businesses, the Hispanic and Asian community and ensure we are we diverse in our sales and marketing techniques.

Each attribute will be tested with each new customer we acquire. This is one area of business where you do not want to take unnecessary risks. Creativity comes into play here as you look for ways to spend just enough to reach just the right people. Testing with small, more trackable groups first may serve as a way to gain information and experience. Later you can use this broader base of knowledge to effectively implement advertising tactics that are tailored to your target market segment.
