DID YOU KNOW...IT’S THE LAW Did you know that in this province, the Ontario Fire Code makes it compulsory for property owners to make sure that their properties comply with every aspect of the code. And the old adage of “ignorance of the law is no excuse” is a well-founded truism and is relied upon by all courts in assessing liability and responsibility. Section 1.2.1.1 of the fire code states: “Unless otherwise specified, the owner is responsible for carrying out the provisions of this Code”. Period. And there are very few “otherwise specified” sections in the Fire Code. And according to Ontario law, the “owner” of a property is “any person, firm or corporation having control over any portion of the building or property under consideration and includes persons in the building or property”. This definition has a practical application that extends the responsibility for compliance to “any person having control” such as a superintendent, manager, supervisor and so on. Each of these people could be held liable/ responsible in the event some aspect of the fire code is found to be lacking, especially if a fire occurs. The key to keeping yourself out of hot water is of course prevention. Each month this year, we’ll bring you a different fire code compliance issue that is commonly encountered in Ontario communities… an ounce of prevention is definitely worth a pound of cure in these instances. STREET PARKING BY-LAW REMINDER No person shall park a motor vehicle or permit a motor vehicle to remain parked on any highway in the Town of Gravenhurst between the hours of 12:00 am to 7:00 am. This by-law allows Town operators to provide effective winter maintenance on Gravenhurst roadways for full snow removal operations and improve operational efficiencies
