Richard K. Riegelman, MD, MPH, PhD is Professor of Epidemiology-Biostatistics, Medicine, and Health Policy, and Founding Dean of The George Washington University School of Public Health and Health Services. Dr. Riegelman has taken a lead role in developing the Educated Citizen and Public Health initiative which has brought together arts and sciences and public health education associations to implement the Institute of Medicine of the National Academies recommendation that “…all undergraduates should have access to education in public health.” Dr. Riegelman also led the development of the George Washington University’s undergraduate Public Health major and minor and currently teaches “Public Health 101” and “Epidemiology 101” to undergraduates.

Whether the ACA’s individual coverage requirement (also referred to as the individual mandate) is a tax for purposes of the Anti-Injunction Act. 2. Whether Congress has the power under Article I of the Constitution to enact the minimum coverage requirement. 3. Whether, if the coverage requirement is found unconstitutional, it is “severable” from the remainder of the ACA. 4. Whether the ACA’s requirement that states expand Medicaid eligibility or risk losing federal funds is unduly coercive in violation of the Tenth Amendment. In this blog post, the first of a four-part series, I focus on the first question. The next post will focus on questions two and
The Anti-Injunction Act (AIA) is an 1867 federal statute that states “no suit for the purpose of restraining the assessment or collection of any tax shall be maintained in any court by any person, whether or not such person is the person against whom such tax was assessed.” Essentially, the law requires that a person resisting the assessment of a federal tax must first pay the full amount of tax assessed by the Internal Revenue Service before filing challenging the tax in an administrative hearing or in court. Because the ACA’s minimum coverage requirement is enforced through a penalty that is assessed under the tax code, the Court agreed to consider whether a challenge to the coverage requirement could be entertained by the courts before 2015, when the coverage requirement penalty will first be assessed. In other words, the Court will decide whether it yet has the jurisdiction (i.e., the power) to rule on the constitutionality of the cover-
Assuming the Court dispatches the AIA question, the Court has a few options at its disposal, each of which was raised during oral argument by one party or another. One approach would be to rule that since Congress called the amount to be owed in the event that an individual refuses to comply with the minimum coverage requirement a “penalty” instead of a “tax,” Congress envisioned the ACA as being excluded from AIA applicability. A second approach available to the Court is to rule that the AIA can be waived by the courts as a matter of equity, because the law is not a total bar to hearing preassessed tax lawsuits. Interpreted this way, the AIA is designed to prevent individuals from bringing facial challenges against tax laws, rather than existing to prevent courts absolutely from hearing claims against pre-assessed taxes. We shouldn’t wait until people are in post-graduate programs to introduce them to applied teamwork (Nash, 2008; Newell, 1990). That road leads to disappointment. Habits of doing everything alone have been instilled and teaching teamwork must undo many of these “I can do it all” or “I should do it all” attitudes. Teamwork education must begin at the undergraduate level and continue through graduate school and beyond (Drake, Goldsmith, & Strachan, 2006; Lerner, Magrane, & Friedman, 2009). Once employed, our graduates will be judged by their supervisors and colleagues on their ability to be team players. In healthcare, lives literally depend on good teamwork (Sehgal, Fox, Vidyarthi, Sharpe, Gearhart, Bookwalter, Baker, Aldredge, Blegen, & Wachter, 2008). So, how can instructors encourage effective teamwork participation in the online environment? Here are some tried and true methods I have used you can apply to your courses. Post a syllabus that explicitly addresses the value of teamwork and the rubrics by which students will be judged. Students want and deserve to know what they need

only by the instructor. There are a number of teamwork rubrics; I happen to like the one I created with my colleagues (Buchbinder, Cox, & Casciani, 2012, p. 374). The tool addresses key criteria for successful team players, including: attendance, preparation, collaboration and goal identification, active participation, open-mindedness and willingness to modify opinions, concise presentation of ideas, timely submission of assignments, respectful and considerate interactions with teammates, fulfillment of responsibilities, and active work on achievement of group consensus. Used as an Excel file, students can easily total up the scores. Students are required to explain why they gave a teammate a score of under 3 or over 8 on a scale of 1 to 10. They must also indicate whether they would work with this person again (Yes/
No) (Buchbinder, Cox, & Casciani, 2012, p. 374). Establish ground rules for netiquette. Most universities have guidelines for student civility and for respectful online interaction with instructors and peers. Place these guidelines in your syllabus and separately in your online course, and make a point of referring students to these documents. If a student behaves inappropriately later on, he or she cannot claim ignorance. Do not allow the students to self-assign to teams. Just as you have students who will congregate in face to face courses, alliances will appear in online courses. Students often “see” each other again and again in online courses and know how their colleagues interact. As the instructor, it is up to you to assign students to teams. You can do this by alphabet or by random number generator, but however you do it, make sure the assignment is transparent to the students. Remember, students always look for equity in the classroom. Teams can be for the duration of the course, or for one project, but you set up the teams. With every evolutionary change in health care over the past 30 to 35 years, there has often been a pause and the question of whether marketing may still be necessary or relevant. In the 1960s and through most of the 1970s, the United States existed in a healthcare delivery system where the reimbursement model was fee-for-service. The value of marketing was to attract paying patients. Dr. Berkowitz:

The focus was on going after employers in more of an industrial marketing model. Personal selling to the corporate buyer was a major focus of activity. In the later ‘90s, the shift was away from HMOs to managed care and contractual medicine where contracts were being made more with insurers and hospitals. The focus shifted as many hospitals began to form large health systems and promotion of these health systems was a key as they had contracts.
Now, will there be any future role for marketing? It may be greater than ever! While the reform legislation has yet to fully play out, some accountable care organizations have formed at some larger group practices around the country. In many respects these entities are again being responsible for managing the health care of individuals (they are accountable for their care).
