President’s Message President

I can’t believe I am already beginning the start of my 2nd year as the President of your organization. I am looking forward to continuing our initiatives and to provide a pathway for our board and future boards that will represent our organization. The 2014/2015 year is going to be a busy one. We will be focusing on a limited amount of initiatives this year and hope to accomplish them by end of this term year.

We are working on developing our scholarship program into a partnership with one of Suffolk County’s largest universities along with the Trusted Choice brand. This could allow us to introduce the future leaders of our industry to the Independent Agents system along with the Trusted Choice Brand. We are going to be working closely with the Downstate Council to enhance the Insurance Industry. With the addition of the PIA into the council we are all going to work towards a common

the President’s Message cont’d goal while at the same time execute our individual initiatives. This is an exciting time. I also want to encourage all of our members to sign up and join other agents and brokers at the 1st NYiDAY event being held in New York City on October 28, 2014. This event is a going to provide our members with resources that we would not normally have access to in this kind of environment. Our state organization IIABNY has put a lot of thought and planning into the event and it promises to benefit your agency into the future. Please make sure you sign up and join us. Lastly, please remember this is your organization, and your participation with this organization is what makes it successful. Please participate and support us throughout the year and join us for our meetings. We welcome your involvement.

installed new officers and directors for the 2014 through 2015 term. Over 90 IIABSC members and guests attended the May 29 event which took place at the East Wind Conference center, Wading River, NY. Richard A. Poppa, President & CEO of the Independent Insurance Agents & Brokers of New York, Inc. performed the installation ceremony along with Michael Bentivegna, husband of the newly installed president.

Joanne Bentivegna, CIC, CRM, of JB Consulting was re-elected as the

took place on Thursday, May 15th at the Hyatt Place in Riverhead which is part of the Atlantis aquarium. The current Chair of the Board, Andrew Kaufman, handed his baton over to Jim Sutton. Jim was installed as Chair of the Board to serve the 2014 – 2015 term. Laura Senn nnn

The room was crowded with many

supporters of IIABNY who were there to thank Andy Kaufman and congratulate Jim Sutton. Andy thanked everyone for their contribution during the year and Jim accepted this new responsibility with the promise of doing everything in his power to represent the Independent Agent and thanking us for the opportunity and honor.

There were also many well-deserved awards

presented. Stephen R. Zogby of Scalzo, Zogby & Wittig received the Vincent Alba award for his outstanding contribution to the political effectiveness of IIABNY. 20

CIC led the list of officers elected yesterday by IIABNY members. The association installed Sutton as chair of the board at its 132nd Annual Business Meeting, held at The Hyatt Place in Riverhead. Members also elected and installed new regional and district directors for the 2014-2015 term. •

Sutton, CEO and president of

James F. Sutton Agency Ltd. in East Islip, has served IIABNY as its chair-elect, secretary-treasurer and as a regional director representing the association’s members in the New York City metropolitan and suburban parts of the state. He has also served on the association’s Independent Agent Branding Committee, Audit Committee, a committee to further the independent agent Trusted Choice ® brand, and on a committee to raise funds for the InsurPac national political action committee.

Sutton is a past president of the IIAB of Suffolk County and the

Downstate Insurance Associations Council, as well as a past chair of the New York/New Jersey NorthStar Agents Council for Encompass Insurance. Has also been an active volunteer in his community, with leadership roles in the Rotary Club of Islip, the Islip Arts Council, the East Islip Chamber of Commerce, the Community Association Institute of Long Island, and local parochial schools.

In his acceptance speech, Sutton warned of growing threats against

agents and brokers, including: • An onslaught of advertising by insurance companies that sell without the involvement of agents • Increasing merger activity • The popularity of purchasing insurance via the Internet • Insurance companies selling through multiple distribution channels

“The local agent and the independent agent channel are undergoing

dramatic change and not all agents will survive the transition,” he said. To counter these threats, he encouraged independent agents and brokers to support the Trusted Choice® brand. He also urged them to participate in Project CAP, an effort to help agents market through the Internet.

Sutton also discussed political and regulatory issues on the horizon, such as

the looming expiration of the federal Terrorism Risk Insurance Program, the precarious market for homeowners insurance in coastal areas, and ongoing problems with certificates of insurance. “IIABNY’s advocacy efforts are another prime example of why we can’t go it alone,” he said. “It is critical to our livelihood that the association is there in Albany and Washington to represent us.”

Other officers elected and re-elected to IIABNY’s executive committee for

one-year terms included: • R. Todd Rockefeller, vice-president of DeRosa, Rockefeller, Sohigian, Werdal, Inc. in Harrison, elected chair-elect. • Jack Smith, CPCU, ARM, CIC, executive vice president for the William A. Smith & Son agency in Newburgh, elected secretary-treasurer. • Michael Vanderwerker, president of Assured SKCG, Inc. in Peekskill, New York to represent the New York City metro and suburban areas; • Kevin R. Crossley, vice president of AAA New York Insurance Services, Inc. in Garden City, also to represent New York City metropolitan and suburban areas; • Karen Peters, CPCU, vice-president of Rose & Kiernan, Inc. in Albany, to represent the state’s Capitol District and areas north;

in Albany, New York, won a two-year term as an at-large member representative on the Nominating Committee, which evaluates candidates for leadership positions and makes recommendations to the membership.

Earlier in the day, the IIABNY board of directors elected Jana Critchfield

of Wright Insurance Group (owned by Brown & Brown, Inc.), St. Petersburg, Florida; Lawrence Pistell, ARM of St. Johns University in New York City; and Jeanne Salvatore of the Insurance Information Institute, also in New York City, to one-year terms as at-large directors.

IIABNY Applauds Assembly Passage of Certificates of Insurance Bill

The Independent Insurance Agents & Brokers of New York today

commended the New York State Assembly for passing a bill to reform the use of certificates of insurance. The Assembly approved the measure, Senate Bill 6545-A, on June 10, 2014.

IIABNY Chair of the Board James D. Sutton, CPCU, AAI, CIC said,

“This is a good day for law-abiding insurance agents and brokers. This bill, carefully crafted to address Gov. Cuomo’s concerns, will prevent agents and brokers from having to make an impossible choice – violating the law or losing a valued client.”

Certificates of insurance are one- or two-page forms that businesses

commonly give other businesses or government entities for which they are doing work. These forms summarize the terms of the insurance policies the businesses have purchased.

In recent years, insurance producers in New York and throughout the

U.S. have reported increasing demands from many organizations that producers make statements on certificates to change a policy’s terms. Organizations often insist that certificates promise lengthy advance notice if the insurance company or the insured business cancels the policy or makes major changes.

Another common demand is for guarantees of complete coverage for

indemnity agreements between the organization and the insured business. 38

Insurance producers who comply with these demands risk breaking

insurance law and incurring fines for issuing fraudulent certificates. Those who refuse risk losing customers.

IIABNY played a key role in drafting the legislation, sponsored by

Insurance Committee Chair Sen. James L. Seward (R-Milford)and Assembly Majority Leader Joseph D. Morelle (D-Irondequoit). The association also worked with other interested groups to resolve differences over the wording. The resulting bill would prohibit a number of practices, including: • Altering or modifying a certificate of insurance • Requesting the issuance of a certificate that contains false or misleading information • Issuing a certificate that changes the terms or coverage provided by the insurance policy • Issuing an opinion letter or similar document that violates any of these other prohibitions, and

IIABNY Applauds Assembly Passage of Certificates of Insurance Bill con’t • Requiring forms other than standard forms created by the Association for Cooperative Operations Research and Development (ACORD) or the Insurance Services Office (ISO).

A similar bill passed both chambers of the legislature in 2013. Gov.

Andrew Cuomo vetoed it out of concerns that generic certificate forms might not meet the needs of state agencies. The new bill requires the use of industrystandard certificate forms. However, it also permits forms created by state agencies if the New York State Department of Financial Services (DFS) has approved them.

“We recognize Gov. Cuomo’s concerns regarding state agencies’ desire to

use their own certificate forms,” Sutton said. “That is why we have worked closely with his staff to devise legislation that will alleviate those worries. This measure permits state agencies to continue using their own certificate forms. Doing so in partnership with the DFS will ensure that the forms do not place insurance producers in legal jeopardy.”

“We wish to thank the bill sponsors and the leadership of both the

Senate and the Assembly for their swift, decisive action on this bill,” Sutton continued. “Since it addresses the issue that the governor saw in the previous version, we urge him to sign it into law as soon as possible.”

Other Noteworthy Insurance Legislation Passed by NYS Lawmakers During 2014

Annual Wage Notice. (S.5885/A.8106C) eliminates the requirement

contained in the Wage Theft Prevention Act that employers provide a wage notice to all employees by Feb. 1 of each year. Employers in New York will no longer have to issue annual wage notices to employees in 2015 and beyond. The bill also increases the penalties for an employer’s failure to provide a wage notice upon hiring a new employee and for an employer’s failure to provide appropriate wage statements to employees. And, it imposes significant consequences on employers who are found to be repeat offenders.

Fire Appraisal. (A.9346A/S.4756A) makes changes to the fire

appraisal process under the Standard Fire Policy. Current law provides that an appraisal will be limited to determining the actual cash value and/or the replacement cost or amount of the loss. The bill adds to the list, a determination of the “extent of the loss or damage and the amount of the loss or damage.” And, it includes language to clarify that coverage disputes would not be subject to the process.

Out-of-state enrollees. (A.9175A/S.6505B) amends the insurance

law to facilitate internet enrollment of an employee who is a resident of this state and who is applying to be covered under a group life, health or annuity contract that has been issued to an out-of-state employer by an insurer that is otherwise not authorized to transact business in this state.

Health Insurance Offering. (S.6960/A.9208) would allow the DFS

to permit health insurers to satisfy the requirement that they sell off the New York State Health Benefit Exchange the same policies that they sell on the exchange through another entity within the insurer's holding company system.

Life Insurance Disclosures. (A.9458A/S.4374A) authorizes the DFS

to develop an alternative to the disclosure requirements for certain life insurance policy provisions. Current law only allows such disclosure to be put forth in red ink, capital letters and 12-point font.

Life Insurance Guaranty Corporation. (A9915/S.7320) amends

the Insurance Law in order to eliminate the cap on assessments that may be imposed against member insurers of the Life Insurance Company Guaranty Corporation of New York (the "Corporation") and make other changes.

Accelerated Death Benefit. (S.6672A/A.8957A) expands the types of

end-of-life care that can be financed by an accelerated death benefit rider attached to a life insurance policy. End-of-life care would include care provided for by a long-term home health care provider, hospice or adult day care services or palliative care. Such long-term care would need to have been provided for at least three months or more, with the expectation that the beneficiary will continue to require such services until death.

Domestic Mutual Insurer Agreements. (S.3539A/A4833A) would

allow the DFS to permit a domestic mutual insurer to enter into certain into 43

Workers’ Comp Board Reporting. (S.7693/A.9986) requires that

the state Workers' Compensation Board provide the New York City Employees' Retirement System with information relating to workers’ compensation benefits awarded to retirees whose pension benefit payments are subject to an offset.

Workers’ Compensation Providers. (A.5299B/S.2360B) Authorizes

licensed clinical social workers to treat injured employees under the workers' compensation program.

Telehealth coverage. (S.7852/A.9129) Requires insurers to cover

telehealth and telemedicine services.

Substance Abuse coverage. (S.7912/A.10164) is one in a package of

bills to address the growing heroin addiction problem. The bill requires insurers to use peer-reviewed, nationally recognized clinical review criteria when making decisions regarding the medical necessity of treatment. In addition, medical necessity decisions will be made by medical professionals who specialize in behavioral health and substance use. Individuals requiring treatment would have access to an expedited appeals process and would not be denied care while the appeals process is underway.
