Government publishes draft Building Safety Bill The draft Building Safety Bill, published earlier this week, sets out a stringent new safety regime for higher risk residential buildings (HRRBs), backed by a powerful new Building Safety Regulator. The government bill creates new responsibilities for the construction teams of new builds and the landlords of existing HRRBs over 18m or six storeys in England and Wales. It is backed by the threat of criminal sanctions if new statutory duties – such as submitting adequate safety cases or ignoring compliance notices – are not fulfilled. Failure to comply could see dutyholders face two years in prison or an unlimited fine. Running to 334 pages, the draft bill incorporates the recommendations of Dame Judith Hackitt’s Independent Review of Building Regulations and Fire Safety following the Grenfell Tower fire on 14 June 2017, where gaps in regulatory oversight led to failings that ultimately claimed 72 lives. The draft text will now be scrutinised by a Parliamentary committee, and further consultations could also be held before measures are finalised. Responding to the bill, IOSH construction group chair Malcolm Shiels CFIOSH said: ‘Maybe you could argue there is too much emphasis on punitive measures. However if organisations or projects do not willingly look to improve and at times continue to place people, individually and collectively, at risk of harm, then those heavy punitive measures will be needed.’ But he also urged construction professionals to get behind the new bill. ‘If the construction industry does not grasp the nettle this time after a disaster such as Grenfell, and all the good work since then in getting to this point of the draft bill being published, and then the building safety regulations being published and enacted, it will be devastatingly disappointing.’ The new bill outlines the scope of the Building Safety Regulator, the branch of the HSE that will scrutinise the ‘safety cases’ submitted by HRRB construction teams at three design gateways, issuing ‘stop’ notices if the information is not acceptable. The new regulator will also oversee all registered building inspectors (covering local authority building control teams and those working in the private sector) and set up a new mandatory reporting system for structural and fire safety breaches. Construction dutyholders – including principal designers, principal contractors and building safety managers – will also have to create, store and update a ‘golden thread’ of building and product information through the three design
‘gateways’, then maintain it throughout the building’s lifecycle. Katherine Metcalfe, legal director at law firm Pinsent Masons, described the bill as a ‘complete regulatory overhaul [that will] signal a new era in the way we build’. She added: ‘New duties are created for organisations and individuals, backed up by penalties equivalent to health and safety law. Enforcement of the building regulations for the whole of the built environment will be strengthened by increasing time limits for enforcement [to 10 years], and the penalties for non-compliance.’ Katherine also welcomed the new regulator’s role in overseeing building control teams’ performance, saying that it ‘should improve consistency geographically, and also between local authority and private sector inspectors’. In further responsibilities, the Building Safety Regulator will set up a Buildings Advisory Committee, replacing the Building Regulations Advisory Committee for England, and will establish an industry-led ‘competence committee’ to oversee the construction industry’s efforts to raise the bar on professional standards. Katherine added: ‘Competence is a key issue, and central to making the new system work. New competence requirements will apply to all of the proposed new roles, as well as to a wider range of professionals and tradespeople. The new regulator will hold and maintain a register of competent principal designers, principal contractors and building safety managers.’ The HRRB landlord or its agent – known as the Accountable Person – will also be required to appoint a competent Building Safety Manager to manage fire and structural safety risks in the building day to day. ‘It is good to see that the government now accepts that an organisation can act as the Building Safety Manager, albeit that there must be a named individual within the organisation with responsibility for the building,’ noted Katherine. ‘A diverse set of skills will be required to carry out the role and it may prove relatively rare for one individual to possess all of them. ‘Important questions remain about the basis upon which the HSE might veto the appointment of a Building Safety Manager, and the availability of suitable insurance,’ she concluded.

MENTAL HEALTH STILL SIDELINED, POLL REVEALS More than half of UK workers do not have access to mental health support at work, a new survey has revealed.
Despite one in six workers suffering from a mental health condition and a rise of reported incidents of mental illness in employees, the poll found that 55.7% of people working in UK businesses don’t have access to mental health support, or even know if their business has policies to support workers with mental illness. Earlier this month, HSE Network asked a cross-section of more than 1500 workers from various sectors and job roles, across the UK if their workplace had policies for helping staff with mental health. Just 45% said yes, a fifth (21%) said no and 34% said they didn’t know.
Commenting on the survey results, HSE Network founder Paul Clarke said he sees the problem as a misunderstanding at a fundamental level. ‘People who don’t suffer with a mental health problem themselves, don’t always recognise or address it. There is real misunderstanding with mental health. If you have someone with an addiction problem with [alcohol] for example, they can’t just put the drink down. It’s an illness. We don’t have the people in positions of power, from the government level and in certain businesses, who share the right understanding of mental health and mental illness.’
Paul said there is an urgency to address mental health policies in businesses with the added pressures of working during the COVID-19 pandemic. ‘Mental health problems are triggered or compounded by remoteness and uncertainty.’ Due to this, he believes, mental health impacts in employment are expected to rise. ‘There is unhappiness, anxiety, uncertainty and we are often driven by the wrong values, obsessed with status. We need a shift in consciousness and a shift in culture to see a real change to reduce fear, anxiety and stress.’

COVID SPOT CHECKS RAMP UP FOR THE HSE The Health and Safety Executive (HSE) is carrying out spot checks on businesses that have reopened since the UK went into lockdown. The UK regulator’s inspectors are visiting workplaces across a range of sectors following up any reports or concerns about safety in the workplace including over COVID-19 and ensuring compliance. They are also carrying out proactive checks to ensure that appropriate measures are in place to protect workers from COVID-19, the safety authority confirmed to IOSH magazine. Between 9 March and 29 June, the HSE received 23,569 COVID-related contacts, of which 7784 were COVID-related concerns, 9944 were COVID-related calls and 5871 were COVID-related advice requests.
Of the 3856 businesses contacted between 26 May and 2 July, 2386 spot checks were carried out by a mixture of phone checks and site visits. The phone checks included obtaining visual evidence such as photos and video footage. Out of nearly 4000 spot checks, 295 were follow ups to check on issues with cleaning regimes, social distancing as well as failure to engage with the regulator. All but 41 of these were deemed compliant after the second check. The remaining 41 are currently subject to inspector visits and further investigation.
‘Putting dutyholders on the spot, and checking on how they are managing risks, has always been part of our regulatory approach,’ said an HSE spokesperson. ‘This has continued to be the case throughout the pandemic. We’ve responded to workplace concerns and are inspecting some workplaces in response. This will continue as more businesses return to work.’ Last week we reported on the HSE’s latest annual fatality statistics, which revealed that workplace deaths have halved in the past two decades. However, the 2019/20 figures do not include RIDDOR-reportable deaths linked to contracting COVID-19 in the workplace, as these will be counted alongside other deaths from occupational disease. ‘With the virus prevalent in the community at large it is very difficult to be certain that an individual case of the disease resulted from occupational exposure,’ the HSE said in a statement to IOSH magazine. Cases reported are those which employers suspect could be due to an occupational exposure. The HSE plans to publish data on work-related COVID-19 deaths ‘at a later date’. ‘We want to publish this data on number of cases reported to the enforcing authorities where occupational exposure is suspected as the cause given the considerable public interest and are working hard to do so as soon as possible,’ the spokesperson told us.

FEVER DETECTION SYSTEM TO HELP ENSURE RETURN TO ‘NORMAL’ LIFE As the world tries to find ways to safely return to work in the midst of the Covid-19 pandemic, a new system designed to automatically test body temperature is adding an important technological contribution in the ongoing war against the virus. FeverTIR is a thermography system which quickly and accurately measures people’s body temperature without any need for contact. With a fever being one of the main symptoms of Covid-19 infection (as well as many other contagious diseases), organisations are looking to ways in which employees and other building users can be screened for possible infection. Many of the existing potential methods are labour-intensive, time-consuming and expensive but by adapting a system originally designed to detect temperature in monitoring for potential fires, a ‘plug & play’ solution has been developed which is available in the UK from Reading based company Patol. The system features a high-precision thermal detector with a visible full HD camera which simultaneously measures a person’s core body temperature. This data is accurate to within 0.3°C, supported by a traceable calibration certificate – an important factor when there are alternative technologies on the market which are unproven. The suitability of the system for medical use is illustrated by FeverTIR meeting the ISO IEC 80601-2-59 Medical Electrical Equipment – Part 2-59 standard. This specifically addresses the basic
safety and essential performance requirements of screening thermographs for human febrile temperature screening. Patol Sales Director, Kelvin Miller, comments – “while we are in no way suggesting this is a panacea, it can be a very useful contributor to a more effective and safer return to the life that we knew pre-Covid-19. The cameras can be used in a wide range of applications, including large office buildings, hospitals, retail complexes, airports, construction sites and
hotels – in fact anywhere in which large numbers of people gather and a quick and accurate snapshot of their respective body temperatures could provide an indicator of potential infection.” FeverTIR features a special calibration temperature range for measuring facial temperature, offering prealarms and alarms with on-screen notification. It provides real-time hot-spot analysis and can be easily integrated with other safety and security systems. Go-ahead for ground breaking new £150m mental health facilities at springfield university hospital South West London and St George’s Mental Health NHS Trust (SWLSTG) has today announced that it has secured government approval to start work on its two new state-of-the-art facilities for south west Londoners. This multi-million-pound development will see the construction of two new mental health facilities set to open in 2022 on its largest site in Tooting, south London. This includes eight new inpatient wards which will be further boosted by the modernisation of the Trust’s community services. SWLSTG has already started construction work on this programme, which will include new housing and a 32-acre public park (the first of its kind since the 2012 London Olympics). The Trust has now formally signed contracts for the delivery of the Springfield University Hospital development with Springfield and Tolworth Estate Partnership (STEP), a 50/50 partnership between Sir Robert McAlpine Capital Ventures
Ltd and Kajima Partnerships. STEP will act as master developer for the site with Sir Robert McAlpine Ltd as main contractor for the new mental health units and the park, surrounding public realm and infrastructure. This huge milestone in the Trust’s Estate Modernisation Programme marks a once-in-a-generation opportunity to transform the way the SWLSTG delivers mental health services for 1.1m south west Londoners. The Trust received government approval for its Full Business Case for the development following extensive engagement with the Department of Health and Social Care, NHS Improvement, NHS England and Her Majesty’s Treasury.
