MOUNTAIN VIEW PARK HOMEOWNERS ASSOCIATION GENERAL RULES The following are rules established by the Board of Directors (the board) of the MVP Homeowners Association as empowered by the Articles of Incorporation, the Declaration and the Bylaws of the Homeowners Association. They are intended to help provide a secure, well maintained and comfortable environment that will be as conflict free as possible for current and future use while protecting and increasing our property values. Refer also to the “Recreational Vehicle (RV) Parking Area Rules” and “Swimming Pool and Spa Rules” The following rules apply to all homeowners, residents and renters, and their families, guests, or employees. Continued or repeated violations of these rules or of the “Declaration” or “By-laws” may result in suspension of the homeowner’s voting rights in the association, suspension of the homeowner’s use of the recreational facilities of the association, or monetary fines assessed against the homeowner/property, or a combination of the above. COMMON AREAS – GENERAL 1.
The paths, parking spaces, streets and other facilities of the Common Area are for the use and enjoyment of residents of Mountain View Park and their guests only. Unauthorized persons may be prosecuted for trespassing.
2.
The curfew in the common areas of Mountain View Park is 11:00 P.M. for all persons under 18 years of age.
3.
Trash and debris shall not be discarded in the Common Areas.
4.
No personal property shall be left or stored in the Common Areas.
5.
Damage to any facilities of the Common Areas, including trees and shrubs will be assessed against the owner of the lot whose residents or guests are responsible for the damage.
6.
Throwing of rocks, use of B-B guns or any air-powered gun, firearms, slingshots, archery equipment, golf balls and similar items, which can be dangerous to other people, animals and property, is prohibited.
7.
Horses, or other livestock, and unauthorized vehicles are prohibited in the Common Areas.
8.
The use of motorized riding toys and non-street legal motorcycles is prohibited in the Common Areas. Street legal motorcycles are permitted only for entering and leaving the premises via the most direct route to the homeowner’s residence. Motorized carts for medical purposes are permitted.

9.
Bicycle, tricycle, and other non-motorized toys or means of transportation are permitted, providing that caution is used and that the right-of-way is yielded to pedestrians at all times. These items are not permitted in the Sports Court.
10.
The posted speed limit of 15 miles per hour throughout the park, and corner stop signs are to be observed at all times by all motorized vehicles. LOTS AND HOMES
1.
No changes or additions may be made to the exterior of the homes or lots without prior written approval of the Architectural Review Committee.
2.
Fences shall be no taller than six feet in height, be constructed from cedar wood, and be of the “good neighbor” type which is defined as: the rails do not face the street; slats are on alternate sides of fence i.e., only 50% of the rails are visible from the street or neighbors yard; or, the slats are solid – rails not visible from the street or neighbors yard. They may be constructed in the backyard and sideyard areas of a lot only. No fences shall be built in the front yard area of a lot beyond the front of the house or garage. It is highly recommended that fences be stained with a quality, natural color, wood preservative. Although this is not required, it will provide for best appearance and longevity.
3.
No owner, resident, or guest shall make or permit any disturbing noises to be made, or anything to be done on the premises which interferes with the rights, comfort, or convenience of other owners or residents.
4.
No owner, resident, or guest shall play or allow to be played, any musical instruments – either live, recorded, or broadcast – between the hours of 11:00 PM and 8:00 AM which would disturb or annoy other owners or residents.
5.
Trash and recycle cans must be stored either in resident’s garages or behind approved fences/screening to prevent them from being visible from the street or neighbor’s yard.
6.
Residents are responsible for the pruning of all shrubs and trees throughout their property and the weeding of side and back yards. Front lawns are mowed, edged, fertilized, etc., by a contractor hired by the HOA board. Non-grass areas in front yards are weeded by the contractor. Arrangements may be made with the contractor for additional work throughout each lot by the homeowner.
7.
Holiday decorations on the outside of homes shall be removed within 30 days following the holiday.
VEHICLES – GENERAL Mountain View Park has two Common Area parking sections – referred to as the Sports Court Area and the Pool Parking Area. The ‘Declarations of Mountain View Park’ preclude ongoing resident parking in common areas as well as precluding the use of common areas to store vehicles. All common area parking spots are for short term visitors only. General Rules, Page 2 of 4

Each lot in Mountain View Park is considered to have four parking spaces – a two-car garage and a minimum of two parking spaces in the driveway. Vehicles in violation of the following rules will be posted. Failure to correct the cited violation may result in the vehicle being towed away at the owner’s expense. 1.
Homeowner or resident parking in common areas is prohibited. The exception being when one of the above desires to use the pool or sports court, they may park at the pool or sports court for the time of the facility use.
2.
Guest parking in the Common Areas is limited to 48 hours. Homeowners or residents expecting guests for longer than 48 hours may contact a Board member for special permission provided no vehicle storage is involved.
3.
No vehicle shall be parked in another resident’s driveway without that resident’s permission.
4.
No vehicle shall be parked in such a manner as to impede or prevent entry or exit from another resident’s driveway.
5.
Vehicles are not to be parked on any lawn/landscaped areas. Vehicle parking on concrete or gravel pads adjacent to garages is allowed – space permitting.
6.
No major repairs or restoration of any vehicle shall be done on any driveway or lot or in the Common Areas.
7.
No vehicle shall be parked in a non-operative condition in any driveway, on any street, or in any parking space in the Common Areas. STREET PARKING – RVs AND OTHER VEHICLES
1.
All streets are FIRE LANES, as law requires 20 feet of paved access for emergency vehicle access. Each home in Mountain View Park is constructed with a two-car garage and each driveway is adequate to accommodate at least two additional vehicles. Additional homeowner’s or resident’s vehicles may be parked in a neighbor’s driveway with the permission of that property owner. Immediate short term visitors may park in the street areas for periods less than overnight provided the driver is immediately available to move the vehicle for emergency vehicle response. Other guest overflow parking are the Common Areas which are addressed in the rules under ‘PARKING – GENERAL’ above.
2.
Service vehicles that do not fit in the driveway may be parked curbside provided the driver is immediately available to move the vehicle.
3.
Overnight parking of any vehicle on the streets of Mountain View Park is prohibited.

4.
Fire marshal regulations prohibit street parking of RVs due to the narrow width of our streets. This applies to both guests and homeowners. However, the fire marshal recognizes the need for homeowners to load and unload RVs prior to, and after trips, but states that they need to be expedient in this task and be ready to move at the sight of emergency vehicles. No overnight parking. Do not leave the premises while a RV is parked in front of your house without a qualified driver available. Guest RVs may be parked for short periods at the pool (October – May) or sports court parking areas with board approval. No special permit is required for less than a 48-hour stay. DRIVEWAY PARKING – RVs, TRAILERS, BOATS, ETC.
Resident RV parking is permitted in driveways that are of sufficient size to accommodate the RVs but is limited to four days prior to and after trips. Likewise, guest RV parking is limited to four days per occurrence in homeowner’s driveways of sufficient size. Permanent parking or storage of RVs, trailers, boats, etc. is not permitted in Mt. View Park driveways. PETS 1.
Dogs and cats, not to exceed a total of two each, are allowed provided they do not annoy or disturb other residents.
2.
Dogs and cats must be either carried or on a leash while off of the homeowner’s property and are not allowed in the fenced, swimming pool area or sports court enclosure.
3.
Owners are responsible for cleaning up after their pets or those of their guests and visitors, on the lots, streets and in the common areas, and are responsible for any damage caused by their pets and those of their guests and visitors. GARAGE SALES Individual garage sales are limited to two per year, lasting no more than three days. Exceptions are death or proven, severe hardship. Individual garage sales impact the security of all residents, may be in violation of sign rules and may violate City of Bend Fire Ordinances. Street parking rules must be followed. COMPLIANCY ACTION
The Mt. View Park Homeowners Association “Violations and Fine Policy” outlines the verbal and written notification process and possible fines for non-compliance with rules and regulations.
