terms and conditions: All sales are subject to the approval of DEEOHS Footwear’s terms and conditions as set forth below. Terms are 50% percent with order confirmation and 50% net thirty (30) days for all approved orders unless otherwise stated. 1.
ORDERS All orders are subject to acceptance by DEEOHS Footwear. Such acceptance is conditional upon customer’s acceptance of these terms and conditions. A purchase order issued by the ordering retailer is required to process the order.
2.
ORDER DEADLINES All orders must be received no later than the order line as set forth by DEEOHS Footwear. All orders must include relevant information specified in the catalog such as, but not limited to: style numbers, size runs, quantity, colors and price. Any information relevant to the customer such as customer specific requirements or special instructions should be provided to DEEOHS Footwear in writing thirty (30) days of the invoice date.
3.
PRICES Orders are invoiced at the prices prevailing at the time of the shipment.
4.
TERMS OF SALE All DEEOHS Footwear goods shall be sold F.O.B. shipping point. No deductions are allowed for freight, parcel post, or UPS / FedEx charges, DEEOHS Footwear shall have the right to immediatly terminate customer’s ability, if any, to purchase on credit or otherwise at any time DEEOHS Footwear sole discretion.
5.
CANCELLATION Any request for cancellation of any orders must be made in writing to DEEOHS Footwear within thrity (30) days after customer has placed its order and its subject to DEEOHS Footwear’s approval.
6.
LOSS OR DAMAGE IN TRANSIT DEEOHS Footwear shal not be responsible for goods lost or damaged in transit. Customer will be responsible for checking its shipment upon delivery for total carton count or condition. Any shortage or evidence of damage must be noted on carrier’s delivery receipt and reported to the carrier’s local office. All claims must be filed with the carrier within forty-five (45) days from the date of loss or damage.
7.
RETURNS All returns must be pre-approved in writing by an authorized DEEOHS Footwear sales or customer service representative. Returns received after expiration date or without written authorization shall be refused. All return freight charges and any re-stocking fees shall be paid by the customer.
8.
LIMITATION ON DAMAGES DEEOHS Footwear shall not be liable for any loss or profit, interruption of business or any other special consequential or incidental damages suffered by the customer.
9.
MODIFICATIONS No supplement, modifications, or amendment of these “Terms and Conditions” shall be binding unless executed in writing and approved by DEEOHS Footwear.
10.
RESTRICTIONS ON PURCHASES Customer shall not purchase DEEOHS Footwear goods from any source than DEEOHS Footwear. Customer shall not sell or otherwise transfer, transship, or sell DEEOHS Footwear goods to another retailer, distributor, or broker. Customer shall not sell through mail, catalog, internet, or other electronic means without the express consent of DEEOHS Footwear. Violation of these conditions may result in termination of customer’s account.
11.
ADVERTISING Customers shall submit all advertising of DEEOHS Footwear goods and / or brand name and logo to DEEOHS Footwear for approval. All prices and designs are subject to change. All catalog content © 2015-2016. All rights reserved
