According to the Mississippi Department of Wildlife, Fisheries, and Parks, the state’s whitetail deer herd is smaller than it was last year as hunters prepared to take the field. And, that is a good thing. “Our deer population last year was high — extremely high; ridiculously high,” said Lann Wilf, leader of the MDWFP’s Deer Program. Wilf said the whitetail deer numbers have decreased of late due to natural causes (hemorrhagic disease, especially in Southwest Mississippi) and new deer-management practices. While the herd is smaller, the deer are larger. The average age of a buck shot in Mississippi last year was 3.25 years old. The bigger bucks taken have elevated Mississippi to one of the prime spots in the United States to take a trophy animal. In the June/July issue of Outdoor Life, Mississippi made the top 10 for places to shoot a trophy whitetail, coming in at number seven. No other state in the Southeast made the top 10. “Every year there are stories about which state has become the latest trophy whitetail destination, but frankly the equation has been wrong all along,” says Andrew McKean, editor of Outdoor Life. “If you only look at the total number of deer killed, it gives an unfair advantage to states with high numbers of hunters and deer. When you’re considering investing the time and money it can often take to go on a trophy hunt it’s important to consider all the factors to get the most accurate picture, which is what we’ve done.” But, Wilf said due to Mississippi’s longer season and more liberal bag limit, the state would place higher, and he gives the credit to education. “We have the most educated hunters in the nation, without a doubt,” Wilf said. “Our hunters and biologists have crafted a deer program that is second to none.” And, a new study completed by Mississippi State University’s Deer Lab has further boosted optimism that this could be a record year for whitetail deer hunters. Just this month, researchers with the Deer Lab released the results of a survey that found while deer in other parts of the country, particularly the North, have bigger bodies, they do not have bigger antlers. When it comes to trophy racks, environment and habitat trump geography and latitude. Mississippi’s large agriculture base is key. “Antler size is known to be highly correlated with body size,” said Dr. Steve Demarais, who is also a Dale H. Arner professor of wildlife ecology in the Forest and Wildlife Research Center. “However, our research further proves that agricultural areas with rich soil provide more food for deer, leading to deer with larger bodies, independent of their latitude.” That means good soil and agricultural crops lead to larger deer with bigger antlers. Places with rich soil, such as the Mississippi Delta and the bread basket states, produce deer with big bodies and big antlers. Dr. Bronson Strickland, associate Extension professor and researcher in the Forest and Wildlife Research Center, said soybean crops contribute the most to deer size. White-tailed deer eat only the seed of grain crops like corn, but they eat all parts of soybean plants, which are grown on rich soil. This gives them the nutrients required to grow larger bodies. Archery season opens next month (Oct. 1 in Delta and Hill zones; Oct. 15 in Southeast Zone). Youth gun season begins Nov. 9. The bag limit on antlered buck deer is one buck per day, not to exceed three per license year. Legal bucks must meet the antler criteria within the appropriate deer management zone. For youth hunters (15 years of age and younger) hunting on private land and authorized state and federal lands, all of the three buck bag limit may be any antlered deer. The bag limit on antlerless deer is one per day, not to exceed five per license year. Antlerless deer are defined as any female deer and any male deer without hardened antler above the hairline. For decades now, the Deer Ecology and Management Lab at Mississippi State University has been conducting cutting-edge research into the understanding of whitetail deer and what they require to grow and prosper. The work is well-known among biologists and researchers, but outside of academia the lab’s work is generally unknown. However, the Deer Lab’s tag as one of Mississippi State’s best-kept secrets is under siege. The lab, a unit of Mississippi State’s Forest and Wildlife Research Center, has recently launched a new website (www.msudeerlab.com) in an attempt by those who have deer under the microscope to feed information to those who routinely see deer through a rifle scope. “We just launched the new website,” said Dr. Bronson Strickland, an associate Mississippi State University Extension Service professor and researcher in the university’s Forest and Wildlife Research Center. “What we are attempting to do is get information out of the lab and into people’s hands so they can use it to formulate good deermanagement practices and decisions.” The deer research program at Mississippi State University began with the arrival of Dr. Dave Guynn and Dr. Harry Jacobson in the mid-1970s. The synergism between these two young research biologists spawned many unique projects that generated national attention. Guynn
would eventually leave the lab, but Jacobson expanded the breadth of deer research projects over a 20-year career. Dr. Steve Demarais, who earned his doctoral degree with Harry and subsequently worked as a deer specialist in Texas, replaced Jacobson. Today, he is the Dale H. Arner professor of wildlife ecology in the Forest and Wildlife Research Center. After training at the Caesar Kleberg Wildlife Research Institute in Texas, Strickland contributed to the deer research program as a research associate for six years and joined the faculty of the Department of Wildlife, Fisheries and Aquaculture in 2006. Dr. Jerry Belant, a carnivore and deer specialist with extensive experience in northern regions, joined the department in 2008. Currently, 13 MSU graduate students flush out the staff of the Deer Lab. The Mississippi Department of Wildlife, Fisheries, and Parks is one of the lab’s chief collaborators. Lann Wilf, leader of the department’s Deer Program and whose area of responsibility includes nearly half of the state’s counties, said, “The work they are doing there at the Deer Lab is absolutely instrumental and the work we are doing in the field,” adding that the lab’s researchers deserve a large part of the credit for Mississippi’s deermanagement efforts being consistently ranked among the top in the United States. U.S. Supreme Court schedules oral argument for Hood’s price-fixing lawsuit By CLAY CHANDLER I STAFF WRITER clay.chandler@msbusiness.com
The U.S. Supreme Court will hear oral arguments in November related to Attorney General Jim Hood’s price-fixing lawsuit against liquid crystal display (LCD) screen manufacturers. In 2011, Hood sued the companies, accusing them of price-fixing from December 2006 to April 2011. He claimed the companies of forcing consumers to pay too much for their products, in violation of the Mississippi Consumer Protection Act. LCD screens are used in computers and televisions. Hood brought the action in Hinds County Chancery Court, under the parens patriae theory, which allows a state’s top law enforcement officer to sue on behalf of his constituents. The defendants removed the case from chancery court to Mississippi’s Southern District federal court. In court filings, defendants argued that the Class Action Fairness Act, passed by Congress in 2005, allowed the change in venue because the plaintiffs were the people of Mississippi,

not Hood. The CAFA defines a “mass action” as litigation with a lot of plaintiffs, similar to class action lawsuits. The law allows for the removal of mass actions to federal court. Hood countered that the case, since it arose out of the parens patriae theory, belonged in state court. Federal judge Carlton Reeves of Jackson agreed with Hood, and sent the case back to chancery court. The defendants appealed to the Fifth Circuit Court of Appeals, which ruled that the case belonged in federal court. The Fifth Circuit is the only federal appeals court to rule that consumer protection litigation brought on behalf of a state belongs in federal court, and not state court. The

appeals court issued a similar ruling relating to consumer protection litigation brought by Louisiana’s attorney general against Allstate Insurance Co. Due to the split, the U.S. Supreme Court ruled on May 28 that it would hear the case. The justices will determine who the actual plaintiff is – Hood, or the people he sued LCD manufacturers on behalf of. Their ruling will likely determine the venue of future consumer protection litigation brought under the parens patriae theory. “We are pleased that the court granted the state’s petition and look forward to having the case heard on the merits,” Hood

said in June in an email to the Mississippi Business Journal. “Corporations have abused federal jurisdiction by using the Class Action Fairness Act to remove consumer actions from state court to federal court. During Senate debate on the Class Action Fairness Act, even the senators supporting the act stated on the record that it would not apply to actions brought by attorneys general. I anticipate a vast majority of attorneys general joining in an amicus brief supporting our position, which three Federal Circuit Courts of Appeals upheld.” Consumer interest group Public Citizen has filed an amicus brief in support of Hood’s position. The Washington, D.C.based group was active in the process to pass the CAFA. In the brief, Public Citizen says the removal of parens patriae cases to federal “departs from the plain language and intent” of the law. Forty-six states have filed briefs supporting Hood’s position to go with the AARP and the Center for State Enforcement of Antitrust and Consumer Protection Laws. The case name is Mississippi ex rel. Hood v. AU Optronics.

among others. As example, to meet land owners’ and managers’ concerns the lab conducted a study on coyote’s impact on deer numbers. The common perception was that increasing coyote numbers was having a drastic effect on deer numbers due to fawn predation. “Landowners would see one coyote and immediately get out their guns and traps and look to thin them out,” Strickland said. However, lab scientists, who looked at sites across Mississippi and into Alabama found no correlation between coyote numbers and deer herd size. Instead, they found habitat was the key, not less coyotes. The most recent study into the body and antler size of whitetails has garnered national attention. Lab scientists spent approximately six months gathering harvested deer information from across the country to determine where trophy deer were more likely to be found and why. Research conducted by Mississippi State University Deer Lab scientists has determined northern deer may have bigger bodies but they don’t necessarily have bigger antlers. The discovery showed that antler size depends more on diet than latitude. “In white-tailed deer, large antlers are generally found on deer with large bodies. However, the

largest antler measurements were found in the Midwestern states and not the far North, as commonly believed,” said Strickland. Strickland, a Georgia native who had a childhood fascination with wildlife biology that landed him at Mississippi State, said he is just as proud of the lab’s work in generation the next generation of deer biologists as he is the research they are conducting. “It’s very rewarding — to be a part of educating young students is truly an honor,” he said. “We’re doing great work here. Now, we just want more people to know about it.”

Mississippi ends Q2 with 18.3% of home mortgages underwater; another 6.2% at risk of falling there Nearly one in four Mississippi homeowners ended the second quarter owing more on their homes than the homes were worth, California-based real estate survey and data analysis firm CoreLogic reports. While Mississippi showed a negative equity rate of 18.3 percent for the quarter, home mortgages underwater nationally decreased to 14.5 percent from the previous quarter's 14.56 percent, CoreLogic reports. In its national survey, CoreLogic found that about 2.5 million more residential properties returned to a state of positive equity during the second quarter, and the total number of mortgaged residential properties with equity currently stands at 41.5 million. The analysis shows that 7.1 million homes were still in negative equity at the end of the quarter. The first quarter ended with 9.6 million homes, or 19.7 percent of all mortgaged residential properties, with mortgages underwater. The bulk of home equity for mortgaged properties is concentrated at the high end of the housing market. For example, 91 percent of homes valued at greater than $200,000 have equity compared with 80 percent of homes valued at less than $200,000, CoreLogic notes. Pirates and Rogues: Employee theft of trade secrets and proprietary information
I
n the mid-18th century, an owner of a merchant vessel on the high seas would clearly know when his ship came under pirate attack. In the modern workplace, the theft of an employer’s treasure, i.e. trade secrets and customer data, is much less obvious but just as devastating. This type of piracy is most likely to be carried out by a trusted and supposedly honest employee, usually for the benefit of a business competitor or to assist the employee in setting up his own competing business. It is a type of employee theft that is increasingly common in Mississippi and nationwide. According to a 2013 survey conducted by computer security software company Symantec, more than half of departing employees retained confidential information belonging to their former employer. An alarming 40 percent planned to use such misappropriated trade secrets in their new jobs. Trade secret theft costs American business billions of dollars each year and companies such as Intel and General Motors are among those who have recently sustained serious losses at the hands of former employees. However, businesses of any size can fall victim to such misappropriation. While there is no sure-fire protection from the rare dishonest employee, employers should have some basic policies in place to prevent, or at least deter any would-be workplace pirates. One of the easiest ways to prevent employees from stealing your company’s confidential information is to simply have them contractually agree in advance not to do it. If properly drafted and implemented, restrictive covenants such as noncompetition or
nondisclosure agreements are enforceable in Mississippi and allow an employer to assert a breach of contract claim and other remedies against a noncompliant former employee. In a recent survey, 92 percent of the responding companies reported that they had employees using their personal devices for work. However only 44 percent of those organizations had “bring your own device” or “BYOD” policies that regulated the use of personal devices in the workplace. There is nothing inherently wrong with the increasingly common practice of allowing employees to use their personal devices, but without a policy in place, employers are opening the door to trade secret misappropriation. While a BYOD policy should be individually tailored to the type of business, some common features include requiring that all devices be preapproved, that the employee agree in writing to all security and acceptable business use provisions, including specific prohibitions against copying and forwarding of confidential information. A good BYOD policy also should include a written agreement, signed by the employee, stating that the company’s IT department will be allowed to inspect and delete all confidential information from the device when the employee leaves the company. Unfortunately for many employers, such policies are implemented only after the employer has been victimized. The most immediate step to prevent any further losses is by “locking the digital door”, i.e. terminating any remote access privileges or user
Mark Fijman credentials the former employee might have to the company’s computer network. Employers should confer with legal counsel and retained computer forensic specialists to assess the extent of the theft and determine what legal options are available. While it is tempting for a company to rely on its in-house IT personnel to look for evidence of computer piracy, it is always advisable to have an outside expert do the job. They typically have the specialized training and software to analyze the data without altering the contents or operating parameters of the devices and drives in question. This preserves the evidence for any litigation. Depending on the individual circumstances, legal options can include injunctive relief, such as a temporary restraining order or bringing an action under the Mississippi Uniform Trade Secrets Act or the federal Computer Fraud and Abuse Act. If the dishonest employee is sufficiently highly placed in the company, a cause of action for breach of fiduciary duty also may exist. Other possible claims might include breach of contract, tortious interference and civil conspiracy. A cause of action also might exist against a former employee’s new employer if the stolen trade secrets are being utilized for the benefit of the other company.

OSHA cites Delta oil mill for 25 violations Federal work safety regulators have slapped the more than half-century old Delta Oil Mill with a $83,415 fine after discovering 25 safety and health violations at the cottonseed oil plant. The U.S. Department of Labor’s Occupational Safety and Health Administration initiated its inspection in May after receiving a complaint alleging a worker sustained a back injury after falling through a floor opening and landing on a powered industrial truck. The workplace safety agency termed 22 of the 25 violations as “serious” The “serious” infractions included failing to guard wall openings, opened-sided platforms and floor holes without a cover or standard railings. Regulators further cited the plant for failing to keep floors clean and dry of water and cotton lint and not providing specific procedures for controlling hazardous energy. The list of violations also includes: »Failing to document certification of periodic inspections of the energy control procedures; »Failing to train employees on the company’s lockout/tagout program; provide training on electrical safety work practices; »Failure to implement written electrical safety work practice procedures;
»Failure to post signage and safety symbols to warn employees of electrical hazards; »Failure to provide employees confined space training before entering a railcar; »Failure to inform workers of the hazards they face before entering a railcar. »Allowing employees to use a forklift inappropriately to elevate workers; »Allowing workers to enter a railcar without a retrieval line attached to the body harness; »Blocking access to electrical boxes and several instances of unguarded equipment. OSHA said it terms a serious violation an instance in which there is substantial probability that death or serious physical harm could result from a hazard about which the employer knew or should have known. Three other-than-serious violations were also cited. OSHA said in these instances the mill did not have an OSHA 300-A form certified by a company executive and failed to ensure workers were wearing hearing protection. Delta Oil Mill is a manufacturer of cottonseed oil, cottonseed meal, cottonseed hulls, linters, cottonseed meal fertilizer and whole cottonseed. What to do about abandoned, rundown properties in your town
A
bandoned, rundown properties are a challenge to neighbors, the local government and the community at large. Dealing with them is a complicated issue, but there are strategies that can be employed to deal with the situation. Detroit’s current housing situation is certainly the poster city for urban blight. A picture of an overgrown lot with a burned-out house has replaced the photo of the gleaming downtown skyline as the image of “The Motor City.” With over 80,000 vacant houses and some streets overgrown with vines Detroit is representative of what can happen when extreme urban blight occurs. The City of Detroit is employing a variety of strategies to raze abandoned properties. Some are successful; others not so. Although Detroit represents a worst-case scenario, it is important that every neighborhood and local government deal as soon as possible with abandoned properties. For the neighborhood itself, the main reason is very simple: Abandoned, rundown properties contribute to a decline in surrounding property values. As every real estate appraiser knows, the most important influence on the value of a parcel of real estate is the property next to it. So what can be done? The residents of the neighborhood where a property becomes abandoned are typically the first to notice that something is wrong. The house is vacant, the yard is unkept and overgrown and lack of maintenance is becoming evident. The first step the neighbors might want to do is check with the local recorder of deeds - the chancery clerk in Mississippi - and find out who owns the property. Most abandoned residential properties go through the stages of owners, then renters and then abandonment. Understanding who owns the property and why the owner al-
lowed it to become vacant is the first step. Owners of abandoned properties come in all shapes and sizes. Some are absentee owners who have moved away and simply abandoned the property. Some are lenders who have foreclosed on the property or are waiting to foreclose on the property because the borrower has stopped making payments and cannot be located. Others are heirs of the previous owner and may not even know that they own the property. Sometimes the owner dies without any heirs, and the property eventually escheats to the state. All of these situations, and more, result in a property that is setting vacant and deteriorating as time passes by. Once the owner has been determined, a representative of the neighborhood should contact the owner to learn the intention of the owner. If the owner is interested in refurbishing the property or tearing down the property the neighborhood should offer whatever assistance might be available. Ideally, the owner will follow through so that all live in peace and harmony ever after as property values rise in the neighborhood. Unfortunately, that seldom happens. If the owner can be found, but is not responsive to working with the neighborhood to solve the problem, the next step is to meet with the local governing authority’s code enforcement office for the purpose of bringing it to the attention of the local government. The appropriate authorities can then begin their process of notices, cleanup and billing the owner. Because of legal notice requirements this can become a lengthy process as the property continues its increasingly rapid morphing into even greater deterioration. Sly owners, aka slumlords, are adept at using legal notice requirements to delay the process. One common method is to deed the property to someone else so that the legal process will have to begin all over again. The

new owner will then deed it back to the first owner as the cycle goes on. If the above actions do not result in positive action then a second sometimes effective strategy is to bring public attention to the matter by contacting the local media. Television stations, in particular, seem to be interested in showcasing abandoned, overgrown properties and letting the public know who owns them. Such cases make for good “before and after” stories. Along the same lines, one frustrated neighborhood finally began putting up signs in front of such properties stating, “This property is owned by ...” That strategy can be effective if the property owner is local and is influenced by shame. The real problem with dealing with abandoned, overgrown properties seems to be procedural. Property rights are a fundamental part of society in the United States. Government intervention in property ownership is anathema to many, if not most, people. The U.S. Constitution and that of most states provides that private property may not be taken by the government except for a public purpose and not without adequate compensation to the owner. That authority is the basis for public notices and procedures. Unfortunately, owners of abandoned, overgrown properties can use these legal safeguards to their advantage, and to the frustration of local authorities and neighborhoods. As efforts continue to balance private property rights with neighborhood improvement it remains that the property itself continues to deteriorate. It seems that the best strategy for a neighborhood and for local authorities is to catch the abandonment in the early stages and deal vigorously with the situation. While the legal industry has bottlenecked in recent years amid a recovering economy, Neely and Stracener hope to grow their practice and over time add additional staff. “It appears lawyers generally are making less money comparatively than they were before I entered the profession,” Neely says. “On the flip side, the legal profession is not and will never go away.” Neely often volunteers on pro bono cases for clients that cannot afford an attorney. He also enjoys spending time with his wife and 16-month-old daughter, playing tennis, running, cooking, reading, and traveling. “Get to work doing something,” Neely advises young legal professionals, “There is work out there; just get yourself into some courtrooms and you’ll find that there is work for you to do.” — By Stephen McDill

Kosko, M.D. of Southern Bone and Joint Specialists, P.A., a fellowship-trained orthopaedic foot and ankle surgeon, was awarded board certification by the American Board of Orthopaedic Surgery. Kosko, a Greenwood native, graduated summa cum laude in biological engineering from Mississippi State University. He received his doctor of medicine degree magna cum laude from Kosko the University of Mississippi School of Medicine. He completed an orthopaedic residency from the University of Mississippi Medical Center. At UMC, he received the Department of Orthopedics OITE Award, Resident Research Award, Citizenship Award and Best Orthopaedic Teaching Resident. He completed a fellowship in foot and ankle reconstruction from OrthoCarolina Foot and Ankle Institute in Charlotte, N.C. He is a member of the American Orthopedic Foot and Ankle Society, American Academy of Orthopedic Surgeons and Mississippi Orthopaedic Society. Kosko was a visiting medical student to the University of Oxford and the Nuffield Orthopaedic Center in Oxford, England. He completed an AO Fellowship in Luzern, Switzerland. Kosko and his wife Kendy have three children.

As a senior associate at Wyatt, Barker will concentrate her practice in the areas of government and public officials’ liability, labor and employment law and general litigation. Barker comes to Wyatt from the Jackson City Attorney’s Office, where she Barker represented the City of Jackson in litigation of all civil matters in state and federal court. Prior to joining the City Attorney’s Office in 2007, Barker was an attorney with Whittington & McGehee in McComb and Page, Mannino, Peresich & McDermott, PLLC, in Biloxi. Barker received her law degree in 2003 from the Mississippi College School of Law, where she received the American Jurisprudence Award for Wills and Estates, and participated in Moot Court. She received her bachelor of arts degree in political science from Southeastern Louisiana University, where she held a Presidential Honors Scholarship and was a member of Phi Kappa Phi Honor Society.

The University of Southern Mississippi Gulf Coast recently held its faculty orientation for eight new faculty members who will be teaching at the university’s Gulf Park campus in Long Beach. Keeping our eye on... ANDREW NEELY On most resumes, “previous work experience” probably doesn’t include teaching English in Costa Rica. That’s exactly what Andrew Neely did for a year and a half during college. “I taught to all kinds of business professionals and everyday folks wanting to improve their language skills,” Neely says. The experience gave the Jackson native an interest in international law, and after earning a double major in business administration and Spanish, Neely pursued a law degree from Mississippi College in Jackson. Along with law partner Eric Stracener, Neely handles insurance disputes and personal injury litigation as well as some probate practice. “I have a feeling people often start with one goal in mind and end up in a different place. Lansford edits book Dr. Tom Lansford, academic dean and professor of political science at the University of Southern Mississippi Gulf Coast, was editor for the “Political Handbook of the World 2013.” The 2013 edition was 1,848 pages in length and contained updated information on the composition of governments, the evolution of major and minor political parties and groups, and significant events within each country or organization. Between 2004 and 2010, Lansford was an associate editor of the publication. He served as co-editor, along with Thomas C. Muller and Judith F. Isacoff, for the 2012 “Political Handbook of the World” before becoming sole editor for the 2013 edition.
Rogers wins award Phillip C. Rogers, a civil engineer with the U.S. Army Corps of Engineers Vicksburg District’s Engineering Division, recently received a Commander’s Special Emphasis Award at the District’s ninth annual Founder’s Day ceremony. Rogers received the award for his service and dedication for exceptional achievement of his assigned duties in the support of the War on Terrorism. During his deployment to Rogers the Transatlantic District South, Kandahar Afghanistan, he managed four military construction (MILCON) contracts totaling $55 million. He successfully completed the 451st Air Expeditionary Wing Intel, and Operations and Maintenance Facility. He also provided oversight and coordination for the MILCON M20 North Airfield Road and Utilities project during the critical final connections of the power distribution system. He began his career with the District in 2009 as a civil engineer in the architectural, civil, mechanical, and electrical branch of Engineering and Construction Division. He is a member of the American Society of Civil Engineers. A native of Oxford, Rogers earned his bachelor of science degree in civil engineering from the University of Mississippi. Burton appointed to commission State Sen. Terry Burton (R-Newton) has been appointed to the Southern Regional Education Board's Commission on Career and Technical Education. Burton, who represents Mississippi on the SREB, is chairman of the Senate Universities and Colleges Committee and serves on the Appropriations Committee. He represents Senate District 31, which includes Newton County and parts of Lauderdale and Scott counties. Burton was appointed to the commission by SREB chairman Gov. Steve Beshear of Kentucky.
Brown to lead EMA Troy D. Brown Sr. has been hired as director of the Greenwood-Leflore Emergency Management Agency. The Leflore County Board of Supervisors approved his hiring this week after interviewing four candidates. Brown has been a project officer with the Federal Emergency Management Agency for eight years.

Construction of museums just few weeks away
» Contract for 1st phase of Mississippi Museum of History, Civil Rights Museum to be awarded Sept. 26 By TED CARTER I STAFF WRITER ted.carter@msbusiness.com
The State of Mississippi is scheduled to select a general contractor Sept. 26 for phase one of a pair of museums whose construction is projected to run $80 million. The contract award — which could go as high as $40 million — is a prelude to an Oct. 24 groundbreaking for the long-awaited Mississippi Museum of History and the accompanying Mississippi Civil Rights Museum on Situated on Old Capitol Green, one will house the story of the Magnolia State through its pre-Columbian past, its evolution as an agrarian region with the arrival of the first European settlers and on to today's emergence as a diverse and innovative manufacturing center. The other will chronicle the decades-long struggle of African Americans for such basic rights as voting and the enjoyment of previously “whites only” public accommodations. The first phase gets the shell built and completion of exterior landscaping for the complex to be built between North and Jefferson streets, said Kevin Upchurch, executive director of the Mississippi Department of Finance & Administration, the state agency overseeing the bidding as well as the up-coming construction. “We anticipate the shell will be completed in May of 2015,” Upchurch said, and added the $30-million buildout phase should begin the following month. However, that next phase will require additional money, he added. The DFA will ask legislators to put the $30 million for the build-out phase in the 2014 general bond bill, according to Upchurch. The state is expected to pitch in another $10 million to-

Private fund-raising will soon be under way to cover the remaining cost of the exhibits, museum officials say. Corporate sponsorships of exhibits will be sought as well, they say. The museums will share common areas and a 200-space below-ground garage but otherwise will be distinct in appearance and in the exhibits featured, said Lucy Allen, director of the Museum Division of the Mississippi Department of Archives and History and the official in charge of choosing the exhibits that tens of thousands of
In total, the museum complex will encompass more than 300,000 square feet. A ground-breaking ceremony is slated for next month, and the target completion for the museum’s shell is May 2015.
visitors will view upon the opening of the museums in Mississippi's bi-centennial year of 2017. In total, the museums and their common space will cover 319,000 square feet on four floors. Shared space includes the lobby, meeting rooms and an auditorium that will seat 300 and catering kitchen. The second floor will be reserved for a pair of halls to accommodate temporary exhibits. A hall will be dedicated to each museum, though the design will allow for the halls to present combined exhibits. The 131,733 square-foot history museum, in the planning stage since the late 1990s, will come as a continuation of the nearby William F. Winter Archives and History Building, the Old Capitol and the War Museum, sharing the limestone and brick exterior appearance of its neighboring buildings, said Jackson architect James Eley, whose firm Eley Guild Hardy Architects& Engineers joined with the Jackson firms of Cooke Douglass Farr Lemon Architects & Engineers and Dale Partners Architects to design the history museum. Design work on the Museum of History had been substantially completed but underwent a revamp after state leaders decided to add the Civil Rights Museum. “We kept a lot of the original design,” Eley said. The job of designing the 74,670 square-foot Civil Rights museum went to the Freelon Group of Durham, N.C. While it, too, will have a limestone and brick exterior, its outside walls will include terra cotta “used in a very modern way,” Eley said. The Freelon Group, he said, “used a lot of metaphor in its design” and drew from the Civil Rights Movement. Visitors will enter the complex through a two-story See

An electric power association and a trade organization have asked the Mississippi
Public Service Commission to reconsider the energy efficiency rules regulators adopted in July. South Mississippi Electric Power Association and the Electric Power Associations of Mississippi said in documents filed with the commission that state law may render the efficiency rules inapplicable to electric power associations.
Specifically, the motion to rehear and reconsider the efficiency rules question whether the Mississippi Public Utilities Act of 1956, which establishes PSC jurisdiction over electric power associations, allows that jurisdiction to extend to the associations’ rates. The documents say rate regulation “is limited to circumstances involving intrastate

business and property of public utilities and when where service is rendered to the member as a consumer in a municipality. “As a result of the foregoing, and since it is impossible to implement an energy efficiency program without a rate impact, SMEPA and its Members are exempted from the regulation of the Commission in the area of Conservation and Energy Efficiency programs and implementation, thus exempted from compliance with Rule 29,� the documents continue. The energy and efficiency rules regulators adopted over the summer were the result of more than three years of study and input from stakeholders. Upon their adoption, commissioners said they would benefit ratepayers by instituting operational mandates on utilities that would maximize efficiency in energy production and distribution. Among the mandates are that electric and gas utilities implement energy efficiency programs. The rules also require utilities to make available to their ratepayers technical, financial and educational resources and incentives related to energy efficiency. An economic impact statement conducted over the course of the commission’s formulating the rules said that the rules would have a positive effect on consumers, and especially small businesses. SMEPA and EPAs of Mississippi argue that since the costs of the mandates imposed on utilities can, with PSC approval, be put into their rate bases, the rules constitute a rate regulation, therefore exempting them from the guidelines imposed. The documents go on to say that SMEPA has already instituted its own set of energy efficiency programs. Listed as an example is SMEPA’s Comfort Advantage initiative, which the association says has added 25,000 energy efficient homes to meters served by SMEPA’s member cooperatives. “SMEPA and its Members have been active in developing additional energy efficiency programs without PCS regulation,� the documents state. “Before the PSC publicly addressed energy efficiency and considered energy efficiency regulation, SMEPA was moving forward with its Energy Efficiency Potential Study and Pilot Programs that will develop into long-term energy efficiency programs. The programs SMEPA implements will be available to all customers, not just a focused few, will make good economic sense for both the rate payer and the utility and will help SMEPA avoid or delay adding expensive new generating capacity.� Tacking the new rules onto those existing programs would make them no more effective, SMEPA says in its filings. One year old and growing » Appellate Practice Section seeks to increase advocacy in state’s appellate courts By LYNN LOFTON I CONTRIBUTOR mbj@msbusiness.com
Just one year old, the Appellate Practice Section of the Mississippi Bar Association has approximately 100 members and is running smoothly. It was started to increase the level of advocacy in the state’s appellate courts. These court decisions affect all Mississippians – decisions regarding business issues, family law, custodial matters and capital punishment. “In Mississippi, as in every jurisdiction, appellate courts decide issues that apply to everyone; not just the person in a particular case,” said Michael Bentley, current chairman of this section of the Mississippi Bar. “Lawyers play a key role, and we want the best, most skilled lawyers and want the issues fully vetted because these decisions also affect future cases.” John Henegan was instrumental in starting the section and served as the first chairman. He says the division has provided a useful service to the courts. “It has created a forum for the exchange of ideas and work related to effective appellate practice techniques as to writing and what courts require in writing and oral briefs,” he said. Henegan, who practices with the Butler Snow firm, says the courts did not request the establishment of this section but have been supportive. “At least two members from the court of appeals come each time and take part in our meetings,” he said. “They’re genuinely interested in supporting this section. We’ve also been pleasantly surprised at the number of members who’ve responded and are interested in increasing their skills. We hope to have more members involved.” Bentley was also involved in establishing the section after he and others looked at other state bars. “We thought it was important for Mississippi to set one up because today it takes a different set of skills and types of experiences for appeals. Much of it takes place in written briefs to distill issues,” he said. “Clear and concise writing is needed; not persuasive skills.” An attorney with the Bradley Arant firm, Bentley says the division gives lawyers a go-

One recent seminar included four judges who participated in a question-and-answer session. “Our members liked hearing directly from judges. They were very receptive and found it beneficial,” he added. Two important things came from the seminar. “First is how critical it is to effectively present your case in writing, and second, when you do get to oral arguments, the necessity of being prepared to discuss
everything in your brief – it’s not just a 10minute speech,” Bentley said. A fact that may be surprising for those not in the legal profession is that the court of appeals decides more than 1,000 cases a year, but only 70 to 80 make it to oral arguments. “Therefore, it’s important in writing briefs to cut to the chase and make it clear,” Bentley said. Henegan says the ultimate goal is for members of the bar to understand what
court judges want to help them make difficult choices. “We’re blessed with the members of the court we have,” he said. “They take it seriously; they’re energetic and have a great work ethic. The want to pull the bar along with them to be part of the team and help serve the public through better briefs and arguments. It’s helpful for them to get together with people who appear before the court on a regular basis.”

Ben Claxton has a bit of a different background for a law school student. Now in his second year at the Mississippi College School of Law, Claxton played for the NFL for nine years before injuries forced his retirement. Claxton, 33, won many awards as center on the University of Mississippi football team. While he was in college, he had aspirations of being able to play professional football, but knew there were steep odds.
“There is just so much talent,” said Claxton, who played on the Rebels team with his twin brother, John. “You are reminded of that throughout your time in college, just how difficult it is to make it Claxton to the next level. So, obviously, it was an extreme high point when I was drafted in the fifth round by the Denver Broncos.” But Claxton didn’t even get to play his first game with the Broncos. In training

camp during a routine practice drill, someone rolled up on his leg, which tore cartilage and ligaments in his knee. “That effectively ended my stay in Denver,” Claxton said. “I immediately had surgery, but it took a year to completely recover. I bounced around with a couple of teams because I really wanted to play again. I ended up the year with Tampa Bay, and they sent me to NFL Europe, which was the development program the NFL had at the time for guys in similar situations.” The spring he was in Europe he was fortunate enough to play in the World Bowl,
the championship game. His team, the Berlin Thunder, ended up winning. “It was a wonderful experience,” Claxton said. “The stresses of playing over there were nothing like the standard NFL season we have over here. It was a much more laid back experience. We would usually be done mid afternoon, so we would be able to get out and experience the cities and sightsee. Sometimes we had one or two days off. It was a really interesting experience. I had a great time.” See

The next highlight was being picked up by the Atlanta Falcons. Being from Georgia, that was like winning the lottery for Claxton. “I grew up a Falcons’ fan,” he said. “So when I was signed by the Falcons, it was a dream come true. I was with them a little shy of three years. I played center in college, and center and guard in the NFL. I was mostly a guard with the Falcons.” The second season Claxton suffered a serious injury, and was placed on the injured reserve list. He basically missed the whole season due to that injury. The next year after the Falcons hired a new coach, the coach revamped the roster and Claxton was released. He was a couple of years on the mend, and the last substantial stop he had was with the Arizona Cardinals. “The injuries take their toll,” Claxton said. “There is a cumulative effect. At the end of my time in Arizona, I spent more time in the training room than on the field. That is when I knew it was time to hang it up.” Coming back to Mississippi was an easy decision. He loved it at Ole Miss, and had a wonderful experience there. His wife, Haley Claxton, worked in Jack-

son, so he would spend the off seasons with her in Jackson. “I enjoyed it,” he said. “I made a lot of friends. I didn’t give it a second thought. When I retired from the NFL, it was where I wanted to be.” Claxton had law school in the back of his mind during those years in the NFL. He knew that the average career in the NFL is only three years. “It isn’t a substantial amount of time you can expect,” he said. “Certainly there are guys who have played longer, but that is not the norm. “I knew when I got done playing football I wasn’t going to retire and kick back and do nothing. And certain experiences
through my playing days made me realize how valuable a law degree could be.” Claxton hasn’t decided on a legal specialty yet. “I want to be as open as I can be,” he said. MC Law Dean Jim Rosenblatt said they are pleased to have Claxton at MC Law. “He is a serious student and has done well here academically and is an active part of our student body,” Rosenblatt said. “We value and recruit those prospective law students who participated in varsity or professional athletics. Athletes have a leg up in terms of their background and preparation for law school. They possess time management skills, understand team play, know the taste of victory and disappointment, are familiar with goal setting and planning, and have been yelled at before.” Rosenblatt said Claxton came to them highly recommended. In addition to being a scholar and athlete in college, he was active in a variety of organizations and advanced a number of charitable causes. “I am confident he will make an effective attorney and will be a leader in his community,” Rosenblatt said. “It is MC Law's honor to afford Ben his legal education.” Claxton has been named to the MC Law Review, a major tribute.

The merger preparations between Jackson CPA firms Haddox Reid Burkes & Calhoun and Eubank Betts Hirn Wood is on schedule to be finalized by late October, officials with both firms said. Paul Calhoun, who will be the managing partner of the blended firm, doesn’t expect to skip a beat when they begin operating under the new name Haddox Reid Eubank Betts. “I think because we are very similar in our nature in terms of our values and the way we do business that a number of issues that would be present in a merger won’t be as big a challenge with us,” Calhoun said. “Our people are trained to use the same type of audit software, tax software and research software so we feel like the bringing of the two practices together is going to be a lot smoother than it otherwise might be.”

ABERDEEN — Federal public defenders George L. Lucas and Gregory S. Park have asked a judge to replace them as attorneys for James Everett Dutschke of Tupelo, who is charged with mailing ricin-laced letters to President Obama and others. The two, in federal court documents filed yesterday, cite an undisclosed conflict with another client in the public defender’s office. A judge has not ruled on the motion. Dutschke is scheduled for trial Oct. 7 in U.S. District Court in Aberdeen. Dutschke is a former martial arts instructor arrested in late April after federal investigator claimed they linked him to letters mailed to Obama, U.S. Sen. Roger Wicker of Tupelo and Lee County Justice Court Judge Sadie Holland. Dutschke has pleaded not guilty. He remains in the Lafayette County jail without bond.

Kitchen Brothers selling shuttered sawmills UTICA — Equity Partners CRB and Heritage Global Partners have been retained to sell three hardwood sawmills on behalf of Kitchens Brothers Manufacturing Company. Equity Partners is seeking bids for each mill in its entirety through late October, with any remaining assets to be offered at auction in November by Heritage. When the housing market collapsed and lumber prices fell to an all-time low, the company was forced to close two facilities and reduce its workforce in an attempt to survive. After struggling to continue operations and injecting substantial personal capital into the company, Kitchens Brothers ceased operations at all three locations on Nov. 28, 2012. Ownership is hopeful that the ultimate buyer of the business will want to resume operations and continue to serve the customer base, as well as bring jobs back to the area. This illumination symbolizes individual and community light that shines on the heroic struggles, provides a venue for dialogue, and illuminates a common path forward.” Further, the promotional material notes, “A stunning sculpture honoring civil rights veterans will be the focus of this dramatic light-filled space.”

Allen said she is working with an exhibit design firm “on what the story is that needs to be told.” When that job is done, “We will know where every case, light, electric plug-in, photograph and graphic display is to be,” she added. Fabricators are building the larger exhibits and installing the extensive electronics necessary to make them function interactively. “It will probably take them about a year to do that,” Allen said of the exhibit building. “They will bring them to the museums on flat-bed trucks. The rest will be built on site.” The fabrication work will run parallel with the build-out phase that begins in 2015, according to Allen. Before the opening a couple of thousand artifacts must be put into exhibit cases, each requiring a special mount, she said. A mountain of work is ahead, but for Allen, Eley, Upchurch and others who have spent so much time getting the project to this point, a great amount of gratification will come with the Oct. 24 groundbreaking. “Once they put the hole in the ground,” said Allen, some important stories will soon be told.

Giving others credit Pharr believes effective leaders should shun glory-seeking
I
n my study of leaders, I have found a simple but common theme — they CARE. They think beyond themselves and work for the greater good. They have a servant mindset and want to elevate others. Some leaders extend their sphere of influence to impact the communities around them as well. They take an interest in civic matters and use their knowledge, skills, and motivation to make a difference. Business leaders who are civically engaged are the bedrock of a community. They serve on boards, engage with politicians to cast vision, and provide financial support for charitable organizations. These humble leaders agree with Harry S. Truman’s quote, “It is amazing what you can accomplish if you do not care who gets the credit.” I am inspired and appreciative of these leaders who spend their discretionary time choosing to serve the common good for all of us. David Pharr is one of those civicminded leaders. Pharr founded his own law firm in 2012 after rising to equity partner with a large regional law firm. Pharr grew up in Jackson and earned his undergraduate degree at Millsaps College before obtaining his law degree from Ole Miss. He shared, “One of the reasons I wanted to become a lawyer was that so many effective community leaders were lawyers.” Pharr believes that leadership is about building consensus around clearly defined goals and

I accomplish more with teams when I willfully ignore the question of who is getting credit for a positive outcome. I can't say I'm always great at this but when I reflect on collaborative projects, it is often clear that success hinged on a leader's willingness to forgo credit for a major contribution.”
In addition to a busy life as a successful lawyer, husband to his wife, Michelle, who is a physician, and his role as father, Pharr invests himself in making Jackson a better place. He has served in leadership roles with the Greater Jackson Chamber Partnership, the Jackson Chamber of Commerce and the Central Mississippi Planning and Development District to name a few. One of the projects he is most engaged with right now is Alignment Jackson, which is a new group

focused on providing an education support framework. Pharr is also active in the Fondren community and is in the process of developing commercial property in that area. Pharr shared, “In Martin Willoughby starting my law practice and working on real estate development in Fondren, I have met the future leaders of the creative economy in Jackson. These are bright people in their 20's and early 30's who have faced serious challenges and their leadership response has been incredibly resourceful.” Pharr went on to note, “I am inspired by their courage and innovation, and they make me hopeful about the future of Jackson.” For growing leaders, Pharr wisely shared, “Do not be afraid to take ownership of causes you feel strongly about. Do not wait for someone to extend an invitation or hand you authority.” Pharr is one of those leaders who sees a need and steps forward to be a problem solver. I know I have been guilty too often of recognizing the need for leadership, and I just hoped someone else would “raise their hand.” Through his law practice, real estate development, and civic engagement, Pharr will be making a positive contribution to his community for years to come. I know he will serve as an inspiration for aspiring leaders who want to make a difference. Burdened with secrets, a family struggles to rebuild a home
T
his work of fiction is an astonishing first novel that chronicles a family's struggle to create a home in the aftermath of World War II. It's a good read and according to some reviewers is earning comparisons to Sophie's Choice and Sarah's Key. I don't put it in the league with those two outstanding novels, but it tells a compelling story of a Polish husband, wife and small son who're separated for six years during the war. The mother and son are rescued from a refugee camp by the father and brought to a small house and garden in Ipswich, England. Both adults bring secrets and emotional scars to the reunion. They have had many experiences — some of them heart wrenching — and done whatever was necessary to survive. During the occupation of Poland, the mother and son were always on the run and spent time living in forests. In England, Janusz, the husband/father, must teach mother and son not to take baths in their clothes, not to steal vegetables from the allotments by the river, and the son,
Aurek, must be forced to attend school. The author moves between the points of view of Janusz and his wife, Silvana, and occasionally Aurek and links each to flashbacks from the war. Sometimes this method is cumbersome and robs the book of momentum. Yet, the story is riveting and you can tell it's moving toward something major, a secret too painful to recall. Hodgkinson reminds us that an exploration of the past, no matter how horrific, lodges deep in our innermost selves. There is a maternal bond between mother and son that is gripping and heart scorching. The fight for survival intensified this bond. There are twists and turns that I won't give away. It's a touching, penetrating story of how a family survives, rebuilds and forgives to move forward.
