SEMINAR ON ADVOCACY IN THE HIGHER JUDICIARY AND ITS CONTRIBUTION TO EVOLVING JURISPRUDENCE ________________

A PANEL DISCUSSION SEMINAR ORGANISED BY THE JOURNAL AND SEMINAR COMMITTEE OF THE DEPARTMENT OF LAW, UNIVERSITY OF CALCUTTA ON THE 3RD OF AUGUST, 2019 AT THE SEMINAR HALL OF THE DEPARTMENT, FROM 11:00 A.M. TO 2:30 P.M. _________________ MOTION: In a constitutional republic, whereby an independent judiciary is constitutionally vested with the discretion of judicial review; every decision of the Court plays a profoundly significant role in affecting the ordinary lives of its citizens. The Seminar intends to address the contribution of advocacy, as an integral component of the legal profession, in establishing case laws, settling precedence and empowering the Supreme Court and 25 High Courts of India to qualitatively exercise their writ jurisdictions under Articles 32 and 226 of the Constitution, respectively. The Seminar shall endeavour to address the following major themes and sub-themes: THEMES: • Importance of Oral and Written Arguments in Judicial Decision-Making; • Advocacy and the Preservation of Civil Liberties; • Advocacy and the Evolution of Comparative Common Law Jurisprudence; • Advocacy and Precedent in the Administration of Justice. © 2019 Journal and Seminar Committee, Department of Law, University of Calcutta


SUB-THEMES: • Construction of Legal Arguments; • Professional Ethics and Social Obligations of Legal Practitioners; • Advocacy and Public Interest Litigation; • Trial Advocacy in the Chartered High Courts; • Scope and Importance of Writ Jurisdiction of Supreme Court and High Courts under Articles 32 and 226 of the Constitution. READING MATERIAL: For the convenience of our esteemed panelists, attendees and the students of our Department, in substantiating the Motion of the Seminar, the Executive Board of the Journal and Seminar Committee has taken the liberty and the conscious decision to forego the publication of a conventional Seminar Brochure, in lieu of a comprehensive and articulate Introductory Reading Material, describing briefly the themes and various sub-themes of the Motion. The Committee is in its intermediate stages of drafting the said Introductory Reading Material, which shall be made publicly available at its official Facebook account (www.facebook.com/CULawJSC) and will be dispatched to all subscribers to the Committee Notification Recipients’ List by official email handle (culawjsc@gmail.com), upon its completion. PANELISTS: Subject to further discussions with the Committee, the tentative list of speakers for the Seminar is as follows: 1. The Honourable Mr. JUSTICE DIPANKAR DATTA, Judge, High Court of Judicature at Calcutta; 2. The Honourable Mr. JUSTICE ASHIS KUMAR CHAKRABORTY, Judge, High Court of Judicature at Calcutta; 3. Mr. KISHORE DUTTA, Learned Advocate General for the State of West Bengal; 4. Mr. SABYASACHI CHAUDHURY, Learned Advocate of the High Court Bar at Calcutta; and 5. Professor (Dr.) JATINDRA KUMAR DAS, Dean of the Department of Law, University of Calcutta MODERATOR: The Panel Discussion Seminar shall be moderated by Mr. SUBHO DEB, Learned Advocate of the High Court Bar at Calcutta.

FORMAT: The Seminar shall follow the prescribed format, as laid down below: (I)

Introductory Speeches by Panelists in a pre-determined order;

(II)

Question-Hour Session moderated by the designated Moderator, wherein pre-vetted questions submitted before the Committee shall be directed before the Panelists as per allotted numbers, in a sequential order; (III) General Interactive Session between the Panelists and attendees; (IV) Concluding Statements or Speeches made by the Panelists in the said pre-determined order. The Panelists and the Moderator may also choose to forego the Committee allotted order and freely engage in the said Dialogue as per their own respective conveniences.
