BOARD ACTIONS

• Reviewed five personnel matters. • Reviewed 0 member disciplinary matters. Reviewed four legal matters, including ongoing issues with the

Tahoe Keys Marina and Yacht Club (TKM&YC). • Reviewed three contracts, no new contracts were approved.

SEPTEMBER 8TH – BOARD OF DIRECTORS & FINANCE COMMITTEE MEETING

BOARD ACTIONS

• Approved the Islanders 2 Sewer Line Replacement

Project not to exceed $7,000. • Voted to reschedule the TKPOA 58th Annual Meeting and the Board Election to September 22nd, 2021 due to the Caldor Fire Mandatory Evacuation.

docks and accessory structures within the Tahoe Keys. • Will not require TRPA approval for modifications and reconstructions which otherwise would require applications, filing fees and permits from TRPA. • No required applications or permits for Boat

Maintenance or Replacement (Or New Structures) with the TRPA, this is all under the TKPOA

Architectural Control Department authority. • This MOU brings the TKPOA in conformance with the TRPA rules and regulations relating to permitting of shoreline structures within the lagoons and the registration of moorings, which is critical to ensuring the continued efforts of TRPA in helping to secure additional funding for the control of aquatic invasive weeds in the Tahoe Keys lagoons.

The legal authority of this TRPA TKPOA Shoreline Plan MOU is provided in the following TRPA Code section 84.2.1, which states: “All projects and activities in the nearshore, foreshore, or in lagoons of Lake Tahoe shall comply with the standards and provisions set forth in this Chapter, with the exception that the standards and provisions set forth in this Chapter shall not apply to the lagoons within the Tahoe Keys Homeowners Association”. “Development Standards for the lagoon area within the Tahoe Keys Homeowners Association will be established in a Memorandum of Understanding (MOU) between TRPA and the Homeowners Association (TKPOA).” The TKPOA Covenants, Conditions and Restrictions (CC&Rs) give the Association the authority to regulate the design, construction, modification, and rebuilding of boat docks and accessory structures to be installed within the Tahoe Keys Properties and permit the same only with the written approval of the ACC in accordance with the CC&Rs and the ACC Rules. The CC&Rs also give the authority to regulate the use of lagoons within the Tahoe Keys Properties including, without limitation, the alteration or present lagoon contours, dredging, rock removal, installation of any type of retaining wall, fill, or rip-rap, all of which are prohibited without Association and TRPA approval.
