Police probe stabbing

A stabbing in the earlymorning hours yesterday (Sept. 8) sent one man to Royal Inland Hospital with non-lifethreatening injuries. Kamloops RCMP Cpl. Cheryl Bush said Mounties were called to the area of Nicolani Drive in Brocklehurst at about 2 a.m.

There, residents told police a man had been in the street, yelling that he had been stabbed. Bush said a 38-year-old man was taken to hospital to receive treatment. “Police have determined that this was not a random incident and may be related

to other events reported to police earlier in the evening,” Bush said, noting the stabbing victim is likely known to the assailant. Anybody with information on the attack is asked to call Kamloops RCMP at 25-8283000 or Crime Stoppers at 1-800-222-TIPS (8477).

The head of the Kamloops-Thompson board of education and the president of the district’s teachers’ union agree on a couple of issues — something has to happen soon to resolve the teachers’ strike/ lockout and the ball is back in the government’s court. Denise Harper, chairwoman of School District 73’s board, said the situation can’t continue as is, with students waiting for their school year to start and both sides in the dispute waging a media battle. “Something has to happen in the next two weeks,” she said. David Komljenovic, president of the Kamloops-Thompson Teachers’ Association (KTTA) agreed, noting education is an essential service under the province’s legislation. Teachers across

the province will vote tomorrow (Sept. 10) on a proposal by their union, the B.C. Teachers’ Federation (BCTF), to end their strike and go back to work if the government will agree to move outstanding issues that are not related to class size and composition to binding arbitration. “Binding arbitration is the quickest and most fair means of bringing an end to this long and difficult dispute,” BCTF president Jim Iker said. “Let’s agree now to take our dispute to an independent third party to resolve our differences. “And, in the meanwhile, teachers and students can get back to school.” Education Minister Peter Fassbender, however, rejected the idea and its preconditions for acceptance by the union.

A city businessman has stepped in to buy the assets of a steel-fabricating company, saving jobs and what he calls an asset Kamloops can’t afford to lose. Tom Hughes said M3 Steel & Fabrication Ltd. remains in operation and is now working on a pedestrian bridge in Banff, as well as a steel-viewing platform at Roderick Haig-Brown Provincial Park, in time for viewing of the sockeye run.

Among its notable projects in Kamloops are the downtown CP Rail pedestrian bridge, Interior Savings Centre, Lansdowne Shopping Centre and Summit Shopping Centre. Hughes will retain the same staff, including operations manager Vance Smelland. Hughes believes if M3 Steel’s

State Group Inc., an Ontariobased multi-trade contractor, told employees earlier this year it would close the Mount Paul Industrial Park operation at the end of August, putting about 14 people out of work. Hughes said he was originally interested in the firm that has constructed many of Kamloops’ signature buildings strictly for its building and property and for its sophisticated steel-fabricating equipment. “I bought the assets and I realized there’s a business there with

The driver of a pickup travelling at more than twice the posted speed at night in a busy residential area has been found guilty of dangerous driving causing death in connection to the deaths of his two passengers.

hol, however, Kloegman acquitted Fedan on charges of impaired driving causing death due to RCMP failures to read the 53-year-old man his Charter rights at the scene or in hospital. Similarly, lab results that found him at more than 50 per cent higher than the legal limit for alcohol consumption an hour after the crash were not allowed as evidence because of failures to properly advise Fedan of his right to speak to a lawyer without delay. Defence lawyer Anthony Varesi said he expects the Crown to ask for a jail sentence. Sentencing is set for Oct. 30.

Kloegman accepted evidence obtained from the pickup’s black box, which recorded data — including acceleration, speed and braking — five seconds before airbags were deployed. That data interpreted by RCMP experts determined the truck was accelerating and travelling at 106 km/h one second before the crash, when Fedan hit the brakes. Sgt. Wayne Noonan, an accident deconstructionist, also testified his testing found the “critical curve speed” — the speed beyond which a vehicle would start to slide as it rounded the turn — is 79 km/h. The speed limit on

Mackenzie is 50 km/h. “There’s no conceivable reason the accused should have been driving at that speed and in that manner,” Kloegman said. She also found Fedan was behind the wheel at the time and well beforehand, in part due to an admission he made to a paramedic, as well as the fact his DNA was captured from the driver’s side windshield. None of three people in the truck were wearing seatbelts and all were drinking, according to witnesses who testified from a party earlier that evening. “There’s no evidence to suggest anyone else

was driving or whether the others were licensed or even capable,” Kloegman said. Fedan did not testify in his defence. The B.C. Supreme Court justice also found the speed at the time was not the only evidence of Fedan’s recklessness, a fact needed to ensure his driving was a “marked departure” from the norm. Another witness testified Fedan’s pickup was following so close on Tranquille Road 20 minutes before the crash that he could not see its headlights. The truck also changed lanes and speeds erratically and caused a pedestrian to jump back from a crosswalk.

A Kamloops man who pulled down his pants, whipped out his genitals and told a mall security guard to “suck them” will have to wait a little bit longer to find out whether he will be left with a criminal record. Alden Smith appeared in Kamloops provincial court yesterday (Sept. 8), pleading guilty to one count of committing an indecent act with intent to insult. Court heard the charge was laid after an incident on June 10 at Lansdowne Village in downtown Kamloops. Smith, 18, showed up at the mall just after 10 a.m. and was spotted by a security guard who had apparently banned him from the property the previous month.

When Smith saw the guard, he raised his middle finger in his direction. “He then grabbed his pants, pulled them down, grabbed his penis and testicles and said, ‘You can suck them,’” Crown prosecutor Tim Livingston said. Smith then left the property, but returned about four hours later. When approached by the same security guard, court heard, Smith once again pulled down his pants and invited the guard to perform oral sex. “It’s wildly inappropriate behaviour,” Livingston said. “This is not how members of civilized society deal with matters.” Livingston said the second incident took place in front of women and children, who screamed when they saw Smith’s genitals. Smith, however, denied any women or children were pres-

ent and said there was some “confusion” about the ban in the first place. After hearing those complaints from Smith, Livingston said he would like to call evidence to prove women and children were present and that Smith ought to have known he was banned from the mall. Kamloops provincial court Judge Len Marchand agreed, calling the presence of women and children “an important fact” in sentencing. In court, Smith apologized for his admittedly “childish” actions. A date will be set later this week for a sentencing hearing. The Crown is seeking a oneyear probation term with a suspended sentence, while Smith has asked for a conditional discharge — meaning he wouldn’t have a criminal record if he completed a period of probation without incident.

Mayor Peter Milobar has his first challenger — though, perhaps, not the one he would have expected. Yesterday (Sept. 8), Mr. Open Pitbelly stood on the steps of Kamloops City Hall and announced his campaign for mayor. In an interesting twist, it is the first time a candidate with a model of an open-pit mine strapped to his stomach has campaigned for mayor in the Tournament Capital. Pitbelly told a crowd that included Coun. Tina Lange and another potential Milobar challenger, Denis Walsh, he will campaign on “three P’s of prosperity” — (tailings) ponds, pits and pollution — and outlined a plan to boost job creation in Kamloops through environmental disaster. Speaking as though he himself were the controversial Ajax copper and gold mine proposed for south of Aberdeen, Pitbelly boasted of the economic spinoffs that a tailingspond failure could bring the Tournament Capital. “When it lets go, it’ll whoosh down Peterson Creek and through the city and to the river — and then into Kamloops Lake,” Pitbelly said. “And think of the urban renewal that will create. There will be all sorts of researchers and lawyers and grief councillors and soil specialists — all kinds of people. That will create very diverse kinds of jobs.” Pitbelly is also hoping to provide a long-term solution to some of the city’s parking problems by turning the Ajax pit into a parkade once it is no longer used for mineral extraction. “This parkade is forever,” Pitbelly said while placing model cars into the mine model on his stomach to illustrate the plan. greeted Pitbelly’s announcement, Elaine Sedgman (the artist and master gardener behind Mr. Open Pitbelly) said the campaign is legitimate — and she intends to have her character on the ballot in the Nov. 15 civic election. “Mr. Pitbelly is serious about running,” Sedgman told KTW. Sedgman said she was inspired by performance artist Vincent Trasov, who famously ran as Mr. Peanut in the 1974 Vancouver mayoral race, where his campaign mostly involved tap dancing. “His is more subtle. His thing was more art and about art. Mine is not too subtle,” Sedgman said.

Mr. Pitbelly may be familiar to some opponents of Ajax, having appeared at a few previous anti-Ajax gatherings. Sedgman said she’s not affiliated with any of the city’s most notable anti-mine groups, beyond getting their email newsletters, but considers herself an opponent of the project. She hopes her campaign can offer a different take on the jobcreation narrative advanced by some supporters of Ajax. Nominations for office open on Sept. 30 and close on Oct. 10. If the performance artist behind Mr. Open Pitbelly — Kamloops’ latest mayoral candidate — is intent on getting her character’s name on the Nov. 15, she’ll be in for a legal challenge from city hall. According to chief electoral officer Cindy Kennedy, updates to election legislation for 2014 permit candidates to use their usual name on a the election-day ballot instead of their legal name. “A usual name is my name is Cynthia, but my usual name is Cindy,” Kennedy said. “I’ve got lots of documentation. I can prove I’m Cindy. People know me as Cindy. They don’t know who Cynthia is.” But, an artistic alias? That’s not something current legislation allows. “Mister is definitely out,” Kennedy said. “Legislation speaks to you cannot use any prefixes. You can’t be Doctor. You can’t be any of that.” As for the rest of the Open Pitbelly name, Kennedy said if artist Elaine Sedgman insists on having her alter-ego on the ballot, the nomination would have to be challenged in provincial court because it’s not her usual name. The challenge could be made by any elector or nominee — or Kennedy herself. Kennedy said if Sedgman does bring in nomination papers once filing begins on Sept. 30, Kennedy will advise her that she will be making the challenge as the city’s chief electoral officer. Sedgman told KTW she wasn’t aware the rules had changed to disallow a candidate’s name like Pitbelly. “That’s very sad, isn’t it?” she said. Sedgman said she’s not sure if running under her own name, but campaigning as Pitbelly, would be the way to go — or how she will approach the legal question. The proposal includes letting the court process now addressing those two contentious issues to play out and taking proposed language off the table, a requirement Fassbender said the government will not accept. Instead, he called on the union to get schools open and operating again, returning to negotiations under mediator Vince Ready. Komljenovic said while he expects the vote will pass, he has heard some KTTA members saying they will vote against it “because they’re determined they’re not giving up on their right [to negotiate]

class size and supports for students.� Komljenovic, who is a member of the provincial BCTF bargaining committee, said binding arbitration was discussed by the union and Peter Cameron, the government’s chief negotiator, in the presence of Ready last week. Although he is a member of that committee, Komljenovic was not at the meeting — only the three key people were involved — and couldn’t speak to what Ready’s viewpoint on the idea was on the concept. But, Komljenovic added, the discussion included the BCTF’s position that binding arbitration could resolve the impasse.

Iker presented the option during a press conference on Friday, Sept. 5, a move Fassbender criticized and Cameron said wasn’t a serious proposal. Harper said any movement on either side “is positive� and noted up until now, teachers have insisted they wanted a negotiated deal rather than one imposed on them. A binding arbitration process involves a third party who listens to both sides and makes a decision both have agreed they will accept. The last time a contract between the government and one of its unions was resolved through binding arbitration was in 2002,

when the province’s doctors were awarded $400 million in raises. The government responded by raising the provincial sales tax, MSP premiums and tobacco tax, saying the move was necessary to cover the arbitration award. Teachers will vote in two phases to allow for those on picket lines to take part. They will gather tomorrow at the McArthur Island Sport and Event Centre between 10 a.m. and 11 a.m. and from 1 p.m to 2 p.m. Arrangements will be made for teachers in rural areas to vote and the provincial result should be made public later in the evening.

An 83-year-old Kamloops woman who fatally struck a fellow elderly member of her church parish in a crosswalk following a mass on the North Shore last year won’t be prohibited from driving. Loretta Huff pleaded guilty in Kamloops provincial court yesterday (Sept. 8) to failing to yield to a pedestrian on a green light. The Crown had been seeking a one-year driving ban for the crosswalk crash, which happened last November, killing Anne Hubic. Court heard Huff and Hubic were both leaving a mass at Our Lady of Perpetual Help Catholic church on Tranquille Road on the evening of Nov. 30, 2013. Hubic, 85, was walking to meet her son-in-law in the

parking lot of a nearby grocery store, which required her to cross Tranquille Road at Vernon Avenue. After waiting for the light to turn green, Hubic entered the crosswalk and was struck by a left-turning Huff. Hubic was knocked out when struck and taken to hospital. She died on Christmas Day without ever regaining consciousness. Court heard Huff and Hubic knew each other through church, but were not especially close. Huff, who volunteers her time reading with David Thompson elementary students and with Kamloops and District Crime Stoppers, became emotional in court when asked if she had anything to say. “I think about Anne a lot,” she said through tears. Weather wasn’t a factor in

the crash, but lighting might have been. Hubic was wearing dark clothes and the since-upgraded overhead lighting of the crosswalk was less than ideal. Crown prosecutor Chris Balison said a driving ban would send a message that extra caution has to be taken when driving at night. Kamloops provincial court Judge Len Marchand disagreed. “No public interest is served by imposing a driving prohibition,” he said, calling the accident “a tragic case.” Huff was placed on a year-long probation term with a condition barring her from driving between sunset and sunrise. She will also have to pay a $1,000 fine. In exchange for the guilty plea for failing to yield, the Crown stayed a charge against Huff of driving without due care and attention.

It may have been a milestone day for the Kamloops United Church but, as shovels broke ground on the new affordable housing development going up at 429 St. Paul St., many in the congregation were already looking towards 2016. By then, the first residents should be moving into the 56-unit housing development in the space where its community hall used to stand, bringing to an end almost a decade of planning. “I’m just expecting lots of excitement,” said Margaret Waldon, chair of the church’s council

circle, during a groundbreaking ceremony yesterday (Sept. 8). “You could feel it today, but it’s just a huge dream for 200 people, just a middle class group of people to talk about.” Of those units 41 are affordable purchase homes, where the church carries 10 per cent of the purchase price of the home as a second, no interest mortgage, which does not have to be paid until the owner resells the unit. Project co-chair Jennifer Keim said both the affordable purchase units — available only to those whose gross household income is less than $85,000 annu-

ally — and the marketrate units are selling well, with about half the units in the property claimed after six months. “What we’re finding is that by far the vast majority of are purchasers are professional people that work downtown, and they just don’t want to have to drive to work any more,” Keim said. “They work at the hospital or they work in an office and they want to be able to just have that ease of to and from work.” The housing project is the second phase of development at the church. Waldon said by building affordable housing, the congregation feels like it’s giving back to Kamloops’ downtown. “It would have been really easy for us to just turn that space next door into a parking lot,” she said. “It would have been easy. A Kamloops man who was last year banished from city limits as part of an unusual sentence from a provincial court judge is appealing his exile on the grounds it was unconstitutional. Roy Dickie banished Shane Adam from Kamloops city limits for two years as part of a probation term after the 24-year-old pleaded guilty to a pair of utteringthreats charges — the latest in a long line of convictions stemming from the his volatile on-again, off-again relationship with his ex-girlfriend. In February, defence lawyer Micah Rankin applied to Dickie to do away with the banishment condition, arguing it was a hinderance to his client’s treatment for his fetal-alcoholspectrum disorder. He pointed to new criminal charges against Adam in Powell River — where he is living

out his temporary exile — as proof. Dickie declined to change his mind on the peculiar punishment, however, so Rankin took his appeal to B.C. Supreme Court. Rankin admitted Adam is disruptive, but argued his convictions for uttering threats should not have met the threshold for banishment. “He has been highly disruptive in this community,� Rankin said. “There’s little doubt that he’s probably someone who would be difficult in any community. Banishment ought not to have been imposed, or at least ought not to have been imposed in the form it was imposed. “Banishment should only be resorted to in the most extreme of circumstances.� Rankin also took issue with one of the reasons the Crown sought banishment — because of the “fatigue� he had placed on local probation officers while serving previous sentences. “It’s not appropriate to seek a banishment order based on the Crown’s view that there are no probation resources available,� Rankin said. “There’s no evidence there are better resources available elsewhere.� Rankin said banishment as a sentencing tool is “unsettled� as it relates to the Charter of Rights and

Freedoms. Court heard Adam was born and raised in Kamloops and lived in the Tournament Capital his entire life until he was banished last year. A date has not yet been set for B.C. Supreme Court Justice Dev Dley to give his decision on appeal. Adam was not present for the hearing.

ICBC RATE HIKES ARE UNJUSTIFIED Distracted driving is being blamed for the proposed hike in ICBC premiums. Really? How many tickets for distracted driving have the police issued as opposed to other traffic violations? Let’s see the numbers. ICBC can blame the rise in rates on anything and we have no way to dispute their claims. It isn’t a matter of ticketing those who are “distracted,” but of educating drivers. We see people on their cellphones all the time and the police probably only catch a very small percentage of them. People are also distracted by a screaming baby, checking their makeup, eating, changing a CD or even funbling around in a briefcase or purse. It’s not just about cellphones, but that is what they are using as rationale for raising the already exorbitent premiums. Now that people are not drinking and driving they need another way to generate revenue and they have to get that revenue stream from all drivers. ICBC is not in a deficit position, in fact they are raking in the profits — and those profits come from everyone who gets behind a wheel. This is another case of punishing everyone for the misdeeds of a few. Big Brother is alive and well and he wants your money. If there are indeed so many accident claims due to distracted driving, then punish those who are causing the accidents, not the ones who are not. We don’t ever share in the profits of ICBC so why should we pay more so they get more? The provncial government made sure ICBC was a monopoly and we have no choice in where we get our insurance. Put the blame and the cost onto those who commit the offenses, not the ones who don’t. — Sooke News-Mirror

Good faith takes a vacation

n the ongoing labour dispute between the provincial government and the B.C. Teachers’ Federation, neither side can lay sole claim to the moral high ground. This is not a dispute in which there is 100 per cent victim on either side. When KTW published an editorial last week noting as much, criticizing both sides for their part in extending this dispute at the expense of students, a note arrived via email from a Kamloops teacher. He was furious to find in his community newspaper an argument that, perhaps, his union was not blameless in this sad saga, claiming he was on the picket line from six in the morning to four in the afternoon for the sake of students. If this particular teacher is indeed on the picket line for 10 hours per day, every day, beginning at 6 a.m., then kudos to the commitment. Somehow, though, I would bet against such a claim being followed through, day in and day out. In fact, picket-line duty is a sparse activity, as can be seen outside any Kamloops school this month — and that is to be expected as many teachers are working other jobs to pay the bills and feed their families as the strike continues. I imagine the stress levels in homes of teachers — particularly two-teacher households — is mighty high right now. As for the union, there are legitimate questions to be answered,

MUSINGS such as the fact there is no strike fund to help teachers on the picket lines. If there are 41,000 teachers paying union dues of about $1,000 a year, we are talking about $41 million per year going to the BCTF. Where is all this money? Is there a bloated bureaucracy? Is it being used to support the NDP? Was much of it spent on ongoing legal battles with the provincial government? A resolution introduced at the March 2013 BCTF convention noted teachers in British Columbia pay the highest dues of any group of teachers in Canada. If so, surely they would expect strike pay of $50 a day to last longer than three days in June? The fact there is no strike fund and teachers are living without a paycheque as we move deeper into September tells us the government is hoping to financially starve the union until its members can no longer afford to maintain their stand. The BCTF’s most significant move thus far was to have union president Jim Iker call on the

provincial government, via its bargaining agent, the B.C. Public School Employers’ Association, to agree to binding arbitration. It was and is a good move in that it tells the public the teachers’ union is confident its bargaining position is fair and that it is willing to risk it all on a third-party opinion. The fact Education Minister Peter Fassbender rejected such a notion tells us the B.C. Liberals are not as confident in their position. His refusal also tells us the party recalls very well losing big in an arbitration case involving doctors in 2002 that prompted decision to raise the provincial sales tax, MSP premiums and taxes on tobacco. In recommending Fassbender reject the overture, BCPSEA chief negotiator Peter Cameron said: “And it involves a third party, who would likely be a labour-relations person rather than an educator making educational decisions.” Last I checked, neither Fassbender nor Premier Christy Clark have post-secondary degrees of any kind, yet they alone will decide how this labour dispute ends and, ultimately, how the education system in B.C. is shaped. Unless and until union members capitulate due to financial need, arbitration is the only fair avenue in ending this impasse. Perpetual appeals of court decisions and government’s refusal to drop the clause that gives it an out if and when it loses at the next court hearing is anything but acting in good faith. editor@kamloopsthisweek.com Twitter: @ChrisJFoulds

My wife is a teacher and I told her about this mythical Tom Cruise land, where she could be making $15,000 to $20,000 more per year than she does now. She works full-time and has a master’s degree. The commenter forgot to actu-

ally look at a politician’s wage and compare it to a teacher’s salary. Premier Christy Clark makes more than $190,000 per year, which is probably how she affords to send her son to private school. Teachers make about as much as assistants to our MLAs. And I love how letter writer Cecilia Boyd (‘Public-school teachers are striking for the almighty dollar,’ Sept. 5) talks about “decades ago,” as

if she is an expert. She uses no facts and tells teachers to quit whining. The court system that had facts from both sides continually ruled in favour of the teachers, but I think we should go with what the letter writer remembers from decades ago. I am sorry to be blunt, but I am tired of people attacking teachers (including my wife) who are fighting for my three children’s

education — and the education of every other child in B.C. I respect people with opinions opposite that of teachers when they provide facts to support what they are saying, as they have earned my respect by educating themselves on a very important topic. As for the aforementioned commenter and letter writer, please look into facts surrounding the situation and I will look forward to your educated opinions. ADDED COSTS OF CAMPING ARE RIDICULOUS Editor: This is a copy of a letter I wrote to B.C. Enviornment Minister Mary Polak: On the Labour Day weekend, three friends and I went tenting at the Shuswap Lake Provincial Campground. Although it really isn’t pertinent, I will inform you that we are all seniors. Our issue is with the cost. We had circumstances that forced us to take three vehicles. I called the reservation line before we left home and was told it would be $12 for an extra vehicle. When we arrived at the park, we were informed the second vehicle had to pay $12 and a third vehicle had to pay $30 extra per night. This made our $30 plus $6 registration fee cost increase to $78 per night. The woman at the gate also informed us that we were only allowed two vehicles per night parked at our campsite.

The third would have to park at some other location the park supplies. This is how we did it. On the first night, we paid $12 for one extra vehicle and parked all three vehicles at the campsite until 10 p.m., when the third vehicle had to leave and park outside the grounds in order to not incur the $30 fee. In the morning, she went and picked her vehicle up and brought it back to the campsite. On the next night, one of the women (second vehicle) had gone home for the night, so her vehicle wasn’t there and the third vehicle was able to park in the campsite for the night. The second vehicle came back the next night, but it was very inconvenient for the third vehicle to be parked outside the gate again, so we paid the $30 and kept it at the campsite. Seems if there is room, we could have

parked all vehicle at the campsite as long as we paid the outrageous fee. Because we are only using one campsite and not bothering anyone with however many vehicles are parked there, why the high-priced parking fees? If we had walked in, the cost of the campground would have been the same, so charging extra for vehicles parked on the site is ridiculous. The other thing I have an issue with is the fact we have to pay three registration fees for one transaction. If a person camps for three nights, they have to pay a $6 registration fee for each night. But, if they stay for two weeks, they only pay for three nights’ registration. You only have to fill out one form either way so way charge three separate registration fees. Heather Green Logan Lake

The weather was hot but, for the most part, Kamloops’ lawns and gardens made it through the summer without using excess water. City utilities manager Mike Firlotte said on the city’s highest

water-consumption days, Kamloopsians went through about 121-million litres of water. Last year, the high was 117-million litres. “But, even with that hot spell, we had maybe only three days in that range,” said Firlotte. “Our average was

about 98-million [litres] or something like that. It was pretty low, actually, considering the weather.” Firlotte said Kamloops’ water use hasn’t changed dramatically from year-toyear for some time. While residents used to conume about 130-million litres on an average summer day, Firlotte said better education, watering habits and water meters have consistently kept the num-

bers lower over the past few summers. “We expected some increases ourselves, but it’s really held tight probably for the last three years,” he said. Firlotte said it’s likely the city’s water usage has plateaued for the time being, with any decrease in usage offsetting new growth. The Kamloops Centre for Water Quality can handle demands of 160-million litres per day.

Canyon heroics by crews SEARCH AND RESCUE PULL WOMAN FROM STEEP AREA CAM FORTEMS

Search-and-rescue crews used both swiftwater and rope-rescue skills to pull an injured visitor out of a canyon north of Kamloops on Thursday, Sept. 4. Alan Hobler, search manager for Kamloops Search & Rescue, said the group was tasked by RCMP with rescuing a young woman from a steep canyon in Upper Tranquille Creek, about five kilometres north of Watching Creek. She was one of four people in the canyon who were walking in the area in the earlyafternoon hours. “They decided to head out and access

pools for swimming,” Hobler said, noting the area is scenic and remote. The quartet was not equipped with ropes or outdoor gear and alcohol may have been involved. The woman slipped while climbing down an old access rope needed to descend to the bottom, falling about seven metres (21 feet) and banging her head. Another hiker described her as semiconscious at the time and there were concerns about hypothermia. Two others walked out to get help. Two teams of search-and-rescue vol-

unteers were brought in by helicopter. “It was a little complicated because it was rope rescue in combination with swiftwater rescue,” Hobler said. “It’s rare to combine those two.” The woman was conscious at the time of rescue and brought back up the canyon by the rope team.

The search team was back at the hall by about midnight. The woman was checked by B.C. Ambulance paramedics at the scene, but she was not taken to hospital. Hobler said teams are typically called to rescue hikers farther downstream in the canyon area.

Lac Le Jeune Road will get an upgrade The Ministry of Transportaiton and Infrastructure will spend $7.8-million on repaving in and around the city, including the Lac Le Juene Road. The province announced Monday (Sept. 8) work will begin this week with four kilometres of paving on the Trans-Canada Highway in Valleyview, from Vicars Road to Grand Boulevard. Contractor Dawson Construction will do work at night to reduce traffic disruptions. The climbing lane from the Aberdeen underpass to Versatile Drive will also be repaved. Once work on the Trans-Canada Highway is complete, a project

That reality, the politicalscience teacher at Thompson Rivers University said, is due to his concern about ISIS (Islamic State of Iraq and Syria), the terrorist group that has been attracting young people from around the world to its haven, including Calgary resident Collin Gordon, who once attended TRU. Cook put together a forum on Thursday, Sept. 4, that drew about two-dozen people to listen as he talked about how ISIS presents itself as a religionbased organization but, in his view, is a politically based group “made up of criminals and others.” Cook said he agrees with the way Prime Minister Stephen Harper and Foreign Affairs Minister John Baird have addressed the issue, with Harper equating the rise of ISIS to that of the Taliban in Afghanistan in the 1990s. Referring to some of the 18 books he had displayed at the front of the room in the Arts and Education Building, Cook suggested universities need to “inoculate” students against extremism by ensuring they’re exposed to “liberal values.” Cook told the group he had been advised by the university

Don’t normalize rape behaviour, students told

A phone call from his mother changed Mike Domitrz’s life 25 years ago. A university student at the time, Domitrz heard his mother ask him if he was sitting down — and he immediately assumed someone had died. “Was it grandma? My aunt? My cousins?� Domitrz told about 100 students at Thompson Rivers University

during last week’s presentation. It wasn’t a death, but his mother calling to tell him his sister Cheri had been raped and she wanted to talk to him. Domitrz said his immediate reaction was to hunt the perpetrator down “and kill him.�

But, the first words his sister said to him made him rethink his anger. “She said. ‘Mike, are you all right? Is there anything I can do to help you?� he told the group — and it made Domitrz stop, think and, eventually, find his life’s work giving sessions intended to lead students

to realize it’s better to ask direct questions and get answers than to try to read body language. With an interactive program filled with laughter and with the audience encouraged to shout out answers to his questions, Domitrz told the students how much words matter

The Kamloops mountain biker captured gold in Norway on Saturday, Sept. 6, racing in the 2014 Union Cycliste Internationale Mountain Bike and Trials World Championships. It’s the second time Pendrel has won the championship. Her first title came in 2011. “I like to race from the front and when there’s an opportunity to take the lead, you should go for it,” Pendrel said.

Women’s v-ball team wins pair in pre-season action The WolfPack women’s volleyball team went 2-for-3 in pre-season tournament action on the weekend in Burnaby. After losing its opening match to Simon Fraser University in four sets, Thompson Rivers University swept a pair of games against the Capilano University Blues and the Vancouver Island University Mariners — both Pacific Western Athletic Association

Baseball hits streak

After losing the opening game of its fall schedule, the WolfPack baseball team

TRU lost the first game of the weekend on Friday, Sept. 5, a 14-6 defeat to the University of Calgary Dinos. Following the loss, however, the ‘Pack

won six games against the Okotoks Dawgs midget team. TRU closed out the weekend with a 10-0 victory in a rematch against the Dinos. The WolfPack will return home to Norbrock Stadium for action this weekend, Saturday, Sept. 13, and Sunday, Sept. 14, against the University of British Columbia Thunderbirds.

But, while experience got the Storm to the championship final last season, Patterson said the this year’s group might have more potential that last year’s. The 2013-2014 team is regarded as one of the best in franchise history. “Last year’s team — they were older,” he said. “It was tough motivating them sometimes, although they were skilled and talented. When we worked on the same page, we were great. “But these young guys are motivated to get to the next level. They know every night is a tryout for a different team, so they’re going to bring it every night.” Of course there are still questions. Goaltending was arguably the team’s Achilles heel in its playoff run last season, with the Storm using five netminders throughout the regular season and playoffs.

Broncos quell Rebels in Westshore The Kamloops Broncos are out to prove they belong with the B.C. Football Conference’s stallions. On the road to face the Westshore Rebels, Kamloops won its fourth game of the season by a score of 42-14. Kamloops improved to 4-2 on the season, while Westshore fell to 2-4. The Broncos dominated the game from the outset, taking a 24-7 lead into the dressing room at the half. The visitors put up 553 yards of offence — 232 yards on the ground and 337 in the air — to Westshore’s 218.

Quarterback Connor Whitelaw went the distance for the Broncos, going 16-for-30 in the air with four touchdowns and no interceptions. His game-long pass was for 73 yards. Jacob Palmarin led the team on the ground with 66 yards. Tyrel Norbeck was a close second with 48 yards rushing, while Aaron Morran ran for 43 yards and a touchdown. ANN JANE (JEAN) JOHNSON (MACLEOD) Born Ann Jane Grant on October 23, 1920 at Red Deer Hill, Saskatchewan (near Prince Albert) to Alexander James Grant and Jemima Grant. Jean was the youngest child with five older brothers who tormented her continuously in her younger years. Jean is predeceased by her parents and all five brothers (Alex, Frank, William, Thomas & Donald). The last of her generation Jean was steadfast in her convictions, unwavering in her beliefs and resolute with those around her. She was also quite proud to have outlived her tormenters. Jean first arrived in Kamloops in 1937 with her family and resided at Black Pines. She worked at various jobs, was at one time personal secretary for Syd Smith. Then she went on to owning her own Flower shop, ladies retail store, sold real -estate and handled accounting activities for Dearborn Tractor Ltd. until 1969 when she moved south to Yakima, WA area where she lived 20 plus years. Jean loved to golf in her spare time and sold real estate until she returned to Kamloops to be close to her family. Jean liked business and stayed active until the age of 87 helping her son Douglas with day to day activities at his business, Extreme Excavating Ltd. Just last week, Jean was demanding to know “How’s the receivables”? Helping Doug at his business enabled Jean to golf with the business girls and not be relegated to golfing with the “old cronies”. Jean’s passion was golfing and played until the age of 87 when she packed up the clubs because she could no longer beat the business girls anymore. Jean was a long time standing member at the Kamloops Golf & Country Club. Jean is survived by her son Douglas and his wife Rita Macleod of Kamloops, BC Her beloved grandchildren Sarah Jane (Drenin) of Calgary, AB, John Douglas and Ann Jillian of Kamloops, BC Jean is also survived by many nieces and nephews of the “Grant Clan” in Kamloops, Vancouver and Alberta areas. Jean proudly lived independently in her own home until her 93rd birthday when she unexpectedly fell and hurt a hip. After leaving Royal Inland Hospital she resided at Kamloops Senior Village until April of this year when she unfortunately fell again, this time fracturing her hip and was subsequently placed at Ponderosa Lodge for recovery. Jean was on Ponderosa Lodge’s “Ten Most Wanted” list. She had tried to make not one, but several escapes during her (captivity). We, the family, would like to extend our sincere thanks to the Staff at Ponderosa Lodge for showing Jean so much patience and unending compassion. The Staff does so much, for so many with so little and we appreciated their commitment to Jean. We would like to extend special thanks to Navy Sahota (Nurse Practitioner), Dr. J. Howie and Joanna Harrison (Acting Manager). We would also like to thank the nurses at the RIH emergency ward for their help. A service will be held Thursday, September 11 at 2:00 pm at Schoening Funeral Service Ltd. in Kamloops, BC. On behalf of Jean we invite all family, loved ones and friends to attend and celebrate her life. We would like to thank our Mother and Grandmother for dedicating so much of her life to making sure we succeeded in ours. She taught us all things are possible when you believe in yourself. Dorria Vesely nee Batt passed away peacefully on Tuesday, September 2, 2014 at the Royal Inland Hospital. Born in Germany July 1924 and emigrated to Canada November 1952: daughter of Dr. Batt; survived by spouse Robert Vesely, children Raymond and Carmen, grandchildren Aaron and Ue Xiang. While raising her two children after a long career as a teacher, she coached Special Olympics Rhythmic Gymnastics successfully for many years. She cherished her painting, learning foreign languages and traveling home and abroad. On Friday, September 5, 2014 Mrs. Sylvia June Garay (nee Kuoppala) passed away peacefully in her home at the age of 94 years. She will be sadly missed and lovingly remembered by her family, husband John and their three daughters, Jan (Ernie) Seedhouse of Pritchard, Judith Garay (Anthony Morgan) of Vancouver and Joan (Ian) Hargrove of Ottawa; her grandchildren Dan Seedhouse of Kamloops, Alison (Shane) Morrow of Squamish, Davina Hargrove (Matlock Guse) of Ottawa and James Hargrove of Ottawa; her great-grandchildren Caelyx, Samantha and Hanna Morrow; her nephew John (Doreen) Hannah and family.

Dan passed away peacefully at home on September 4, 2014, at the age of 81.

Sylvia was predeceased by her two sons John and James Garay, her siblings Elsie Szkilnyk, Ilmari and Wilho Kuoppala. Sylvia was born February 29, 1920 in White Lake, B.C. to Finnish immigrant parents. She worked as an artist for the Kamloops Advertiser, then the Kamloops Daily Sentinel. She later studied and painted in the U.K., Victoria, Halifax and Ottawa where she earned an Honors Visual Arts degree from the University of Ottawa. She exhibited across Canada and had many solo shows, won numerous awards and taught painting for several years. She and John retired to Kamloops and she spent her “retirement” years gardening and painting. A Celebration of her life will be held on Saturday, September 13, 2014 at 11:00 a.m. in the Schoening Funeral Chapel, 513 Seymour Street. He was a kind, gentle man who would go out his way to help family and friends whenever necessary. Dan loved to watch his grandchildren grow and to hear of their accomplishments. Bieber ‘relieved’ after assault charge dropped TORONTO — An assault charge has been withdrawn against Canadian pop star Justin Bieber in connection with an incident involving a Toronto limousine driver.

DIDSBURY, Alta. — The mother of a nine-year-old girl found dead in a vehicle on a rural road in westcentral Alberta has been charged with first-degree murder. Laura Coward, 47, cried as she appeared in Didsbury court via closed-circuit television. She was to face charges of abducting the girl in violation of a court order, break-and-enter and theft. However, RCMP said those counts were replaced by the first-degree murder charge. Coward was arrested last week near Sundre, Alta., when she was found standing outside the vehicle in which her dead daughter, Amber Lucius, was discovered. Her next court appearance has been set for Oct. 6 in Calgary. Amber’s father, Duane Lucius, said a funeral for his daughter will be held later this week. He said it’s important that parents not take their children for granted and to make time to “have fun’’ with them because they could be taken from them at any time. Lucius said he is devastated by the loss of his “innocent, sweet and lovely daughter.’’ Court documents describe the bitter divorce of Lucius and Coward and a custody tug-of-war over their daughter that continued until the girl was found dead.

MONTREAL — Jury selection got underway this week in the first-degree murder trial of Luka Rocco Magnotta. Magnotta faces five charges in connection with the May 2012 slaying and dismemberment of Jun Lin, a 33-year-old Chinese engineering student. It is believed that choosing the bilingual jurors who will hear the evidence will last as long as two weeks. The accused is expected to be present for the selection process. The 32-year-old Magnotta is represented by Toronto-based criminal attorney Luc Leclair, while the Crown’s case will be presented by Louis Bouthillier. Quebec Superior Court Justice Guy Cournoyer will preside over the trial, which is expected to last between six and eight weeks. As it stands, evidence is unlikely to be heard before Sept. 22. Magnotta has pleaded not guilty to the murder charge and the four others: Committing an indignity to a body; publishing obscene material; criminally harassing Prime Minister Stephen Harper and other members of Parliament; and mailing obscene and indecent material. — The Canadian Press

t’s a dream many teenaged boys have — to not just play the guitar, but to play it well. To step up to the microphone and sing their songs, playing their guitar. Sam Weber had that dream — and now he’s living it. “More than anything, I wanted to be a guitar player,” Weber told KTW. “I grew up learning guitar solos from Aerosmith songs, stuff like that. It took a little while before I figured out what really resonated with me were the songs. “Bands like Aerosmith are famous for

big, hooky choruses and I think listening to them awoke my desire to feel that catharsis in writing and performing my own music.” His desire led to a 17-year-old Weber receiving a summer scholarship to the Berklee College of Music in Boston, an institution that has built an international reputation for its focus on all things music — writing, the business, film scoring, production and performing. Its graduates have won more than 250 Grammy Awards. Weber was offered a full scholarship after the summer program ended, but decided the program wasn’t for him. Instead, he headed back home to Victoria, built a studio, worked on his recording skills and kept on

writing and singing. When he was 19, Weber was featured in Guitar Player Magazine, one of the youngest to ever be included in the publication. He hit the road, as well, sharing the stage with the Tragically Hip, Sam Roberts and Current Swell, among others. He’s getting ready to head out on a 16-stop tour, promoting his new release, Shadows in the Road — and Kamloops is on the schedule, with a show tonight (Sept. 9) at the Dirty Jersey, 1200 Eighth St. “We’re going to tour the heck out of this album and, hopefully, make some new friends along the way,” said the Victoria native. “We plan to focus on Canada until the end of the year and hope to start looking at touring opportunities in the UK and the U.S. in early 2015. “I’d also love to play more festivals next summer — there are so many fantastic summer festivals in Canada now. Once the touring cycle slows down a little, it’ll be

time to record all the new material we’ve got spinning in the shadows of our sets.” The 21-year-old spent six years writing and touring before he created the 13-track recording, songs filled with the emotions that accompany the uncertainty of a life’s journey. “Places really inspire my creative process,” Weber said. “Cities, mountains, fields. “Different places tend to pull different feelings out of me when I’m writing songs. Right now, we’re driving through Manitoba and really enjoying the Prairie vibes.” Weber said his burgeoning fame hasn’t led to any life changes. “I still get to do all the things I like to do, which is really nice,” he said. “I’ve gotten in the habit of attenuating my expectations, not counting any chickens prematurely and enjoying the small things — the time I get to spend with my friends doing what I love to do. “I think it’s important to stay focused on that stuff, the substance of it all.”

orraine Korobanik has been studying drunks. While that may seem a strange subject to be investigating, there’s a method to her work — the theatre kind of method as she prepares for her role in Dinner and Drinks, which is being brought back to the Coast Kamloops Hotel and Conference Centre this week. When the play by Todd Sullivan was presented at the Rogers Way venue earlier this year, it led to soldout audiences and people wanting to see it again. Korobanik said there are several reasons why a play about five couples in a restaurant resonates with the audience. “There’s a young-adult couple, a couple celebrating their 40th anniversary, so pretty much everyone will identify with someone.” Her role serves up much of the comedy, as she plays the wife of a couple out for dinner and some conversation with decidedly sexual overtones. Her character slowly gets intoxicated during the play, hence her research. “It’s hard doing drunk,” she said. “It’s not just slurring your words.” For example, there are the different kinds of drunks, like the one who “tries to act sophisticated, but can’t even say the word.” There’s the angry drunk, the giggly one, all stages she’ll bring to life during the play. Korobanik has been rehearsing things as basic as putting down a glass of wine — after having

imbibed several — doing up a button or standing and trying to walk, for example. And, given the subject revolves around sex at different stages of life, there’s coarse language, Korobanik warned, making this definitely not for the whole family. Sullivan originally wrote Dinner and Drinks as a one-act play but, once the Laughingstock Theatre took it on, it was adapted to be two acts in about two hours. The five pairs of actors share the stage, overlapping their times in the spotlight and, other than reacting to her character as she gets a bit loud, they don’t interact at all. Instead, the audience gets a glimpse into their conversations, much like at a restaurant. This isn’t the first role for Korobanik. In 2003, she was Nancy in the Kamloops Symphony Orchestra’s production of Oliver and she was Aladdin in an earlier Laughingstock production. She’s become involved with Laughingstock, co-producing its Christmas panto production last year and auditioning for the role of the evil queen in this year’s production, Snow White The Panto. Dinner and Drinks runs from Thursday, Sept. 11 to Saturday, Sept. 13. In keeping with the theme, the venue’s Prestons restaurant is part of one ticket option with a buffet dinner available along with a ticket to the show for $40. A ticket alone is $16. The score of Closer Than Ever has been a mainstay in Daryl Cloran’s music library for years. But, when the Western Canada Theatre (WTC) artistic director turned 40 this year, the songs started hitting closer to home. “It’s suddenly become more poignant to me,” Cloran told KTW. The musical revue, which kicks off WCT’s 2014-2015 season, takes aim at middle age in all its glory — and folly. Originally staged off-Broadway 25 years ago, the show was updated in 2012 to give its middle age tales a more modern feel. “It’s one of those shows that every music theatre actor uses a song from for their auditions because they’re all so great,” said Cloran, who’s also serving as Closer Than Ever’s director. Rather than telling a single story, the revue features 24 songs over two acts, each showing a different snapshot of adult life. WCT’s musical director and pianist Steven Thomas and

Plenty is still being kept under wraps, but Mazda has unveiled its new MX-5 While the highlight of the show was Mazda’s fourth-generation two-seat roadster, star power was added by the internationally acclaimed rock group Duran Duran. “Duran Duran and the MX-5 Miata both made their world debuts in the 1980s and captured the hearts and imagination of an entire generation,” said Russell Wager, vicepresident of marketing, Mazda North America. “In 25 years, both the car and the band have evolved while staying true to their roots. It is this combination of authenticity and endurance that makes the pairing of the MX-5 and Duran Duran so appropriate for this reveal.” While Duran Duran

has sold more than 100 million records over that time, the MX-5, also known to millions as the Miata, had sold more than 940,000 units and holds the Guinness World Record for the best-selling twoseater sports car of all time. At the gala media launch, details were sparse, but it will remain front-engined with rear-drive as the Miata has been since it was launched in 1989 at the Chicago Auto Show. Interestingly, the MX-5 is being built in concert with Fiat, which may surface next month at the Paris Motor Show.
