Legally Speaking Your Spouse Is Court Ordered To Pay A Debt, Are You Discharged From Your Responsibility? By Scott Berry — Berry Law Offices

This is one of the top misconceptions many people have. Many people believe that if the court orders your spouse to assume the responsibility for the mortgage payments, for example, the loan documents with the bank are also changed so your spouse is solely responsible for the debt. Whether it is a mortgage, credit card or some other loan, if your name is on the debt before the divorce, you will continue to be responsible for the debt after the divorce has been completed. Just because the judge orders your spouse to pay for the debt does not change any personal responsibility you may have with the creditor if your spouse refuses or fails to pay. The divorce court does not have the ability to modify the contracts and obligations with your creditors. In order to be actually released from your debt obligations, the release must be directly from the creditor and not through a divorce order. As the court has no authority to revise your responsibility for the debt with your creditors, you are in charge of contacting and negotiating with each credit or to get their agreement to release you from the debt. Molly and Gary’s Example Let’s use an example of how outstanding mortgages effect the fictitious couple of Molly and Gary who were recently divorced. For purposes of our example, Molly was awarded the homestead which is subject to a first mortgage to Wells Fargo and a home equity loan to Bremer Bank. The court orders that Molly take on the responsibility for both the mortgage and home equity loan. After the divorce, Gary attempts to attain a mortgage to purchase a new home. However, Gary does not qualify for the mortgage because of his continued obligation under the mortgage to Wells Fargo and home equity loan to Bremer Bank. Upon realizing this glitch, Gary requests, and Molly agrees to attempt to refinance the mortgage to Wells Fargo and home equity loan to Bremer Bank to release Gary from his obligations. Despite her best efforts, Molly is only able to refinance the mortgage to Wells Fargo. Although this is enough to allow Gary to get a mortgage to purchase a house, he remained responsible along with Molly for the home equity loan to Bremer Bank. Two years later, due to financial struggles, Molly is unable to continue to pay the monthly payments on the home equity loan to Bremer Bank. Shortly after stopping paying on the home equity loan to Bremer Bank, Molly declares bankruptcy and discharges her obligation under the home equity loan to Bremer Bank. Bremer Bank brings a lawsuit against Gary to collect the remaining amount due on the home equity loan. Gary objects stating that the court during Gary and Molly’s divorce ordered that that Molly, not Gary, is responsible for the balance of the loan. Gary loses. Bremer gets a judgment against Gary for the remaining balance on the loan. In addition, Gary’s credit is substantially impacted as a result of the missing payments and remains individually responsible for the judgment Bremer Bank brought against him. Again, the court has no authority to modify the agreement Gary had with Bremer Bank for the loan. Depending on the language contained in the divorce order terminating Gary and Molly’s marriage, Gary does have the ability to bring a lawsuit against Molly as a result of her failure to pay the Bremer Bank home equity loan. But the damage has been done. Gary’s credit has been negatively affected and based upon Molly’s bankruptcy, it is probable that Molly does not have the resources to pay the amount of the judgment to Gary. Additional Questions? Another pedestrian killed crossing Hwy. 65 near Snake River bridge: A pedestrian was struck by a vehicle and killed near the Highway 65 Snake River Bridge in Mora at approximately 7:53 p.m. Saturday, Feb. 6. According to the Minnesota State Patrol incident report, William Alfred Tinklenberg, 57, of Andover was crossing Highway 65 on foot from east to west when he was struck and killed in the traffic lane by a southbound Hyundai Santa Fe, a compact SUV. 2. WEDNESDAYS JUST FOR TEENS MENTAL HEALTH SUPPORT GROUP Virtual or in-person meetings will take place at 3 p.m. Th is is a small group setting for 14-17 year olds with the intention to offer support for one another by sharing experiences with current events, friendships, grief, depression, isolation and other topics that participants would like to discuss. FREE TAX PREPARATION GOES VIRTUAL Lakes and Pines will be offering the free Volunteer Income Tax Assistance (VITA) program this year; it will just be a bit different than past years. Due to COVID-19, there will not be any in-person interaction with taxpayers. Th is decision was made to ensure safety to taxpayers, volunteers and staff. So how will it work? Taxpayers will call and schedule an appointment. At that time, a list of required documents will be provided. There are required forms which need to be completed and signed. These will be provided to taxpayers via email or postal mail. Taxpayers should provide copies of required documents, not originals. Taxpayers will also be given a code to be used to verify when a Lakes and Pines volunteer calls them. When all copied documents are received by Lakes and Pines, the following process will take place: 1. A volunteer will call to complete an Intake. 2. The return will be completed by a volunteer during the scheduled appointment time. 3. The return will be reviewed. 4. A volunteer will call the taxpayer via phone or video and go over the return with them. 5. Documents will be sent out for signatures. When signed forms are received at Lakes and Pines, the return will be e-fi led. To schedule an Income Tax appointment, call 320-679-1800, option 4. Property Tax appointments will not be available until April 2021.

SENIOR CHORE PROGRAM RETURNS The Senior Chore Program is returning to Lakes and Pines with a few changes. If you are 65 years or older, need help with chores around your home and live in Aitkin, Carlton, Chisago, Isanti, Kanabec, Mille Lacs or Pine counties you are eligible for Chore Services. Th is program includes occasional maintenance tasks to keep a home livable and safe. Limited grocery ordering and delivery services are also available. However, weekly housekeeping is not provided. Most chores will now be completed by a staff member. Volunteers will be needed primarily just for Community Chore Days. Community Chore Days will consist of doing chores for multiple homes in the same community on the same day. Funding is also available to contract with snow plow drivers or companies in each county to clear snow from homeowners’ driveways and paths. Snow plow drivers and companies are encouraged to contact Lakes and Pines for more information. There is a sliding fee scale for this service, so those with moderate and higher income will be asked to contribute a share of the cost of these services. Services will not be denied to lower-income participants due to inability to contribute fi nancially. Homeowners are responsible to supply all necessary material for the chores. For example, if the lightbulbs need to be changed, the
