What is Domestic Abuse in Minnesota? Orders For Protection By Scott Berry — Berry Law Offices

In Minnesota, the “Domestic Abuse” statute (Minn. Stat. § 518B.01) is somewhat limited in its application. There are two parts of the statute that must be met. First, the abuse must have been committed by a family or household member against a family or household member. A “family or household member” means a spouse or former spouse, parent or child, someone related by blood, people who are living together or have lived together in the past, if they have a child together, or someone who is involved in a significant romantic or sexual relationship. What constitutes domestic abuse is also specific. Domestic abuse includes (1) physical harm, bodily injury, or assault; (2) infliction of fear of imminent physical harm, bodily injury or assault; (3) terroristic threats; (4) criminal sexual conduct; or (5) interference with an emergency call. Notably absent from this definition is emotional abuse and stalking. The purpose of an Order for Protection is to prevent an individual that has caused domestic violence from having any contact (or limited contact) with the abused individual. In most cases, the Order for Protection defines an area for which the abuser must stay away from the person abused. In limited situations, where the parties share children, the court may allow limited contact between the parties by phone, text, or email to discuss issues relating to the parties’ children. Horse & FarmLife How to identify and manage common unwanted behaviors in horses • Cribbing and windsucking Cribbing is a repetitive behavior where the horse places its upper teeth against a Àat surface, arches its neck, and pulls backwards with its body while making a grunting sound. Windsucking is similar to cribbing, but the horse doesn’t grasp an object with its teeth. Contrary to belief, cribbing horses don’t swallow air. Often owners worry one horse may learn to crib from watching another, but this idea lacks support. Cribbing may occur in several horses under similar care. To reduce cribbing: - Increase the amount of long-stemmed forage (hay or pasture) available - Reduce the amount of grain in the diet - Offer multiple types of forage (such as adding hay cubes) - Feed more, small meals per day • Weaving Weaving is a side-to-side movement of the horse’s neck and weight, which sometimes occurs with lifting and lowering of the feet. Stress often causes weaving and occurs in horses separated from the herd or con¿ned to a stall. To reduce weaving: - Increase the time spent out of the stall (i.e. in a paddock or pasture) - Allow the horse to see neighboring horses when in the stall - Put up a non-breakable mirror if you must con¿ne the horse to a stall • Separation anxiety Separation anxiety is when a horse gets stressed when separated from other horses. The horse might neigh or scream and be hard to handle. When dealing with a horse with separation anxiety, try separating the horse gradually. Lead the horse around the pasture before leading them

out of the pasture, or take the horse away and bring it back to the pasture repetitively. • Bucking Bucking is a normal behavior for horses in a herd. Bucking creates a pecking order. Horses may buck while being ridden because of discomfort in their back from poor saddle ¿t, an unbalanced rider, or frustration from not being able to move where they want to go. If you have a horse that bucks, make sure that it is not from physical discomfort before assuming it is a behavioral issue. Rule out poor saddle ¿t and rule out injury. • Rearing Rearing is a normal play behavior in a herd, but can be dangerous in the presence of people. Speci¿c events such as rein pressure or fear can trigger rearing. If a horse rears, ¿nd the trigger and a way to safely work around it. • Headshaking Headshaking is when the horse continually shakes its head for no clear reason. Likely causes for headshaking include: Nerve pain, Ear mites, Dental problems, Allergies and Disease. To reduce headshaking: - Keep your horse away from Àies - Keep your horse out of the sun - Use a nose net while riding, nose nets may ease nerve pain. • Wood chewing Wood chewing results in damage to wooden stalls and fences, may cause problems if the horse swallows splinters or wears down their teeth. Horses may be suffering from an unbalanced diet, speci¿cally poor forage intake.

When given the choice of being in a paddock or in a stall, horses will often choose a paddock, even in poor weather. - Keep horses in herds, not alone. As social animals, horses live in herds. A herd size of four to 10 same sex horses works best with the exception of stallions. Limit changes to your herd. If your horse must be kept outside a herd, try introducing your horse to another animal, such as a goat, donkey or sheep. - Provide a forage-based diet - Use positive training methods - Highly controlled environments cause unwanted behaviors Treatment of unwanted behavior Treating unwanted behaviors can be hard. If the environment stays the same the horse will continue the unwanted behavior. If the owner improves the environment, what may start as an effort to return to natural behavior may release tension for the horse. The longer a horse participates in an unwanted behavior, the harder it is to treat. The behavior makes the horse feel good, which makes it hard to stop. The best measure you can take when considering unwanted behaviors is prevention.

Remote work has been around for many years, though it certainly picked up steam in 2020. In an effort to prevent the spread of the novel coronavirus COVID-19, in March 2020 government officials implemented stay-at-home measures that mandated many working professionals to begin working from home. That transition occurred seemingly overnight, forcing men and women to find somewhere in their homes to work.

As the dust settled and working professionals grew accustomed to working from home, many recognized the need to have an office in their homes. Various factors can make home offices more conducive to getting work done, and the following are some home office must-haves that can help people be more productive while working from home.

Lighting

Lighting is important in a home office. It’s easy to overlook natural light, especially for workers who previously worked in offices that did not have windows. But natural light can help save on energy costs and boost mood. In fact, natural light is a valued commodity for people used to working in office settings. A 2018 survey of more than 1,600 workers conducted by the human resources advisory firm Future Workplace found that access to natural light and views of the outdoors were the most sought after attribute of a workplace environment. In addition, 47 percent of workers surveyed admitted they felt tired or very tired from the absence of natural light or a window at their office. When designing their home offices, homeowners should keep this in mind and choose areas of their homes that get ample natural light during a typical workday. Additional lighting also will be necessary. Recessed lighting can give an office a sleek look, and lights that can dim can allow workers to adjust their lighting based on how much they need at any given point in the workday. Professionals forced to work at home when social distancing measures were implemented may not have had much quiet, especially for those with young children whose schools were closed. But when designing a home office, homeowners have the chance to make their offices more conducive to concentration. Soundproofing walls may not be necessary, but look for areas of the home that don’t get much foot traffic. Kitchens are very popular rooms in many homes, so try to locate your home office away from the kitchen. A spare bedroom upstairs may make for the most ideal home office setting if the home does not have a traditional den. Spare bedrooms come with doors, which can instantly create a sense of quiet when closed. A converted garage also can make for a useful home office, but make sure the room already has cooling and heating and, ideally, windows.

Electrical outlets Recently built homes tend to be equipped with enough outlets to accommodate our increasingly connected lifestyles. But older homes may need some electrical updates before they can capably accommodate home offices. When updating your electrical, replace existing outlets and fixtures with energy-efficient LED fixtures, which save money and benefit the environment. Before updating the electrical, decide on how you want the office to be laid out so you can have outlets installed where your computer, devices and other items, like a printer and television, will be. This makes it easy to hide cords and give the office a clean, professional look. Home office capabilities became a big priority in 2020. Designing such spaces can be fun and easy.

One of the ways homeowners can keep their lawns looking lush and green is to aerate the turf when the need arises. Aerators perforate the soil with small holes. These holes allow air, nutrients and water to penetrate all the way to the roots, helping them grow deep and strong. Deep, strong roots are essential to healthy, lush lawns. While aeration can help many lawns, not every lawn will necessarily need to be aerated. Thatch also can foster grub infestations, providing another benefit to removing it and aerating a lawn. When to aerate depends on the type of grass. Homeowners should consult with a lawncare professional about the best time to aerate their particular lawns, but it’s generally recommended that cool-season grasses be aerated in early spring or fall, while it’s best to aerate warm season grasses in late spring.

Though new flooring and ceiling tiles might not offer the wow factor of a remodeled kitchen, a 2019 study from researchers at the Joint Center for Housing Studies at Harvard University found that replacing floors and ceilings was the most popular home improvement project in the United States in 2017, the most recent year for which data was available at the time of the study. More than five million homeowners replaced carpeting, flooring, paneling, or ceiling tiles in their homes in 2017. The popularity

of such projects may have something to do with the relatively low cost associated with them, as the experts at BobVila.com note that overhauling surfaces underfoot and overhead costs an average of $3,283. That places floor and ceiling tile replacement projects among the least expensive home improvement projects homeowners can undertake, even though such renovations can immediately and dramatically transform the look of a room.

Traffic includes residential as well as logging trucks, emergency vehicles and the school bus. The existing road may seem adequate for now but must accommodate two way traffic now and in the future.
