Non-Marital Property in Minnesota By Scott Berry — Berry Law Offices ”I sold my former house to buy our marital house, so I have a nonmarital interest.” Maybe. Under Minnesota law, “non-marital property” is property received before the marriage or, in the case of a gift or inheritance, received by just one spouse after the marriage. Sounds simple enough, right? Unfortunately, there are other factors that the court takes into account when determining whether an asset is marital or nonmarital. Property received by either spouse during a marriage is presumed to be marital. A spouse can refute this presumption by showing that the down payment for the purchase of a property was through non-marital assets. So if a house is purchased during the marriage, it is presumed to be a marital asset unless a down payment can be specifically traced to one spouse’s non-marital assets. Minnesota courts have developed a formula for apportioning marital and non-marital interests that depends on three variables: 1) the non-marital contribution, 2) the value of the property at the time of the marriage, and 3) the present value of the property. According to this formula, the increase of equity of non-marital property from normal market forces remains non-marital. However, it becomes much more complicated if the increase in equity is due to improvements made during marriage. Typically, money expended for improvements to the home that comes from the parties’ joint efforts will result in a portion of the equity in the property being declared marital. Likewise, a non-marital interest in a property can be completely extinguished by refinancing a property during the marriage if the funds from the refinancing do not go towards payment of the loan and are used jointly during the marriage. Horse & FarmLife The basics of raising pigs Many people subscribe to the notion that “everything is better with bacon.” Imagine being able to control the quality and Àavor of pork products, and knowing just what went into producing delicious bacon? In an era of growing uncertainty about commercially produced food, many agriculturally inclined people are raising livestock right on their properties, and small-scale pig farms can be a successful venture. Despite pigs’ reputation as dirty animals, the animal resource PetHelpful indicates they are actually one of the cleanest farm animals. Pigs tend to wallow in mud only if they do not have proper shade and a clean, steady water supply to regulate their body temperature. Furthermore, giving pigs plenty of space to roam will enable them to keep dry, clean and cool. Pens should be large enough so pigs can sleep and eat on one end and use the other end for soiling. Pigs also are intelligent animals that will adapt to routine. This means it may be easier to care for pigs than some other farm animals. Even though pigs can grow to be quite large, they do not need to live on an expansive farm. Many pigs can live quite well on an acre if their pen and foraging areas are rotated periodically. Data from the past 50 years shows that today’s pig farms use less land and other resources to produce one pound of pork, according to the National Pork Board. Therefore, rais-

ing pigs can be a sustainable undertaking. According to Mother Earth News, when selecting pig breeds for a pig farm startup, these are popular as lean-meat producers and shouldn’t be hard to ¿nd: Yorkshire, Duroc-Jersey, Berkshire, Hampshire, Poland-China, Chester White and Tamworth. Choose sows (females) or barrows (castrated males) for the best-tasting meat. Also, keep in mind that pigs are social animals, and even though the average family will do just ¿ne with one pig’s worth of meat, pigs do better if raised in pairs or more.

Elmer C. W. Koch, of Brook Park, died on Wednesday, Aug. 5, 2020, at Mercy Hospital in Coon Rapids. He was 95 years old. He was born on Sept. 26, 1924, aat home in Pomroy Township to parents William and Florence (Herp manson) Koch. He was united in m marriage to Vera Lilienthal, and they m sspent many years together farming. They raised seven children while at tthat farm. He and his family began attendiing Sunday school at the Pomroy SSchoolhouse. Many times services were held at their country farm w house. His testimony was that he h loved Jesus as his Savior. lo In his last several years he lived with his daughter, Barb Koch, who w ffaithfully cared for him. In 1983, his wife passed into the arms of Jesus. He later married Violet Lilienthal, who also preceded him in death. He was also preceded in death by grandchildren Arianna, Charity, Gabriel and great-grandson Weston. He is survived by his children, Jim (Dixie), Gary (Betty), Dale (Gwynn), Ken (Chris), Ray (Kathy), Russ (Barb) and Barb; many grandchildren; many great- grandchildren; and two great-greatgrandsons. A memorial service was held on Saturday, Aug. 8, 2020, at Quamba Baptist Church with Rev. Bruce Thompson officiating. Music was provided by Angie Anderson. Urn bearers were Barry Koch, Dustin Koch, Dwayne Koch, Nathan Koch, Kory Koch and Kevin Koch. Burial will be at Oakwood Cemetery in Mora. Violet Elaine Anderson-Adams (nee. Anderson), of Grasston, died and went home to be with the Lord on Sunday, Aug. 9, 2020. She was 89 years old. She was born on Oct. 12, 1930, to G.G. and Olive (Erickson) AnderG sson on the family farm in Comfort Township, in rural Mora. After T aattending country school and Grasstton High School she graduated from Mora High School in 1947. She went M tto work in the cities at Toro. It was tthere that she became friends with Ruby Anderson who introduced her R tto her brother J. Richard. The couple were united in marriage on Sept. w 115, 1951, and made their home in Poskin, Wisconsin. They later reloP ccated to their farm in rural Grasston. Her husband passed away on March H 17, 2003, and she married Russell Adams on May 10, 2008. They enjoyed eight years together before he passed away on June 3, 2016. Besides being a homemaker, wife and mother, she worked as a bookkeeper at the Braham Community Hospital, Kanabec County Hospital, was the clerk/treasurer for the City of Grasston and secretary for the Stanchfield Baptist Church. She was active in the Grasston Baptist Church and was the Sunday school secretary for many years. In her youth, she attended Wood Lake Bible Camp in Wisconsin, and it was there that she met her best friend and eventual sister-inlaw, Charlene (Johnson) Anderson. Their friendship lasted for over 75 years. She was preceded in death by her parents; husbands, J. Richard Anderson and Russell Adams; brothers, G. Vernon, Russell, Glen and Eldon; sister, Vivian; and twin sons, Merlin and Marlin. She is survived by her sons, Bruce (Linda) Anderson of Mora and Craig (Deb) Anderson of Dodge Center; seven grandchildren; five great-grandchildren; as well as many nieces, nephews, other relatives and friends. A funeral service will be held at 11:00 a.m. on Wednesday, Aug. 19, 2020, at the Rock Ingebrand Funeral Home in Braham with Pastor Joe Reed officiating. Visitation will be held from 4:00-7:00 p.m. on Tuesday, Aug. 18 and again one hour prior to the service, all at the funeral home. Burial will be in the Grasston Baptist Cemetery. Arrangements are by the Rock Ingebrand Funeral Home. Condolences may be posted at www.aifuneralhome.com.

The substitute teacher rate of pay is $125 per full day and substitute paraprofessionals start at over $12 per hour. The Minnesota Legislature, recognizing the shortage of teachers in our state, provides a procedure for people holding four-year degrees (BA or higher) for a Substitute Teaching License (Tier 1 License)*. Completion of this procedure through the Professional Educator Licensing and Standards Board provides a person with the licensure needed to serve as a short-call substitute teacher in Minnesota schools whether or not the individual has a teaching degree.
