By Scott Berry — Berry Law Offices In most cases, the personal representative has discretion in how to handle the estate assets and the affairs of the estate. If there is a will, the intentions of the testator as expressed in the will should always be considered as well as the desires of the estate beneficiaries – when practical. For the sake of family harmony, a personal representative should be fair in the administration of the estate. “The personal representative has discretion in how to handle the estate property� The personal representative should not act until the estate they appointed by the court as the personal representative. The personal representative should, however, maintain real estate or continue to operate a business. If the personal representative is also a beneficiary under the will or an heir according to law if there is no will (e.g., an adult child), he or she is absolutely forbidden to “self-deal� or give anyone preferential treatment. Note that – absent his or her own negligence or wrongdoing – the individual serving as personal representative is not personally responsible for satisfying claims or lawsuits against the decedent or the estate itself. The personal representative is responsible for prudently investing estate assets. The law imposes a fiduciary duty on personal representatives to act cautiously and always to have the best interests of the beneficiaries in mind. If this duty is violated and a loss or waste of assets results, the personal representative might be ordered to pay compensation personally (or as an institution) to the beneficiaries in this situation, as well. However, the personal representative is not held responsible for a poor return on estate investments as long as any investments chosen by him or her are appropriate. For example, if a general market downturn decreases the value of the estate portfolio of “blue chip� stocks and bonds, the law would not hold the personal representative responsible. By contrast, if the personal representative lost money due to risky speculative investments or failed to get a reasonable return by leaving substantial assets in a checking account, these would probably be considered inappropriate, and he or she might be individually liable. The personal representative’s fiduciary duty also requires him or her to protect and preserve estate assets. For example, if estate funds were available but the personal representative neglected to pay an insurance bill and a fire loss to the decedent’s home resulted, he might well be held liable to the beneficiaries. The personal representative has a fiduciary duty to protect and preserve the estate assets. A personal representative is entitled to reasonable compensation. The fee taken must be listed on the final account and is, therefore, ultimately subject to approval by the court. BASKETS OF HOPE FILLED BY ROYAL NEIGHBORS Royal Neighbors of America Grasston Chapter 5146 gave 20 Baskets of Hope to the Black Dog Women’s Refuge. Baskets were fi lled with a variety of 14 different items. Some of the items included were a towel and washcloth, hair products, toothbrush and toothpaste, lip balm, body wash and buff puff, hand sanitizer and other personal items plus a small bag of chocolate candy. BRAHAM VIETNAM VETERANS MEMORIAL DEDICATION POSTPONED The dedication ceremony for the Braham Vietnam Veterans Memorial monument, which was scheduled for Wednesday, Nov. 11, has been postponed due to the illness of one of the participants. According to the organizing committee, the memorial is dedicated to the Vietnam Veterans, especially the six Braham High School graduates who gave their lives. However, the committee emphasizes any veteran or family member is welcome to be recognized at the memorial with a paver
block with the veteran’s name, date of service and rank. The cost of the pavers is $200, which includes the engraving. Mentioning of Medal of Honor, Purple Heart, or POW can also be included in the engraving. General donations are also welcomed. Kenneth “Ken” Robert Dalbey died and went home to be with his Lord and Savior on Wednesday, Oct. 21, 2020 at age 78. He was born to Robert “Bob” and Mary “Ardis” Dalbey on Dec. 19, 11941 in Barnes City, Iowa. During his childhood, his family relocated h tto Mora. As a young man, he liked ttinkering on cars, playing football aand made strides in developing a cclose relationship with God and bbeing active in his church – Hillman Baptist. B He met his wife, Janice Johnson, tthrough close mutual friends, Stu aand Mary (Lindberg) Oleen. They were united in marriage on May 8, w 11965 and went on to have five children: Faye, Karen, Rebecca, Timothy d aand James. He initially chose a successful career in computer technology at Control Data until one fateful day during his commute to the Twin Cities; he was in a serious car accident. During this time of recovery, he followed the Lord’s calling and decided to devote his career to the ministry. He would joke about how it took a lot for God to grab his attention. He graduated from Northwestern College (Roseville) in 1982 with Bachelor of Arts degree majoring in ministry and Bible; minoring in Christian education ministry. He served as a minister at Hope Baptist Church (Minneapolis) and Cavalier Baptist Church (North Dakota) and then served as area missionary for American Missionary Fellowship previously known as American Sunday School Union in East-Central Minnesota for 20 years. Camp Evergreen and CornerStone Connection were two ongoing ministries of outreach and fellowship. He worked with hundreds of adults and children throughout the last 50 years and would have given his last nickel to help someone else. He served his Lord well and even toward the end of his life, he would always perk up when anyone wanted to discuss the scripture. Throughout his entire life, he held an unwavering faith in God. “And whatsoever ye do in word or deed, [do] all in the name of the Lord Jesus, giving thanks to God and the Father by him.” Colossians 3:17 He joins his parents, Bob and Ardis; wife, Janice; and daughter, Rebecca, in Heaven. He is survived by his children, Faye (Mark) Kihne of Cavalier, North Dakota, Karen Dalbey of Milaca, Timothy (Julieanna) Dalbey of Greenville, South Carolina and James Dalbey of Mora; grandchildren, Zander, Cassandra (Travis), Sophia and Jade; great-grandchildren, Vivian and Charlotte; sisters, Mary Etta Schwartz of Mora, Linda Dalbey of Minneapolis and Sandra (Eric) Carlisle of Mora; and many beloved extended family members. Supportive words to his family and friends: “See, I am sending an angel ahead of you to guard you along the way and to bring you to the place I have prepared.” Exodus 23:20 A celebration of his life will be planned in the spring of 2021. Valid Driver’s License. Additionally, must be age 18 or older to apply and a favorable background check & drug test required. Minimum Salary $17.28/Hr.
