Talk of the Town What is a Fiduciary Standard, and why does it matter? I
wrote an article about this a little over a year ago, but I’ve had some requests to do so again. So, here we go with a little bit of a different twist. It doesn’t sound like much of a big deal, but these two words - fiduciary and suitability - are critical to determining the type of care you receive from your “trusted” financial advisor Unfortunately, most of the public is not aware that a very small minority of advisors are actually held to a fiduciary standard, while a majority is held to a much lower suitability standard of care.
Who is held to a Fiduciary standard of care and who to a Suitability standard of care? James D. Stillman Currently, only independent Registered Investment Advisors and their Investment Advisor Representatives (RIAs/IARs) are required to act in a fiduciary capacity. Brokers and/or financial advisors working for a broker dealer firm or an insurance company are held only to a suitability standard (not a fiduciary standard). Not sure who’s a broker dealer firm? A few well known firms include Merrill Lynch, Edward Jones and Morgan Stanley.
What is the difference between Fiduciary standard of care vs. Suitability standard of care? Part of the reason this difference is not well known is that the terms are not easy to describe and the large firms held to the Suitability standard, who could afford to spread the word, obviously have no interest in doing so. A Fiduciary standard of care means doing what is best for the client by always putting the client’s interest before the advisor’s interests. It also means disclosing any possible conflicts of interest, including compensation related to products or referrals. A Suitability standard of care usually means an advisor need only suggest products that are suitable for your objectives, your income level and your age. Also, no disclosure is required for possible conflicts of interest, and transparency is questionable. Just because something is suitable for you doesn’t mean it is necessarily the best for you.
Taking it one step further, would you feel comfortable making your car buying decision by simply relying on the salesperson representing the car manufacturer? Or, would you feel more comfortable using an independent research organization such as Consumer Reports to help find the best car for you? The bottom line is that the Honda dealership is likely not going to try to sell you a Hyundai! What you’ll find is that a salesperson affiliated with a single company and only required to find you a “suitable” product will likely not be driven to find the best product for you, because often times they may not even have access to it or know a lot about it. I think most people realize the importance of making wise choices with their finances, so why not demand an independent, fiduciary level of care for your financial future? Well, help may be on the way. One provision of the massive new Financial Reform legislation attempts to deal with the Fiduciary issue. The law gives the SEC the authority to create rules requiring investment advisors, who provide personalized investment advice about securities, to act in the best interest of their customer. It also allows the SEC to require these advisors to disclose material conflicts of interest and obtain consent from the customer. There is one catch. Due to heavy lobbying by large broker dealer and insurance firms, the SEC is not required to make these rules. Instead, the law requires the SEC to commission a six month study to look at the effectiveness of existing legal or regulatory standards of care for broker dealers and investment advisors providing investment advice. Let’s hope the SEC does the right thing for consumers and doesn’t give in to the lobbyists. Until then, ask your current or prospective financial advisor if they are a “registered fiduciary”. I’d take it one step further and seek out an “Independent Registered Investment Advisor” to make sure the advisor works for you only. Let’s use the everyday example of buying a car. Assume you are looking for a car that costs less than $30,000 and gets over 28 mpg. However, most of us would do further investigation and consider additional criteria before making a decision on such an important purchase. For example: Which models have the best safety record, maintenance/ repair history, resale value, etc.? You search to find a car that does not just meet your basic needs or is “suitable” but one that is “best” for you.

My favorite interview that I’ve done as a writer was with an artist, Jack Saylor. His works haven’t been displayed in museums, but his talent is undeniable and he’s wellknown in the community where he lives. While speaking with him and talking about the muse for his paintings, passion flowed from every word he spoke, and I found it inspiring.
Artists have a gift of eliciting emotion from others with their works. Whether it’s
performance art or a painting in a gallery, we all react to it in one way or another. Lake Norman has a vibrant and thriving arts scene, as evidenced by our fall arts preview on page 28 and the arts edition calendar on page 26. Not only are the artists at the lake talented, but they’re also accessible. Writer Lauren Blake sat down with three local artists who have found success in selling their pieces

Going Independent Tired of the usual box office hits and major blockbuster sequels? Try something a bit more independent. Studio-C Cinema screens feature-length independent, documentary, foreign, and classic films at the Cornelius Art Center in Oak Street Mill. Most films are recent releases, and Studio-C’s screenings are sometimes a film’s only theatrical run in the area. Studio-C’s director, Robert Maier, worked in independent film production for more than 30 years. Screenings are generally held on the first and third Saturday and Sunday evening of every month, and sometimes additional screenings are scheduled. Doors open at 6:15 for a reception (with complimentary beer, wine, and snacks) and to allow guests to browse the Cornelius Art Center’s gallery. Tickets for evening shows are $10-11 plus tax, and Sunday matinees are $8-9 plus tax. Firecracker 5K Huntersville Family Fitness & Aquatics held the 12th annual Firecracker 5K and Super Soaker Dash on July 5. The Huntersville Fire Department was on hand to soak the kids as they dashed to the finish line. Overall top male & female winners were awarded cash prizes and Dicks Sporting Good Bucks were given to first, second, and third place age division winners. This year the race had 168 5K runners and 52 Super Soaker participants. The race supports the fitness center’s scholarship program, providing financial assistance to those in need in the local community for membership and children services programs.

Lake Norman Folk Art Festival The annual Lake Norman Folk Art Festival takes the community outside city limits and into the growing world of folk art. In a wooded, 17-acre campground alongside Lake Norman, talented artists display impressive pieces of Southern contemporary folk art. The exhibition features a wide range of works in clay, paint, found objects, carvings, metal, and glass yard art, but with a twist of innovation. Ordinary household objects are formed into new shapes and sculptures. Bottle-cap collages, pet portraits, recycled and repurposed clothing, corrugated metal, and carved wooden figures are only a few of the many creations that exemplify the limitless approaches to unconventional artwork. And whether or not you choose to invest in a piece, you are certain to leave the festival with visionary inspiration. And a great festival isn’t complete without great food. This year’s selection of Creole inspirations, ice cream, bagel sandwiches, and of course, barbecue, will surely hit the spot for any foodie. Bella Love Art Crawl Every second Friday, Bella Love invites people to cultivate community and self-expression through social interaction and art with their community art crawls. The venue welcomes people of all ages—even pets. Local talent fills Oak Street Mill as artisans, musicians, and comedians light up the stage. Food trucks and vendors offer delicious treats from around the town while craft beer, wine, and fresh-brewed coffee are also available. Through a collaborative environment, Bella Love brings people together to support and celebrate local businesses and talented individuals. Mooresville Arts The Mooresville Artist Guild, recently renamed Mooresville Arts, has been supporting and appreciating local artists for almost 60 years. Starting as a small group painting and sharing ideas in the basement of the local war memorial building, the group has grown to more than 225 members. The group has since moved out of the basement and into the Southern Railway Depot, where they have adapted the space to create a gallery, classroom, and office spaces. Throughout the year the gallery is home to many judged and unjudged exhibits like the annual Artoberfest and Photography Show. All of the exhibits begin with an opening reception, a great chance to meet the artists. With something always going on at this great local gallery, it’s the perfect place to enjoy and learn about the impressive art scene in the area. Davidson Community Players Since 1965 the Davidson Community Players have been producing high quality theatrical performances for viewers of all ages. These talented actors draw people in from all over the Lake Norman area, and even steal some of Charlotte’s die-hard theater patrons. With a collection of awards and accolades from across the state, it’s easy to see why they have been a staple in the community for almost 50 years. Their eclectic season is filled with an assortment of shows from children’s theater to pieces with more adult content. On Oct. 2, their newest play, “Dixie Swim Club,” opens and chronicles the friendship of five Southern women who met on their college swim team. With stories that focus on our very own North Carolina coastline, it is not to be missed. The following month on Nov. 8, “Suessical Jr.” will be the hot spot for every kid in the area. Telling the story behind one of Dr. Suess’s beloved stories, it’s sure to entertain the entire family (parents, too!). Finally, the Players will be closing 2014 with their performance of “It’s a Wonderful Life.” This twist on a classic is made to mimic a live radio broadcast of George Bailey’s Christmas Eve adventure. Lakeside Artists Studio Tour Step into the creative world of some of Lake Norman’s most celebrated artists with the Lakeside Artists Studio Tour. This annual event gives art lovers the chance to enjoy a behind-the-scenes glance into the work spaces of artists who work with a number of different media. Whatever your artistic preference may be—wood, ceramics, painting, jewelry, or even furniture—you could have the chance to walk away with a one-of-a-kind piece of your own. Since the event’s beginnings in 2009, the tour has been drawing more than 500 people each year. The popularity of the Lakeside Artists Studio Tour has become apparent through the word-of-mouth advertising that leads the group’s efforts in promoting these wonderful local artists. These local artisans may live around the block, but their craftsmanship is recognized far beyond Lake Norman-area galleries and shops. Though their art forms differ vastly, they all share a common denominator in the way they market themselves as artists. Learn how the emergence of online markets has enabled artists to sell their goods to consumers near and far from the comfort of home studios and workspaces.

Jamie Reed 30, humanshapedrobot.com For Jamie Reed, one of the coolest aspects of his small business is seeing where his posters end up. The Huntersville resident’s male-centric, retro prints feature subjects ranging from bacon obsessions and men’s grooming products to old-fashioned cars and vinyl records. And according to his online sales, there are folks in Africa, the Netherlands, Israel, and Japan who find this Americana-type art worthy of their wall space. “A Japanese company liked one of my prints, a man wearing a wrestling mask, licensed it, and now they have it on their site with models wearing it on t-shirts,” Reed says. “But, what’s funny is the picture of the wrestler is actually me with a mask on so I always laugh that there’s a bunch of Japanese teenagers wearing my face on their shirts.” Concepts like this one come to him rather unexpectedly, which he admits results in a lot of sketching in the car. But coming up with the idea is the simple part, Reed says. It’s what comes after that makes his prints a labor of love. “With screen printing by hand you have to kind of understand how the colors are going to lay down,” Reed adds. “Everything is done in layers so you do one color, and the second, and the third… you can also do metallic colors and glow-in-the-dark, so it’s kind of cool, all of the different colors and techniques you can use.” Because of the nature of hand printing, each poster has its nuances that make them different from the next. Signed and numbered—and at just around $15 to $20 a piece—they make for affordable, original pieces, which is almost an oxymoron in the art world. After his concepts are executed, Reed uploads photos to his website and Etsy page, which can reach consumers around the globe. It’s then that he’s able to sit back and enjoy allowing the Internet to move his pieces without spending a penny on gallery space.

Dawn Vertrees 54, Etsy store: DawnVertreesJewelry After retiring from a lengthy corporate career, an unexpected mentor came into Dawn Vertrees’ life. Volker Kracht, a senior master jeweler from Germany, put off retirement for three years after seeing a stunning orchid pendant that Vertrees made from three sheets of wax. Since 2001, Vertrees has pursued different artistic media, starting with ceramic jewelry and moving on to the world of Lost Wax, which she works in today to make fine artisan jewelry like intricately designed rings and pendants depicting tree frogs, turtles, starfish, and other nature-inspired subjects. Along the way, she’s picked up numerous awards at festivals and art shows across the Southeast while making a living from her craftsmanship. But when the constant travel started to take its toll, Vertrees turned to the Internet to keep her business going. “I got so tired of being out on the road that one day while my husband was filling up the motor coach with gas, I created an Etsy site and at each rest stop and break I had, I photographed my pieces so I could continue to make money without having to constantly travel to shows,” Vertrees says. The Internet opened up more doors for Vertrees, allowing jewelry retailers in St. John, Virgin Islands and Disney resorts to discover her pieces and add them to their collections. In the coming months, Vertrees says her business will come full circle as she’s in the process of building a wholesale market and will eventually only sell through brick-and-mortar stores. “It’s the circle of life of being a jewelry designer. Art shows come first, then Internet, and then wholesale,” Vertrees adds.

Liz Rogala 31, Etsy store: JustArtinAround Davidson resident Liz Rogala creates digitally mastered prints popular with growing families seeking to mark milestones via art. Case in point: custom prints featuring a baby’s initial, birthdate, and newborn measurements. “Just Artin Around” launched online in 2013 with items ranging from chalkboard art prints and all-occasion personalized invitations to “Made in North Carolina” state silhouette prints and personalized coffee mugs. Even without experience in art sales prior to the emergence of online markets, Rogala

acknowledges that the Internet has made it possible for her to do what she loves, while making fun money on the side. “It would probably just be one to two pieces a month but right now I’m selling about a piece a day,” Rogala said. “You have to kind of be a go-getter when you’re an artist, you have to put yourself out there and with two kids, I don’t really have time to be out there selling my stuff.” Etsy and Facebook grant Rogala the means to sell her pieces on a consistent basis, with the click of a button, all while reaching a wide consumer base and often,
she notices regional purchasing trends. Recently, an entire week of her sales came exclusively from North Carolina and Virginia, which, in part, can be attributed to a lack of consumer privacy with online purchasing. Similar to “liking” something on Facebook, Etsy has a “favorite” option, which allows users to share their discoveries. But for Rogala, and other artists around the globe, this type of online publicity is a good thing. If it weren’t for the Internet, she says her sales would be dependent on galleries and word of mouth. LNM

Husband and wife Cliff and Nancy Hucks started their company, Kathryn’s Cottage Kitchen, because they missed the salad dressings, dips, and spreads that Nancy grew up eating at her parents’ Mooresville restaurants. Kathryn’s Cottage Kitchen, based in their Davidson home, is reintroducing those restaurant-quality products to the home cook.

Cuisine From 1968-1984 Nancy’s parents, Claude and Dora Blaine Little, owned Little Kitchen on Main Street in Mooresville (next to what is now La Patisserie), as well as Chicken Little, Little Spaghetti, Delk’s (dime store with a lunch counter), and Little’s at the Beach (in Myrtle Beach). “The success of those restaurants was because of two things: We used the best quality ingredients, and had the best people working there,” Nancy says. It was after the Littles retired and sold their restaurants in 1984 that the Hucks decided to bring back a few of the most popular family recipes. “Mother’s chicken salad had been made and served in Little Spaghetti and the Delk’s lunch counter for 50 years—people loved it!” Nancy says. Before starting Kathryn’s Cottage Kitchen, Cliff would simply make the recipes he and Nancy missed, for themselves and friends. “Each dressing recipe makes five gallons, so I’d make some for us and give the rest away in jars to friends.” Soon,
those lucky friends began asking for the dressings and spreads on a regular basis. Nancy, 67, is a realtor with Lake Norman Realty and Cliff, 56, is retired. They have no employees for Kathryn’s Cottage Kitchen, though their daughter helps out. Offering seven products, the Hucks had to choose the most popular of Mrs. Little’s original recipes. “The bleu cheese dressing has always been very popular, both in the restaurants, and with our friends,” Cliff says. Nancy confirms the dressing’s popularity: “Once, Daddy caught a lady with a Mason jar in her pocketbook, filling it up with the bleu cheese dressing in the Little Kitchen salad bar. He had to ask her to please leave.” Kathryn’s Cottage Kitchen offers bleu cheese, ranch, balsamic, and thousand island dressings, wine and cheese spread, olive and cream cheese spread, and chicken salad. The couple uses a co-packer in South Carolina to make and package the dressings and cheddar wine spread,

and the cream cheese and olive spread and the chicken salad are made locally in McLaughlin’s Farmhouse in Mooresville. While they’ve been successful selling Kathryn’s Cottage Kitchen foods regionally, like Reid’s Fine Foods, McLaughlin’s Farmhouse, Dean and Deluca (among many others), they gained a considerable boost when Harris Teeter began carrying their bleu cheese and ranch dressings this past April. They are now available in every Harris Teeter store from southern Georgia to Baltimore. The Hucks believe that this Harris Teeter connection is a natural one, “Willis Teeter [co-founder of Harris Teeter] was from Mooresville and often ate at Little Kitchen,” says Cliff. “He loved the bleu cheese dressing!” With plans of introducing a honey mustard dressing this fall, Kathryn’s Cottage Kitchen is going from strength to strength, showing the Southeast that a Little recipe and a lot of hard work reaps success. www.kathrynscottagekitchen.com LNM

Mooresville mixed media artist Flavia Lovatelli is a consummate recycler. She loves taking cast-off materials, especially pages torn from magazines and other bits of discarded paper, and incorporating them into her artwork.

Her interest in taking thrown-away objects and using them to create works of art led her to collaborate with several likeminded regional artists in 2011 to form a collective known as Art Ecologie. Lovatelli, 54, along with artists Marcee Musgrove and Monique Luck became ecoevangelists of a sort, exploring and promoting the virtues of repurposing found objects, packaging, and just plain trash into all manner of art work, including fashion. Soon they uncovered a community of other local artists excited about exploring the movement. Art Ecologie is an open organization, welcoming all artists with no dues, membership structure, or even formally scheduled meetings. They simply create and work in the sustainable art space at Eden Street Market and follow a mantra of “Adapt. Design. Create.” Shortly after forming, they looked for a way to showcase their creative talent and demonstrate just how far they could take their ideas.

Trash to Treasure “One person’s trash is another’s treasure—right?” says Lovatelli. “We’re taking this to another level and using our work with recyclables to show off our creativity and demonstrate what can be done when materials are looked at in a different way. I thought that a fashion show could help bring attention to our work and the bigger issue of excessive waste in our culture.” In 2012, Art Ecologie spawned their first Charlotte show with ecoFAB Trash Couture. The event has been held annually since. The shows feature runway worthy designs by more than a dozen local artists. Venues have included the Mint Museum’s Randolph location, NC Music Factory, and this year’s April show at the Projective Eye Gallery at the University of North Carolina Charlotte School of Arts + Architecture’s City Center Campus. “The designs are ‘wearable’ yet not practical,” Lovatelli said. “It’s really not about clothing as much as giving artists a different
and creative outlet and letting people see what we are capable of doing.” Susan André, 60, is a mixed-media artist that shares studio/gallery space along with Lovatelli and several other artists who take residence at Eden Street Market in Davidson. She exhibited “Green Tea,” a party dress fashioned from foil packets containing tea bags at this year’s ecoFAB Trash Couture show. “I like that people are starting to think actively about things that are typically thrown away,” said André. “Perhaps people will find inspiration and think ‘I can use this (recycled material) as gift wrap or to wrap a package.’ The shows are also a great avenue for artists in a variety of fields to express themselves in new and creative ways and be recognized for their work.” Lovatelli agrees. “There is a larger movement here,” she says. “Trash is not necessarily garbage. Allyson Greenwood needed a change. After living in Mooresville for more than a decade while conducting research to support international operations at Lowesâ&#x20AC;&#x2122; headquarters, Greenwood decided to downsize and purchase a new, 1,800-square-foot, two-story townhome in Corneliusâ&#x20AC;&#x2122; Antiquity neighborhood.

With the change in location and size also came an innate desire to rework her home’s aesthetic. “It was time for an update,” says Greenwood. “My furniture needed to be replaced or re-covered.” And the color palette—greens, yellows, and purples—she had in her previous home had to go, too. To help her navigate everything from the finishes she chose during the home’s construction phase to the wallpaper, furniture, and accessories once it was move-in ready, Greenwood looked to designer Melanie Crabtree of Interiors by ReDesign. “I couldn’t keep all [of the design details] together so I hired Melanie,” laughs Greenwood of her decision to hire Crabtree, who had previously designed her former home’s studio room where she paints in her free time. First came the color palette: a complementary combination of fuchsia and lime green inspired by one of Greenwood’s favorite spring outfits and a kate spade bag. “When I saw the combination I immediately thought of Dorothy Draper and the amazing, colorful interiors she designed for the historic Greenbrier hotel in Sulphur Springs, West Virginia,” says Crabtree. “The colors of fuchsia and

green could have been a bit too sweet and preppy for this stylish, career woman, but when tempered with deep gray walls and matte gold accents, the interior took on a more updated, classic look that reflected [Allyson’s] personality.” When it came to the furniture and accessories, Greenwood opted to embrace the downsizing move and ditch nearly all of her previous furnishings and only keep timeless pieces. “[Those items] worked in beautifully with the new additions,” says Crabtree. Other items were given a fresh look to help update and transition with the new aesthetic. “Her existing upholstered, wood arm chair was updated in a playful green and ivory striped fabric. Her bamboo side chair cushion was recovered in an over scaled houndstooth pattern and re-purposed as her desk chair.” Greenwood’s appreciation for art helped guide Crabtree’s interior design, too. “The two contemporary portrait drawings over the sofa [in the family room] are by a local artist, [Charlotte Foust], and the small Paris street scene paintings that hang outside the powder room were given to her by a great aunt that traveled extensively,” explains
Crabtree of the collection. “They were gallery framed and matted to complement the room and showcase the special keepsakes.” A collection of decorative ivory plates hangs across from the sofa and serves as “a lovely vignette alongside the existing ivory hand painted chest, re-purposed as a media console and reupholstered wood arm chair. The Boone native also led the U.S. Open on Saturday, briefly atop the leader board in the third round in 1977 at Southern Hills, Oklahoma, where Hubert Green was the eventual winner.

The rooms are quite spacious, with the three-bedroom suite able to sleep 10 people. Close by, Bristol Caverns offers spelunkers the chance to explore the banks of underground rivers, carved deep into the earth millions of years ago. Hikers are mere miles from trailheads on the Appalachian Trail, the most scenic hiking trail in North America. LKN Quilters use member donations, fabric and thread donation from Westminster Fabrics, and a grant from the North Carolina Quilt Symposium to sew blankets that are donated to local social service groups. Recipients of the quilts include Lake Norman Regional Medical Center’s Obstetrics department, Barium Springs Home for Children, Crisis Assistance Ministry, and Hemby Children’s Hospital.
