It is Keltbray policy to ensure that any person working for Keltbray shall be provided with all rest breaks during the working day required by the Working Time Regulations (WTR) 1998. Further, no individual working for Keltbray shall be allowed to exceed the maximum hours specified in the WTR unless they have signed an opt-out of the limitations set out in the WTR. Planning and monitoring of staff working hours will help ensure they, and the parties they interact with, are not at risk of harm from an accident caused by fatigue.
Working on Rail Infrastructure (RI)
– No individual will be permitted to work more than 12 hours (14 hours with travel time door to door) per shift
No individual will be permitted to work more than 72 hours per calendar week (Saturday to Friday)
– An individual must have a minimum 12 hours rest between shifts
No individual will be permitted to work more than 13 consecutive shifts in a 14-day period
Any person selected to work on RI will not, other than in exceptional circumstances, exceed the limits imposed in the Network Rail Hours of Work policy by working the planned shift(s) and that they will be sufficiently rested before commencing the shift.
Keltbray ensures that all staff working on RI do not work more than 12 hours per shift/duty, work no more than 72 hours in any 7-day period, have a minimum of 12 hours rest between booking off shift/duty and booking on to another shift/duty, and work no more than 13 shifts in any 14-day period. All proposed work on RI must be planned in advance and working hours rostered so that staff are not required to work in excess of the prescribed times whilst adhering to project and client requirements.
Our operatives are aware of the ‘Refusal to Work on the Grounds of Health, Safety and Environmental (Work Safe)’ procedure and are encouraged not to work excessively if they consider it to be unsafe. The calculation of working hours must take into account all time worked for the company in whatever capacity. All employees must report all work undertaken outside of Keltbray to evaluate effects on the required working hour’s limits.
Rostering is arranged to ensure that operatives do not work during the twelve hours before commencing work. All staff members are asked to confirm that they have not worked in the preceding twelve hours before they are rostered. Rostering for site activities will be carried out in accordance with client requirements. Unauthorised exceedances of working hours in accordance with this policy will not be paid.
The policy is to be briefed to all employees during induction and each time it is reviewed.
Keltbray and its management team fully support this policy and are committed to provide competent personnel and financial resources to implement it. This policy statement shall be reviewed annually by all interested parties. All Keltbray policies are available on the Keltbray Business Management System. New employees are briefed on the use of the Business Management System and locations of the Keltbray policies and any reviews or key changes in the policies are advised to employees.
This policy is governed by and supports our Keltbray Code of Practice and recognises the facility afforded by the Whistleblowing policy statement (GRP-CAL-PCY-029).
