Schmitt proposes affordable housing strategy

ffordable Housing is the topic “du jour.” Monroe County, Marathon, Islamorada and Key West have appointed committees to study the matter. Officials and other interested parties are exploring options ranging from special taxing districts to tiny homes as ways to incentivize private investors to develop workforce and affordable housing. A little-known Monroe County code allows trailers to be deed restricted as affordable, freeing up a market rate building permit allocation that the owner can than sell or develop on another piece of property. (The law was enacted in 2008 during the condominium conversion craze, as a means of preserving affordable housing in trailer parks that was disappearing at a quick rate.) Building right allocations — affordable and market rate — are free when issued by government. However, owners often sell their market rate

“The city loses nothing,” Schmitt said. He also added that this type of deal lessens the city’s exposure to lawsuits by property owners when all building rights run out in seven years, by state decree, to comply with hurricane evacuation times for the Florida Keys. The more market rate allocations that exist to be distributed, he said, means the fewer number of property owners who would sue when their right to develop their property is extinguished. . Right now the proposal is still in the earliest stages. County staff has Schmitt’s interlocal government agreement, but the Board of Monroe County Commissioners probably won’t act until the Marathon City Council decides on a policy direction. On Tuesday, this very issue came to the forefront during a discussion to approve the redevelopment of a lot in Marathon with eight existing units to be replaced with eight new modular homes. Marathon Councilman Dan Zieg characterized at least some of the units as affordable housing. Although the redevelopment was approved, it didn’t escape the notice of Marathon’s Affordable Workforce Housing Chairman Josh Mothner. “Preservation of affordable housing is what’s in question. This is one-for-one displacement [of workers for vacation renters],” Mothner said. “I implore you to incentivize the defacto affordable housing by allowing the owner to keep the market rate.” According to Marathon City Planner George Garrett, this

allocations in the private sector. Currently, market rate building allocations are selling between $60,000 — $40,000 for the right itself, plus a $20,000 transfer fee paid into an affordable housing fund. Affordable housing allocations, on the other hand, are in low demand. Municipalities often hand them out in bulk to developers who propose a specific project. Recently developers of the Oceanside property on Stock Island purchased about 70 trailers and deed restricted them as affordable before moving the market rate building rights to complete their new development. While the precedent exists to deed restrict exiting mobile homes, deed restrictions are typically allocated to new construction in Monroe County and Keys municipalities. Until now. Marathon businessman Brian Schmitt has pooled 34 of his existing, sub-market rental properties in the city (with three belonging to developer Pritam Singh) and applied to Monroe County for 37 affordable deed restrictions. “If you deed restrict the 37 affordable allocations, then there are 37 market allocations that I can move somewhere else in Marathon. Right now we are losing affordable housing at a rapid pace and there is no incentive to do something different,” Schmitt said. “This would create that incentive.” Schmitt said it’s an advantageous move for the City of Marathon. Because the affordable rights would come out of the county’s pool, Marathon would in effect gain 34 new building rights it didn’t previously have.

M
arathon Mayor Mark Senmartin called on Councilwoman Michelle Coldiron to remove Planning Commissioner Lott Pansky on Tuesday. Pansky paid for a fullpage advertisement published in the Marathon Weekly on April 8 in support of Coldiron’s plan to pass a resolution that would not allow for any “new” hotel development until current projects are completed. The community was sharply divided over the resolution to suspend the issuance of 100 Transient Rental Units (TRUs) — the right to build hotel rooms — the City of Marathon has banked since 2011. For some, it was perceived as a “tactical pause” to slow traffic congestion, address affordable housing and allow the City of Marathon to address infrastructure needs. For others, it was an unwelcome attempt to meddle with the free market and cause an artificial increase in the value of existing building rights. Semartin criticized Pansky’s position as “self-serving” and in conflict with his role as an appointed member of the Planning Commission and as a member of the city’s expanded Affordable Housing Committee. Panksy owns the Sea Cove Motel on the east end of Marathon and also owns parcels in Keys RV park property, each with attendant building rights. “There is no room for this on our board. His opinion is geared towards his best interests and has nothing to do with the actual resolution to protect our city. I ask that [Coldiron] remove him as her appointment on the planning commission and replace [Pansky] with someone else,” Senmartin said in a prepared statement. Pansky defended his right to his opinion. “Yes, I do have transient

On behalf of all members of Crane Point Museum, the staff and board would like to thank the City of Marathon for the grant to restore our museum aquarium. Because of your grant, we were able to complete the project of updating and repairing the aquarium to perfect working order. Thank you, city staff and council, for this wonderful gift. We can now tell the story of lionfish. We are so excited and grateful.
Please include my wife, Riet, and I into the group of folks who are opposed to adding more hotel/motel units into our beloved city. The primary reason is that Marathon is “full” during the winter months and a lot of the summer. When I say “full,” I refer primarily to our only real thoroughfare, U.S.1. Bringing hundreds of more automobiles into town during those periods would be much, much more disastrous than the congestion we suffer now. Our restaurants, merchants, service firms and the like are also swamped during those times. Have you tried to get a seat at your favorite restaurant in February? Impossible. Marathon’s lifeblood is tourism, of course, and probably 90 percent of us first came here as tourists, so we certainly must not destroy those businesses. Tourists certainly do not enjoy dragging along in snail-moving traffic any more than we do. Too much of that will certainly encourage them to visit and vacation in other areas that will have more pleasant conditions. And that will end up greatly harming our local tourist industry. In 2014 there was a huge stink raised because the TDC was not going to sponsor the Seafood Festival. Their reason was that we do not need to bring in more tourists during March. I fully agree. Key West hosts Fantasy Fest in October, our deadest tourist time of the year, and it works out very well indeed. The Seafood Festival would be hundreds of percent greater benefit to the local businesses if it were held in May, for example. We should urge the TDC, chamber of commerce, and others to spend probably half of their money and efforts in promoting Marathon in the spring and fall for the real good of our local business folks in the short and long run.

Libertarian files for State Attorney race Shad Neiss challenges Vogel Weekly Staff report

ey West attorney and youth advocate Shad Neiss threw his hat in the ring for the post of State Attorney for the 16th Circuit (Monroe County) as a candidate for the Libertarian Party. Neiss, who has a history of public interest law and advocacy, first joined his family in Key West in 1995 and has been Shad Neiss in private practice since 2008. The graduate of The Ohio State University Moritz College of Law is running on a reform platform to reduce plea bargains for dangerous predators and to deemphasize criminal prosecutions for victimless crimes, children, the mentally ill, and others better served by scientifically informed treatment or restorative justice program. He said he also wants to reform civil forfeiture practices. Neiss is also a member of the Ohio Bar and maintains a part-time practice in Cleveland, Ohio. When not practicing law, the Big Coppitt resident serves as Key West High School JV Boys soccer coach and as a volunteer Guardian Ad Litem. Passionate about protecting freedom from both criminal predators and from governmental overreach, he has a special concern for juveniles caught in the criminal justice system. A campaign kick-off reception will be announced at the end of April.

Hometown PAC calls on candidates Meet and greet filled with those vying for seats By Kristen Livengood
T
his past Monday, about 45 candidates vying for local, state, and federal votes this fall came out to meet the community and offer their stances at Hometown PAC’s Call to Candidates event. Hometown PAC aims to be a resource for the voting com-
munity and provides events for prospective and incumbent candidates to make their views known, such as meet-andgreets and political forums. “I am extremely happy with the turnout,” said PAC Chairman Todd German. “This was the biggest turnout we’ve had to date.” With the 2016 presidential election, Joyce Griffin, Supervisor of Elections told the 300 attendees that she expects an 80 percent turnout for the November election. She also said she thinks the ballots will pull
high numbers for the August elections and mentioned that voters have 29 days before the election to change parties. Griffin, a Democrat, is finishing her first term as Monroe County’s Supervisor of Elections and is currently unopposed. Key West was introduced to two U.S. Senate candidates, Pam Keith and Anton “Tony” Khoury, who made the trip to Key West for the event. “This is the first time Senate hopefuls have shown up for Hometown PAC,” German said. “It’s a big deal.” District 39 State Senator hopefuls Anitere Flores, Daniel Horton, and Andrew Korge were also on hand to meet and greet interested locals at the event, along with congressional hopefuls Joe Garcia, Jose Peixoto, and Annette Taddeo. State Representative for District 120 Holly Raschein spoke at the event with opponents Artie Leichner and Kevin Diaz. Locally, several open seats brought out candidates in races for Monroe County Commission, Key West Commission, Monroe County School Board, Mosquito Control, Key West Utility Board, Clerk of Court, State Attorney and Public Defender. The next Hometown PAC event will be June 24 at 5 p.m. at Studios of Key West. “It’s an important event because candidates have to qualify by noon that day, so this will be a good event to meet them all,” said German.

Marathon Community Theater is offering free dance classes to MCT members starting Monday, April 11. The schedule is as follows: beginner tap on Monday at 6:30 p.m.; intermediate tap on Monday at 5:30 p.m. (all tappers welcome who have previously danced either in their younger years or from the beginner class); Irish step dance on Tuesday at 5:30 p.m.; Coralette on Tuesday at 6:30 p.m.; Belly dance Wednesday at 5:30 p.m.; and Bollywood dance Wednesday at 6:30 p.m.
Living Springs Counseling, approved by the Upper Keys Family Court, will be offering a nine-week parenting class on Tuesdays beginning Tuesday, April 19 from 4 to 6 p.m. behind the MARC store at MM 90, Oceanside. The cost is $50. It will also offer a 12-week arts and meditation workshop on Thursdays from 4 to 5 p.m. The class will begin when full, with 10 seats currently available. Cost is $10 per session. Guests can interact with nurse sharks Contributed

he Florida Keys Aquarium Encounters recently opened its newest display, Big Shark Bay, to the public as an “encounter” program. On hand for the opening of the encounter were Matt and Carolyn Anthony, local business owners, who are the official sponsors of the exhibit. Big Shark Bay allows guests to assist one of the aquarium’s marine biologists with the training of resident adult nurse sharks. The marine biologist teaches the step-by-step method of behavioral training, and guests are then able to participate in the process. The Anthony’s also sponsor another exhibit and encounter at the aquarium, the Nursery Touch Tank. Nurse sharks are relatively docile sharks, making them easy for humans to interact with in a controlled marine environment. Their unique eating style allows visitors to get close and feed an adult nurse shark in the tank. The unique, hands-on encounter programs immerse
visitors in close and personal contact with a wide variety of marine animals. “This one-on-one experience fosters a stronger relationship and appreciation for both marine animals and the entire ocean,” said Carolyn Anthony.

Pansky told the council he has nine TRUs for sale with local broker Ginger Henderson, of which he owns half. “Removing me from the Planning Commission has never been done before. When the time comes, I am going to open my mouth. I am not afraid. I think it’s more self interest on your side,” Pansky told Senmartin. The council was unanimous, including Coldiron, in issuing Pansky an official warning. “[Pansky] has a right to free speech,” Coldiron said, referring to the paid advertisement in the form of an open letter to the community. “But I would agree with Councilman Bill Kelly that it’s not appropriate to put the title of the organizations that you belong to, just your name.” Coldiron also noted it is Pansky’s second term on the Planning Commission and that he was originally appointed by another council. “There are strong emotions on this issue and personal differences of opinion,” said Councilman Dan Zieg. “Let’s let things calm down and not pursue removal at this time.” Coldiron’s resolution regarding the halt of new hotel development failed to pass. “I’m disappointed that I didn’t get my message across that this wasn’t forever. I just wanted to have an open discussion to see how the city handles new development coming on board,” she said. In other news: • The City of Marathon passed an anti-littering law that would result in a fine if citizens are caught throwing out cigarette or cigar butts on public property. • The City of Marathon also passed a law making it possible for law enforcement to issue a civil citation, rather than arrest, a member of the public in possession of less than 20 grams of marijuana. Voters will be asked whether they support the construction and maintenance of a community “funded by taxes, assessments, user fees, or any other permissible source of public funds?” • The council directed staff to research whether annual vacation rental license fees can be increased by $500. The extra money — about $250,000 — would be diverted to pay for affordable housing needs.

andy, chocolate, Mattheessen’s cookies, cakes, pies, brownies, fountains filled with melted chocolate… the menu at the 14th annual Michelle’s Willie Wonka Chocolate Festival taking place on Sunday, April 17 from 11 a.m. to 3 p.m. at Southernmost House in Key West is never-ending. Raising thousands of dollars for Cancer Foundation of the Florida Keys, the event is named in part after the name synonymous with candy, Willie Wonka, and shares the title with Michelle Halpern, the founder of the event who died of cancer in 2012. “The first year, 14 years ago, we had about 200 people and raised $2,000,” said event cofounder attorney Michael Halpern, Michelle’s late husband and co-owner of Southernmost House. “The past few years, the event has raised more than $50,000 a year for the foundation.” For the price of a $10 ticket, kids’ (and adults’) eyes light up when they walk into Willie Wonka’s Key West house with rows and rows of delightful goodies to choose from, all donated from local restaurants and businesses for the event. “Every penny we raise goes to the charity,” Halpern said. Fourteen years ago, Michelle with the help of Michael and their three sons, started the event to help local non-profits before the reins were handed over to Cancer Foundation of the Florida Keys. “Every year the event just keeps getting bigger and better,” said volunteer Doria Goodrich, who has been with the event since its inception. According to Goodrich, a member of the all-volunteer Cancer Foundation of the Florida Keys, which supports patients from Key Largo to Key West, the Willie Wonka event is the biggest fundraiser of the year. “We support anywhere from 20 local patients a year with help with their cancer treatments,” she said. “No one should have to blow every penny they’ve ever made just to stay alive.” Just in case chocolate and candy isn’t your thing — there’s pretzels, and hot dogs, and live entertainment, and a balloon man, and a beautiful view of the ocean at one of the most iconic houses in town. n my book, they are all winners. I’ve watched the race from the starting line, the finishing line, and actually participated in two 7 Mile Bridge Runs. he Marathon Yacht Club Education Foundation is now accepting applications for the four, two-week sessions scheduled for this summer. Summer sailing in Marathon will begin with the first two-week session June 13–June 24. The classes are weekdays in the morning (9 a.m. to noon) or afternoon (1 to 4 p.m). Younger sailors (5-8 year olds) will be scheduled in the morning and older sailors (9-18 year olds) will be scheduled in the afternoon. Class size will be limited to four sailors (5-8 year olds) and eight sailors (9-18 year olds). Students will be sailing Blue Dragon prams or Sunfish, depending on student size and weight. Applications will be taken on a first come, first served basis. Subsequent sessions will be
from June 27 – July 9 (no class on Monday, July 4th, but will sail on Saturday, July 9); July 11July 22 and July 25–August 5. An application package and program manual can be found on the Marathon Yacht Club Educational Foundation website at www.MYCEF.education. trading of deed restricted affordable building rights for market rate allocations isn’t entirely new. The developers of a project on 73rd street — a mixture of apartments and efficiencies on several lots — petitioned the city for some affordable permits but held on to some of the market rate allocations associated with the property for future “leverage,” possibly selling them for cash but more likely to trade for other building rights within the City of Marathon. Currently, mobile homes or existing rentals deeded affordable by Monroe County, must meet certain conditions. They must meet or be brought up to code, meet life safety standards, be deed restricted for 99 years and subjected to audits ensuring the tenants qualify for affordable housing and are being charged “affordable” rates. In the county, landlords and tenants self report on an annual basis. Both Islamorada and Marathon have conducted audits in the past, but not on an annual basis. Currently, Monroe County has by far the largest share of affordable market rate units to dole out over the next seven years — about 700. Then the Keys will have reached “build out.” As the affordable-for-market-rate scenario becomes more established, it’s the next step that’s up for debate: what to do with the plethora of market rate building right allocations that have real value. So far, two scenarios have emerged. One, Keys cities or Monroe County will require “payment” for affordable deed restrictions in the form of some share of the market rate allocations the trade creates. Two, developers with market rate building rights will either use them, sell them, or trade them for the right to build hotel rooms, an even scarcer commodity than affordable housing. The City of Marathon may be the first to decide this issue. Although he must wait until Marathon and Monroe County have ironed out the conversion of affordable deed-restricted properties for an equal number of market rates, Schmitt currently has an application to turn 37 market rate units into rights to build hotel rooms. It’s unknown when the Marathon City Council will address the issue.

ew Jersey native and TV/ radio host, Bill Hoebee ended up in the Keys like the rest of us — because no one else would take him. Okay, that’s only a half truth, but he’s ours now, for better and/or worse. Today Bill Hoebee just might be the most recognized celebrity in the Florida Keys. In fact, he has been nominated for “Best Local Celebrity” for two consecutive years at “The Bubbas: Key West People’s Choice Awards” and he receives rock star treatment at just about every establishment (mainly bars)
that he frequents. But there is just something about Bill Hoebee that affords him the liberty to say (and do) just about anything on the airwaves. With puerile charm and “radio good looks,” Hoebee commands a dominating stranglehold on the radio ratings; imparting wisdom, fraternity humor and pop culture sarcasm as effortlessly as Tony Soprano consumes fagoule. From a successful stint with an ’80s hair band to hobnobbing with celebrities around the country, Bill Hoebee never takes himself too seriously, which is perhaps his recipe for such broad appeal. His heart remains on the microphone — talking and laughing with his younger sidekicks: The Bird and Mel T. t the Florida Keys County Club in Marathon, bartender Paul Lippens recommends the rum punch. The restaurant, Harbor View, is undergoing a Renaissance of sorts, and the cocktail is just the tip of the iceberg. “I make it with spiced coconut rum, banana liquer, blackberry brandy, orange and pineapple juices, and grenadine,” he said. “Plus, each drink is served with a dark rum floater.” Lippens is a three-year native of Florida, by way of Nashville, although his roots are all “Yooper” — the Upper Peninsula of Michigan. He and his wife and 14-year-old daughter live on a boat. “We like to spend time on the water,” he said. Lippens recommends pairing the rum punch with a pineapple walnut salad or the tiger shrimp kabobs. For beer lovers, he recommends the Left Hand Milk Stout; it has all the body of a dark beer but none of the bitterness. Harbor View is located at 4000 Sombrero Boulevard, on the lagoon side of the property. It is open every day for lunch from 11 a.m. to 6 p.m. and dinner service is on Wednesday and Friday from 5:30 to 9 p.m.

‘Taste of Key West’ comes to Waterfront The 21st Annual “Taste of Key West” will be held on Monday, April 18 from 6 to 9 p.m. at Truman Waterfront Pier, overlooking Key West Harbor at the end of Southard Street. Tuning in — and definitely NOT dropping out David Gilmour shines on his ‘Rattle That Lock’ tour
D
avid Gilmour is bloody amazing and one of the most inspiration musicians in all of rock. Darn that David Gilmour to heck! After 2014’s final Pink Floyd album, “The Endless River,” it was a bit surprising late last year when Floyd guitarist and singer David Gilmour released a new solo recording, “Rattle That Lock.” And then, there was the announcement of a world tour to accompany the new album. This was his first tour in almost 10 years, and I knew that I really wanted to see one of these shows. Odds are that this is the 70-year-old artist’s last tour, so waiting until next year was not an option. Like when I passed on my chance to see the Eagles back in 1980… Not to mention that a couple of music-loving friends of mine who shall remain nameless (but their initials are Joe and Patty Ivey) saw Gilmour’s concert at the Royal Albert Hall in London and just raved about how good it was. The reason I didn’t see a show on the last tour has to do with Gilmour’s touring habits. When playing in Europe, Gilmour plays everywhere. Every little nation and sub-kingdom, it seems, gets a concert. But when he plays North America, just like 10 years ago, he plays Los Angeles, Toronto, Chicago,
and New York City. That’s it. Sure, there are multiple dates in each city, but still … not even an Atlanta show? After securing tickets and airfare, we were Chicago-bound. The Windy City lived up to its name, greeting us with icy breezes and a somewhat typical April snow that blew between the buildings, through the streets, and under the CTA trains. We were certainly not in the Keys anymore. The preconcert soundtrack consisted of ambient noises and some very recognizable Pink Floyd sound effects. The lights went out, the crowd roared, and Gilmour and his band eased us all in with “5 A.M.,” “Rattle That Lock,” and “Faces of Stone” — the first three songs from the new album. Just as I thought he might perform the new record in its entirety as he did with “On an Island” a decade ago, the tuning radio sound and the 12-string guitar heralded the first of the Floyd classics: “Wish You Were
Here.” And there were a lot of Floyd classics that night: “Shine On You Crazy Diamond” (“Wish You Were Here”); “Time,” “Money,” and “Us & Them” (“Dark Side of the Moon”); “What Do You Want From Me,” “Coming Back to Life,” and “High Hopes” (“The Division Bell”); “Sorrow” (“A Momentary Lapse of Reason”); and “Run Like Hell” and “Comfortably Numb” (“The Wall”). There were a couple of true real classic Floyd songs as well: a folky “Fat Old Sun” from “Atom Heart Mother,” and Syd Barrett’s “Astronomy Domine” from “Piper at the Gates of Dawn.” There were other reminders of Pink Floyd there as well — the large circular video screen (Mr. Screen) and one of the most amazing light shows ever seen… as well as the arenafilling lasers on “Comfortably Numb.” In addition to the Floyd classics, Gilmour performed seven songs from the new album,
which includes “A Boat Lies Waiting,” a moving tribute to his old Floyd bandmate, the late Rick Wright. n my book, they are all winners. I’ve watched the race from the starting line, the finishing line, and actually participated in two 7 Mile Bridge Runs. This year, I was granted a unique perspective — from the sidelines of the bridge at Mile 5, right across from the “Christmas Tree” on the old span. It’s illuminating to watch the tide of runners sweep past. I saw a man on crutches, and I saw two runners pushing strollers. I saw the faces of the folks picked up by the buses, as well as the determined looks on the faces of the leaders rushing past. I saw silly hats and many sweat-soaked T-shirts. I saw friends encouraging one another and strangers making friends. There is something undeniably special about the 7 Mile Bridge Run and it is no wonder that it endures. I came. I saw. They ran.

It includes Russian thugs, a Seminole Indian spirit who saves CJ from drowning, a boat explosion, and CJ and Skye’s heroic attempt to save the boat owner, who surprises them with the funds to pay for both their college educations at the University of Florida. In Marquesas Gold, the adventures continue with a giant squid who kills unsuspecting boaters, including a dear friend named Cap, until a sperm whale Skye calls Willy kills him, and CJ and Skye are honored by President John Shannon, who instantly likes the teens and stays in touch with them. In A Miracle for Tristan, CJ and Skye are invited to Fort Jefferson for a few days of fishing and snorkeling with the president and his son, Tristan, who is kidnapped by mercenaries intent on killing President ShannonAr, Tristan and his Secret Service Agents. CJ is near death from an explosion at the fort, and Squeaky and Flapper come to the rescue as Tristan get a shock when he experiences a miracle. In addition, Mr. Stovall authored The Cuban Sanction, and exciting adult novel about friends who find themselves involved in drug smuggling, murder, kidnapping, and the NSA. Mr. Stovall also wrote a lengthy published article called Never Too Late about his and a friend’s Cessna flight to Barrow Alaska in the Arctic Circle.
