etail is changing; no doubt Amazon and other e-retailers have made an impact. Despite this, people still care about shopping as an experience. Now it is in the hands of retailers/centers to give people what they want. Oliver Chen, managing director, retail and luxury sector at Cowen and Company, says that retailers must give people something to do, then they will shop. But shopping can’t be the thing to do. Centers need to be convenient, curate relevance, and create a culture for the community. Retail, and more importantly the American Shopping Center, is NOT DEAD.

New 2020 Labor Laws Affecting California Employers Excerpted from an article by James W. Ward, J.D.; Employment Law Subject Matter Expert/Legal Writer and Editor, CalChamber
O
f the 2,625 bills introduced in the Legislature in 2019, 1,042 bills reached Governor Gavin Newsom’s desk. He signed 870 and vetoed 172 — and many of those signed will affect California employers. Some bills made significant changes to California employment law, such as the much-publicized independent contractor bill, Assembly Bill (AB) 5. Others made small but important changes of which employers must be aware, such as those changing the mandatory harassment prevention training deadlines.The governor also
vetoed several CalChamber-opposed bills, including AB 589, which would have created overly burdensome requirements for employers to post and provide employees with a “Worker’s Bill of Rights,” among other things. The governor also vetoed Senate Bill (SB) 218, which would have amended the Fair Employment and Housing Act (FEHA) to allow local governments in Los Angeles County to enact their own anti-discrimination ordinances similar to the FEHA, creating uncertainty, inconsistency and confusion

regarding the FEHA’s application and interpretation. New laws have been passed in recruiting and hiring; discrimination, harassment and retaliation protections; leaves of absence and benefits; workplace safety; arbitration; privacy; and wage and hour. Below is a brief overview. The full article/ PDF can be found under the “Member News/Chamber Updates” tab on MyChamber.org. Unless otherwise noted, the new laws took effect on January 1, 2020.
RECRUITING AND HIRING
One of the most significant and widely publicized bills to emerge from last year’s Legislature was AB 5, which codifies and expands the “ABC test” that’s used to distinguish employees from independent contractors under the Industrial Welfare Commission (IWC) Wage Orders. Under the ABC test, a worker is classified as an employee unless the employer can establish all three of the following: A. The worker is free from the hiring entity’s control and direction in connection with the performance of the work, both under the contract for the performance of the work and in actually performing the work; B. The worker performs work that’s outside the usual course of the hiring entity’s business; and C. The worker is customarily engaged in an independently established trade, occupation or business of the same nature as the work performed. AB 5 carves out numerous exceptions from the ABC test for various industries.
DISCRIMINATION, HARASSMENT AND RETALIATION PROTECTIONS
California’s Legislature is still working toward increasing employee protections for 2020; it extended the amount of time a harassment or discrimination victim has to file a complaint, as well as expanded both lactation accommodation requirements and anti-discrimination laws. The Legislature also passed several bills related to harassment prevention training.
LEAVES OF ABSENCE AND BENEFITS
California passed several bills expanding access to various leave of absence protections and other benefits, expanding leave protections under AB 1748 to include protected leave for organ donation, a change to how California law defines “domestic partnership), and
increasing the maximum duration of Paid Family Leave (PFL) benefits from six to eight weeks, per SB 83.
WORKPLACE HEALTH AND SAFETY
The Governor signed several new bills related to workplace health and safety this year. AB 1805 changes the definitions of “serious injury or illness” and “serious exposure” to align with the federal Occupational Safety and Health Administration (OSHA) standards. Under current law, employers must report to the California Division of Occupational Safety and Health (known as Cal/OSHA) a “serious injury or illness,” which is defined as requiring inpatient hospitalization for more than 24 hours for reasons other than medical observation or tests. AB 1805 removes the 24-hour minimum hospitalization requirement. This means employers will have to report all inpatient hospitalizations, regardless of the length of stay. The bill also updates the definition of “serious exposure” to mean exposure to a hazardous substance that has a “realistic possibility” of death or serious physical harm (versus current law requiring “substantial probability” of death/ serious harm).
AGREEMENTS
The governor signed several bills affecting agreements between employers and employees, particularly arbitration agreements. First, AB 51 effectively bans mandatory arbitration agreements entered into between employers and employees. The bill specifically prohibits an employer from requiring an applicant or employee to waive any right, forum or procedure for any employer violations of the FEHA and the Labor Code.
PRIVACY
The 2018 California Consumer Privacy Act (CCPA) changed the consumer data collection rules, allowing consumers to know about and request deletion of data that businesses collect about them, among other things.
WAGE AND HOUR
The Legislature passed several bills addressing the payment of wages and penalties for failure to pay wages, some of which were limited to specific industries. Current law imposes, independent from other penalties, a civil penalty on employers who fail to pay wages as provided in certain sections of the Labor Code.

ach January the Corona Chamber of Commerce Board of Directors assigns a Board member to act as its Chairman for the calendar year. For better or worse, for 2020, it is my name landing on the rotating position. It is an honor to be Chairman, but the Corona Chamber of Commerce is not about individuals. That’s a good thing, because for over a century, thousands of people have been responsible for the longevity and success of the Chamber. Just as all of those who have served in our long history, we are just passing through, to be replaced by others who will volunteer. The Corona Chamber of Commerce is an institution in the Circle City. Its membership has included leaders from not only businesses, but non-profits, government and education. For most of its existence, the Chamber of Commerce has been either fully or partially subsidized by the City of Corona. From its founding for over sixty years the city did not have staff to take care of regulation compliance or business and public queries. The city and the Chamber continue to partner for specific services and programs. The Corona Chamber is dedicated to sustaining the positive aspects of

Corona. Never has membership support been as important as it is today, because it has never been as difficult to work through the codes, taxes, laws and legislative actions that now govern California businesses. Our Chamber’s Legislative Action Committee monitors government actions and the over 100 pieces of new business legislation passed in our State each year. Despite the importance of what is at stake, we will still hear people ponderously lament that they do not see a “value in Chamber membership.” It is a preposterous belief considering all that the Chamber does to enrich our community. Of course, the fact is that those entities that do not participate with financial support, will by virtue of their location, receive the benefit of our works. It is sad to realize however, that without their support, we are not able to accomplish as much as we can with it. As is the annual custom, this year will quickly pass. We can but ask that you will join our endeavors to grow the Corona Chamber of Commerce and extend its influence to protect local businesses while continuing the orderly evolution from the one time rural “Lemon Capital of the World” to an important Southern California center of commerce.

ADVOCACY OUTREACH IS VERY IMPORTANT FOR OUR BUSINESS COMMUNITY, AND FORECASTING THE ECONOMIC SITUATION IS ON THE FOREFRONT OF ALL OUR MINDS.
D
o we expand, or do we hold for that inevitable oncoming recession? Looking at the stock market, job growth, and recent agreements with other nations tend to be great indicators for a bright future. The CORONA Chamber partnered with 3 Orange County Chambers to host an Economic Forecast at The Richard Nixon Presidential Library in February. The featured speaker was Dr. Chris Thornberg, founding partner of Beacon Economics, who shared an overall optimism specific to economic growth in the year ahead. “This expansion is going to continue,” stated Thornberg, referencing the pessimism in the last year—the economy is just fine. Regardless of the distractions in Washington, D.C., business owners realize it is imperative to focus on their business. I often challenge top leaders to consider investing in their own development. Last issue, I shared about the many seminars and workshops we offer for the business community. The 2nd Monday of each month at 8am we offer Coffee with an Entrepreneur, where we invite an established business leader to share their experiences and provide tidbits and ‘nuggets’ for others to benefit. In February, the CORONA Chamber presented letters to the City of CORONA Planning & Housing Commission and the CORONA City
Council. These letters were in support of proposed projects that could bring in excess of 1,000,000 sq.ft. of light industrial /manufacturing and R&D buildings. These 15 buildings on one property and another location in CORONA vary from multi-tenant buildings with multiple suite sizes to a larger building, with one just over 250,000 sq. ft. These projects will enable residents to have options on working locally! Part of our CORONA 2020 program is to eliminate miles traveled, and another component of the Public-Private partnership is to create more jobs. The CORONA Chamber maintains our efforts in Representing the Interest of Business with Government! Catalyst | Convener | Champion – these three words best describe the CORONA Chamber’s focus and direction for continuing to lead the communities we serve. Our membership base is growing, and many top executives have selected to apply for our coveted Executive Leadership Roundtable (ELR) program. This 9-month program consists of 10 full day sessions for a better understanding of how our community functions. The ELR 2020-2021 applications (due in July, and sessions begins September) are available online at MyChamber.org, and our ELR 2.0 program is enrolling now for a July start (ELR completion is a prerequisite). Personal Development is something serious business leaders embrace. Recently I joined a “Business Book Club”, where a group of professionals agree to read a book a month (#ReadersAreLeaders). The group is regional, and available to log on via Facebook. I extend to you the opportunity for you to join us on the 3rd Wednesdays from 4pm – 5pm, as we explore and share the various topics, findings and interpretations each author provides. A
number of Corona businesspeople were fortunate to attend a luncheon at the Nixon Library, hosted in part by the Corona Chamber of Commerce (in partnership with Brea, North Orange County and Yorba Linda Chambers), featuring Dr. Christopher Thornberg, founder of Beacon Economics. The short answer to when the next recession will be upon us is: There are no major indicators currently pointing at any correction in the economy.

THERE ARE NO MAJOR INDICATORS CURRENTLY POINTING AT ANY CORRECTION IN THE ECONOMY. Over the years I have attended a number of economic forecasts by a number of economists, before, during and after the Great Recession, so you learn to interpret their analysis with what you know personally from your own business and acquaintances. Dr. Thornberg is very engaged and obviously very knowledgeable in the economy of Southern California. A number of cities and counties rely on Beacon Economics to give them forecasts that they use to help map the future. From what I have seen in our business and with the business owners I come in contact with, most everyone is very positive in the direction the economy is headed. One of his slides showed the strength of the Corona economy, with over 70,000 jobs including 12,000 in manufacturing and 12,000 in construction. When you compare this to other cities, it shows the years of growing Corona’s manufacturing base has worked quite well. These are all well-paying jobs, with skills that allow employees to grow in their companies. Corona is also very fortunate to have headquarters or main offices for a number of national

n 1896, an Italian economist named Vilfredo Pareto observed and recorded peculiar data trends in his country. Most notably, he found that 80% of the wealth in Italy was controlled by 20% of the people. Additionally, Pareto noticed that 80% of the land was owned by 20% of the population. Through the centuries, Pareto’s observational process was applied and repeated by others. And the same correlations and observations were replicated in various scenarios. To recognize Pareto’s accomplishment, these correlations and observations are now more commonly called the 80/20 Rule, or the Pareto Principle. Essentially, the rule states that 80% of an effect is from 20% of the source or input. The Pareto Principle is found everywhere and in all aspects of society. In our personal lives, there are countless of examples of the 80/20 Rule. Some examples include 20% of wardrobe is worn 80% of the time. Consider your friends. Chances are that you spend 80% of your time with 20% of your friends. And with technology, 20% of all the features on a cell phone are used 80% of the time. In the business world, examples are as numerous. Twenty percent of employees account for 80% of absences. Twenty percent of investments account for 80% of gains. Twenty percent of the sales team accounts for 80% of sales. Twenty percent of factories account for 80% of the pollution. A fascinating extension of the Pareto Principle is that you can extend the 80/20 Rule into further observations and analysis. For example, you determine that out of all your products in your inventory, 20% of the products account for 80% of product
sold. In other words, if you have 100 different product offerings, you find that 20 of the products are bringing in 80% of the sales. Then you can apply the 80/20 Rule again within the 20 products. Applying Pareto’s Principle to the 20 products, you will find that four of the products (20%) contribute to 80% percent of the sales within the 20 products. In the end, you will be able to determine the products that impact your business most. Another important focus with the 80/20 Rule is your clients. You will find that 20% of your clients are directly responsible for 80% of your sales. You can then drill down within your database and find that within the 20% of your clients, 20% again is responsible for 80% of the revenue. If the principle holds true, you will find that only a handful of clients are responsible for a big part of your sales. The aforementioned examples are just the tip of the iceberg. If you view and observe your life and business with the lens of the Pareto Principle, I promise that you will discover countless more examples and observations. Then you can make educated executive decisions and actions that will positively affect your business and life by focusing on those 20%. The huge implication and takeaway is that every unit of time that you expend will be more effective and efficient. Leaps & Bounds Celebrates 10 Years of Helping Children in our Community I
n 2010, Leaps & Bounds Pediatric Therapy started in a tiny space, with a big mission: to bring quality therapy services to every child in need
in the Inland Empire. It started with physical therapy, and just Dr. Cassandra Sanders-Holly PT, DPT, PCS, Director/Founder, finishing year one with 3 special kids. Their mission has grown far beyond the original scope, adding programs out of sheer, apparent need. Along the way, they have added occupational therapy, speech therapy, adaptive riding, parent support, community riding lessons, recreational horsemanship camps, and sibling support programs. Each of these were inspired by a specific family who said, “wouldn’t it be great if...” and they just keep going. As they approach their 10-year anniversary this June, it is amazing to think about what has been accomplished. At the end of 2018, they were
preparing to move into their brandnew forever home. They added 11 top-notch staff members and grew to serve 803 patients to the tune of 20,839 visits over 2019. That is 3,344 more visits than 2018. Their Adaptive Riding Team completed over 2,400 adaptive riding lessons, where these special kids get to continue to learn important community life skills, woven in with the joys of horsemanship. With the increase in space and staff, they have been able to decrease waitlist times for services. Siblings are receiving some incredible support with the expansion of their sibling group, and parents continue to share joy, resources, tips, cries, and hugs. Leaps & Bounds Pediatric Therapy continues to be the only center in the state to accept insurance coverage for the use of hippotherapy, and have grown to serve more children, while other private practices shrink and close. Leaps & Bounds is not just a place where kids receive therapy. They are a community. All measurements of the effectiveness of the plan are from third parties. Employers independently confirm the jobs here they created or brought to Corona since December 2017. The measurement of likely commute times is based upon publicly available statistics generated by CalTrans, the State Department of Finance, and the federal government. “We first started working on this plan in May 2017 to help our community eliminate unnecessary traffic from all the roads and highways we worked so hard to improve,” said Anthony Edwards, Chamber board member and Legislative Action Committee chair. “And the best part of the plan is helping 2,500 of our neighbors build their careers with new local jobs.” Employers participating in Corona 2020 are helping area businesses save more than $7 million in lost economic wages and opportunity according to statistics from CNBC. “Traffic delays are one of the leading economic challenges that face any operation on a daily basis,” explained Mike Ryan, long time Corona Chamber board member and 2019 Chamber Chairman. “Anyone who has sat in a weekday slowdown knows how costly and maddening traffic is to schedules, employees,

and customers. We have been working hard to improve our job market and keep roads operating efficiently, and Corona 2020 has worked.” The public private partnership with the City of Corona already has been recognized by the State Legislature for being the first of its kind in the state to combine economic development with a daily traffic savings measurement. “To us, great new jobs have a daily impact that you can measure improving the quality of life in Corona,” stated Don Williamson, the 2020 Chair of the Corona Chamber. “Historically, Corona has been a regional leader in business development and in being home to innovators. It’s great to see Corona 2020’s success.” Corona 2020 will run through the end of the year with monthly updates of progress forthcoming. NSWC Corona’s Data Analytics Enables Navy to Dominate the Threat
T
o fight the great power competition at sea and abroad, data analytics is what the Navy needs, and Naval Surface Warfare Center (NSWC) Corona has it. That was the message imparted by Capt. Khary W. Hembree-Bey, commanding officer of NSWC Corona. “We’ve been doing data analytics before it was a thing,” said Hembree-Bey. “And we are a primary resource for the Navy for data science and engineering.” As the Navy faces ongoing challenges from adversaries, its leadership has emphasized the need to leverage technology to dominate the threat. For decades, NSWC Corona has served as the Navy’s independent assessment agent, gauging the Navy’s warfighting capability by providing analysis and assessment of fleet readiness and system performance and measurement accuracy to ensure the Navy’s warfighters have the tools to train, fight and win. As the Navy invests in technologies such as cyber security, unmanned vehicles, artificial intelligence, machine learning and digital twin, it seeks the partnerships of industry and academia to help achieve its goals. “The data is a conduit that helps the fleet better understand its readiness,” said Hembree-Bey. “You don’t just want the information; you want it to be predictive. We’re looking at the realm of what’s possible.” Private industry helps the warfare
center meet more than $255 million in annual contracting requirements, with $84 million in small business contracts. NSWC Corona also partners with local universities and high schools to place students in internships and STEM positions, helping to bridge the gap between schools and industry. Along with a science and engineering workforce of more than 3,700 civilians, contractors and military personnel, partnerships with industry and academia enable the command to carry out its mission. “We are here to enhance readiness and lethality,” said Hembree-Bey. Naval Surface Warfare Center Corona, headquartered in Norco, California, is the Navy’s premier independent analysis and assessment agent, using measurement, analysis and assessment to enable our warfighters to train, fight and win. The center analyzes warfare and missile defense systems, provides systems engineering for Live Virtual Constructive training ranges, and advises and administratively manages measurement and calibration standards for the Navy and Marine Corps. The Crossings opened in 2004. Laura Whitaker, the president of Castle and Cooke, the owners of the Crossings came to city council to provide an update. First, over 86% of the center is currently occupied. The Crossings has approximately 1 million sq. ft. of rental space. In the past year, over 276,000 new sq. ft. were leased long term. Another 35,000 sq. ft. is in process now. Over a 1/3 of the center has brand new leases. The Crossings is a legacy project for Castle and Cooke. Castle and Cooke
City staff and I met with the property management and the new owners of The Shops at Dos Lagos to express our support for Dos Lagos to be an entertainment/shopping/dining destination for not just Corona, but the surrounding area. Over the next couple of months, we will be looking into ways we can ease regulations to spur growth. The new owners understand this and are looking to add additional restaurants and other experience-oriented tenants. Minutes Mattered for Quinn Carney … After two heart attacks, Carney knew just what to do when he experienced chest pain. He went straight to Corona Regional. It wasn’t a heart attack this time, but in the cardiac catheterization lab, cardiologist and Medical Director Sumit Khandhar, DO, detected major blockages in Carney’s artery, known as the “widow maker.” Dr. Khandhar used the minimally invasive, life-saving PCI (percutaneous coronary intervention) procedure to clear the blockages. Corona Regional is approved and licensed as a PCI facility by the California Department of Public Health for specialized cardiac care.
