There is a 3 week swim clinic for all new swimmers 4 - 10 year olds. The cost of the clinic is $60. The coaches work with the swimmers and will determine if they are ready for the meets. It is the coaches’ decision after the 3 week clinic to allow the non swimmers to stay on the team for the season. If the coaches feel the new swimmers are ready for team and the swimmers want to stay with the team there will be an extra team fee.

DEED RESTRICTION REVIEW IMPROVEMENTS/MAINTENANCE OF DWELLINGS The deed restriction violation reviewed in this issue is maintenance of dwellings. Once again, this is an overview and there could be specific issues that are not covered. For additional information feel free to contact the Deed Restriction Department at ACMP, Inc. 281-855-9867. The Association regularly cites properties with the violations such as paint house/ACC required, paint garage doors, repair or replace garage doors, paint mailbox, replace roof and paint or replace house trim, among other violations regarding the maintenance of a dwelling or a house. In most cases these are referred to as exterior maintenance. A successful realtor has stated items that create good property values. One of those items was the neat, attractive appearance of the house and mailbox. There are several issues to keep in mind when discussing exterior maintenance. These will be presented following the discussion of the Covenants & Restriction. Every section of Glencairn Community Improvement Association, Inc. has a restriction regarding exterior maintenance. Once again, the restriction regarding maintenance of dwellings or exterior maintenance was not something the Board instituted but was put in place by the Developer. The restriction was put in place to ensure neat, attractive dwellings that are in harmony. Dwellings or structures not maintained or with a wide variety of colors all over the spectrum present unsightly appearance in the neighborhood. This in turn would cause property values to decline. Most sections of Glencairn C.I.A., Inc. have the following restriction regarding improvements or alterations to a structure or property. “Article VII, Section 2 If in the opinion of the Committee the exterior of any dwelling is in need of repair or maintenance, the Committee shall notify the

Owner thereof in writing of the need of such repairs or maintenance and if such repairs or maintenance are not accomplished within thirty (30) days of said notice, then the Committee may proceed to have such repairs or maintenance work done for the account of and payment by the Owner and the Owner shall pay upon demand the Committee’s cost , together with interest at the rate of ten percent (10%) per annum until such payment is made and reasonable attorney’s fees if referred to an attorney for collection.;” And “Article IV, Section 2: Architectural Control. No building shall be erected, placed or altered on any Lot until the construction plans and specifications and a plot plan showing the locations of the structure have been approved by the Architectural Control Committee, hereinafter established, as to the quality of workmanship and materials, harmony of external design with existing structures and as to location with respect to topography and finished grade elevation.” These are the Covenants and Restrictions you agreed to abide by when you purchased your property in Glencairn. Since these were established the State of Texas has passed legislation, which states: Section 204.010. (6) “Powers of Property Owners’ Associations…regulate the use, maintenance, repair, replacement, modification and appearance of the subdivision;” The majority of the aforementioned deed restriction letters should have an accompanying Architectural Change Request for the ACC committee to review, approve, disapprove or request additional information. Several past Boards and the current Board were concerned with the “in the opinion of the Committee” wording in Article VII, Section 2 of the Covenants and Restrictions. These Boards have worked on a set of ACC Guidelines that can be distributed to members in an effort to make them aware

of the improvement guidelines. These guidelines also state that there is an approved color chart available at the management company office or at Sherwin Williams to select exterior paint colors. You do not have to purchase Sherwin Williams paint, if you prefer another brand, just take a sample to the store where you wish to purchase your paint from. Once again, when the color is selected, it must be submitted along with the ACC form to the committee for approval.
The Association could have the attorney send a letter to the property owner requesting the violation be corrected. There is definitely a charge associated with this avenue of enforcement. If the Board chooses to take the attorney avenue for correction of the violation and the violation is not corrected, the next step is a lawsuit. Once this step is taken, legal fees increase rapidly. The Association could send a “President’s” letter, which is a final appeal from the Association for the violation to be corrected.
The Association, its Board of Directors and management company have a responsibility to enforce this deed restriction. The Board believes the enforcement procedure is fair and offers property owners the opportunity to explain any problems regarding improvements or alterations to a structure or property.
The Association does not want to file lawsuits for any deed restriction violations. If homeowners communicate with the Board, they have always worked with the homeowners. The same would apply in this situation. The key issue is communication. The Board is usually left with no other choice but to file a lawsuit for the majority of the exterior maintenance violations due to nonexistent written communication from homeowners.
The management company inspects the subdivision twice a month. If there is a need for exterior maintenance observed a first class letter will be sent. Every attempt is made to be as specific as possible in an effort to help identify the violation and have it corrected. However, this does not mean each and every situation can or will be addressed. The first letter states that if there are extenuating circumstances or you believe the letter is in error, you should contact the management company. If the ACC form is returned within the ten days stipulated in the letter this serves as the response. If the ACC cannot be returned within the ten (10) days then the homeowner needs to inform the Association when the violation will be corrected. If the violation has not been corrected and we have not received any response from the owner by the subsequent inspection, certified letter is sent. A picture is taken at the time the violation(s) is observed during the second inspection. The charges for the certified letter and photo are the responsibility of the property owner in accordance with the Texas Property Code. If the violation still exists during the subsequent inspection, it is placed at Board Direction. The violation has now existed at least six weeks. The Board will inspect the property to observe the violation and will take one of three courses of action. If the maintenance is not to the structure itself or will not cause any type of damage to the structure or property, the Association may have a contractor correct the violation. The charges for enforcement of deed restrictions are the responsibility of the property owner but the Association must pay the expense up front and get reimbursed by the property owner.

MEETING MINUTES The January 13, 2016 Meeting of the Members minutes were not reviewed because the were not in the Glencairn Chatter. Resolved, the minutes were not in the Chatter, this matter was tabled until the March meeting. 2016 ANNUAL MEETING The Annual Meeting of the Members is scheduled for April 2, 2016. In accordance with Texas state law anyone desiring to be place on the ballot for the Annual election must submit their name in writing to the Management Company by March 21, 2016. COMMITTEE REPORTS LANDSCAPING No Report POOL REPORT A slide is being installed at the Cairnway pool. A new diving board and stand are being installed at the Kieth Harrow pool. New lifeguard stands are being installed at both pools. The tennis court is being resurfaced next week. EXECUTIVE MEETING BOARD ACTION 1. Approved $5,000 for Kieth Harrow pool repairs. 2. Reviewed correspondence from four homeowners and provided direction for management to take and a response to forward to the homeowners. HOMEOWNER FORUM No business transacted. NEXT MEMBER MEETING The next member meeting will be March 9, 2016, 7:50 PM. MEETING ADJOURNED The meeting adjourned at 8:11 PM.

Your Board of Directors are volunteers from your community that give up their time in an effort to make Glencairn a better place to live. More importantly, they strive to keep the property values up since your home is probably your single largest investment. We trust you will understand that Board members do not mind discussing association issues with members. We respectfully request that homeowners do not approach Board members away from Board or member meetings to discuss personal deed restriction or collection matters. The individual Board members cannot make a decision on an individual basis. It takes a majority vote of the Board to make a decision. That is why the Board meets on Mondays before the member meeting to discuss issues with members.
CALL SHERIFF’S OFFICE TO REPORT AFTER HOURS & ILLEGAL ACTIVITY If your home backs up to the greenbelt, please call the Sheriff’s Office at 9-1-1 if you see or hear suspicious people, underage drinking, graffiti artists or any activity after 10 PM, etc. Graffiti has extended to some homeowner fences and to the sidewalks. It is imperative that you call the Sheriff’s Office, give your address and explain that this area is behind your home in order to get this activity stopped. We are looking at solutions to this problem of recalcitrant teens and young people in their 20’s who have nothing better to do with their time than disobey the law and terrorize the neighbors. All common areas (the pool area, the parks, the civic center, tennis courts, etc.) in Glencairn are closed at 10 PM. After 10 PM, people at any of the common areas are in violation of the trespassing laws of Texas.

SLOW DOWN IN THE NEIGHBORHOODS
Almost everyone is aware that the Sheriff’s Office has adopted a zero tolerance of speeding and other violations of the law with a motor vehicle. That zero tolerance has resulted in an average of 50 tickets per month issued in Glencairn. The speed limit in residential areas, by Texas law, is 30 miles per hour. There are cautionary signs regarding slower speeds on curves. There are stop signs, which indicate the vehicle must come to a complete stop. Residents of Glencairn want to see a slower pace of traffic for the protection of all-especially the children. For some reason, the people of Harris County seem to be perpetually late. A suggestion for each of us is to leave five minutes early in order to avoid the impulse to speed. Develop patience; we do not want a fatality auto-pedestrian accident in our neighborhood or any serious accident caused by thoughtless speed. Be mindful of where you are driving.

In order to increase compliance and spread awareness, our office is requesting your assistance in informing residents in your community through your HOA newsletter or your scheduled HOA meetings of the need to obtain a permit for operating an alarm system, residential or business, within unincorporated Harris County. Many residents and businesses are unaware of the requirement to obtain an alarm permit once an alarm system has been installed and activated by the alarm company. Alarm systems are established and defined in the Local Government Code 233 (subchapter D), as well as the authority to regulate, adopt rules and impose penalties for unpermitted locations. Obtaining the required permit will avoid the issuance of a citation and excessive false alarm fees. The fee for current permit issuance is $35 with a yearly renewal fee of $10. All permit fees are waived for senior citizens 65 years or older. Under current guidelines, a permitted location is allowed five (5) free false alarms annually. Any subsequent false alarms during your permitted year are subject to a $75 fine that is billed to the permit holder’s address. If a site has an active alarm system, yet does not have a permit to operate such alarm, a false alarm may result in a Class C citation, which could range up to $500.

GARDENING TIPS FOR APRIL
Mulch - If possible, buy Bagged Mulch. Bagging helps eliminate a great many pests that die from various causes while in the bag. When you buy ‘loose’ mulch that is trucked to your home, you are also buying ants, roaches, termites, etc… Spend a little more on bagged material and save lots of future pest problems. Keep your mulch at least 4” - 6” below the top of your homes exposed foundation edge/side. This will aid in minimizing pests in your home and allow for quick and accurate termite inspections.

Lawn - Spring is the perfect time to do a fungicide treatment to stop brown patch in its tracks along with other fungi. If your lawn is thin and weak in some areas, here are some important fundamentals: a) lawn aeration b) fertilization c) weed control. Most important is proper watering: • Water once per week (unless you get a 1/2” rain or more then do not water.) • Water heavily (1” - 2”) for total lawn coverage. • In severe drought, water every 5th day. • Water from 5 AM to 7 AM in the morning - NOT AT NIGHT. • A heavy deep weekly watering makes the turf grow deeper, stronger and more drought resistant roots. • Less watering also saves you money!!
Shrubs, Flowers and groundcovers - Trim all shrubs/plants at least 12” - 18” back from your home. Do your best to create a plant free zone that is 18” - 24” wide around your home. The exception is your lawn - it can grow up next to the slab as long as you keep it 4” - 6” below the top of the slab. The most conducive to termite infestation are groundcover plantings, growing high against your homes exterior or (especially) ivy that grows on your walls. Trees - Spray your trees at least twice annually. The spring spray eliminates overwintering pests and fungi while preparing trees to resist the pest onslaught of summer with residual pesticides. The

DAISY DASH 5K FUN RUN AND KIDS 1 MILE RUN The Daisy Dash 5K Fun Run and Kids 1 Mile Run will be held Saturday, April 23, 2016, at the Jersey Village Park Pavilion in Jersey Village, Texas.
