MONTHLY MEETING OF THE MEMBERS JANUARY 10, 2012 Pursuant to Article V, Section 3 of the RESTATED AND AMENDED BY-LAWS OF THE GLENCAIRN COMMUNITY IMPROVEMENT ASSOCIATION the Regular Monthly Meeting of the Members was duly called and held on January 10, 2012 7:30 PM at 17030 Kieth Harrow Blvd, Houston TX 77084. IN ATTENDANCE Directors Coy, Kohler, Mendieta and Rocha were in attendance. Management representative Brandi Leal and homeowners listed on the sign in register were also in attendance. MEETING MINUTES The Members approved the November 8, 2011 Member meeting minutes as they appeared in the Glencairn “Chatter.” COMMITTEE REPORTS Landscaping Director Kohler has scheduling a contractor to work on trees throughout the community. The Board of Directors has approved Silversands 2012 Landscape Management proposal in the amount of $3,841.77 a month. The Association budgeted $4,167 a month for this contract in 2012. This price includes additional weed treatment and fertilizing.
CRIME WATCH Officer Marin informed resident that burglaries were up in the month of October. During the holiday season crime was down. Please ensure that you lock your car door and secure your house and anything else of value are secure. Be aware of your surroundings at all time. If you see suspicious people walking the street call the police. If you feel like somebody is following you home, go a different way or call the police. Harris County has a new phone app: I WATCH HARRIS COUNTY. You can log in and send a report via cell phone. HARRIS COUNTY SHERIFF’S Paul Anderson informed residents that the Harris County Sheriff Citizen Police Academy will be offering a class on February 2, 2012 at Second Baptist Church from 7:00 pm-10:00 pm. For information, contact Director Patty Hill. OPEN FORUM The Board of Director inquired if residents from the floor had any issues to discuss with the Board regarding issues in the community. Resident inquired if the article that was in the December 2011 Chatter referring to “Parking cars that block the sidewalk” is truly a law. She would be happy if this is an enforceable law. Resident inquired if the most common deed restrictions and number of letters that went out for these violations, could be listed in the Chatter on a monthly bases. She stated that it use to be in the Chatter years ago, but for some reason it hasn’t been in the newsletter in several years. Residents inquired if the “Glencairn Complaint Form” could be changed. Residents stated that they would like to remain anonymous when submitting in these forms. Residents stated that the Associations current bank information should be included in the Chatter. Several people have had their checks returned from the previous Bank that the Association used. The Board stated that they would have this information added in the next issue of the Chatter.

KB HOMES MERGER The Board will be meeting with KB Homes officials this week to discuss a possible merger with Berkshire Place or a facility use agreement. DIRECTOR VACANCY The Board of Directors appointed Orlando Mendieta to serve the remaining time of former Director Wyatt’s term. There still is one more vacant position on the Board of Directors. An article will be placed in the Glencairn Chatter announcing the vacant position that still is open. Please contact ACMP if you are interested in becoming a Board member. LEGISLATIVE DOCUMENTATION All legislative requirement changes and facility use rules approved by the Board of Directors were forwarded to the Association Attorney by December 29, 2011 for filing. FORECLOSED AND PREVIOUSLY OWNED ACCOUNT WRITE OFFS The Board wrote off $9,843.42 to bad debt. These funds were assessments owed by homeowners foreclosed on by the first lien holder (Mortgage Company). When the first lien holder forecloses it wipes out the Association’s lien on the property. The Association could proceed with attempts to obtain a personal judgment against the former homeowner. However, the Association attorney has stated that the cost of obtaining a personal judgment is high. The likelihood of collecting any funds is slim and the Association is better off writing off these assessments.
ANNUAL MEETING INFORMATION The Attorney prepared the necessary information and procedures for the Annual Meeting and election to be in compliance with new state statutes. CHRISTMAS EVENT AND DECORATION APPRECIATION The Board would like to express their gratitude for the tremendous job the Swim Team did decorating the Civic Center and hosting the Breakfast with Santa event. The decorations are excellent. The Board would also like to thank all residents for cleaning up the streets after New Year Eve celebrations. The Board met with four (4) out of ten (10) homeowners that requested a meeting with the Board. The Board reviewed correspondence from fifty-eight (58) homeowners and provided responses for Management to forward and action for Management to take. NEXT MEMBER MEETING The next member meeting will be February 14, 2012. MEETING ADJOURNED The meeting adjourned at 8:30 PM.

Suspicious activity: people hanging out late at night, cars which “come and go” rather quickly at an address, young individuals with no visible means of support who are “living well,” unknown persons who perpetually drive through the subdivision, etc. We all know what suspicious behavior is by now. If it is ongoing, please email me with it. If it is a possible crime in progress (unknown truck backed up to your neighbor’s house while they are on vacation), call it in. If it is a crime in progress, call 9-1-1, if you are reporting something after the fact, call the 713-221-6000 number. And yes, there is a long hold. But the more calls that dispatch receives from our subdivision, the more that our deputy knows about problems, which might be hidden from view. Whenever possible, get a license plate number, color and make of a vehicle on suspicious vehicles. You can share these with me, as well as call dispatch. I will forward these to our deputies. Personal Safety and Home Security While we all know that we don’t get a 24-hour bodyguard free of charge from Harris County, we often do not think of the ramifications of not maintaining an awareness of our surroundings and the security of our homes and vehicles. We must talk with our children about caution in public places and security within the home. The Sheriff’s Office offers the RAD (Rape Aggression Defense) course for women of all ages (13 to 85 years). This is an excellent course that offers instruction and hands on methods of defending yourself and escaping an attacker. Call the Fry Road Storefront for availability of classes. The problems now are much more threatening than in the past due to the lack of pro-active, marked patrol units’ presence in our commercial areas. On another note, three arrests have been made in the bludgeoning death of a man in the Silvermill subdivision. It seems he was dealing drugs. This is a risky lifestyle for both the drug dealer and the drug dealer’s family. Capital murder charges have been filed on this one. Farm Animals A turkey was running free between two homes. Also reported was a house that has chickens in the backyard. As most of you know, farm animals are a violation of deed restrictions and a health hazard in a densely populated area such as our subdivisions. If you know of an address that is keeping farm animals of any type (chickens, turkeys, ducks, goats, sheep, cattle, etc), please let me know and I will forward on to the offices of A.C.M.P. so that these can be removed expeditiously. This is not Green Acres and this kind of activity is not acceptable. Please let me know about the abandoned homes and provide any information you can on any suspicious activities and farm animals. DEPUTY JESSE MARIN
RECEIVES DEPUTY OF THE YEAR AWARD. Deputy Marin came to work at the Sheriff’s Office on January 28, 1991. He worked several assignments before ultimately transferring to the Patrol Bureau in 1999. As a patrol deputy, Deputy Marin is always willing to assist his fellow deputies and his bilingual ability to translate has proven invaluable in numerous cases. During the calendar year 2011, Deputy Marin apprehended twenty-three (23) suspects and recovered over $29,000,000 in property, thus clearing numerous burglaries of habitation/ burglaries of motor vehicle cases. Deputy Marin consistently works closely with Safe Home Task Force to develop suspect information and is continually searching for suspects. Anytime a burglary occurs, Deputy Marin researches the case and does as much follow up as possible to try to solve it and apprehend the suspects. Deputy Marin developed his crime fighting skills through: extensive knowledge of Glencairn, attention to detail, developing a good rapport through citizen contacts, and maintaining a vigilant pro-active stance to deter crime. Deputy Marin also takes an active role during in-Progress burglary calls through: quick response, sharing informa-
tion with deputies on scene, establishing and maintaining perimeters, conducting follow up investigation to recover property and gain intelligence to combat and/or prevent future criminal activity. Deputy Marin exemplifies the professionalism and commitment to serve the community that is expected of Sheriff’s Office personnel. His actions led to the apprehension of these criminals and may have prevented additional criminal offenses from occurring in the future by these suspects. Deputy Marin continuously represents the Harris County Sheriff’s Office in a positive manner. He is faithful to the department, his fellow deputies and the Glencairn Community. His dedication to duty is unwavering. He brings a “gung ho” attitude to everything he does and has a positive effect on all those around him. He is the deputy we want patrolling our neighborhood, watching over our families and coming to our aid should it be needed. Thank you Deputy Marin for outstanding service to the Glencairn Community. Board of Directors met with representatives of Sherwin Williams, located on Highway 6 a block before West Little York and provided them with the Association color chart. They will maintain this color chart for residents to use when selecting approved colors. This does not eliminate the submission of an ACC request form to paint your house. The ACC form must still be submitted to ACMP for approval by the ACC Committee. The discount will be for the purchase of paint, paint supplies and equipment. Sherwin Williams Duration paint line is excluded from this discount. Residents just need to inform the sales clerk that they reside in Glencairn. We sincerely appreciate this local business for taking an interest in Glencairn and we ask that you support them. However, you do not have to use Sherwin Williams paint. Again, the important thing is to submit an ACC form prior to painting. Your ACC Committee and Board of Directors do everything they can within the parameters of the governing documents, to work with all homeowners in a timely manner and on a one on one basis. COLLECTION POLICY The GLENCAIRN Community Improvement Association Board of Directors would like to inform the owners of the maintenance fee collection policy. The Board reserves the right to change this policy from time to time without notice to better serve the members of the Association.

Homeowners begin receiving their annual assessment and account statement usually between November 15th and November 30th of each year. These statements will list any balances owed to the Association and payment is due by January 1st, of the next year unless the account is being handled by the attorney. If the account is being handled by the Association attorney, then the next year maintenance fee assessment is still due by January 1st. All other balances are due at that time but you should contact the Association attorney at 713-780-4135 to determine the total amount owed. There will probably be some legal fees invoices that have not yet been received by our management company. Once again, if legal fees are displayed on the statement, then the owner should contact the Association attorney to determine the total legal charges owed unless stated otherwise. The assessment is due January 1st, becomes delinquent January 31st and is subject to the following actions when delinquent. The week of February 1st interest will accrue and be posted to any accounts that are delinquent. Additionally, a late penalty will be assessed to each delinquent account. A letter will be sent to each delinquent account stating the current balance. Once again, those accounts being handled by the attorney for prior year delinquent fees or lawsuits should contact the Association attorney at the phone number listed above. The letter will request payment within fifteen days or a certified letter will be sent by the Association and the homeowner will be responsible for all charges associated with the collection of this debt. If the payment is not received within fifteen days from the postage date of the first delinquent notice, a certified letter is sent by the Association to all accounts with delinquent balances. The same circumstances for accounts being handled by the attorney as stated above apply to this circumstance. The Association certified letter will state that an administrative charge plus postage has been added to the balance of the account for processing the certified letter. The letter will also state that payment of the balance is due within thirty days or a lien may be filed or the account will be turned over to the Association attorney. The owner will be responsible for all charges associated with filing and releasing of the lien and/or any legal fees incurred for the collection of this debt.

Delinquent accounts turned over to the attorney for collection will normally be handled in the following manner. A certified letter will be sent and a charge added to the account for the letter. A lien could be filed. If payment is not received within the specified time a lawsuit will be filed for collection of the assessment. This could ultimately lead to foreclosure. The Board of Directors does not want to foreclose on any property but has a responsibility to all the homeowners to ensure all fees are paid. It is unfair for other homeowners to bear the burden for homeowners that will not pay their maintenance fee assessment. However, the Board has, on a case by case basis, worked with homeowners unable to afford paying the assessment all at one time. This Board will continue to do so but if there is no communication from the homeowner, the Board has no other option but to proceed with the above collection policy. If every homeowner would pay their assessment on time, it would result in fewer expenses and less aggravation for everyone involved. The Association must expend some funds for the collection of delinquent accounts. This expenditure is passed on to the individual homeowners but still an expenditure to the Association until the homeowner reimburses the Association. GLENCAIRN CRIME WATCH Harris County Alarm Detail In order to increase compliance and spread awareness, our office is requesting your assistance in informing residents in your community through your HOA newsletter or your scheduled HOA meetings of the need to obtain a permit for operating an alarm system, residential or business, within unincorporated Harris County. Many residents and businesses are unaware of the requirement to obtain an alarm permit once an alarm system has been installed and activated by the alarm company. Alarm systems are established and defined in the Local Government Code 233 (subchapter D), as well as the authority to regulate, adopt rules and impose penalties for unpermitted locations. Obtaining the required permit will avoid the issuance of a citation and excessive false alarm fees. The fee for current permit issuance is $35 with a yearly renewal fee of $10. All permit fees are waived for senior citizens 65 years or older. Under current guidelines, a permitted location is allowed five (5) free false alarms annually. Any subsequent false alarms during your permitted year are subject to a $75 fine that is billed to the permit holder’s address. If a site has an active alarm system, yet does not have a permit to operate such alarm, a false alarm may result in a Class C citation, which could range up to $500. Should you or your residents require a copy of the permit application form or would like to review the regulations regarding permit requirements, you may do so by visiting the Harris County Sheriff’s Office website at www.hcso. hctx./net. The application can be printed from the website, then completed and mailed to our office with the applicable fees. We are currently in the planning stages of making the application and payment process available on-line for the convenience to the public. The Association has color guidelines that have been set by the Architectural Control Committee and approved by the Board of Directors. These guidelines are comprised of earth-tone and neutral colors. Bright colors will not be approved. If your house is already painted with an unapproved color, then it must be changed the next time it needs painting. However, if you paint it an unapproved color and then submit a change request form, either voluntarily or because you have been cited as being in violation, you will need to repaint the house immediately. Pet Tip: A very important thing you can do is have a collar with some form of ID and your phone number on it. Pet stores have special ID’s for your pets. Many pet owners are now “chipping” the pets. If found and taken to a vet they can scan chip and find the owner. If your pet has a rabies tag, the vet has your name and #. The first thing I ask a caller is “does the pet have ID on it.” If it does, I will help contact the # on the ID and get the pet to it’s owner ASAP. Or, the owner can pick up their lost pet. On March 24th 6 PM – 9 PM, Cypress Lakes High School and Louisiana National Guardsmen will partner together for an event to promote the importance of balancing life’s everyday challenges while also giving back to the community. Money will be raised providing donations to families of first responders, who themselves give back to our community and country on a regular basis. “Balancing Act,” is an opportunity for the students of Cypress Lakes High School, their clubs and organizations, members of the military/ first responders and other members in the community to show the importance of having balance in life. A representative of each group, club or organization will demonstrate their commitment to “balancing life” by doing handstand/wheel barrel walks down the main hallway of Cypress Lakes High School, which is approximately ¼ of a mile.
College representatives, health care providers, first responders and business owners will be on hand for support and to offer different opportunities for students and the community to learn ways to balance academics, health, well being, physical fitness and everyday life situations.
