Williamsburg Settlement MERRY CHRISTMAS!

By the time you are reading this newsletter we will be just a few days away from the Thanksgiving holiday and hence well on our way to Christmas. It’s a wonderful time of the year, especially for those of us who are fortunate enough to be able to spend it with our families. It can also be a financially challenging time as we figure out how to stretch our budget to cover all of those “must have” items on our respective holiday shopping lists. And to make the exercise even more challenging, it is also a time when a few of the big annual bills roll in, two of the major ones being our property taxes and our annual maintenance fees! But while in this process, let’s not forget those less fortunate than ourselves. However deprived we may feel, we are immeasurably more fortunate than so many people in this World. This is a good time of the year to reflect on this, help as we can and never forget to give thanks in our own way for our many blessings.

Whether you are staying home for the holiday or plan to travel, have fun but take care. Remember there is a whole new year awaiting just around the corner. Make sure that you and your loved ones are around to enjoy it!

CHRISTMAS YARD OF THE MONTH DECORATING CONTEST

One of the good things that Christmas brings us is the opportunity to see and enjoy the beautiful decorations that many of our residents put up in celebration of the Christmas Holiday. In accordance with our long tradition, we will once again be holding the Christmas Holiday Yard Contest. On the weekend of December 17th and 18th, we will choose a 1st, 2nd and 3rd place yard and put the corresponding award signs in these yards where they will remain for the remainder of the month. Photographs of these award winners will also be posted on our website and these winners will be mentioned in the February edition of the community newsletter. Williamsburg Settlement is such a beautiful subdivision all year long and at Christmas, our residents really make the neighborhood sparkle. So, be sure to get your lights and decorations up early and maybe your yard will be chosen this year!

2011 LEGISLATIVE CHANGES

There are a number of changes to the laws effecting Texas Homeowner Associations that must now be complied with, most of which become effective on January 1, 2012. These affect the procedures for the appointment of directors, the handling of all documents that govern the way in which the Association

is run and the conduct of meetings. To bring our Association into compliance all of our governing documentation is now posted on our website www.wsmaonline.org and filed with the County. There is no reasonable method for updating the Articles of Incorporation, so they remain as written but where they are in conflict with the new laws, the laws take precedence. The Bylaws can be amended by a majority vote at a regular meeting of a quorum of the members, so a revision to this document has been drafted, reviewed by our Association attorney and posted on our website for access by our members. Approval of this update will be voted on at our Annual General Meeting next April.

A POLICY CHANGE IN THE POSTING OF MEETING MINUTES

A number of residents have commented on the fact that by the time they receive these newsletters, the meeting minutes that are included are so dated that their usefulness is questionable. For example, in this December newsletter the information was given to the printers on the 25th of October by which time the latest approved minutes were those given below for September. As approval of the minutes very rarely requires changes of any substance the Board has decided to amend the posting policy to allow the inclusion of the unapproved draft minutes, rather than the approved minutes, in subsequent editions of this newsletter. This will allow residents to have the information one month earlier. To make this transition, this edition includes both the approved minutes for September and the draft minutes for October. Future editions will just contain the most current draft. As a reminder, those who have used the Registration page of our website www.wsmaonline.org, to register their email addresses will continue to receive notifications immediately the draft minutes are posted on our website. This is usually within a couple of days following the meeting at which time they will also find posted the approved minutes of the previous month’s meeting.

The Board hopes that the residents who do not access our website but rely on these newsletters to learn of Board decisions will welcome this change.

With a quorum being established, the meeting was called to order at 5:38 PM. MINUTES The minutes of the August 16, 2011 meeting were reviewed and upon a motion made, seconded and approved, it was unanimously agreed to accept the minutes as written.

DOCUMENTS FOR NEW LAWS The Board reviewed the documents that need to be completed to bring the Association into compliance with the new laws passed by the Texas Legislature. Some of these documents are at the Association attorney for review. A motion was made by Larry Crain, seconded

by Walter Smith and unanimously approved that the documents be approved subject to any changes recommended by the Association attorney, and then filed with Harris County as required by the new laws.

ELECTRICITY PROVIDER Dave Ellis presented proposals for a new electricity provider. Prices from seven (7) providers were presented. After due discussion, a motion to sign a three (3) year contract with Brilliant Energy was made by Walter Smith, seconded by Larry Crain and unanimously approved.

TREE REMOVAL AND PRUNING Larry Crain presented three (3) proposals for work required to clear trees and foliage around the outside of our perimeter fence and the trimming of some trees in the recreational area and removal of two that did not survive the drought. After due discussion, a motion was made by Dave Ellis, seconded by Martin Spears and unanimously approved to accept the proposal from Garcia Tree Service.

REPAIRS AT POOL Martin Spears informed the Board that he has received two (2) proposals for the replastering of both pools, updating the drain, replacing some tiles; installing water line depth markers and replacing expansion joints around the pool and between the concrete sections of the pool deck. He will secure another proposal for this work and asked that a subcommittee be appointed to review all the bids and to present their recommendations at the October 18th meeting. It was agreed that the members of this subcommittee will be Martin Spears, Larry Crain and Dave Ellis.

POOL SHADES The Board discussed the proposal they had received for installing shades over the baby pool, play structure and on the east side of the

pool. After due discussion, it was decided this issue will be tabled for the present and revisited next year after the pool repairs have been completed TENNIS COURTS The board discussed that the canopy poles at the tennis courts are beginning to rust and will in due course require some attention.

PROPOSALS Larry Crain’s discussed his contention that when contracts for our various services come up for renewal, we should seek bids as opposed to necessarily limiting ourselves to renewal with the incumbent vendor. Furthermore, we should try to seek significant price reductions by requesting three (3) year rather than single year contracts so that we can use such savings to accelerating the perimeter fence renewal schedule.

2012 BUDGET The Board reviewed the preliminary budget. After due discussion and changes, the Board unanimously agreed to adopt the 2012 budget.

2012 RATE A motion to hold the 2012 annual maintenance rate at its current value of $700 was made, seconded and unanimously approved. The Board instructed PCMI to mail invoices November 1, 2010. Dave Ellis will prepare an insert to be mailed with the notices.

ADJOURNMENT There being no further business to come before the Board, the meeting was adjourned at 8:00 PM. The next meeting was scheduled for October 18, 2011 at 5:30 PM at the clubhouse, 1602 Hoyt.

DRAFT MINUTES OF THE MEETING OF THE BOARD OF DIRECTORS OF Wsma, INC.

OCTOBER 18, 2011 A meeting of the Board of Directors of the Williamsburg Settlement Maintenance Association, Inc. was held on Tuesday, October 18, 2011 at 5:30 PM at the Williamsburg Settlement clubhouse, 1602 Hoyt, Katy, Texas 77449.

ATTENDANCE Board Members present were Dave Ellis, Walter Smith, Martin Spears, Larry Crain, Floyd Ball and Don McClelland. Also in attendance was Dolores Sue representing Planned Community Management, Inc. (PCMI) and Officer Wayne Felchak.

With a quorum being established, the meeting was called to order at 5:35 PM. MINUTES The Board reviewed the minutes of the September 20, 2011 meeting.

A motion to accept the minutes as written was made by Walter Smith, seconded by Dave Ellis and unanimously approved.

HOMEOWNER CONCERNS There were four (4) homeowners present for various portions of the meeting.

A resident stated she had a concern as to why the perimeter fence is being repaired by volunteers. She sees the financials in every newsletter and wondered why that money is not being spent to hire a professional fence company. The Board explained that the cost to have the fence replaced by a contractor at this time would exceed the total funds currently available in the reserve account leaving nothing for the other items of our infrastructure - such as the replastering of the pool which is about to take place. The volunteers are working to extend the life of the existing fence while additional funds are being accumulated in the reserve so that when sections have to be replaced there will be money available for a professional contractor to perform the work.

PATROL SERVICE REPORT Martin Spears presented the patrol service report. He expressed his satisfaction of the service being provided.

CLUBHOUSE ROOF At this time, the Board re-arranged the agenda as the roofing contractor was present. The Board had contacted Mr. Osborn from FairClaims Roofing to inspect the clubhouse and pool building roofs for wind damage, as there is currently a water stain on the ceiling of the Big Room. Mr. Osborn determined that there is enough damage to warrant an insurance claim. The insurance company was contacted and a claim was submitted. Mr. Osborn made a second visit when the insurance adjuster came to inspect the roofs and was successful in getting the adjuster to agree to the damage and the claim was subsequently approved. Mr. Osborn was invited to provide a bid for the replacement work and was able to offer a complete replacement for the $18,347.94 that will be received from the insurance company.

Thus if his bid is accepted, this work will be performed at no outof-pocket cost to the Association. Dave Ellis explained that Willis insurance was very supportive in getting the claim resolved quickly.

The Board asked how long the roofing job would take. Mr. Osborn stated that the roofs can be replaced in two days. However, as the contract will also include repainting the big room ceiling, additional time will need to be allowed. The Board thanked him for coming to the meeting.

FINANCIAL AND DELINQUENCY SUMMARY Dave Ellis presented the financials. As of September 30, 2011, the money in the bank totaled $462,209.58. This includes checking, savings accounts and CD’s and is the money to cover both operating expenses and the necessary reserve to fund maintenance and replacement of the Association’s capital assets.

Delinquency for the month ending September 30, 2011 totaled $35,829.01.

OLD BUSINESS Perimeter Fence Repair Larry Crain presented the Board with a quote for materials needed for the volunteer repairs. This quote did not include coated screws.

The total was $1,288.67. He also explained he has received replies from eleven (11) volunteers, who will work on repairing the fence on Saturday, October 22, 2011, beginning at 8:00 AM. the volunteers will be meeting behind the Mobile station off Earl of Dunmore and Mason Road. A motion to accept the quoted price for the materials and the extra for the coated screws was made by Walt Smith, seconded by Don McClelland and unanimously approved.

The homeowners who are on email distribution will be advised so that pets can be secured while the fence work is in progress.

Two Perimeter Fence Repair Agreements whereby homeowners request permission to repair their section of the perimeter fence were submitted for two (2) addresses on Abby Aldrich. A motion to accept the agreements was made by Walt Smith, seconded by Larry Crain and unanimously approved.

Update on Trees and Shrubs Larry Crain informed the Board that the tree trimming and dead tree removal has been completed. Dave Ellis mentioned that he would like more foliage trimmed from the trees that border Hoyt, as there are still some branches that are obstructing the tennis court lights.

Basketball Court Striping Floyd Ball reported that the basketball court has been striped using the stencil that was purchased thus closing out this task. Floyd thanked volunteer Raul Moreno and Dave Ellis for handling this.

Additional paint is available to strip the lines around the court. Dave reported that the timer switch for the new lights has been broken and will shortly be replaced.

Pool and Baby pool Re-plastering Martin Spears presented three (3) proposals for the re-plastering of our pool, baby pool and repair of the deck expansion joints.

The proposals were from Lone Star, Hancock Pool Services, and Pools by Dallas. The proposals came in between $31,065.00 and $38,512.50. Martin explained that he has not yet had time to check the references so a motion was made by Larry Crain to allow Martin Spears to make a recommendation to Dave Ellis and Larry Crain, the other subcommittee members, for expenditure not to exceed $34,000 for the selection one of the three companies following his checking of references. The motion was seconded by Walt Smith and unanimously approved.

Document Update Dave Ellis reported that all new documents necessary to bring WSMA into compliance with the 2011 legislation and which the Board has authority to approve have been completed. These documents are now published on a new Governing Documents page on our website and are at the Association attorney for preparation of the updated Management certificate and filing with the County as is required by the new law.

NEW BUSINESS Landscape Contract As the existing landscaping contract with IMS expires at the end of October, Larry Crain has solicited competing bids from a number of companies. Of these companies, three (3) submitted bids, which Larry presented at the meeting. These were from IMS Landscape, Superior Lawn Care and Texas Lawn Care. The IMS bid was the most expensive.

After much discussion, Larry Crain made a motion to accept the proposal from Texas Lawn Care for the cost of $25,514 per year. This motion was seconded by Walt Smith and unanimously approved. As there is a 30-day termination clause in the existing contract, it was agreed that the new contract should begin December 1, 2011.

Clubhouse Roof Because the FairClaims Roofing Company worked with the Association and the insurance adjuster and is prepared to perform the roof replacement project at no cost to the Association, the Board felt there was no need to seek additional proposals. A motion to accept the contract in the amount of $18,347.94 from FairClaims Roofing Company was made by Larry Crain, seconded by Walt Smith and unanimously approved.

Martin will draft an email for Dave Ellis to transmit to the residents seeking volunteers for this task with the objective of having a proposal for Board approval of the necessary funds by the November 15, 2011 Board meeting.

Clubhouse Repair This issue was tabled until the November 15, 2011 meeting.

ADJOURNMENT TO EXECUTIVE SESSION At 7:20 PM, the Board adjourned to executive session to discuss Delinquencies, Deed restriction matters and contracts.

Playground Area Picnic Table The Board discussed the possible replacement of the bike rack closest to the playground with a new picnic table. With this approach, new table would be located on the existing concrete pad. It was agreed that the bike rack bordering Hoyt provides sufficient capacity for the bikes that are brought to the recreation area and thus there would be no problem in discarding second bike rack. Floyd Ball will be taking proposals for a new picnic table.

Yard of the Month Floyd Ball explained that due to the sensitive information that needs to be revealed as to whether a potential winner of the Yard-of-theMonth award is in good standing with the Association, the person responsible for administering this program should be a member of the Board. There had been some prior discussion of this issue and Board member Cyndy Thompson has agreed to take over this task from Leta Whisenhunt. This transition was accepted by the Board.

Floyd expressed his appreciation to Leta for her service as Yard-ofthe-Month administrator.

Contracts Floyd Ball reported that the pool service contract will soon be up for renewal and asked Dave Ellis to seek competitive bids for this service for 2012.

Holiday Decorations Martin Spears made the observation that the decorations we have used for many years at our entrances during the holiday season are

ADJOURNMENT At this time, the Board reconvened to open session to inform residents of decisions made during executive session. There were no homeowners present.

Decisions Made During Executive Session Delinquencies There were fourteen (14) accounts to which the Association had sent notices and received no responses. One of those has a sale pending and one had written an NSF check. The Board instructed the Association attorney to proceed with collection of all accounts currently at their offices for collection.

Deed Restriction Violations The Board instructed PCMI to send reminder notices to six (6) residents for repeated violations. The Board instructed PCMI to send one (1) violation to the Association attorney.

With no further business, the meeting was adjourned at 7:45 PM. The next meeting will be November 15, 2011.

This is just a reminder that the email addresses, to which emails from the WSMA Webmaster are broadcast, are those that have been registered on the www.WSMAonline.org website by the residents themselves. This email distribution list is used to disseminate important announcements to Settlement residents. However, email addresses do tend to be rather dynamic, as residents change their ISP for a variety of reasons and when they do so, unless they reregister their new email addresses on the Registration page of the web site, they will no longer receive these broadcast emails.

So please, when conveying a new email address to those in your address book, please also update our mailing list by removing your old email address and replacing it with your new one. This will ensure that you continue to receive the timely announcements on important Settlement activities.

And for those who have not yet registered, you are strongly urged to do so, as this is the best mechanism we have to quickly communicate with our residents.

RESIDENT DIRECTORY MAINTENANCE

If any resident wishes to change the information that they have previously provided for publication in the directory, they can do so by using the Residents’ Directory Entry Form accessible via the Registration page of our website www.wsmaonline.org. When the information is received, it will be updated on the database. If the resident indicates that he or she wants that information published in the directory, it will be sent out in a monthly update to all registered residents who can use it to manually annotate their copy and it will be marked for inclusion in the next edition. A log will be maintained of all changes since the last publication, which will be emailed to any resident who requests it. This way, the directory can remain useful throughout its operational life.

New residents to our subdivision are requested to use the same form to register their information for inclusion in the directory or to state

their desire not to have their information included. This request is included in the “Welcome Packet” given to all new residents, as soon as PCMI is made aware of the change in ownership.

STREET LIGHT OUTAGES

To report a burned out street light, any resident may call CenterPoint directly at 713-207-2222. However, for those with Internet access, you may also make this report on-line. For those interested, the website address to do this is http://cnp.centerpointenergy.com/outage. Then enter your contact details so that they can get back to you if more information is required. On the following page enter the details of the light(s) with the problem. Just as you would if reporting the outage via the telephone, you will need to provide the street address where the light is located and the 6-digit number that is prominently displayed on the front of the pole. Under normal circumstances the crew will be out to fix the problem within 7 working days.

Anyone noticing a streetlight that is out or has some other malfunction is encouraged to report the problem to CenterPoint via either of these two methods without delay. Our Association is charged for every streetlight each month, irrespective of whether or not the light is functioning. So please help us get value for your hard earned money!

Reminder About House painting

Residents need to be sure and pay attention to the state of the paint on their houses. Many of the houses in the settlement are of an age that they will soon need to be repainted or sided. Please be proactive in getting this done when necessary. Doing this before you have a problem will not only keep your house looking nicer, but doing it early can end up saving you money! But please remember that all such work does require Architectural Review Committee approval.

This is obtained by completing a “Request For Home Improvement Approval” form and mailing it to PCMI. A blank copy of this form is included in this newsletter and is also available on the Board Notices and Forms page our website at WSMAonline.org.

WILLIAMSBURG SETTLEMENT CLUBHOUSE AND POOL RENTAL

The Clubhouse is available for rental for non-profit activities to all residents in good standing with the Association The fees are as follows: BIG ROOM RENTAL FEE: Up to 49 people - $50 50-100 people - $75 Plus a refundable security deposit: No alcohol served - $100 Alcohol served or the attendance of 20 or more between the ages of 13 and 21- $200* SMALL ROOM RENTAL FEE: Up to 20 people - $30 Plus a refundable security deposit of $50 *Note that when alcohol is served, two security guards must also be on duty. The requirement for two is mandated by the Sheriff’s Department. When no alcohol is being served but the event is attended by 50 or more people or 20 or more people between the ages of 13 and 21, one security guard is required. The charge for the security guards, which is paid directly to the officers, is the responsibility of the resident requesting the rental. All deposits refundable upon passing the exit inspection. For clubhouse and pool availability, refer to the Clubhouse Bookings page of the Association website www. wsmaonline.org and then to make a reservation, please complete the pool entries on the on-line Clubhouse Booking Form.

KISD Receives Top Rating in Schools FIRST Financial Accountability Rating System

Katy ISD has earned a rating of Superior Achievement under the Financial Integrity Rating System of Texas (FIRST) for the 20092010 fiscal year. Katy ISD has received this top rating for each of the nine years that Texas districts have been rated through Schools FIRST. Schools FIRST is a statewide rating system created to ensure that school districts are held accountable for the quality of their financial management practices, while achieving improved performance in the management of their financial resources. The Schools FIRST accountability rating system assigns one of four ratings, with the highest being Superior Achievement, followed by Above Standard Achievement, Standard Achievement and Substandard Achievement.

Approximately 784 out of the 1,029 school districts in Texas received the Superior Achievement rating this year.

Katy ISD also recently announced that it has been named a FiveStart District in the Texas Comptroller’s Financial Allocation Study for Texas (FAST) – one of only 23 districts in Texas to receive this rank for two consecutive years.

Katy LDS Churches Join with Brookwood Community for Bike Rally

On October 16th, Katy congregations from the Church of Jesus Christ of Latter-day Saints (LDS) joined with the Brookwood Community for a special bike rally and carnival. The Brookwood Community is a residential facility and vocational program for adults with disabilities.

The bike rally or BW15 provided residents with a fun, inclusive bike ride. Some Brookwood residents rode tandem bikes with volunteers from the churches. Others rode independently on either regular or specially modified bikes. Church members from the Katy 3rd and 4th wards, two congregations from the south Katy area, provided food and drinks for the participants. The LDS volunteers also came to support the residents with cheering and encouragement. After the bike rally, the Katy churches provided a carnival with games and activities for the residents at the Brookwood community. This event was part of a broader Houston-wide “Day of Service” in which many Houston area Latter-day Saint congregations participated. The Brookwood community is located in Brookshire, Texas and provides an educational environment that creates meaningful jobs, builds a sense of belonging and demands dignity and respect for adults with disabilities. Enjoy the outdoors with your child, age 2 1/2 to 5, at Audubon nature programs (called the “Titmouse Club”) offered every Tuesday and Wednesday morning, 10:00 to 11:00 AM, from mid-September through mid-May at the Edith L. Moore Nature Sanctuary, 440 Wilchester Boulevard. The programs feature fun nature talks, stories, crafts, hands-on activities and walks in the woods.

The cost is $5 per child or a 5-session card can be purchased for $20.
