PARKING LOT RENOVATIONS

Renovations to the lower parking lot in front of the swimming pool at the Windsong Trails Recreation Area are slated to take place the first quarter of 2012. As you are aware, the lower parking lot was constructed along with the old swimming pool facilities years ago. Due to underground water damage, this parking lot has deteriorated over time and now needs to be demolished and replaced by new construction. The Board worked with Jones & Carter, Inc., Texas Civil Engineers, on the initial phase of the project. As of the date of submittal of this article, the construction contract has not yet been awarded by the Board. The Board has budgeted this capital improvement for 2012. It is one of the last remaining major capital improvements needed to update all of your common areas to current standards.

Dear Resident: This publication has been prepared as an informational tutorial for homeowners, to supply important information regarding YOUR 2012 ANNUAL ASSESSMENT RATE and contains important information about deed restriction issues that could affect all residents of the subdivision. The following is a summary of questions and answers to issues that are commonly asked. Homeowners/property owners sometimes find “deed restrictions” and their enforcement confusing. Additionally, they misunderstand or are unfamiliar with their obligations as owners. The Board of Directors for Windsong Community Improvement Association sincerely hope that this publication will serve to guide and assist you in better understanding the benefit and support you receive by the privilege of homeownership in a deed restricted community. Without the support of a homeowners association, property values are more likely to be debilitated by outside factors that cannot be controlled. WHAT is a “Homeowners Association?” Homeowners associations are non-profit corporations formed to “maintain” a subdivision (community, neighborhood). Because each association is an independent “company,” each is unique in its business operations, governing documents, use restrictions, services offered, rate of assessments, etc.

WHAT is an “Assessment?” An assessment is very similar to a tax. It is used to provide services to the community. Taxes are based on property values and provide many services, some that you may or may not be aware of or feel you benefit from. Assessments are assessed on a “per lot” basis according to the needs of the Association for which they are collected and the services provided. Each member must pay his share of the operating expenses of the “corporation.” In Windsong, those services include pool, tennis courts, playgrounds and clubhouse maintenance; management and deed restriction enforcement; landscape and irrigation maintenance for all common areas and entrances; legal; utilities (water & sewer, electricity, gas and telephone); street lights, community events; mosquito fogging, routine corporate expenses such as insurance and property taxes; capital reserves and other miscellaneous services to the residents. As in taxes, whether you “use” the services or not, does not relieve your liability to pay.

WHO has to pay the “Assessment?” All members of Windsong Community Improvement Association are assessed at a uniform rate and therefore, obligated to pay. Failure to pay can ultimately result in the loss of your property. The Association’s rights include the “power of sale” (Article VI, Section 7.6) in connection with the lien (the right to foreclose the lien), as well as, other collection procedures. “Living, Loving, and Learning in Christ and the Church.”

WHO is a “Member?” Every property (lot) owner within the subdivision is a member of the Association, whether or not they chose to be and whether or not it is referenced in their deed. WHO decides how much I have to pay and what services I get? Your association is governed by three governing documents. The Articles of Incorporation, the By-Laws and the Declarations of Covenants, Conditions and Restrictions, the “Deed Restrictions”. The By-Laws are the rules and regulations that define and regulate the authority of the Board of Directors. The Board of Directors consists of five (5) directors who are elected by the membership. The Board is empowered to operate the business of the Association, which includes, but is not limited to, setting the rate of the assessment. Article VII, Section 7.3 of the deed restrictions provide that the maximum annual assessment may be increased each year not more than 10% above the maximum for the previous year without a vote of the membership and Article VII, Section 7.5 states “Subject to the criteria and limitations set out in Section 7.3, the Board of Directors of the Association shall determine the amount to be levied as the annual assessment.” WHO is the Board of Directors? The Board of Directors is elected by you, the membership, at an annual meeting. Each Director serves a term of three years. The term expirations are staggered so that each new Board member gets direction from an experienced Board member. That provision was mandated in the By-Laws to provide for consistency, experience and continuity. The assessment fees provide a multitude of services. Please help your Board of Directors meet the budgetary needs of the Association by paying your assessment in a timely manner. The 2012 annual assessment is set at $360. The due date, penalty date and terms for payment remain unchanged. BASKETBALL GOALS ARCHITECTURAL GUIDELINES Please be aware that if you have a basketball goal in street view it must be maintained at all times. Basketball goals are permitted subject to the prior approval of the ACC and the following: * A net shall be maintained on the rim at all times. The net shall be replaced in the event that it becomes frayed or torn. * A rim shall be affixed to the backboard at all times. The rim shall be repaired or, if necessary, replaced in the event that it becomes broken or bent. * The backboard shall be repainted, repaired or replaced in the event that the surface of the backboard becomes chipped or cracked or the backboard becomes warped or unaligned. The backboard shall also be kept clean of mildew or mold. * Basketball goals that are visible from the street shall be attached to the front of the garage or freestanding. * In no event shall a basketball goal be placed at any curb either temporarily or permanently. * The pole and all mounting supports must be maintained in an attractive condition. The pole shall be removed if the basketball goal is no longer functional.

CONTRACT DEPUTY PATROL The Harris County Municipal Utility District #183 has a contract through Harris County for one Deputy from the Sheriff’s Department to patrol the District. The MUD has also hired five part-time off duty police officers to patrol the District as needed. Their jobs are to watch out for suspicious persons and/or activities and report any incidents to the Sheriff’s Department for further action. The Deputy Sheriff and the part-time off duty police officers patrol the Windsong and Windsong Place communities as well as any commercial properties within the District.

TRASH SERVICE INFORMATION Royal Disposal collects our trash. The homeowner’s maintenance fee does not pay for trash pick-up. Residents are billed quarterly in advance on an individual basis. A letter regarding this service was mailed to all residents in January and articles were published for the first few months of 2011 in the “Windsong Whistler.” Information is also published on a monthly basis on the inside back cover. BE A GOOD NEIGHBOR We would like to address one of the items that the Windsong Community Improvement Association gets the most complaints about. We receive many complaints from homeowners about vehicles parked on the street blocking the flow of traffic. The reason for that is because the roads were not designed with a parking lane. There is not enough width to allow for a parking lane. More seriously, when an emergency vehicle is unable to obtain egress and ingress to a street, precious minutes are lost that could mean loss of life/and or property.

The problem becomes intolerable in cul-de-sacs where emergency vehicles or others cannot turn around due to vehicles parking inappropriately and not parallel to the curb. The neighbors of these improperly parked vehicles are inconvenienced when they have to go out of their way to get around them.

They cannot help but have to euthanize some. You, as a responsible pet owner can be of great help by having your cat or dog spayed or neutered and not worry about finding homes for the offspring. Windsong Community Improvement Association handles the financial and legal affairs of the subdivision. Each lot owner is required to pay an annual maintenance fee which is used to pay street lights; taxes on and maintenance the common areas, such as the swimming pool, tennis courts, clubhouse, playgrounds, and entrances.; contract deputy patrols; and legal expenses incurred to enforce the deed restrictions, etc.

The WCIA has a new resident package available which are sent once a month to the new homeowners once SCS Management Services, Inc has received transfer information.

Complaint forms are included in every “Windsong Whistler” for your convenience. The association’s office verifies complaints and writes letters to violators. WCIA will initiate legal action when warranted, to enforce the deed restrictions.

CONTRACT DEPUTY PATROLS

Harris County MUD #183 provides additional patrols for two Sheriff’s Deputies through a contract with Harris County. Please call 281-463-2648 to report any suspicious person, activity or for vacation watch.

TRASH COLLECTION ROYAL DISPOSAL.

Royal Disposal collects our trash. The homeowner’s maintenance fee does not pay for trash pick-up. Residents are billed quarterly in advance on an individual basis. You must call Royal Disposal to start service at 713-526-1536. 1. Trash pick-up days are Tuesdays and Fridays between 7:00 AM and 6:00 PM. 2. Curbside pick-up for each home for a maximum of 6 cans per day. 3. All tree branches less than 3 inches in diameter and shrub trimmings should be cut in four feet lengths and bundled. 4. No pick-up is schedule on New Year’s Day; Memorial Day; Independence Day; Labor Day; Thanksgiving Day; and Christmas Day. Pick-up will resume the next regularly schedule day. 5. Heavy trash pick-up is scheduled every Friday. 6. Excluded items include, but are not limited to, acids; batteries; car parts; car tires; chemicals; construction trash (to include concrete, large quantities or rolls of carpeting, fencing, construction material and debris); dirt; garage door openers; hazardous or toxic or radioactive waste; large pieces of glass (must be broken and placed in cardboard box and weigh less than 40 pounds); human or animal fecal waste; large sofas and sleepers and furniture with metal frames; metal items; paint; petroleum products or filers; refrigerators (if Freon is not removed and refrigerator tagged); rocks; sand.
