Rawlings sets tone for the future

david@katytrailweekly.com Dallas Mayor Mike Rawlings said that Dallas is in better shape today than when he took the office in 2011. But he acknowledges that there is still a lot of work to do, which is one reason that he will seek reelection in 2015. Speaking before an audience at the Edgemere senior living community near Hillcrest Road and Northwest Highway, Rawlings looked back at his tenure and laid out his plan for the future. “Right now Dallas is hot,” Rawlings, 60, said. “And I don’t mean in August. It is moving and it is amazing what is happening in this city and in this area. DFW has created more jobs than any
other market in the United States in 2014. We are the number one job creator, and that is fabulous to see. “Dallas is a big part of that,” Rawlings said, “but we are also part of this big city called DFW. The airport is a big part. For more information concerning this, the best resource would likely be an accountant who can prepare you taxes reflecting this. The Ebola virus outbreak was a major topic in the 2014 medical arena. This little virus has cost countless lives including one American life being added to that number. In a previous article, I outlined the details of the virus including the history and the fact that this is not the first outbreak. Many of the fears that surrounded this disease dealt with the media-induced hype of ease of transmission — leading mostly to mass hysteria. Although the Ebola virus is virulent, meaning the likelihood
of death is relatively high once it is contracted, it is also relatively difficult to contract. Unlike the common cold virus, the proximity to a patient with active symptoms of Ebola that is required makes transmission more difficult than was initially presented. Less information has been circulating lately concerning more recent updates of the happenings in West Africa, but the numbers should not be ignored. To date, there have been 22,000 reported cases worldwide of the virus in 2014 and more than 8,800 reported deaths. The measles outbreak is truthfully a result of laxity in vaccination. There are a lot of concerns among parents concerning the risk of autism and autism spectrum diseases, which are thought to somehow be linked to vaccinations. Despite where you fall on those concerns, vaccinations have nearly eliminated the presence of such diseases. There have been in one month (January 2015) 121 new cases of measles in 17 states. The disease starts with fever, runny nose, cough and sore throat. Later a skin rash

It appears if a blade of grass exists in the Dallas/Uptown area, something is being built on it. With the continuing building boom, problems inevitably arise. For residence owners, the Texas Residential Construction Liability Act Gregory M,. Clift (Act) provides remedies for construction defects. The Act provides specific deadlines for making and responding to construction defect claims — deadlines that may impact or bar a homeowner’s claims. The applicability of the Act requires a brief review of its definitions. Specifically, the Act applies to “construction defects,” which, in part, “means a matter concerning the design, construction or repair of a new residence or an alteration of or repair or addition to an existing residence …” The definition applies to the structure, as well as, the real property. Second, the Act applies to “contractors,” which generally means “a builder … contracting with an owner for the construction or sale of a new residence or for the repair or alteration of or an addition to an existing residence …” Finally, the Act applies to “residences,” which means “the real property and improvements for a single-family house, duplex, triplex or quadruplex or a unit and the common elements in a multiunit residential structure in which title to the individual units is transferred to the owners under a condominium or cooperative system.” Once the owner determines the Act’s applicability, proper notices should be given prior to performing remedial work. The following outlines the notice and offer of settlement requirements. 1. S ixty days before filing suit a claimant must give notice to the contractor, by certified mail, return receipt requested, specifying the construction defects 2. I f requested by the contractor, the claimant must provide evidence of the defect including, for example: a. Expert reports

If a contractor makes a written offer of settlement the claimant considers unreasonable within 25 days after receiving the offer, the claimant should tell the contractor in writing and in reasonable detail, the reasons offer is unreasonable; and the contractor may make a supplemental written offer within 10 days after the contractor receives this response. The Act contains repercussions for refusing a reasonable offer. For example, a claimant may not recover more than the cost of repairs or the amount of the reasonable settlement offer. A claimant may only recover attorney’s fees incurred prior to the day the offer was rejected. However, if no offer is made, or the offer is determined unreasonable, the claimant may recover: 1. Reasonable cost of repairs 2. Reasonable cost for the replacement or repair of any damaged goods 3. Reasonable and necessary engineering and consulting fees 4. Reasonable expenses of temporary housing 5. Reduction in current market value, if any, after the construction defect is repaired if the defect was a structural failure 6. Reasonable and necessary attorney’s fees. Headaches abound when trying to repair construction defects to a home. However, as set out above, it is important to try and resolve the issues quickly and fairly. As always, the above is not exhaustive and consultation with experienced counsel may be warranted. At the unofficial halfway point of the NBA season, the Dallas Mavericks had a decision to make. They could play out the string or they could make a bold run to try to beat the best in the west. Based on their recent move, the Mavericks and owner Mark Cuban are obviously trying to recapture the magic of the 2011 championship season. As with any older team, the Mavericks have battled injuries, which created holes that had to be filled. They desperately needed the time off provided by the recently completed All Star break. The team filled a hole this week but got older in the process. Amar’e Stoudemire was scheduled to join the Mavericks for the rest of the season and play a key role in the playoff run. Remember last season, the Mavericks took the eventual NBA champion San Antonio Spurs to seven games. This year’s Mavericks are much better and deeper than last year’s squad. At 6-10, Stoudemire is expected to provide a greater low post presence, increased rebounding, improve shot blocking and give Tyson Chandler more rest for the long haul ahead. The Mavericks have 27 games remaining as of Thursday before the intensity of the playoffs begins. It will be a big job for Coach Rick Carlisle to see if he can make all of these moving parts work. He has certainly proven in the past he can do it. There will be a lot of challenges ahead. First, they need to win more big games. They need to improve their seeding in

(2) Gonzaga will make the Final Four. In their 17th consecutive NCAA tournament appearance, this will be the year Gonzaga finally gets over the hump and makes the Final Four. This is the best Zags team in history, including the team from two years ago that earned a number one seed. It’s a team of veterans, led by senior Kevin Pangos and Kentucky-transfer Kyle Wiltjer. They have a post presence in Przemek Karnowski, and some of the best guard play in the country. For years, Gonzaga has had the reputation of a high-seeded team that drops early. But this year’s team is cut from a different cloth, and if they’re ever going to make a run, this is the year to do it. (3) SMU will make the Sweet Sixteen. The Mustangs have all but solidified their trip to the Big Dance this year, avenging last year’s committee snub. Barring a major collapse, SMU should end up with a fairly nice seeding position (right now probably somewhere in the six-seed to eight-seed range). This is a team that is really talented, and really coming together. They’re moving the ball, they’re playing effective defense, and perhaps most importantly, they are peaking at the right time. They’ve got multiple big men to throw at you, and they’ve got a stud guard in Nick Moore who’s not afraid to put up a shot from anywhere. SMU could face anything from a two-seed to a four-seed in the second round, and many of those will be beatable teams. I’ll go out on a homer limb and predict the Ponies to advance to the second weekend. Rajon Rondo holds the keys to a successful playoff drive. the oh-so-talented Western Conference. And they need to prove that they can stop — or at least slow down — the likes of Stephen Curry and Klay Thompson of Golden State, James Harden of the Houston Rockets, Kevin Durant and Russell Westbrook of the Oklahoma City Thunder (assuming they face no more injuries and make the playoffs), Blake Griffin and Chris Paul of the Los Angeles Clippers and tough, strong teams in Memphis and Portland. And, of course, there are still those champion Spurs. The key to the Mavericks success will be a healthy Rajon Rondo embracing the offense and playing stellar defense. Monta Ellis will need to get back to his blistering offensive game. With Devin Harris, J.J. Barea and Raymond Felton, Dallas has as much backcourt depth as they had in their championship season. Barea can come off the bench and cause a spark when the match-up is right. With Dirk Nowitzki now able to go back out to the point or to the threepoint arc, the wild card in the forward mix is Chandler Parsons. He has been explosive at times, both inside and
outside. But he is inconsistent and can’t be counted on every day. Al-Farouq Aminu provides good depth, and Charlie Villanueva has never seen a shot he didn’t like, which is exciting or frustrating on any given night. Reggie Jackson used to call himself “the straw that stirs the drink.” That role on Dallas is clearly with Rondo. He plays with great intensity and is a proven winner. As much as the addition of Stoudemire can better the Mavericks, it is a return to the Rondo of old that will be a key. He causes problems for other teams and will create scoring opportunities for Dallas. While among the top teams in the Wild West, the Mavericks are still looking up and haven’t played well against top teams. But a run is capable given the personnel in place and the man holding the clipboard. The Mavericks keep adding personalities, but this team has yet to establish its personality. That will be Carlisle’s job with a big assist from Rondo. There is only one basketball, and this team has at least 10 players that can score. But at least fans know this. In 2015, the Mavericks are all in.

We love the public to attend, but come early; it’s always standing room only.

Anorexia nervosa has the highest mortality rate of all the other mental illnesses combined.

Pollo al Mattone “Chicken under a Brick” is an easy and impressive main course for two. I wrapped my bricks in foil before 1 chicken (about 3 pounds), cut in half down the back, backbone removed. Juice of 1 lemon 4 tablespoons olive oil 3 garlic cloves, coarsely chopped 1 teaspoon crushed red pepper Place the chicken on a baking sheet. Combine the lemon juice, half the olive oil, the garlic and the red pepper. Rub the mixture into the chicken, flattening it with your hands as you do. Let stand 20 minutes or cover and refrigerate up to a day. Heat the oven to 500F. Heat a heavy ovenproof skillet (preferably cast iron) over medium-high heat until hot, about 3 minutes. Add the remaining olive oil and swirl it around the pan to coat. Add the chicken skin side down and top it with a second (clean) ovenproof skillet, then add a brick to weigh it down. Cook 5 minutes, then transfer the whole thing to the oven. Roast 15 minutes. Remove the bricks and top pan. Turn the chicken over and roast 10 minutes more or until cooked through. Whitney Claire Kaufman has been one of the featured vocalists since the inception of, “Disney in Concert.” Kaufman offered, “In a world that has all sorts of unpleasant news on a daily basis and where people are dealing with difficult challenge, this show is like a breath of fresh air … really an oasis of sorts.” The conductor concluded, “When you leave the theater after seeing the show, the sky looks even bluer.”

'Kingsmen: The Secret Service' is a jolly good time

The list of targets that “Kingsman: The Secret Service” brilliantly skewers (quite literally) is extensive. Politicians, the rich, climate change activists, and even a Westboro Baptist-like church are viciously and hilariously mauled in director Matthew Vaughn and screenwriter Jane Goldman’s manic world. “Kingsman: The Secret Service” is equal parts hyperviolent, gory, funny and social commentary, all done with a sadistic, gleeful grin. At the center of it all is Colin Firth’s Harry Hart, code name Galahad, who manages to be a true gentleman while surrounded by anything but class. Of course, he wears a $7,000 double breasted bespoke suit that happens to be bulletproof, which means he looks exceptionally good while doing it. This super secret spy agency is like James Bond on performance enhancing drugs. The Kingsman are not controlled by any government, not loyal to any particular country, and function more like an independent agency whose sole goal is to protect the world from bad guys. The Kingsman are led by Arthur (Michael Caine because … duh), and every member takes the name of one of the Knights of the Round Table.

Due to the death of Lancelot, the Kingsman need a replacement to take his spot, and every current Kingsman is required to find a candidate. Harry picks Gary “Eggsy” Unwin (Taron Egerton), whose Kingsman father was killed in action when Eggsy was a youngster. Eggsy’s training, administered brilliantly by Merlin (Mark Strong), is rigorous and extremely stressful to watch. In particular, a group parachute sequence is a nail biter, especially when Merlin lets them know that one person in the group doesn’t have a parachute. Eggsy is surrounded by proper, educated 20 year olds who mock him for being nothing more than street trash. His only friend turns out to be Roxy (Sophie Cookson), but thankfully there isn’t any forced romance
here, and their relationship stays strictly platonic. Meanwhile, Harry is tracking down Lancelot’s killer, who turns out to be Richmond Valentine (Samuel L. Jackson). Valentine is a crazed mix of Russell Simmons, Steve Jobs and, well, Sam Jackson. He happily sends his evil henchman, Gazelle (Sofia Boutella), out to murder anyone and everyone with her prosthetic legs that also happen to be razor sharp knives. But Valentine cannot stomach the sight of blood. He also speaks with a lisp, making everything he says riotously funny, especially the colorful metaphors that he uses in nearly every single sentence. Herein lies most of the fun in “Kingsman: The Secret Service.” Not only is it a parody of the Bond movies of the 1970s, it openly acknowledges
it. In one meeting with Harry and Valentine, they opine about missing a diabolical villainous plot like in those old Bond movies. Harry and Valentine are the perfect creation of good guy and bad guy, both celebrating and mocking the movies of the past. While it graciously cribs from 10s of movies in the past 40 years, one thing that sets “Kingsman: The Secret Service” apart from those films is the violence and action. This movie cooks from start to finish and after the first gory, nasty killing, the rest are child’s play. It appears, via the magic of editing and special effects, that every actor performed every single stunt, which makes this surreal world seem very real. Egerton is relatively new to movies, and it’s hard to see another actor in Eggsy’s shoes. He is just the right amount of crude jackass and noble hero that it’s fairly easy to root for him. He plays a classic rags to riches character, which is highlighted via a joke about a classic movie that should bring the house down. Samuel L. Jackson has played villains before, but nothing like Valentine. His lisp is a thing of beauty, somehow making him one of the scariest cartoony characters ever. Besides, there isn’t an actor alive that could say “Now that is a dope ass top hat” and get away with it like Jackson does.
Then there is Colin Firth. Firth is so suave as Harry Hart that it’s almost unfair for other actors to even try to match it. He makes Bond seem like a brute, Bourne seem like a wuss, and Austin Powers look like a humorless buffoon (which he does well on his own anyway). Yes, Firth has an Oscar. Forget it. This is his opus. When he disgustingly puts his unfinished beer down on a table prior to pummeling a bar full of thugs, it’s done with such brilliant precision that one wonders if he rehearsed placing that glass down hundreds of times. Watching Firth battle his way through
a church full of enraged humans, all to the tune of Lynyrd Skynyrd’s “Freebird,” may turn out to be the most fun 10 minutes in movies of 2015. “Kingsman: The Secret Service” is not for everyone. It’s an extremely violent, albeit tongue always firmly in cheek, movie. It’s crass, lewd and thumbing its nose at seemingly every special interest group on Earth. Those that can’t get over those factors will miss out on a movie that is an absolute blast to watch. It’s colorful production design is immeasurable, and it exudes coolness, mostly thanks to the most unexpected action hero ever, Colin Firth.
