S

ome people skydive, some ride motorcycles, some craft and some volunteer. All of us do something with our “free” time that we feel makes us a more alive and better person. Personally I have always found that the time I spend helping others makes me feel like the person I want to be in life. From helping a friend with a small project to raising money for important causes. The question I get asked a lot is “why?” Why do I spend time helping the AAGO Foundation or the other organizations I volunteer at in town? Why commit time and resources to those things while that time could be spent expanding my business or doing other personally profitable endeavors? The answer is twofold. First is that I believe we have a responsibility to serve others in need. Second is that it serves a purpose in me. We are fortunate to work in an industry that is thriving at this time. This success is widely recognized across our industry from Developers to Suppliers and all of us in between. At the core of this success is serving other people. It is what we do! We make and maintain homes for families. So why not expand that service to our community? We have a responsibility to leverage our success and resources to make our city a better place for all. Many industries have to find a way to help in the community because their business is not directly tied to people’s needs. We don’t have that issue. We actually have the opposite and with that comes greater responsibility to serve the community. We also have a responsibility to leverage the current success of our industry to lay a groundwork of service for the future. Times may not always be so good and people will automatically look at charity as a place to cut back. If we spend time now truly making a difference to people we will be able to continue to serve the community even when times are leaner. We have to put down the roots and ingrain ourselves with the need and want to help regardless of exterior factors.

could use my time and resources to make a difference. Again it is admittedly selfish, and I am unapologetic about that. I want to use my time to make a difference. That is true at home, work or in my time serving my community. At first my efforts were minimal. I attended meetings, asked a few questions and gave a few suggestion I thought may help. Eventually that turned into leading some of our efforts to raise funds for the foundation. After some time those efforts turned into me being recognized as the Management Volunteer of the Year. The key is that is all started with finding something I was interested in and passionate about and committing a little bit of time to it.

Personally I have always found that the time I spend helping others makes me feel like the person I want to be in life.

Service and volunteering really is a selfish act for me. I enjoy it and I do it when I can because of the joy it brings me. Many times I have been asked “Why the AAGO Foundation?” The question means why not AAGO or other parts of the business side of our industry. The truth is that when I became involved in AAGO a few years ago it was immediately clear to me that the AAGO staff and BOD were the best in the state, if not the country. What could I bring to that side of the organization? It was being led and guided by highly intelligent, motivated and knowledgeable people with a considerable amount more experience than I had. I could only stand to bring that to a screeching halt if I got involved there. I did however see in that an organization that wanted to give back. They were doing a good job at it, but I felt that this is where I had something to offer. There I

I am very humbled by this recognition and the platform it has provided me. I challenge you all to find what you are passionate about and what makes you happy. You may be surprised what your “small” effort can turn in to. The Friends of the Foundation Committee was the best choice for me but which one would be the right fit for your talents and needs? hat a great year 2016 was for the AAGO Foundation Fundraising Events. The Friends of the Foundation organized and held two terrific events, The Summer Party Rock and Bowl in July and the Golf Tournament in October which together raised over $35,000 to help others in need. 2017 should be just as successful since we are lucky enough to have two award winners in the Friends of the Foundation Committee leadership roles. Joseph Rosenwasser from Meadow Wood Property Company who was AAGO’s 2016 Management Volunteer of the Year will be the Chair of the Friends of the Foundation Committee with Bryce Heath from Arbor Contract Carpets who was the 1st ever recipient of the Volunteer of the Year Award presented by the AAGO Foundation as the Vice Chair. The committee will once again host both of the annual fundraising events and dedicate themselves to working with the 2017 Charity Partners to help educate and empower the homeless, veterans reintegrating into the workforce/society, and teens aging out of foster care. Will you join them this year and watch firsthand how you can help someone become more than what they ever thought they could be? There will be many opportunities to make great memories through the service projects we are scheduling with our Charity Partners where you can donate your time to the community. AGO’s Legislative Committee had a successful year in 2016. As a brief overview, AAGO exceeded all fundraising goals for both PACs (APAC and NAAPAC). We saw an increase in attendance as well as participation in our Legislative Committee. Another great announcement for AAGO is that we were the first association to pull off a successful ‘joint fundraiser’ — raising funds for both APAC and NAAPAC at the same event. Because of its success, the joint fundraiser is now being looked at as a standard model for other affiliates. AAGO is definitely raising the bar when it comes

Coming up in February, the Florida Apartment Association will be hosting its “Legislative Days” conference in Tallahassee. The Uncertain Fate of the Federal Overtime Rule

O

ne of President Obama’s highest priorities as a candidate for President was increasing the minimum wage. The strong conservative stronghold in the U.S. Congress has not provided an opportunity to pass legislation to achieve this goal. Since this policy change couldn’t be achieved legislatively, the Obama Administration used the power of administrative rule to make progress on this initiative. Current federal law (The Fair Labor Standards Act or FLSA) requires a minimum wage for all hours worked during the workweek and overtime premium pay of not less than one and one-half times the employee’s regular rate of pay for hours worked over 40 in a workweek. However, certain employees that perform administrative, professional, or executive duties are currently exempt from the overtime pay requirement as long as they make at least $23,660 annually. In May 2016, the Department of Labor released the final draft of an administrative rule that would double the overtime-exempt salary from $23,660 to $47,476 annually. In addition, the rule also allowed this threshold to be adjusted on an ongoing basis in conjunction with the rate of inflation. The new rule was set to go into effect on December 1, 2016 before a Texas Judge put it on hold. The Texas ruling is a case and point of your industry’s advocacy at work at the federal level. In response to the initial filing of the ruling, the National Apartment Association (NAA) joined others in the business community to voice concerns about the new policy and its adverse impacts on the apartment industry. NAA also joined the Partnership

to Protect Workplace Opportunity (PPOW) coalition in supporting the Protecting Workplace Advancement and Opportunity Act (H.R. ), which was introduce by U.S. Representative Tim Walberg. In addition, Nevada filed lawsuit against the U.S. Department of Labor with significant support from other states across the country and the business community. In this case, Nevada made the compelling argument that the Department of Labor stepped outside its bounds by drastically increasing the salary threshold and that this policy change should have been initiated at the legislative level in Congress. Nevada also argued this increase would be detrimental to state budgets that would be strained in order to comply with the increased financial obligations under the new rule. In the opinion that was issued on November 22nd, Judge Amos L. Mazzant of the U.S. District Court for the Eastern District of Texas concurred with Nevada’s concerns and stated the new rule essentially established a “de facto salary-only test.” His ruling in favor of the State of Nevada has now placed the implementation of the new overtime rule on hold just before it was due to go into effect on December 1, 2016. Although this sudden turn of events at the eleventh hour is comforting to some, it is essential for those in the business community to remain prepared should this decision be overturned in the future. The Department of Labor has already expressed its stark opposition to the ruling and is actively exploring legal options. As such, this issue is still unfolding and more could transpire before the new administration takes office in January. JANUARY/FEBRUARY 2017

LOCAL If you’ve been following the recent articles in the Key Magazine, you know the City of Orlando has been working on a sustainability proposal that seeks to reduce energy consumption in large buildings, including multifamily. This policy is called the Building Energy and Water Efficiency Strategy (BEWES) and we expect other local governments in the area to adopt similar policies in the future.

On Monday December 5th, the Orlando City Council unanimously adopted the BEWES ordinance. This new policy requires commercial, institutional, and multi-family properties greater than 50,000 square feet in size to track building energy use and report this data to the City on an annual basis beginning in May 2018. The reporting will be done using ENERGY STAR Portfolio Manager, a free tool provided by the Environmental Protection Agency (EPA). This information will be publically available online but buildings will not be penalized for poor performance. Instead, low performing buildings will be required to perform an energy audit, which is offered for at not charge through OUC. This audit can be used to identify how the building can improve energy efficiency in the future and identify problem areas or appliances on-site.

The final draft of this ordinance was a result of extensive feedback from AAGO and other community stakeholders. We would like to take this opportunity to thank the AAGO Board of Directors, the members of the Legislative Committee and all the leaders who weighed in on the ordinance as it was drafted. AAGO is grateful to have a positive working relationship with the City of Orlando and we look forward to working with City as the ordinance is implemented. On December 6th, AAGO partnered with the City of Orlando and the U.S. Green Building Council to host an energy benchmarking workshop at AAGO. Property managers enjoyed this hands-on training that provided attendees with tips for complying with the new ordinance. W

hether you are a member of an apartment community team, in the corporate office or a supplier partner, there is no doubt that social media affects relationships with your customers and prospects on a daily basis. Why? Facebook is said to have 156 million visitors in the United States in 2016 and these users spent an average of 39 minutes per day on the website. Most importantly, more than 40% of these Facebook users are engaged with businesses online. Put simply- Facebook’s presence and impact on consumers is too big to ignore. Facebook is also increasingly advancing its ‘local’ presence. Mark Zuckerberg’s vision for Facebook is for the website to serve as a tool for local referrals, reviews, and buying advice. This vision is already coming to fruition and it will certainly impact your business in a positive or negative way depending on how you choose to manage your presence on social media. In light of Facebook’s growing influence, we wanted to share a few simple tips to kick-start your social media strategy for 2017 and beyond.

Plan your Plan Every workday presents a new set of challenges and unexpected tasks. Managing your Facebook page will generally fall far down your list of items to address. The key is to plan ahead with a weekly or monthly editorial calendar. Instead of scrambling from one day to the next trying to figure out what you want to share on social media, you can follow a detailed plan for sharing your company’s message. It is best to develop your editorial calendar one week at a time or one month at a time depending the nature of your business and how often you wish to utilize social media. When you’re ready to start planning, just follow these simple steps: 1. Build your editorial schedule using a basic Excel spreadsheet broken down by week or by month. 2. Reserve a small block of time each week to review your schedule and incorporate important events, timely announcements, holidays, seasonal messages and local information. • Bookmark a few local websites that provide relevant information, events and tips that may be valuable to your customers. 3. In your spreadsheet, you should include a column for dates, links to relevant websites you want to share, and a draft of the text you plan to use for the Facebook post. 4. You can either manually schedule each post on the day indicated or Facebook has a feature that allows you to schedule the post in advance. There are also helpful tools such as Hootsuite, Buffer, and Everypost (Just to name a few!) that can help you schedule posts in advance for multiple social media channels.

Consistently Monitor and Respond In order to be effective, you must consistently monitor your reviews and comments. More importantly, you should always respond in a timely fashion. Sometimes a simple ‘Like’ or brief thank you comment is appropriate so other users can see that your company is engaged with customers. In other circumstances, it may be best for your company to engage more directly with customers by leaving a more detailed comment or by sending a private message to an individual. Speaking of messages… Time is of the essence! It is absolutely critical for your company to keep up with your message center. New Facebook features are added on a regular basis and these tools can provide valuable opportunities to connect with new customers and demonstrate responsiveness to current customers. Similar to your editorial calendar, it is important to develop an action plan to monitor the message center. You can accomplish this goal by appointing one person on your team to complete this task or by building a monitoring schedule for your team.

How to Handle the Negative While we would love for every customer to be completely satisfied with the service and product they receive, this is not the reality. The expansion of social media has driven more customers to take their complaints online instead of asking to “speak with the manager.” This is frightening for many business owners but when managed appropriately, negative reviews don’t have to hurt your business. Below are a few simple steps to help you respond to a negative comment or review: 1. Do not overreact or take it personal. Comments can easily be misunderstood or taken too harshly on social media. You don’t want to taint your brand by responding poorly to a negative review or comment. 2. Acknowledge the customer’s concerns. 3. Express your willingness to help resolve the issue. • Example: Suzy Q has expressed she is disappointed with the fact that her calls to your company’s office are going unanswered. You could respond with: “Suzy Q. we regret to learn that you’ve experienced difficulty getting in touch with our office and appreciate that you brought this matter to our attention. We always strive for responsive customer service and we look forward to assisting you. We will be in touch with you shortly to resolve this issue.” 4. After you post this reply, you should private message Suzy Q immediately. to ensure the remainder of the conversation is conducted off-line. Often times, it might be best to call the customer so you can resolve the issue directly. Your businesses can’t ignore Facebook’s consumer influence and growing user base. Instead, you should find ways to embrace social media and incorporate this tool in your everyday business. Social media management can seem daunting at first but with the right tools and an effective plan, you can set your company up for success.

Golf Tournament On October 28th, 136 golfers participated in AAGO’s annual Charity Golf Tournament. The event was held at the beautiful Timacuan Golf Club in Lake Mary. Members spent the day having fun on the green with friends and colleagues while raising funds for the AAGO Foundation. Together, we raised $29,765.28 for educating and empowering the homeless, veterans reintegrating into the workforce and teens aging out of the foster care. The report contains an Aging Analysis of the inventory, analysis of Rents and Occupancies for “all units” as well as all of the individual unit types within each of the reportable areas (includes region, county, and submarket), and much, much more.

Historical Trends in AAGO Areas The Average Rent Trends shown in the graph below are for “All Units” in their respective counties. Since the 3rd Quarter of 2013, the trend continues to show rent growth in all AAGO area counties. Each county has hit new post recession highs: $1099 in Orange, $1082 in Seminole, $988 in Lake, $981 in Osceola, and $898 in Volusia. In addition to better market performance of existing inventory, there is higher end new product that has been entering most markets in AAGO. Between the economy/housing markets getting better and the new higher end communities being built, the last couple of years have seen significant rent growth around the state, and the areas in AAGO as shown below. In the graph below it can be seen that although there have been dips here and there, the Overall Occupancies have continued to increase in all counties during the last few years. That said, it’s interesting to note that four of the five counties were either flat or decreased slightly from 1st Quarter to 3rd Quarter in 2016. Only Osceola has seen increased Overall Occupancy this year. Market wide dips in occupancy can be

Relocating while transitioning into a leadership role however, can seem almost daunting. Luckily for me, AAGO offered tools and a support system that ensured my transition was a success. The variety of educational courses offered by AAGO was instrumental in helping me learn not only local laws and leasing tips, but also effective management skills. By joining the Young Professional Committee I was able to build a network of like-minded individuals. YP offers volunteer and community outreach opportunities that were helpful in

getting me involved locally. AAGO’s leadership development program known as LEAP, has been an invaluable asset to my leadership style. Classes are led by phenomenal instructors who offer such diverse perspectives of each lesson. I can confidently say that I am a better manager, listener and employee because of the skills learned from the LEAP program. Outlook remains mixed for the apartment industry Apartment Industry Advocates,

Add my name to the long list of individuals who did not take the candidacy of Donald Trump seriously and publically doubted whether could win a Presidential general election. My sin is even greater since I am inside the beltway and in “the business” of politics and policy. This is my job! How could I have not seen this coming? I could lay the blame for missing the signs of a Trump victory at the feet of pollsters and pundits on whom I rely to give me the best data and intelligence on the minds of the electorate, but that would be a cop out. Realistically, I think my bias against someone like Donald Trump was in place long before he became a threat. I, like so many in the machine of Washington, D.C., am disconnected from the working class voter in places like Pennsylvania, Wisconsin and Ohio who gave President-elect Trump the White House. While my life and the lives of most of those with whom I am close have hummed along in the present economy, millions of others have watched their jobs disappear with little perceived care or concern from the political system and more precisely the two political parties. Their anger crossed party identification and found a home with Mr. Trump. Okay, so an epic fail on the part of people who should know better. Stipulated. What happens next? What can we expect from a Trump White House? And GOP majorities in both Houses of Congress? With hindsight now available to us, I think managing expectations is important here. Mr. Trump promised a lot of things on the campaign trail – the wall, mass deportations, a blockade against Muslims (or some nuanced variation of that), special prosecutor for Hillary Clinton, large-scale tax reform and shredded trade agreements. In the first week of his pre-administration, Mr. Trump has already softened his rhetoric on several of these items. The wall may turn out to be a fence or simply stronger border-security measures, “mass” deportations will be focused on criminals (something the Obama Administration does now) and continued pursuit of the Clinton email scandal is fading from the priority list. Certainly many in the body politic will be pleased if these moderations hold; however, others in the Trump coalition will not be happy. Time will tell if he sticks to his new position on these issues, especially with Steve Bannon, the voice of the alt-right in the President-elect’s ear. What else happens in a Trump first term will also be heavily influenced by the Congress, of course. And also contrary to expectations, the GOP held its control of the Senate and took only glancing blows to its majority in the House. We have one-party,

Republican rule for the first time since 2006. While the control of the levers of power is not absolute (recall the cloture rule in the Senate), it is strong enough that we can expect a more streamlined path to passage for some legislative priorities – Obamacare repeal and regulatory reform, among others. For others, the path remains difficult but is more doable than was anticipated under a Clinton Administration – see tax reform. For our part, the outlook remains mixed for the apartment industry. Regulatory reform and independent moves by the President-elect to pull back on regulations issued by the Obama team will likely address several areas of concern such as Waters of the United States, the overtime rule and IRS rules on valuation of family-owned businesses. Bigger-picture issues such as the future of Fannie Mae and Freddie Mac, some areas of tax law and immigration reform have the potential to cut both ways for owners and operators of apartment homes. Thus, it is critically important that everyone get involved in NAA’s Advocacy365 program and commit to carrying the message of the apartment industry to their representatives in Congress. Advocacy365, as the name implies, is a year-round effort; however, there is one particular day when the industry combines forces in Washington, D.C. to show our strength and press the case for our concerns. The 2017 NAA Capitol Conference and Lobby Day takes place on March 7 and 8 at the JW Marriott in downtown Washington. There will be a briefing on the issues, training on how to be an effective advocate and expert perspective on the new Administration from Presidential historian Doris Kearns Goodwin. There are more than 50 new Representatives and Senators who need educating on our industry and our issues and 485 incumbents returning for a new Congress and Administration who want to know where we stand. Please join us. This is an historic time for our country and we should take stock of that. There is also the reality of public policy concerns that must be our focus in the immediate term. THREE RECENT VERDICTS This article will examine a few common slip and fall scenarios and their legal outcome:

Tarraza vs. Esca Investment, Inc., Miami-Dade County Case No. 14-8415-CA (August 4, 2016):

Jones v Miami Dade County, Miami-Dade County Case No: 12-4944-CA (February 18, 2016):

Tarraza was a tenant in an apartment owned by Esca and claimed that the Esca was negligent in allowing water to leak into his unit, causing him to slip and fall. Esca denied negligence and further asserted that Tarraza’s negligence caused his injury.

In this case, Jones slipped and fell as a result of grease on a Miami sidewalk. She sued the County and a private corporation (sports club) that operated grills next to the sidewalk. The County denied actual or constructive knowledge of the greasy substance and the private corporation was no longer in existence at the time of the trial.

VERDICT: The jury found Esca 35% negligent and Tarraza 65% comparatively negligent and awarded Tarraza gross damages of $101,332. These damages would be reduced by 65%. Tarraza was not awarded damages for future pain and suffering. Esca filed a motion for post-verdict reduction, setoff and entry of final judgment finding that Tarraza should recover nothing and Tarraza filed a post-trial motion for new trial based on several points including the lack of a damage award for future pain and suffering. Dear Harry, Our resident selection criteria indicates that an applicant will be denied for any felony convictions within the past seven years. It has been this way since I begin working in property management. I just read that the law has changed and our policy may be illegal. We just had a screening report come back showing a felony for cocaine possession from three years ago. We normally would decline the applicant. The applicant just called us, and I was able to put him off for a bit, stating that this felony conviction showed up and that I needed to check with my regional. The applicant said that the report was accurate and that he did have a conviction for which he served a year in jail. He is adamant that we cannot deny him on that basis now. Is he correct? Signed: “Screening in Sanford” Dear Screening, The US Supreme Court has held that a policy or action that has a discriminatory “impact” on protected classes is illegal. Minorities (a protected class) have a higher rate of convictions for felony offenses. If you have a blanket policy that states that you will deny applicants for felonies, then protected classes will be ”impacted” more by your policy, no matter how reasonable you may feel your policy may be or what the rationale may be behind your policy. HUD recently came out with some guidelines trying to explain how your resident selection criteria may have a disparate impact on protected classes if you have a blanket policy of denying an applicant for felony convictions. The main convictions that come up and cause the most denials are those for drug possession. With the Supreme Court ruling and the HUD guidelines, you need to consult you attorney and have your criteria reviewed, as you may have to overlook one or possibly even more drug possession convictions. If the conviction is for distribution or manufacture or illegal drugs, it still is clear that you can deny the applicant.

Dear Harry, We provide a/c filters for our residents, and ask them to change the filters once every three months. One of our longtime residents had an a/c problem, and upon inspection our maintenance staff determined that the a/c filter probably had not been changed in over a year. The air handler had to be replaced, and our maintenance tech is certain that the failure was caused by the increased burden on the blower motor due to the resident’s failure to change the filter. We presented a bill for over $2000 to the resident two months ago, and to date nothing has been paid. My regional wants me to evict the resident, and our attorney is saying that we do not have a good case. Should we evict? Can we force the resident to pay? Signed, “Unfiltered in Umatilla” Dear Unfiltered, You have a number of problems that will most likely prevent you from evicting or charging the resident. You need to be able to prove that the resident’s failure to change the filter caused the a/c unit to fail. A/C units fail for many reasons, and excess strain due to failure to change a filter is just one of many. The other problem is that if you accepted rent from the resident despite the fact that the resident failed to pay you for the a/c repair, you may have waived your right to take further action. If a resident owes you a sum and fails to pay, the resident is in noncompliance. If a resident is in noncompliance, you should not be accepting rent from the resident until such time as the noncompliance is cured. Each time you accept rent, you are forgiving the noncompliance that may have occurred. When a resident does something “wrong”, in this case not paying you for the a/c repair, then you must stop accepting rent from that resident if you wish to proceed on taking legal action. The real issue here is the fact that your maintenance tech is not checking the a/c filters on a regular basis. You cannot rely upon a resident to do this. No lease clause will make a resident do or not do something. Leaving the replacement of the a/c filters up to a resident, as simple as the task may be, LegaLine

is just a recipe for disaster. If your attorney advises against the eviction, you should follow this advice and implement a company policy under which the maintenance tech or other staff member regularly checks the a/c unit in the apartments and changes the filters when needed.

Dear Harry, Our company just implemented a new online payment system for the convenience of our residents. Most of the residents love it, and we like it as well. However, we have noticed a problem: our system will accept a partial payment. The report presents data from garden and mid-rise/high-rise properties further segmented by individually metered and master-metered utilities allowing for definitive benchmarking. Survey data is presented in three forms: dollars per unit; dollars per square foot of rentable area; and dollars as a percentage of gross potential rent (GPR).
