I

t seems like whenever I’m meeting with folks about the apartment industry, including the cool kids like you who work in it, one of the first things they bring up is “they’re building apartments everywhere!” Yep, the sentiment seems to be that there is no way our market can absorb the ½ billion dollars worth of multifamily real estate currently under construction right, or the thousands of units in the pipeline in central Florida. It’s not surprising that folks inside and outside of our industry

would feel this way. With that said, the metro data compiled by The National Apartment Association and The National Multi Housing Council projects that current pace of development isn’t even close enough to keep up with forecasted demand for apartments. In June, the greater Orlando area was one of fifty major metropolitan areas that was part of an ongoing major press blitz to promote the need for multifamily development. The timing of the study could not be more timely. Local governments throughout central Florida are contemplating new mechanisms to promote the development, or inclusion, of “affordable housing.” A greater inventory of apartment units coming on line is sure to have a positive consumer impact on rents as the market becomes more competitive. RANKING and DEFINITIONS: METRO RANKING is the relative rank among 50 multifamily Metro markets based upon the average of HAS forecasted total Metro multifamily demand 2017-2030 and its percent of current Metro rental households, ranging from 1 (Dallas-Fort Worth) to 50 (Cleveland). AFFORDABILITY INDEX is the ratio of median family income to the minimum income to qualify for purchase of a single-family home at the median existing home resale price under standard mortgage underwriting today, then multiplied by 100 to convert to a 100 point index (e.g., an index of 100 indicates that the median family income equals the qualifying income). This index ranges from 69.4 (San Jose) to 290.7 (Cleveland) with a Metro average of 178.0 MF SUPPLY RESTRICTIONS is an HAS composite of the Wharton Residential Land Use Restrictions Index and the Lacroix percent of available Metro land no t yet developed. This index ranges from 19.5 (Honolulu) to –6.0 (New Orleans) with a Metro average of 2.0. STAR SHARE is that share of Metro rental housing stock with five or more units HAS qualified as *Second-Tier Affordable Rentals or those non-institutional sites of typically lower unit count, lower quality and greater age, a critical and ongoing multifamily supply component. Using CoStar® ratings of 1-5 for sites of five units or more, STAR is the lower ratings of 1-2. This share ranges from 61% (Los Angeles) to 17% (Austin) with a Metro average of 36%. For the third year in a row, the Apartment Association of Greater Orlando (AAGO) and the AAGO Foundation, Inc. will partner with the City of Life Foundation, and Community Based Care of Central Florida to provide a hands-on job shadow experience for central Florida foster youth on Tuesday, July 25th. Local teens will spend the day at various AAGO member sites learning about the diverse and financially rewarding careers in the apartment industry. This annual event seeks to inspire teens transitioning out of the foster care system to explore career paths in the apartment industry that can lead to financial independence and professional success.

All AAGO members who are willing to host a foster youth at their company for a job shadow opportunity.

The summer season is now upon us but that doesn’t mean AAGO Advocacy is taking a break from fighting for the apartment industry. Below is a brief summary of some of the action at the local, state, and federal level and how these issues impact AAGO members.

LOCAL: Energy efficiency is becoming a hot-button topic in all aspects of business development and operations, including the multifamily industry. In fact, many local governments around the country are seeking policies that require large scale properties to reduce their energy consumption or maximize their water efficiency. In addition to passing local ordinances related to this topic, some local governments are seeking to inspire healthy competition among large scale buildings to promote energy efficiency practices in their communities. The competition is about to heat up right here in central Florida and we want to make sure you have all the details. The U.S. EPA ENERGY STAR program and the Central Florida Energy Efficiency Alliance (CFEEA) is launching an exciting event in Central Florida starting this summer. Building owners and managers across central Florida can participate in an energy, water, and waste reduction challenge from July 1st - December 31st, 2017. Buildings that choose to participate in this competition will enter to win awards and receive special recognition for their achievements. STATE: The Florida Legislative session ended on May 8th after a showdown over the state budget. Below are a few victories the Florida Apartment Association (FAA) was pleased to see accomplished during the 2017 Session. If you have any questions about the policy priorities discussed below, please contact Courtney Barnard, FAA’s Government Affairs Director, via email at Courtney@FAAHQ.org. • Passage of HB 21: The Florida Constitution requires property to be assessed at market value on January 1st of each year for ad valorem taxation. The assessments are used to calculate property taxes rates that are used to fund counties, municipalities, district school boards and special districts across the state. In 2008, Florida voters voted in favor of a constitutional amendment to limit the annual assessment increase for most non-homestead properties to 10 percent of the prior year assessed value. The 10 percent cap passed by the 2008 amendment is set to expire on January 1, 2019. HB 21 proposes a constitutional amendment that would permanently retain the 10 percent cap on annual non-homestead property assessment increases. This proposed constitutional amendment requires the approval of 60 percent of Florida voters on the 2018 general election ballot. Apartment communities are non-homesteaded properties, which benefit from the 10 percent cap on tax increases. If the cap is not reauthorized by this constitutional amendment, yearly assessments could increase by an unforeseen amount for all multifamily properties. • Affordable Housing Funds Prioritized in the State Budget: As you may know, FAA is part of the Sadowski Coalition. This coalition of organizations focuses on fighting for affordable housing program funding that benefits those in financial need, seniors, individuals


with disabilities and veterans. This year’s budget includes over $120 million in funding for affordable housing programs. Florida’s affordable housing funds are derived from doc stamp taxes, which are collected on every real estate transaction made in the state. These funds are then dispensed by the state in the form of loans. The loans are used to build new affordable housing units and refurbish aging units. Funding for these initiatives is critical to increasing the inventory of affordable housing units across the state at a time when many local governments and Florida residents are concerned about rising rental rates.

NATIONAL: As you may remember from previous issues of the Key Magazine, the reauthorization of the National Flood Insurance Program (NFIP) is a top priority for the

National Apartment Association (NAA). This program is of importance to the apartment industry because the NFIP is often the only insurance coverage option available for multifamily properties in high-risk flood areas. This important program is set to expire on September 30, 2017 if it is not reauthorized by the U.S. Congress. On May 12th, the House Financial Committee Republicans released a document summarizing their vision for NFIP reform. “Our 2017 Trade Show was held April 25 at the central Florida Fairgrounds. Over 1,100 Management and apartment community professionals mingled and made new business contacts. Attendees and exhibitors enjoyed getting into the “Reality TV” theme with costumes, themed booths and marketing campaigns. At the close of the Trade Show, attendees cheered on as the attendees won cash prizes ranging from $250 to $1,000. In addition to these prizes, several suppliers hosted games and prize drawings at the 155 supplier exhibitors’ booths found throughout the Trade Show floor. NAA Releases ‘Value Add of Amenities’ Report

From helipads to breweries to concierge services that can just about read a resident's mind, amenities have been a hot topic in the apartment industry for years, and the bar just keeps getting higher. For apartment owners and operators who neither have the capital nor even the demand for these over-the-top features, there are plenty of ways to increase the appeal of apartment communities through amenities, many of which are simple to implement and require little up-front investment. The NAA “Value Add of Amenities” report seeks to identify top amenities in apartment communities: nationwide and in 11 selected metro areas, at both the community and unit level, and which ones have the greatest impact to revenue. An analysis of major renovations and their impacts on rents and occupancies also is included. The NAA Research study covered 43 unique amenities, added or upgraded from January 2014 to September 2016. The universe of survey responses totaled over 100,000 units in 35 states. TWO FALLS AND ONE SHOOTING…. If a poll was taken regarding the most common type of accident that occurs at an apartment complex, it would likely favor slip and falls or trip and falls….or maybe criminal assaults.

The verdicts abound. The results are startling (to say the least). This article will examine three more verdicts which didn’t necessarily occur at apartment complexes but certainly could have been “on site.”

As a result of the fall, Plaintiff was diagnosed with head trauma and post-concussive syndrome. Four months later Plaintiff developed a subdural hematoma. Everyone agreed that this was unrelated to the fall. The Plaintiff was awarded $10,000 in damages which included $5,000 of past medical expenses.

Verdict: The jury found Defendant 33.3% negligent and the Decedent 66.7% comparatively negligent and awarded $1 million in gross damages. The $1 million was broken down as $185,000 a piece to his parents and $630,000 to his daughter.
