Fair Housing and Social Media: The Rules Still Apply By: Nadeen

came into the multihousing world back when marketing was done through the newspaper, the just-gettingstarted targeted print publications, and flyers stuffed under windshield wipers (the latter which I found incredibly annoying). No websites, no social media, no Facebook or SnapChat. But the times they are a-changin’. The fair housing laws were written in such a way that they are still relevant and in place, notwithstanding that the marketing technologies of today were not anticipated. In other words, your website and social media marketing is advertising; all the rules that have been in place for decades are the same. So… Thou Shall Not forget that Social Media Marketing is advertising! All of the rules that have been in place for decades are the same. So… • Watch what you say. While you know not to make statements that are discriminatory, that may happen inadvertently. For each of your communities, know what state and/or local protections are in place and be sure that your online marketing is universal as to all of the necessary protected classes (because something that you can say in one area might be a fair housing violation in another. Consider an “umbrella approach”). • Watch what you show. Photos, videos, computer graphics, drones…all pretty amazing. But if people are shown, remember the wisdom of diversity. When you show only white people, adults without children, or able-bodied people, your message may be seen as “discouraging” to protected groups or “indicating a preference” for certain groups, and those are fair housing sins. Thou Shall Not think that SnapChat is an exception to the rules! Or that what is posted is really gone… Aubrey Morey, Genevieve Howard, and Claire Washburn with Trimark blogged at MFI.com and talked about how you can

use Snapchat stories to engage with residents in a variety of different ways. One suggestion was to show residents (who have given you model releases) signing leases and in their new apartment. But remember that the fair housing considerations must be in place. How diverse are these residents depicted signing leases, in their new apartment, or enjoying your amenities? If there is not a good cross-section in this regard, you are taking a fair housing risk. And even if the photos you use are only “there” briefly, a screen shot or camera photo of the screen is easily taken and can be used as evidence in a fair housing advertising case. Thou Shall Not ignore what is happening in the world of websites and ADA accessibility. If you have a “brick and mortar” presence (a leasing office) it may be necessary to have your website be ADA compliant. That includes ways for those who are visually impaired, deaf, challenged with fine motor skill disability to navigate and have access to the information you provide. The World Wide Web Consortium (W3C) has issued “Web Content Accessibility Guidelines” that set forth technical standards for making Internet content accessible to the disabled. These standards do not have the force of law but are helpful. Keep in mind, that while the U.S. Department of Justice has extended the time frame to issue definitive guidance until the year 2018, their litigation arm has weighed in on a few cases on the side of the disabled. A fairly recent California case will likely embolden advocates for the disabled. With legal demand letters being sent to companies by plaintiffs lawyers, the complexities and costs of litigation, and the public relations effect for not having a website accessible to the disabled, you would do well to make your websites more accessible sooner than later. The trend is fast moving towards ADA compliance for websites. Thou Shall Not ignore online reviews! The reality is that ignoring reviews about your community, particularly ones that are not good, is not only frowned upon in the world of social media, it presents a fair housing risk. And keep in mind that even if you do not engage directly with a social media presence, your prospects, applicants and residents are putting it out there – about you! While attending a JMLS annual fair housing conference, I heard Bryan Greene (Acting Assistant Secretary for Fair Housing and Equal Opportunity who has devoted his professional career to fighting housing discrimination) chastise colleagues (fair housing advocates) who were doing telephone testing. He told them that people are not on the phone much anymore – the housing process is happening at least initially through the internet – and that that advocates should be exploring that world to hunt for discrimination. If they take Mr. Greene at his word, here are some of the posted reviews they might find:
• “Went to XYZ Apartments last week with a friend of mine who happened to be black. I just wanted to check the area out before I made an appointment, and boy was I ever glad I did. Some guy saw us walking around and started saying crap about us (apparently, a white girl can’t have a platonic black friend?) Started throwing around THAT WORD. He came back out and he didn’t like us ignoring him and he came back out WITH A GUN. SAT ON HIS PORCH WITH A GUN AND THREATENED TO SHOOT MY FRIEND BECAUSE HE WAS BLACK???? ARE YOU SERIOUS????? Called the cops, they don’t care because he stayed on his porch and didn’t come after us. Seriously????? He doesn’t have to come off his porch to shoot us!!!!!! I just want to warn everyone in this area please be careful! I don’t want to see anyone get hurt!!!!” • “I don’t want to move there, just because me and my boyfriend is on Section 8, I thought maybe we could live in luxury. But we were never more wrong. We were told that if [we] used the washer and dryer we would be charged for the use of the water and we couldn’t have access to the amenities. So we would just be renting the apartment. If you are white? You could use full use of the amenities of XYZ, but if you are of color? They will try to run the scam on you as well. Don’t go there.” • “Finally, the amount of Indians and Muslims moving in keep growing by the masses and with all of this terrorism happening here with the shootings and bombs found so close to home it’s scary.”

Now have any of these communities done anything wrong? Not necessarily. But think about a fair housing advocate seeing these posts, particularly if the issues raised are not responded to in such a way as to clarify (such as “We are so sorry for the misunderstanding. Each and every one of our residents has the same lease terms and that includes being responsible for the metered water consumption of their particular home. We would never have different terms and conditions based on the race of our residents, nor would we ever limit any residents and guests from enjoying the amenities that are offered to all at our community.”). Any advocate would likely be remiss in not exploring these scenarios. The voice of the reviewer was raised and your voice should not be silent. Respond! You may need to discuss with your legal counsel, but respond! You may need to get input from others on your owner/management team, but respond! Don’t drag your feet, but respond on as timely a basis as possible! Respond! Thou Shall Not forget what the general rule is: It is illegal “to make, print, or publish, or cause to be made, printed, or published any notice, statement, or advertisement, with respect to the sale or rental of a dwelling that indicates any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin.” Your social media marketing is not an exception. Thou Shall Not forget how very expensive fair housing cases can be. Thou Shall Not forget to: Do it right, because it is the right thing to do.

Believe it or not, we find ourselves completing work orders faster and more efficiently as a result of our training for this event. Amanda: What is your favorite game to compete in? July: My all time favorite event is the Icemaker Install challenge. Here at my property, we have 765 units, so I’ve become very efficient at installing these kits. My goal is to win 1st place in this event at this year’s competition! Amanda: I wish you the best of luck at the big competition. What is the most rewarding part of having a career in the apartment industry? July: This career is rewarding because we get to see our customers every day and they become an extension of our own families. We are making their home, HOME.

Foundation Corner Kicking off 2017 by Empowering our Charity Partners By: Joseph Rosenwasser Meadow Wood Property Company
I
n January, the AAGO Foundation Board met and worked hard to decide who our 2017 Charity Partners would be and what to do with the $35,000 raised in 2016. All things were considered including where the most impact would be, what purpose the money would serve once given and making sure the donations matched up directly with the mission of the foundation. Upon the recommendation from the Friends of Foundation Committee, the board accepted that the Seminole County Friends of Abused Children, the Stephen Siller Tunnel To Towers Foundation, Habor House, and The Sharing Center would be our Charity Partners for 2017. Any changes in Charity Partner status does not reflect the worthiness of the Charity considered instead it reflects upon the duty of the Foundation Board to adhere strictly to the recorded mission of the AAGO Foundation and the effectiveness the AAGO Foundation can have by a partnership with that organization. Votes were cast for the donations listed below.
A $5,000 Grant was awarded to the Seminole County Friends of Abused Children to use for the production of a marketing video which will be broadcasted to empower the teens who are aging out of foster care. It will give attention to the AAGO Foundation and include information on how to pursue a career in the multifamily industry. This grant was presented to their President, Faith Shorthouse, and their Treasurer, Michelle Brightman, by our President, Sean Bailey at the AAGO Installation Dinner in January. We are looking forward to hearing great things about the success they will have with this project. Seminole County Friends of Abused Children will also receive $1,000 for their Light of Hope Event which will be held in April. Our hope is that we will also have a great show of support for that event through the amount of people we have attending it. This event is well publicized and could bring a lot of attention to the mission of the AAGO Foundation so please consider attending and allowing us to have the best turn-out we have ever had at a Charity Partner event. They will also receive $1,000 for their An Evening With Friends Wine Social Event which will be held in September. The Sharing center will receive $1,200 for a sponsorship at their Sweet Charity Wine, Fashion & Dessert Event which will be held in September as well. Harbor House will receive a $250 donation for their Paws for Peace Walk which will be held in April. he 2017 AAGO Trade Show is on April 25th at the Central Florida Fairgrounds. For those of you who haven’t experienced this event in the past, this is AAGO’s largest marketing opportunity of the year. The Trade Show gives exhibitors the chance to engage over 1,000 apartment industry professionals and key decisions makers from the central Florida’s leading management companies. This year’s Trade Show theme is Reality TV and we are looking forward to

Advocacy at Work: AAGO Shares Industry Priorities with Central Florida Lawmakers On February 8th, AAGO joined other affiliates from across the state in Tallahassee for the Florida Apartment Association’s (FAA) annual Legislative Days Conference. The 2017-2018 Florida Legislative Session is now underway and AAGO was pleased to meet with central Florida lawmakers to discuss various policy issues that are of concern to the apartment industry. Please join me in thanking our Legislative Committee and all of the members who participated in this wonderful advocacy opportunity. You made AAGO shine in our state Capitol and your continued support of our industry’s advocacy efforts is much appreciated!
How does the Non-Homestead Property Assessment Cap impact your bottom line? In 2007, the Florida Legislature proposed constitutional Amendment 1, also known as the “Save Our Homes” Amendment. This policy change was approved by voters in 2008 and instituted a 10% cap on yearly assessment increases for most non-homestead property.
• Support Senate Joint Resolution 76 (Sen. Tom Lee, SD 20), which will reauthorize the Non-Homestead Property Assessment Cap.
This cap has successfully protected businesses, like apartment communities, from rapidly rising property values that increase property taxes. If the cap is not reauthorized, apartment communities and businesses will see a drastic increase in property taxes starting in 2019. This could result in a loss of industry jobs and impact rent prices throughout the state. AAGO urged lawmakers to support Senate Joint Resolution 76 (Sen. Tom Lee, SD 20), which will reauthorize this important cap and protect businesses from excessive taxation.
• Oppose Senate Bill 268 to ensure housing discrimination claims cannot bypass the vetting process before preceding to a civil suit.
Why should housing discrimination cases remain fully vetted?
During this legislative session, we are asking lawmakers to: • Support the preservation of the Sadowski Affordable Housing Trust fund.
Why is the Sadowski Trust fund important to the apartment industry? The Sadowski Act (1992) allowed document stamp taxes from real estate transactions to be used for Florida’s affordable housing programs. These funds are used for the State Apartment Incentive Loan (SAIL) program, which rehabilitates existing units and builds new ones where needed. In addition, these resources are used for singlefamily housing initiatives (SHIP). One example of SHIP that you might be familiar with is Habitat for Humanity. These valuable SAIL and SHIP programs benefit Florida’s most vulnerable populations which includes, the elderly, those in financial need, and individuals with disabilities. 18
Most importantly, Sadowski funds are highly leveraged with private sector loans that provide $4 to $6 for every $1 of state funding. As a result, Florida’s housing programs make a positive impact in the community while also minimizing the resources paid by the Florida taxpayers. For these reasons, we asked lawmakers to support the preservation of the Sadowski Affordable Housing Trust Fund by ensuring these resources are used exclusively for housing programs.

The Florida Civil Rights Act (FCRA) and the Florida Fair Housing Act protect individuals from discrimination. Under current law, a discrimination claim must be filed within one year and the case cannot be heard in a civil court until the claim has been investigated and the plaintiff has exhausted his/her administrative remedies. Senate Bill 268 would increase the timeframe for filing a claim to two years and remove the requirement for investigation, which would allow any complaint to move immediately to civil court. This bill would allow a resident to sue an apartment community before their claim is properly vetted, which would greatly increase the number of civil suits in Florida’s court system.
Senate Bill 268 is deeply concerning when you look at the statics in Florida. Since 2010, nearly two-thirds of discrimination cases investigated by the Florida Commission on Human Relations were found to have no cause. Without a proper vetting procedure in place, these unfounded lawsuits would be able to proceed to courtrooms throughout the state. This would undoubtedly increase the legal costs for the apartment industry while also putting an unnecessary burden on Florida’s legal system. In light of these facts, AAGO asked lawmakers to oppose Senate Bill 268 to ensure housing discrimination claims cannot bypass the vetting process before preceding to a civil suit that is both a burden on the judicial system and the Florida taxpayers. Now that you know the issues we are tracking this session, be sure to keep an eye out for email updates from Courtney Barnard, FAA’s Government Affairs Director. There may be other calls to action throughout this year’s session as bills move through the legislative process and the new budget is finalized.

And So It Was... F A A L E G I S L AT I V E D AY S On February 8th, more than 40 AAGO members “took to the hill” in Tallahassee for the Florida Apartment Association’s Legislative Conference! Year after year, our AAGO Legislative Ambassadors have represented en masse and in style. The Florida apartment industry was at the Capitol advocating for three primary legislative objectives this year, and our delegation was very well received by lawmakers and their legislative staff. FAA’s Legislative Priorities this year included: Opposing SB268 which would allow residents filing claims to completely bypass the established administrative process for complaints, and go directly to civil court. • Preserving the revenue allocated to the Sadowski Affordable Housing Trust Fund. Each year the revenue in this fund is placed in jeopardy when lawmakers sweep the fund to balance the budget. • Support the Non-Homestead Property Assessment Cap. In 2018 the current 10% cap on assessed value increases for non-homesteaded properties will expire if not reaffirmed for placement on the ballot. I n s ta l l at i o n o f O f f i c e r s Dinner Meeting On January 18th, 2017 nearly 200 AAGO members converged on the Hilton Orlando/Altamonte Springs for the annual Installation of Officers Dinner Meeting! This important event serves the dual purposes of recognizing those who volunteered their time and leadership to the association in 2016, and charging the incoming leadership of the association with advancing the mission. At the meeting we installed our 2017 AAGO President, Ricardo Alicea with the Bainbridge Companies, the new officers, directors, committee/council leaders, and our AAGO Foundation Board of Directors. We were honored to have AAGO and FAA Past President, Kathy Ratchford, as our installing officer! At the conclusion of the installation ceremony, AAGO President Ricardo Alicea shared some of his personal journey that led him to where he is today and he expressed his gratitude to Immediate Past President, Kimberly Hackett-Maggard, and his fellow officers for their leadership in 2016. President Alicea also charged our incoming AAGO Committee/Council Leaders with specific goals for the year at the meeting, and encouraged them to build upon the positive momentum of the past few years! He also announced that due to the success of completing the majority of the priorities from the 2015 Strategic Plan that we would once again be conducting strategic planning in 2017. The AAGO Board and Committee Leaders would like to thank ALL of AAGO’s volunteers for sharing their time and talents with the association. AAGO is an industry leader thanks to the countless hours and efforts of our volunteer leaders and members. In addition, we would like to thank the Veterans Administration and the Homeless Services Network for their time and for educating our members on how we can play a role in solving the problem of veteran homelessness in central Florida!

MARKET BEAT Multi-Family Market Vital Signs By MyRentComps.com
Report Zone 1a (Downtown Orlando) year are increasing at a greater rate. From Q3 2013 to Q3 2014 rents climbed by 3.7%. Then, from Q3 2014 - 2015, 1a saw 9.2% gains and finally from 2015 to 2016 rents jumped 11.4%. It will be interesting to see if this trend continues when we look at the 2017 numbers from the AAGO Online Market Survey.
Downtown Best of the Best Update Following up on Market Beat articles in 2014and 2016, we once again take a quick look at Jan 2017 data for about 2,900 units representing the “best of the best”, class ‘A’ multifamily rentals in Report Zone 1a.
In the Market Beat this month, we are going to look at Report Zone 1a in the Orange County area of the AAGO Online Market Survey. Report Zone 1a is the Downtown Orlando area of Orange County. The map below shows all of the Report Zones in Orange County that are analyzed in the Central Florida Apartment Market Survey & Trend Report (AMSTR). The AMSTR analyzes all five AAGO area counties and related submarkets. From information collected through the AAGO Online Market Survey, we reviewed the year over year history for downtown Orlando (Report Zone 1a). Zone 1a usually has response from about 7,000 units. Physical Occupancy has decreased for the first time in this year over year study period for this report zone. The occupancy increased from 2013 to 2014, held steady in 2015 before decreasing in 2016.
This group of properties currently has a physical Occupancy of 92.41%, with an Average Base Rent of $1,584, and an Average Base Rent per SqFt of $1.68. All three figures are lower than last year’s numbers for this particular property group of high end product in the 1a Zone. This segment of the 1a Zone is mostly newer properties and coincidently, you can see analysis of the different segments of any report zone in the AMSTR by looking at the “Analysis of Common Unit Types by Vintage” for that area. What you need to know regarding New Section 608 Regulations Matthew Smith

his year, our industry will face new changes that directly impact how Maintenance Teams perform their jobs due to new EPA Section 608 Regulations. These changes not only represent added costs but the potential for properties to be out of compliance if new standards are not met.
NEW EPA REQUIREMENTS Effective January 1, 2017, CFC, HCFC, HFC and HFO reclaimed refrigerants may not be resold unless it has been reclaimed by a certified re-claimer.
ADDITIONAL CHANGES IN 2018 Effective January 1, 2018 the sale of CFC, HCFC, HFC and HFO Virgin refrigerants are restricted to technicians certified under EPA Sections 608 and 609. Wholesalers must keep invoices that indicate purchaser name, sale date, and the quantity of CFC, HCFC, HFC and HFO refrigerants purchased. On site, new recordkeeping requirements for appliances containing 5 to 50 pounds of refrigerant also become effective. Technicians must keep records of the location, date of recovery, and type of refrigerant recovered for each disposed of appliance. Other items that need to be recorded are the quantity of refrigerant by type recovered from disposed appliances in each calendar month, the quantity/type of refrigerant transferred for reclamation or destruction, the person to whom it was transferred, and the date of the transfer. All records must be maintained for no less than three years. Employers must also maintain their own Proof of Certification for Technicians along with a copy of their certification at their place of business. These must be maintained for three years after a certified individual leaves the employer.
NEW EPA CERTIFICATION EXAM Technicians must be certified in order to maintain, service, repair, or dispose of appliances containing CFC, HCFC, HFC and HFO refrigerants. The EPA has developed new 28

certification exam questions reflecting the new rules. The new exam is scheduled for pilot testing during the first quarter of 2017. After the pilot testing is complete, certified test administrators will be provided the new testing material. The EPA requires new wording on the new certification cards, which will result in all new and replacement certification cards having a new look. The new wording includes: “[Name of person] has successfully passed a [Type I, Type II, Type III, and/or Universal, as appropriate] exam on how to responsibly handle refrigerants as required by EPA’s National Recycling and Emission Reduction Program.” Currently certified Section 608 technicians do not need to be re-certified. All requirements for the maintenance, service, repair and disposal of CFC and HCFC are extended to HFC and HFO refrigerants.
Note: The EPA is allowing the continued sale of small cans, two pounds or less of refrigerants intended for use in MVAC systems and equipped with a self-sealing valve. However, this exception is limited to individuals who perform work without monetary compensation.

ave you ever known someone that was training for a marathon? If you answered yes, you may recall hearing stories of the extensive training and discipline it took for someone to prepare for running 26.2 miles during his or her first marathon. In order to successfully complete a race of this length, individuals train for weeks, months, or sometimes an entire year before the big race. All of this training and hard work eventually comes down to one race and 26.2 miles of pavement. Believe it or not, your career in the multifamily industry is much like running a marathon. The question you need to ask yourself is: Am I prepared to race to the top? You wouldn’t sign up to run a marathon without training for it so why should advancing in your career be any different? The opportunity for growth in the apartment industry is endless whether you’re on the management side of the business or serving as a supplier partner. In order to be considered for that big promotion, one thing is for certain- you will need effective leadership skills. This type of training requires persistence and focus, much like training for a marathon.
Olga: Continuing education, learning something new, getting to know the industry trends and hearing other people’s views on leadership is very important to me. I have completed my CAM with AAGO and was happy to learn that AAGO was offering another leadership course to stay abreast with latest leadership strategies, updates, and approaches. Amanda: What session did you find most valuable and why? Olga: The most memorable one was “Listening Pays.” The professor not only inspired me to be a better listener but also, to continue my path of furthering my education. There is no such a thing as too much education or knowledge. The professor had me engaged and used a variety of approaches and tools to deliver her points. I still have the stone the professor gave each one of the participants on my desk and it reminds me each time I see it that “listening pays!” Amanda: How has your participation in this program impacted your professional development?
Olga: It helped me become a better listener and a more patient leader. Now I am the one who doesn’t jump to conclusions without collecting all the data and hearing all sides of the story first. As a result, I choose not to act on emotion and remain calm and confident in challenging situations. Dear Harry, We recently evicted a resident who owes two months’ rent, attorney’s fees and who left significant damages. We did our normal move-out procedure in the computer and sent the total due to our corporate office where they handle sending the delinquent accounts to collections. I just received a very threatening letter from a lawyer today saying that we must return the resident’s security deposit because we did not send the resident the Notice of Intention to Impose Claim on Deposit (we call it the SODA) to the resident within 30 days of the resident vacating. Actually, we never send them at all when we evict a resident. Do we have to actually return the deposit? It sounds absurd. Signed: “Evicting in Eustis” Dear Evicting Forgetting to send out the Notice of Intention to Impose Claim on The Security Deposit is very common in eviction situations. You are very happy the resident is gone, lots of money is owed, and you can’t fathom that the resident would receive the deposit back. Normally, the evicted resident would not stand to receive the deposit back, as the amount owed significantly exceeds the deposit amount. The problem for you is that the law does exempt you from sending the Notice of Intention to Impose Claim on The Security Deposit after finishing up an eviction. Talk to your attorney about this, but most likely you will have to return the funds. The resident will still owe you the money, but your legal right to retain the security deposit against amounts owed may be gone. Dear Harry, We suspect drug activity in one of our apartments. People are constantly coming and going to this apartment, staying a short period of time, and the neighbors are complaining nonstop. We called the police, and oddly, they did not seem concerned and actually said they knew our residents were “bad news”. We are going to lose good residents. One neighbor brought to the office some empty plastic baggies he found outside of his door, and one has been taking photographs of the cars of the residents’ visitors. We can’t prove a thing, but something has to be done. Can we evict these people? Signed, “Traffic in Tavares” Dear Traffic, Unless you have an actual arrest at the property where drugs

are found, these cases are tough. Sometimes law enforcement is totally aware of the drug activity, but because of an ongoing investigation, they choose not to take action. This leaves you and your good residents in a very tricky situation. Your first step is to give the resident a Seven Day Notice of Noncompliance with Opportunity to Cure for “causing unreasonable disturbances due to excessive traffic to and from the apartment, including at late night and early morning hours”. This usually tips the resident off that you know what is going on. Your next step is a face to face conversation with the resident and having an “Agreement To Vacate” in hand. The “Agreement to Vacate” is a form under which the resident agrees to vacate as of a fixed date. Many residents who are engaging in criminal activity will continue to do so until they feel that other people in authority are onto them. The Agreement to Vacate gives them the opportunity to agree to move. If they sign the Agreement to Vacate and fail to move by the agreed upon date, you can simply file an eviction based on the Agreement to Vacate. You do not need to prove that the resident is dealing drugs. If the resident refuses to sign the Agreement to Vacate, you have to begin building your case. This may mean that you actually set up surveillance of the unit. In order to win cases like this in court, you need proof. Written statements by residents, rumors and police reports are not admissible in court as evidence UNLESS the person who spoke to you, or wrote the statement or the police report is actually in court with you. Often residents are afraid to come to court, or the police will simply not show up at your eviction trial. Try the Agreement to Vacate route first, and if this does not work, call your attorney and ask what type of evidence will be needed in order to win the case and get the resident evicted. Don’t delay any of this. Often drug activity will slow down only to speed up again. You don’t need to lose good residents over this, and no resident should have to live in a situation where drug dealing is occurring. Your failure to act could give someone the legal right to break their lease. Dear Harry, We are currently engaging in a major rehab of our property and building another phase. It is hectic all the time, and things are slipping through the cracks. We have residents moving in and not putting the utilities in their name until we have to hound them, unit inspections are not made sometimes before the resident moves in, and even lease problems occur when a resident gets a lawyer who says we LegaLine

did something wrong with the lease agreement. All of this is being compounded by a turnover in leasing agents. Is there anything we can do to streamline the process and make sure things are done correctly? Signed, “Disorganized in Deland” Dear Disorganized, There is a simple solution to your problems. You need to use a Key Release Checklist. This checklist is to prevent things from being forgotten, and if it is used and made mandatory on the part of your staff, a lot of your problems can be avoided. Once the key is given to the resident, you lose a lot of control. The main issue is that the key is being handed out without making 100% sure that everything in in order. A Key Release Checklist can accomplish a lot of things. Before releasing the keys, have your staff member confirm the following and literally have them use a pre-printed checklist and check off each item. Utilities should be in the resident’s name, and this is to be confirmed. The lease agreement should be signed by ALL parties. A copy of the executed lease signed by the residents and manager should be given to the resident. The photo ID needs to be copied (with the exception of military ID, which cannot legally be copied) and the copy should be in the file. Any permitted pet should have been seen by your staff, photographed and the pet fee or deposit paid. All required rent and security deposit money should be collected, and many companies require that the funds have cleared the bank. The unit inspection prior to move-in should be 100% completed, and the last minute inspection the day of resident move-in but prior to key release should be completed. Call our office for the latest Key Release Checklist, or sit down with your staff and create one that works. Once created, make it mandatory for the staff to use. Many mistakes we deal with are preventable, and doing this all prior to key release is an excellent move. Dear Harry, One of residents is elderly and has requested to be moved to a downstairs apartment. Unfortunately, we do not have any available; all our downstairs units are currently occupied, and no residents in these units have given us any indication they plan to move. The elderly resident claims that she cannot walk up the stairs anymore, her son is now involved, and she just wants to break her lease and move. Are we required to allow this person to break the lease? Signed, “Accommodating in Apopka” Dear Inheriting, The law is not clear on whether you should make a reasonable accommodation for this elderly resident and allow her to break the lease. We recommend that you allow it and document everything in your file. If you do allow the resident to break
the lease, use the proper Mutual Termination of Tenancy and Release Agreement that clearly states the date of moving, what will happen to any deposits and the resident’s responsibility for the damages that you may discover in the unit after the resident vacates. Sometimes it is better to decide on the side of caution. The laws regarding disabilities and fair housing can be very vague. You always have to consider what a judge may do in the situation when the law is unclear and act accordingly. Dear Harry, We just took over a property and are dealing with all kinds of problems: unauthorized occupants, unsigned leases, unauthorized pets and balconies that are full of personal items. We know that any curable problem must be addressed by using a Seven Day Notice with Opportunity to Cure, and we have been posting and hand-delivering them for almost a week now. When we were able to address the problems directly with the residents, we hear the same old story about how the previous management had no problem with what they were or were not doing. This is especially coming up with pets and unauthorized occupants, with some of the residents telling us that their occupant was actually paying the rent and it was accepted by previous management. How to we clean up this mess? Signed, “Getting Strict in Sanford” Dear Getting Strict, Waiver is a massive issue you must deal with. The first thing you need to do is look at the ending dates of the leases. If the lease ends within one or two months, your best approach is to non-renew. If you are asked why you are non-renewing, you can explain that you are doing so because of the noncompliances. In conventional housing, you are not required to give the resident a reason, but if rent payments are prompt and you feel that you would want to have this resident stay on if the noncompliances were cured, this is the approach you can take. With noncompliances such as unauthorized occupants, it may be as simple as having the occupant fill out an application for residency, and if approved, allow that person to be added to the lease or a new lease drafted. With unauthorized pets, a pet addendum could be completed with fees or deposits paid. The main thing for you is to work with your attorney on each of the unique situations to get proper advice, as each situation my warrant a different approach. In the meantime, continue to serve the Seven Day Notice of Noncompliance with Opportunity to Cure, and understand that if you take further rent from a resident who is in noncompliance, you further diminish your prospects for success in actually terminating the resident’s tenancy based on the noncompliance. Remember that these problems did not occur overnight and cannot be fixed overnight.

DOGS AND SLIP AND FALLS AND OTHER AGITATIONS FOR THE LANDLORD Any good landlord shudders when they hear stories about dog attacks and slips and falls at apartment complexes. Such stories can result in large jury verdicts for scenarios that could have been prevented. This article considers two recent cases and their outcomes.

As a result of the fall, McCormack injured both her knees which required extensive treatment including two arthroscopic knee surgeries. McCormack’s treating surgeon testified that McCormack’s arthroscopic surgeries revealed multiple pathologies, including chondral defects in both knees which were not visible on the MRI studies. This doctor testified that McCormack’s chondral defects were acute in nature and causally related to the subject slip and fall. McCormack sought past medical expenses in excess of $180,000. She further claimed that she would eventually require a total knee replacement surgery at a cost of approximately $100,000. Defendant admitted that the floor was wet but ar¬gued that there were three wet floor signs close to where the fall occurred. Defendant further claimed that McCormack had simply ignored or disregarded the warnings. Defendant further asserted that McCormack’s knee injuries, which included meniscal and ACL tears, preexisted the subject fall. In particular, McCormack had a 2009 incident in which she tripped at home as well as to longstanding wear and-tear changes. Defendant’s expert surgeon concluded that McCormack’s medical conditions were pre-existing. He further opined that the knee surgeries performed were not causally related to the slip and fall at Defendant’s restaurant. De¬fendant’s expert radiologist added that McCormack’s MRI films, taken of her knees before and after the subject fall, were substantially the same and did not show evidence of new injuries. JURY VERDICT: The jury found no negligence on Defendant’s part of the defen¬dant

As a result of the verdict, Defendant claimed entitlement to costs and attorney fees based on a $5,000 proposal for settlement filed early in the case. Roche vs. Seapaul & Bholaram, Marion County Circuit Court Case No. 15-CA-210 (9/16): FACTS: Roche was 55 years old and riding her bike on the street adjacent to the Defendants’ home when the Defendant’s dog broke free of the light material leash. Defendant’s dog bit Roche on the ankle and knee and knee, she lost control of the bike and rolled into a drainage ditch. Roche suffered a rotator cuff tear on her dominant side and had to have arthroscopic surgery. The court gave Roche a directed verdict on the issue of the Defen¬dants’ strict liability and negligence in fail¬ing to use a chain on the dog that would be more secure. Roche had a damages only trial against the Defendants and Roche testified that she was left with slight permanent scaring from the bite marks. She also claimed that despite therapy and arthroscopic surgery, she will permanently suffer pain and limitations from the rotator cuff tear. Defendant claimed that Roche made a better recovery than claimed. Roche did not make a loss of income claim. JURY VERDICT: The jury awarded Roche $137,158.60 and the Court assessed fees and costs, bringing the judgment to $141,000. CONCLUSION: Even though neither of these cases involved a claim against a landlord, either could have arisen in the context of a landlord/ tenant relationship. Both cases illustrate that juries do not have a lot of patient for dog bites/animal attacks and negligent cleaning efforts. Further, both cases support the notion that landlords have the potential ability to avoid liability and negligence in these types of claims if the landlords exercise an “ounce of prevention” and consider the potential ramifications of allowing an unsafe environment to exist.
