irst I would like to start out by saying thank you. I truly appreciate the opportunity to serve as your Associate Vice President and give back to an organization that has contributed so much to my career. I would not be where I am today if it were not for my involvement with AAGO. As some of you may know, I have experience working on both the management and the supplier side of the industry. I started as a leasing consultant and worked my way up to Property Manager. I gained over 20 years of experience on the property management side of our industry before moving to the supplier side where I serve today. Are you looking to grow professionally in 2016? If you answered yes, your involvement in AAGO can be critical to your success. I encourage you to strive to be more involved with the association in 2016. The best way to get more involved is to join one (or more) of AAGO’s committees. There are a variety of opportunities to volunteer and by doing so, you will make lasting connections in the industry. These relationships grow your business, enhance your career and enrich your membership experience within AAGO. Personally, I enjoy being involved in the AAGO Legislative Committee. This group is on the front lines monitoring legislation at the local, state and national level that could impact the apartment industry. What better way to connect with your clients than by sharing important legislative updates that impact their business? 2016 ELECTION OUTLOOK The 2016 Election season is in full swing with the Florida Presidential Preference Primary on March 15th. Election season can be overwhelming so I’ve compiled all the details you need to know. For more information, please refer to your County’s Supervisor of Elections office. What is a Presidential Preference Primary? The Presidential Preference Primary (PPP) is Florida’s opportunity to have a voice in who we will see on the ballot in 2016. It is important to remember that Florida is a closed primary state, which means you will select your nominee from a list of candidates within the party you selected on your voter’s registration application. In preparation for the PPP, I encourage you to research the candidates and check your County’s Supervisor of Elections website for Election specific information (Voting locations, hours of operations and absentee ballot information). What other election dates should I be aware of? • The 2016 Primary Election will be held on August 30th • The 2016 General Election will be held on November 8th • What will be on my ballot? • President of the United States • U.S. Congressional Races (If applicable) • Members of the Florida Legislature (If applicable) • Some local candidates (If applicable) • Constitutional Ballot Initiatives (General Election ballot only) 14

What if I can’t get to the polls on Election Day? • In Florida, you can request an absentee ballot for any reason or you can take advantage of the Early Voting hours in your county (Please refer to your Supervisor of Elections for more information). Where can I find out more about the candidates and ballot initiatives on the 2016 Election Ballot? • You can visit your Supervisor of Elections’ website for more information. Orange County: www.ocfelections.com Osecola County: www.voteosceola.com Lake County: www.elections.lakecountyfl.gov Volusia County: www.volusiaelections.org Seminole County: www.voteseminole.org LOCAL Fire Assessment Fees are becoming increasingly more common in central Florida. A Fire Assessment Fee is an additional source of revenue that local governments are starting to utilize to pay for or supplement their fire protection services budget. Typically, local governments pass a Fire Assessment Fee ranging from $50-$200+ per residential unit depending on the municipality. This per residential unit fee quickly escalates for an apartment community with dozens or hundred or apartment homes. AAGO learned the City of Fruitland Park (Lake County) is exploring a Fire Assessment Fee for the 2016-2017 tax billing period. The Fruitland Park City Commission is in the process of determining if the City will move forward with a Fire Assessment Fee. Rest assured, AAGO will continue to monitor this issue closely and update members on any new developments.


In addition to monitoring Fire Assessment Fees, AAGO is continuing to track the City of Orlando’s progress on an energy benchmarking ordinance. Orlando is one of ten cities participating in the City Energy Project (CEP). The CEP is a national initiative that seeks to improve the energy efficiency of large buildings. Cities that are associated with the CEP often implement a policy that requires buildings of a certain size to report their energy (and sometimes water) consumption on an annual basis. Property owners use the Environmental Protection Agency’s Energy Star Portfolio Manager® tool to track and report their consumption. Once the data is collected, it is publicized by the local government and available for potential renters or prospective buyers to review. Orlando staff informed AAGO that the City plans to introduce an energy benchmarking ordinance in early 2016. AAGO is thankful to have a positive working relationship with the City of Orlando and looks forward to providing feedback on the ordinance once a draft of the legislation is available. In preparation for the ordinance draft to be released, members are highly encouraged to visit www.AAGO.org and read the AAGO White Paper that discusses how this issue will impact the apartment industry. This White Paper can be found under the Resources Tab: Government Affairs, Central Florida, Orlando City Energy Project. STATE The Regular Florida Legislative Session ends on March 11th. This annual event provides members with a unique opportunity to experience the federal legislative process first hand while representing the apartment industry on Capitol Hill. And So It Was... F A A L E G I S L AT I V E D AY S On January 26th, over 50 AAGO members traveled to Tallahassee for FAA Legislative Days. The day kicked off with a Send-Off Breakfast at AAGO thanks to CORT and ForRent Media Solutions. After breakfast, the group boarded a luxury bus sponsored by Rentpath and hit the road for the Capitol. On the way, the group stopped for a picnic lunch provided by the Law Offices of Heist, Weisse & Wolk. Once in Tallahassee, the group attended FAA’s Reception and Legislative Briefing Dinner at the Hotel Duval with industry representatives from across the state. On January 27th, the group walked the halls of the Capitol and met with 37 state lawmakers or their staff members to discuss FAA’s 2016 legislative priorities: •.Expanding allowable repairs for maintenance professionals •.Clarifying renters insurance requirements • .Supporting full funding of the Sadowski Affordable Housing Trust Fund • .Opposing the creation of criminal penalties for landlords and property management employees AAGO would like to once again thank our sponsors for their continued support of this event and all of the attendees who made this year’s trip to Tallahassee a success!

Greater Orlando Young Professionals By: Julia Comings Assistant Regional Manager Vice Chair, Young Professionals Committee With the start of a new year, the Greater Orlando Young Professionals (GOYP) are headed in a new and exciting direction. In an effort to encourage leadership development and celebrate professional growth for AAGO’s future leaders, we have designed a strategic plan as well as basic committee member criteria to help us to streamline our efforts in accomplishing our objectives. A few of the requirements for 2016 include actively participating in other committees, assisting with the Job Shadow Day, contributing to a hands on volunteer opportunity benefitting

homeless veterans and interviewing one current board member. In addition to these committee member criteria, our current Young Professionals are very focused on the future success of the association. A few of our main goals are sustained member growth and personal development for leadership. Many of the YP committee members are taking advantage of the Lyceum program and the new AAGO Leadership Development programs to prepare themselves for future leadership positions within the association. Keep an eye out for our committee members to be out and about, networking at the next AAGO event. Dear Friends, On behalf of the AAGO F ­ oundation Board members and the Friends of Foundation committee, I would like to start off 2016 with a huge “Thank You!” Thank you for the amazing support, both in your time and financial investment, since the Foundation’s inception three years ago. In 2015 alone we were able to give more than $19,000 to support many amazing local charities. Also, I would be remiss not to take a moment to thank Past President Lori Trainer and the many Foundation Board Members who have faithfully served to get us to this point. As we continue our mission to educate and empower Central Florida’s homeless, veterans, and teens aging out of foster care, we plan to be even more strategic in 2016. With so many great charities to choose from, it was no easy task to select those we will support in the year ahead. January Dinner Meeting On January 20th, 200 members gathered at the Hilton Orlando/Altamonte Springs to install AAGO’s 2016 President, Kimberly Hackett-Maggard, the Board of Directors, the Executive Committee, AAGO’s Committee Leaders, the AAGO Foundation Board of Directors and the Friends of the Foundation Leaders. The Installation of Officers was led by Florida Apartment Association President, Glenn Evers (MAA). Report Zone 1a (Downtown Orlando) In the Market Beat this month, we are going to look at Report Zone 1a in the Orange County area of the AAGO Online Market Survey. Report Zone 1a is the Downtown Orlando area of Orange County. The map below shows all of the Report Zones in Orange County that are analyzed in the Central Florida Apartment Market Survey & Trend Report (AMSTR). The AMSTR analyzes all five AAGO area counties and related submarkets.

Downtown Best of the Best Update Following up on Market Beat articles in 2012 and 2014, we once again take a quick look at Jan 2016 data for about 2,800 units representing the “best of the best”, class ‘A’ multifamily rentals in Report Zone 1a. This group of properties currently has a physical Occupancy of 96.12%, with an Average Base Rent of $1,618, and an Average Base Rent per SqFt of $1.69. The latter two figures mark “records” since we started tracking this particular property group of high end product in the 1a Zone.

This segment of the 1a Zone is mostly newer properties and coincidently, you can see analysis of the different segments of any report zone in the AMSTR by looking at the “Analysis of Common Unit Types by Vintage” for that area. From information collected through the AAGO Online Market Survey, we reviewed the year over year history for downtown Orlando (Report Zone 1a). Zone 1a usually has response from about 7,000 units. Physical Occupancy continued its steady upward climb from the beginning of the study period through Q3 of 2014. From 2014 to 2015 Occupancy was steady in 1a which is certainly notable when considering the arrival of the new product with several properties in lease up in the downtown Orlando market.

The three newest properties finishing construction or in lease-up have average rents of $1,682, $1,702, and $1,859 averaging $1.91, $1.97, and $2.02 per square foot. It will be interesting to see if this trend continues when we look at the 2016 numbers from the AAGO Online Market Survey.

Dear Harry, We have been dealing with a mold issue in one of our apartments for over 3 months. At first, our maintenance tech could not find any serious mold at all, but then later it was discovered after more complaints that there was a small leak behind a wall that was causing some mold. The resident got a mold test on his own, and our regional maintenance supervisor reviewed it and said that it was “no big problem”. We offered a transfer to the resident last month, and he refused, saying he wanted the problem solved. We are trying to work on rectifying the situation, but now the resident is being uncooperative, and we just received a letter from his lawyer stating that rent is not going to be paid until the mold problem is resolved. The attorney even demanded information about our insurance carrier. At this point, we just want the resident to leave but he has no intentions of doing this. What can we do? Signed: “Opening wall in Orlando” Dear Opening, It is crucial to take any mold complaint seriously and get your attorney involved sooner in the process. Since most attorneys who work for apartment communities have dealt with scores of mold related matters and they give advice for free, you are selling yourself short when you do not immediately contact your attorney at the first sign of a mold issue. Mold problems when dealt with immediately almost always have a good result. You needed to have the area tested immediately by a professional. Proper equipment would have discovered the moisture source. Your maintenance supervisor is not licensed or certified to do this, and there is a natural bias towards minimizing an issue. Next, if there is in fact mold and a moisture source, proper remediation must be done right away. This does not necessarily have to be done by a licensed contractor; it could be a

small issue that your maintenance tech is fully able to accomplish without violating any contractor licensing laws. Offering a transfer without legal counsel can also cause serious problems. This matter needs to be given top priority, dealt with now at any cost and fast. If the resident is refusing access, this needs to be proven and also dealt with as soon as possible by you and your attorney. Finally, by law, your company must provide the attorney with insurance information. Send the demand to your risk management department or regional and make sure they follow up. This is Florida law and cannot be ignored. Dear Harry, One of our residents has hired a lawyer who sent us a threatening letter disputing the claim we made on her security deposit. The attorney is claiming we did not send the Notice of Intention to Impose Claim to the resident’s forwarding address and that our charges are excessive. I examined the file, and it is true that we failed to see that the resident did give us a new forwarding address in writing, but when she notified us, we did send another one to her new address. The security deposit was only $200. Can we just ignore this? My regional manager says we are not returning a dime, but the lawyer now has given us a deadline to respond, or he says he will file a lawsuit. A lawsuit over $200? Is this for real? Signed: “Threatened in Tavares” Dear Threatened, With over 100,000 attorneys now in Florida, a new cottage industry has arisen. There are attorneys right now who are taking tiny security deposit disputes for free for aggrieved residents, making written demands and filing suit. This is resulting in awards of attorney’s fees that your company must pay in the range of $2000 to $20,000 over really miniscule disputes. Our advice? LegaLine

Send the resident back the $200 immediately or risk a massive gamble in court. The only people who benefit in these cases in court are the attorneys. You will always pay more in the end, possibly a lot more. Is this “throwing in the towel” or “raising the white flag”? No. It is good, prudent business practice. Don’t believe us? Ask any attorney who does a lot of landlord/tenant law.

Dear Harry, We recently saw one of our residents with a large dog on the property. We looked in the resident file and see that she does not have a pet addendum and has not paid the required pet fee or deposit. We spoke to her, and she stated it is a service animal. She provided us with an official looking certificate stating that it is a registered service animal with the “Federal Service Animal Registry”, the dog wears a yellow vest, and the resident also gave us a letter from her doctor stating that the resident is disabled and needs the service animal for her disability. We have no problem with service animals and understand we must accept them, but this is a very large German Shepherd which is on our prohibited dog list, and we do not allow any dogs over 30 pounds here. Can we ask the resident to remove the dog and get one that meets our company rules and regulations? Signed: “Skeptical in Sanford”

Guest speaker and AAGO President, Kim Hackett-Maggard (Vice President of Operations Royal American Management, Inc.) gave an outlook on our upcoming year. Kim also shared her goals for 2016 and the strategic plan that was approved by the Board of Directors for 2016 and beyond. In closing, she encouraged supplier partners to get more involved with the association in 2016 and beyond. RECENT FALL VERDICTS This article will consider a few recent cases involving slip and falls and trip and falls at apartment complexes and other common areas and the potential exposure to landlords.

As a result of his injuries, Muniz had a shoulder surgery and a knee surgery and sought recovery of his past medical expenses in excess of $250,000. The City and the homeowners claimed that the surgery was caused by Muniz’s prior condition.

MUNIZ VS. THE CITY OF HOLLYWOOD, et al., Broward County Case No. 13-015656 (November 17, 2015):

VERDICT: The jury found no negligence on the part of the City or the homeowners.

Muniz trip and fell on a residential sidewalk that was pushed up by tree roots. As a result of his fall, he suffered cervical and lumbar disc herniations, a rotator cuff tear and a meniscus tear.

Muniz asserted that both the City and the property owner failed to maintain the sidewalk under a large gumbo-limbo tree which pushed up the sidewalk with its roots. The City and the homeowners denied negligence and asserted that Muniz was negligent in failing to watch where he walked. At trial, Muniz pointed out that he was visiting his girlfriend’s father at the time and had not walked in the area before.

JACKSON VS. LAUDERDALE MARKETPLACE INVESTMENTS, LLC., Broward County Case No. 13-9376 (October 21, 2015):

Jackson slipped and fell on the exterior ramp in a shopping center. As a result of his fall, Jackson suffered cervical and lumbar disc herniations and had a cervical fusion surgery performed. Jackson asserted that the defendant was negligent in allowing a dangerous, slippery painted exterior ramp which caused Jackson to slip and fall. Jackson also claimed that the defendant should have warned of the slippery condition. Defendant denied that the ramp was dangerous and asserted that Jackson was negligent in failing to exercise due care while walking on the ramp. Defendant also raised an issue as to whether the accident happened as described by Jackson. At trial, Jackson offered an expert who opined that the coefficient of friction testing of the ramp confirmed its excessively slippery nature. Jackson noted that her cervical surgery was a two level fusion and that she had herniated discs in her lumbar area which required epidural steroid injections.

Jackson sought past medical expenses of $179,000 and future medical costs in excess of $200,000. Defendant’s expert opined that the ramp was not excessively slippery and was well-maintained. Defendant pointed out that there were other witnesses who indicated that Jackson may have fallen on a curb in a different location. Defendant’s medical expert opined that Jackson’s neck and back complaints were preexisting conditions and were not caused by the fall. VERDICT: The jury found that the defendant was not negligent and Jackson was awarded nothing.

JAMES VS. C.A. SERVICES & TRADES, INC., Volusia County Case No. 13-31713 (November 18, 2015): James slipped and fell on wet paint and claimed that the defendant contractor failed to place warning signs. The defendant contractor admitted liability and disputed some of the damages sought by James. James was a 54-year-old female who was working as a cleaning contractor at the time of her slip and fall. She explained at trial Legal News


that she slipped and fell in on a concrete floor as she was exiting an elevator. Defendant had just finished painting the floor, but had failed to place ‘Wet Paint” signs. To break her fall, James extended her hand and arm and slammed onto her left side on the concrete floor. As a result of her fall, James suffered a concussion, severely bruised left hip and a torn rotator cuff of the left shoulder. James had rotator cuff surgery and three courses of physical therapy, which caused her to miss months of work. At trial, however, James did not assert a wage loss claim. James claimed past medical expenses of $38,936 and future medical expenses of $10,000. Defendant contractor admitted that James was injured but disputed that she sustained a complete rotator cuff tear as alleged. Defendant’s expert radiologist opined that James’ left shoulder condition pre existed the fall. VERDICT: The jury awarded James $191,936 in gross damages. This was reduced by setoffs to a net recovery of $180,326. HOLTON VS. OAKBROOK CONDOMINIUM ASSOCIATION OF CLEARWATER, INC., et al. Pinellas County Case No. 121714 (November 18, 2015). Holton resided at the defendant’s complex and tripped and fell on carpeting on the stairs. Holton asserted that the carpeting was defective, there was no lighting and the stairs were not uniform. As a result of the fall, Holton fractured his ankle which required surgical repair. Defendant denied any negligence pertaining to Holton’s fall. Holton was a female, approximately 60 years old at the time of the fall. She explained that she was walking up the exterior concrete stairs to her unit, carrying groceries. The stairways light was out, the carpet was pulled up and the stairs were not uniform. As a result, she tripped on the top step, stumbled forward but did not fall. Holton suffered an ankle fracture that required surgery and hardware. She later had to have a surgery to have the hardware removed. Defendant noted that there was a functioning light on the wall at the top of the landing which was adequate. Defendant further contended that It had no notice of a problem with the carpeting. Holton and two other witnesses testified they never noticed a carpet defect prior to Holton’s fall. Defendant noted that Holton had lived in her unit for two years and regularly used the stairs. Defendant offered a human factors expert’s opinion that Holton’s description of her fall was inconsistent with his analysis of the mechanics of her ankle injury. VERDICT: The jury found no negligence on Defendant’s part. CONCLUSION: These cases represent a “mixed bag” of results for defendants and potential landlords in the same scenario. Each suggests a “beginning” that could have resulted in a different outcome if the defendant had been sensitive to the potential trip and fall and slip and fall. Legal News

Capitol Conference Advocacy Hits Critical Apartment Concerns

O

n March 8 and 9 NAA will host its annual Capitol Conference and bring before Congress some of our most important issues. I say some because there are of course many, many concerns about which we would love to bend a Representative or Senator’s ear. To really be effective, however, we have to hone in on a couple of topics. This year those issues are reform of the Section 8 program, enabling a right-to-cure period for alleged violations of the Americans with Disabilities Act (ADA) and reform and reauthorization of the National Flood Insurance Program (NFIP). Here is how we arrived at this particular list and why you should care. Selecting issues for Lobby Day is complicated. First, you must identify topics that are of actual concern to the industry. Second, it’s preferable for the issues to come with a specific “ask” or request to take action. “You should support apartment housing” is great but “You should support apartment housing by sponsoring this legislation” is better. It gives Members of Congress a specific action and allows us to track whether or not they agreed to our request. Finally, speaking to issues that are moving in Congress makes us timely and more likely to be on the radar. All three of the 2016 Capitol Conference issues hit close to home for a significant portion of NAA members. For example, many members interact with the Section 8 program in some way, either by choice or by local mandate. The program, while critical to affordable housing, can be extremely burdensome for owners and reform is something on which the apartment industry has been working for over a decade. There is bipartisan legislation on the table that mitigates some of these burdens. The House of Representatives has already passed the bill with NAA’s support. We need to thank them and prod the Senate to take action. This benefits owners who participate in Section 8 now and in the future. Compliance with the ADA is a central part of everyone apartment owner’s regulatory life. As our members strive to create and maintain accessible communities they encounter complex even conflicting guidance. As well, there are differing opinions on compliant design and construction standards as well as the role of proven alternative methods of achieving accessibility goals. This results in lots of litigation. A growing trend is litigation initiated purely for financial gain and not to increase accessibility. Our view is that the focus ought to be on curing design or construction defects not generating

settlement fees. To that end, we support bipartisan legislation to allow for up to 120 days to cure an alleged ADA violation before litigation can be initiated. According to the National Severe Storms Laboratory, flooding causes more damage and takes more lives than any other kind of severe weather-related event. Losses average $5 billion per year. Multifamily structures face significant, unique challenges when it comes to mitigating for flood damage. And, while most multifamily mortgages require flood insurance coverage, there is a lack of affordable, private coverage in the marketplace. As a result, the NFIP is critical to managing risk and protecting multifamily investments. The program expires in September of 2017 and is in need of reform to ensure its long-term financial viability, increase its effectiveness for multifamily owners and reduce exposure for the taxpayer. Though expiration of the NFIP is 18 months off, the Congressional calendar between now and then is not our friend. Being an election year, we essentially lose the latter half of 2016 for any real legislating. Likewise, next year a new Congress and Administration will be getting settled which also will cost at least the first few months of the year. There is bipartisan, bicameral legislation on the table right now that we need to support to keep the ball rolling on NFIP reform and reauthorization. All of the issues for the 2016 Capitol Conference have real impacts on apartment communities and there is legislation moving now to address them. Even if you cannot come to Washington, D.C. to participate in the Capitol Conference, you can still help our advocacy efforts by meeting with members of the House in their district (they will be on recess during the Capitol Conference so we in D.C. will have staff all to ourselves!).
