he automobile has fallen out of favor in recent years thanks to increased congestion and longer commute times in fast-growing metropolitan areas across the country. Ride-sharing, ride-sourcing, car-sharing, bikesharing and living in walkable environments are also moving consumers away from car ownership.

Although ride-sourcing services (Uber, Lyft) have grown in popularity, a recent survey from the Shared-Use Mobility Center showed that, among shared mobility users, they are the preferred mode of transport between 8:00pm and 4:00am, a time when many public transit systems offer few, if any, options. However, buses and trains remain the most popular option during rush hours.
As the labor market becomes increasingly tight, public transit’s role in linking workers to job opportunities becomes critical. In the past, employees followed the jobs. Now, more and more companies are basing their location choices on where their prospective employees want to live. A 2014 study by the American Public Transportation Association (APTA) found that large corporations gained a competitive advantage by locating in areas with both shorter commute times and multiple modes of transportation available. Multifamily developers have certainly taken heed of this trend, choosing sites on or near public transit at increasing rates. Yardi Matrix has tagged nearly 66,000 units under construction with 2017 delivery dates as “transit-oriented” which it defines as being within a one-quarter mile radius of a public transit rail station. That’s about 21% of all units on the books for delivery this year – more than double the share just 5 years ago.
It’s important to note that large cities like New York, where public transportation is plentiful, will skew the numbers – and we all know that plenty of new construction has occurred in our largest cities. But this is not just a big city phenomenon. Smaller apartment markets such as Sacramento, Salt Lake City, and Cleveland, among others, are building transit-oriented units that comprise as much as one-third of the stock currently under construction. Overall, transit ridership of all types is at its highest since 1957, according to the Federal Transit Administration,

In 2015, about 61% of public transit users commuting to work were renters. In five years’ time, 387,000 more renters used public transit to get to and from their jobs. There’s no denying that we remain a car-centric society, so removing “drive alone” from Census data reveals public transport as the fastest growing mode of transportation for renters, as illustrated in the pie chart.
Public transit systems across the country face numerous challenges including aging infrastructure, deferred maintenance and lack of funding. Public/private partnerships are emerging as just one solution to this problem. Those municipalities, transit authorities and private sector firms which understand the natural symbiosis of rental properties and public transport will be far ahead of the curve.

Apartment Industry Job Shadow Day

For the third year in a row, the Apartment Association of Greater Orlando (AAGO) and the AAGO Foundation, Inc. will partner with Goodwill of Central Florida, the City of Life Foundation, and Community Based Care of Central Florida to provide a hands-on job shadow experience for central Florida foster youth on Tuesday, July 25th. Local teens will spend the day at various AAGO member sites learning about the diverse and financially rewarding careers in the apartment industry. This annual event seeks to inspire teens transitioning out of the foster care system to explore career paths in the apartment industry that can lead to financial independence and professional success.

• Orange County Affordable Housing: One of Mayor Jacob’s top policy priorities is affordable housing. AAGO is working with county staff to arrange an opportunity for members to sit down with individuals working on the Mayor’s affordable housing policy to discuss the industry’s perspective on this policy issue.

Why is the National Flood Insurance Program important?
• Florida Fire Prevention Code and Valet Trash Services: AAGO has been actively involved in discussions regarding potential changes to Florida’s Fire Prevention Code that could impact the operation of valet trash services in apartment communities. AAGO worked with the Florida Apartment Association, management company members, and supplier partners to offer alternative language that would protect the ability for apartment communities to continue to utilize valet trash services effectively.
NATIONAL: On March 8th, AAGO members and association staff walked the halls of Congress to meet with federal policymakers and discuss the National Apartment Association’s (NAA) 2017 legislative priorities. Below is a brief rundown of the policy issues NAA is tracking this year and how they may impact your business. We would also like to take this opportunity to thank the AAGO members who took time out of their busy schedule’s to travel to Washington, D.C. to participate in this crucial advocacy opportunity. We are grateful to have such wonderful ambassadors for the central Florida apartment industry! This year, NAA members are asking federal lawmakers to: • Support tax reform that fosters economic growth and investment in the rental housing industry. • Reauthorize the National Flood Insurance Program. • Support policies that ensure the enforcement of the Fair Housing Act and the Americans with Disabilities Act (ADA) do not create operational obstacles for the apartment industry. Why is tax reform a priority for the apartment industry? Now that the Republican party is in control of the House, Senate, and the Oval Office, reforming the nation’s tax code has become a top policy priority. The federal tax code impacts
The National Flood Insurance Program was last reauthorized back in 2012 and will expire in 2017, unless it is reauthorized by Congress. As you may know, flood insurance is required for multifamily properties located in high-risk areas if the mortgages for the asset are federally backed. Unfortunately, the National Flood Insurance Program is the only coverage options for many apartment communities located in these high-risk areas. Therefore, if this program is permitted to expire in 2017, many multifamily properties will lack access to the flood insurance coverage that is required under the law. How does the enforcement of the Fair Housing Act and the Americans with Disabilities Act impact the multifamily industry? As you may know, apartment communities have specific responsibilities under the Fair Housing Act and the Americans with Disabilities Act (ADA). For example, rental housing providers are required to make “reasonable accommodations” to ensure the features of the apartment home are accessible for individuals with disabilities. This could include installing railings in a resident’s shower or widening a doorframe to ensure a wheelchair can get through the building entry. However, building code regulations often vary quite significantly between local governments and the complex nature federal regulations has resulted in a lack of understanding regarding the accommodation requirements under the law. As a result of the complexities found in the law, many apartment communities are becoming victims of drive-by lawsuits where law firms or spotters seek to target properties for costly litigation proceedings. NAA seeks to ensure multifamily properties have the ability to cure a potential ADA violation prior to allowing the complaint to proceed to the expensive and burdensome litigation process. If enacted, H.R. 620 would give property owners 120 days to remedy an alleged ADA violation prior to the commencement of litigation. This legislation was introduced by Rep. Ted Poe (Texas) and referred the House Judiciary Committee for consideration.

So Many New Apartment Units! Lately, it seems there has been some concern regarding new multifamily development across the AAGO Region. When one looks at the number of units currently under construction and how many are in the pipeline, it can make one a little bit concerned that the market may soon be reaching oversupply. In this month’s article we will take a look at some of the numbers involved with the current state of development affairs. In particular, we will look at multifamily permitting, the number of units both under construction and planned, population changes, and the employment numbers.
Multifamily Permitting in the AAGO Area Apartment development pipeline continues its strong trend in our region as evidenced by the permitting table below. This is despite 2016 being the first year in the last seven where we saw a slight decrease in permitting (-1.5%). Regardless, it was still the 4th year in a row the region’s multifamily permitting exceeded 6,000 units.This sustained trend in permitting suggests that developers and lenders are still optimistic about the future economic conditions in Central Florida.
However, we have been seeing multifamily permits rising and expect that apartment development will continue at higher levels as well.
Population in AAGO Area A contributing factor to the strong trend in multifamily permitting is the growing local population. From July 2010 to July 2016, the AAGO region saw a population increase of 336,476. This marks a 12.8% increase. As the population table shows, the recorded population of the AAGO region was over 2.9 million in July of 2016. This number is up from the 2.6 million recorded in 2010. Osceola saw the largest percentage increase as it increased by 24.5% over the six year period. Meanwhile, Orange County gained over 165,000 new inhabitants. These strong population increases are certainly a driver for the continuing multifamily development across the AAGO Region. Another reason we continue to see strong development can be found in the job sector.
Employment Numbers in the AAGO Area
The AAGO Region continues to add units - albeit not at the pace experienced in the early 2000’s - but at a healthy rate nonetheless. MF permitting does account for both apartments and condominium permits so not every multifamily permit equates to a rental unit. That said, a good number of them are at this point.
Apartment New Construction Summary of the AAGO Region We show upwards of 10,000 units currently under construction and/ or in initial lease-up in the AAGO Online Market Survey (“OMS”). Furthermore, we are tracking nearly another 10,000 units that are planned and/or proposed that will try to get financed and developed over the next couple of years. The developers that are building or planning to build in the AAGO area cover the gamut from local builder to national REITs. Some of these planned properties have been proposed for many years and we know that all of these planned properties do not get developed.
Naturally, when there is an increase in population, there’s also an increase in the labor force. When there’s an increase in the labor force, it’s important to see an increase in the number of the employed so unemployment stays low. Since the employment lows of 2009, we’ve seen a steady increase in both the labor force and employment in the AAGO Region. More importantly, we’ve seen a decrease in the difference between the two. This difference, or the unemployment number, has fallen from a high 11.2% in 2009 to a low 4.5% in 2016. When factored together; the MF Permitting, the New Construction, the Population Increase, and the strong employment numbers, it can be seen why developers and lenders continue to produce more apartment units for the AAGO market.

PERSONAL PROTECTION EQUIPMENT (PPE)
There are many types of Personal Protective Equipment (PPE) that, when used properly, contribute to safer and more efficient work practices. The operation and maintenance of an apartment community requires use of the more common forms of PPE items like gloves, goggles, earplugs, face shields, etc. Although PPE is to help protect you from an injury or accident, you must keep in mind that using the wrong PPE, or excessive PPE can actually cause an injury or accident. Also, PPE must always be used in conjunction with good judgment and not solely relied on for protection. Just because you are wearing a back-belt doesn’t mean you can lift anything without getting hurt. 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. 11. 12. 13.
Each property’s Maintenance Supervisor must assess the hazards of their property, and acquire the appropriate PPE for each employee that meets ANSI standards. OSHA requires employers to provide PPE and train employees on their use. All employees must know how to obtain, properly use, and maintain PPE to accomplish their tasks safely. Make choosing the necessary PPE part of the same process of choosing tools and materials needed to perform a job. If the necessary PPE is not available, notify your supervisor. Inspect PPE prior to use and report any damage to your supervisor immediately. Using gloves with holes or goggles that are all scratched up impair your work performance and can create a hazard in itself. Choose the appropriate gloves for each of the many types of potential hand injuries. The wrong kind of gloves can cause an accident. Keep gloves and goggles with you at all times. You are likely to need them throughout the day. Wear shoes or boots that will protect your feet from impact, scrapes, punctures, heat, cold, and any prevailing hazard on the property. Like all PPE, overly worn or torn shoes are lacking their protective properties, and worn soles can affect balance and traction. Back belts are good additional support when used in conjunction with proper lifting technique. Earplugs are to be used around noisy machinery. Flying objects are usually unexpected, so keep your goggles on when working with key machines, hammering, cutting wood, using a leaf blower, pressure cleaning, trimming shrubbery, sanding, and using hand tools. Clean your PPE after each day of use, and store in a dry location.

NAA Releases ‘Value Add of Amenities’ Report
From helipads to breweries to concierge services that can just about read a resident's mind, amenities have been a hot topic in the apartment industry for years, and the bar just keeps getting higher. For apartment owners and operators who neither have the capital nor even the demand for these over-the-top features, there are plenty of ways to increase the appeal of apartment communities through amenities, many of which are simple to implement and require little up-front investment. The NAA “Value Add of Amenities” report seeks to identify top amenities in apartment communities: nationwide and in 11 selected metro areas, at both the community and unit level, and which ones have the greatest impact to revenue. An analysis of major renovations and their impacts on rents and occupancies also is included. The NAA Research study covered 43 unique amenities, added or upgraded from January 2014 to September 2016. The universe of survey responses totaled over 100,000 units in 35 states. Dear Harry, We are experiencing severe problems with one of our residents, including excessive noise, an unauthorized dog and an unauthorized occupant. We did what we thought was right and prepared a Seven-Day Notice of Noncompliance with Opportunity to Cure. As we expected, the problems were not cured. We sent the Seven-Day Notice and lease to our attorney, and he is saying the notice is “no good”. It appears that we worded the notice incorrectly by copying and pasting the exact wording from our lease that pertains to occupancy, pets and noise. Now he says we have to start from scratch. This problem has been going on for a long time, and we are going to lose good residents. How do we do this correctly? What did we do wrong? Signed: “Serving notice in Sanford”
Dear Harry, Many of our residents are getting up there in age. Sometimes they die either in the apartment, or they go to a nursing home or hospital and die shortly thereafter. The moment a resident dies, we are bombarded with phone calls by relatives who want to get into the apartment. Some even have a power of attorney and try to say that we must let them have access because of this. We were told at a legal class that we cannot give anyone access, but were wondering if there is some way that the resident can sign a lease addendum at move-in or at some point thereafter that will allow a friend or relative access to the apartment to clean it out or get needed items if the resident dies. The moment a resident is in noncompliance, that person needs to be served a Seven-Day Notice of Noncompliance with Opportunity to Cure. No letters, no discussion and no delays. Too many property managers sit back and feel that a conversation with the resident or letter to the resident will cure a problem, and sometimes it does, BUT if it does not, you MUST serve a proper Seven-Day Notice of Noncompliance with Opportunity to Cure. Now, you are going to be delayed. The key is to serve a PROPER notice and learn from your mistake. A proper Seven-Day Notice should never parrot the lease. The Seven-Day Notice is not a means to tell a resident what the lease provides, it is to tell the resident what he or she needs to stop doing or start doing so to be in compliance with the lease. Quoting the no pet clause or the occupant clause simply tells the resident what the lease says. It is often useless, totally useless, as the resident’s particular noncompliance is buried within the lease clauses. You must describe the noncompliance in enough detail on the Seven-Day Notice so the resident will know the actual noncompliances. Please make sure you use your attorney to assist you with the wording on each and every Seven-Day Notice. Many attorneys like us prepare them for free for their clients. Not only will you need to start from scratch, BUT some noncompliances that are not dealt with immediately can become almost impossible to rectify if you have accepted rent knowing that the resident is in noncompliance. Simply accepting rent while you know a resident has an unauthorized occupant or an unauthorized pet can result in your complete inability to do anything about it. If there is a noncompliance, promptly serve the PROPERLY worded Seven-Day Notice, and if the noncompliance continues, do not accept rent.
Dear Dealing, That “simple fix” seems like a great idea and it certainly would be easy to do, but it is not legal at all. When a person dies, no one has authority to do anything on behalf of the deceased individual until a court decides that a person can act. Any person designated before death will have no power to do anything once the person dies. A power of attorney is only valid when a person is alive or incapacitated. A power of attorney ceases to have any power whatsoever the moment a person dies. This is when probate law takes over. Until such time as an estate is opened up in probate court, and a personal representative (also called an executor in many states) is appointed, everything stops. It does not even matter what a will may say. The probate court must approve and validate the will and appoint the personal representative. Now comes the frustrating reality. Many residents who die in apartments do not have significant assets justifying the formation of an estate, so the relatives do not bother hiring an attorney to open up a probate estate and spending a lot of money when there may be not much there. Often a person financially plans prior to death and holds bank accounts in that person’s name and a child’s name jointly, so opening up an estate is not even necessary. When no estate is formed, this can leave you with a mess. Simply put, no one can be given access until the sooner of one of two events take place. The relatives must open up a probate estate and a personal representative gets appointed, who then can do anything the resident could do, and you can deal with the personal representative directly, OR you must wait 60 days from the date of death. If a probate estate is not opened in that time, the unit becomes yours. Under the law, all the contents will become abandoned property subject to disposition as you see fit if you have the proper abandoned property wording in your lease agreement. LegaLine

Dear Harry, Our property is now virtually 100% smoke-free. For the most part, it has been working well until recently, and we proudly advertise our property as smoke-free. We have a nice designated covered smoking area a good distance from the buildings, and smoking is totally prohibited in the apartments, common areas and within 200 feet of the apartments. It has turned into a mess somewhat recently. We are receiving resident complaints that other residents are smoking in the hallways, their cars and sometimes on the balcony. One resident is actually threatening to break her lease, as she said that because of allergies, she picked our apartment community specifically because we prohibited smoking, and she sees people violating the rules. We cannot be everywhere at once, and people do what they want to, but how are we going to enforce our rules? Should we let the complaining resident out of the lease? She is threatening a lawyer on us. Signed, “Approaching Smoke-free in Apopka” Dear Approaching, When a property decides to go smoke-free, they are usually in for a surprise. You are now undertaking a legal obligation to make sure that the residents abide by the terms of the lease agreement and
the smoke-free policies. Enforcing your smoke-free rules need to be done like enforcing any other lease clause. If you receive a complaint or witness a noncompliance, you must take immediate action just like you would if you saw that someone had an unauthorized pet or occupant. There can be no delay whatsoever, and any delay could result in you being accused of not providing a smoke-free environment, thus you breaching the contract. The moment you get a credible complaint about another resident, you should serve your Seven-Day Notice to Cure. You must then follow up vigorously, and like any other noncompliance, prepare to gather proof. The words, emails or other written complaints of another resident will never be enough to win a case in court. That resident must come into court. You need solid 100% proof that the resident is actually smoking in violation of your rules and the lease. This may mean you need actual video surveillance evidence, photos, residents who will come into court and testify they saw another resident smoking and also possibly staff who witnessed the smoking. You can have a stack of written resident complaints and recordings of phone calls, but these will be totally inadmissible and useless in court when the resident denies smoking. If a resident is complaining about another resident smoking, and you are not able to rectify the situation or gather the needed proof, but you feel very comfortable that the resident is in fact smoking, we recommend you give the complaining resident the ability to break the lease without penalty.
