irst, let me say a huge thank you for everyone who attended the Paws for Peace event with Harbor House at Blue Jacket Park. This was a great fundraiser to raise awareness and support for survivors of domestic abuse and their children. We had a great day of meeting new friends and showing as an industry that we care. Also thank you for the donations that you and your companies dropped off at the AAGO trade show to support our community partners fight homelessness by caring for those in need.
At the core of the AAGO Foundation is a desire to make our communities better by supporting the local charities that do so much. It’s been a busy season for AAGO advocacy and the continued success of the industry is always on the line at the local, state and federal level. Below is a summary of the ways AAGO advocacy is working for you and the multifamily industry here in central Florida and beyond. LOCAL As you may remember, the City of Orlando has been crafting an energy-benchmarking ordinance that would directly impact the multifamily industry. At the end of February, the City of Orlando held a stakeholder roundtable where they unveiled the draft ordinance. AAGO participated in this meeting and had the opportunity to provide feedback regarding how this new policy would impact the multifamily housing industry. Below is a quick summary of the draft ordinance that is expected to come before the Orlando City Council in the coming months. It is important to remember the ordinance is in draft form at this time and therefore, changes can still occur. For the latest information on this ordinance, please contact Chip Tatum at AAGO at Chip@AAGO.org or by phone at 407644-0539. • If signed into law, any commercial property in the City of Orlando in excess of 40,000 square feet (aggregate) will be required to benchmark (report) their water and energy consumption to the city on an annual basis using Energy Star Portfolio Manager. • All energy and water consumption reporting must be performed by a “Qualified Benchmarker.” In order to be qualified, a certification is required. • It is important to note that in other cities across the U.S. that have similar reporting requirements, the benchmarking (reporting) function is often outsourced to a third party company that performs the service for a fee paid by the property owner.

• After reporting, properties that fall below a an Energy Star score of 75% will be required to perform a “Level 2” audit once every 10 years. The schedule for this audit will be determined by the city, not the owner. • Consumption data will be publicized on the City’s website on an annual basis and accessible for consumers, which will include prospective tenants and property buyers. While the industry wholeheartedly supports the practice of energy benchmarking, AAGO is concerned that this ordinance will negatively impact the apartment industry by adding additional reporting requirements that will be difficult for building owners to meet without hiring a third party. Rest assured, AAGO is actively participating in stakeholder discussions with the City of Orlando and will continue to voice the concerns of the apartment industry regarding this potential policy change. Please stay tuned for more updates via email once the final draft ordinance is put before the members of the City Council. In the meantime, AAGO encourages members to visit www. AAGO.org and explore the Central Florida section under the Advocacy Tab. On the Central Florida page members can scroll down to the Orlando City Energy Project (CEP) section for a copy of the AAGO informative White Paper on this issue. This White Paper will provide an overview of this issue and its potential impact on the apartment industry. STATE This February, AAGO joined industry representatives from across the state to travel to Tallahassee with the Florida Apartment Association (FAA) to meet with state lawmakers to discuss the policy issues impacting the industry. One of FAA’s legislative priorities this session was expanding the allowable work for Certified Apartment Maintenance Technicians (CAMTs). FAA drafted a bill that was eventually incorporated into the building code bill (HB 535) that would allow CAMTs with at least one year of maintenance experience to repair existing HVAC, water heater, and AC units if the repair would cost less than $1,000 and the community had
more than 100 units. This bill passed the House and Senate unanimously on March 3rd and was signed into law by Governor Rick Scott on March 25th. In addition, FAA is a proud member of the Sadowski Coalition, a group that focuses on securing funding for Florida’s affordable housing programs. While in Tallahassee, the industry advocated for state lawmakers to fully fund the Sadowski Affordable Housing Trust Fund to ensure adequate resources are allocated for Florida’s most vulnerable populations. As a result of FAA’s advocacy efforts, the industry helped secure $200 million in funding for affordable housing. As you may know, Florida’s affordable housing funds are derived from ‘’doc stamp’’ tax revenue. These are taxes that are collected from every real estate transaction and are then distributed by the state in the form of loans. The loans are used to repair existing affordable housing units or build new housing for veterans, senior citizens, people with disabilities, and those experiencing homelessness.

On March 9th, AAGO members walked the halls of Congress to meet with federal lawmakers to discuss various barriers that prevent the apartment industry from meeting the growing demand for rental housing. NAA’s legislative priorities this year include: • Supporting legislation that provides a business owner with the opportunity to cure an alleged ADA violation prior to the start of a lawsuit. • Supporting legislation that reforms the NFIP and provides for long-term reauthorization of the program before it expires in September 2017. • Supporting legislation that reforms the Section 8 Housing Choice Voucher Program to streamline the program and make it more effective for tenants and property owners.

t’s no secret that a vast majority of multifamily fires are preventable. However, prevention is often a matter of education on fire safety best practices. In order to effectively communicate best practices with your residents, you’ll need to know the top three causes of preventable fires in apartments. AAGO partnered with the Florida Fire Marshals and Inspectors Association (FFMIA) to investigate this question. According to fire incident data, the top three causes of fires in apartment homes are: cooking equipment, candles and smoking. Cooking is by far the leading cause of preventable fires in apartments: • 67 percent of fires in multifamily buildings between 2007 – 2011 were caused by cooking equipment. Cooking fires often occur as a result of residents leaving food unattended on the stove or add water to a grease fire, which only increases the flames. That staggering statistic begs an important question, what could be done to educate residents on fire safety best practices in the kitchen? AAGO sought to provide members with a valuable resource that could serve as a tool for apartment communities to educate residents on fire safety. In order to achieve this goal, we’ve created two tools that will be available to member communities upon request:
In addition to these resources, AAGO is also working on a www.preventapartmentfires.org website, which will have additional fire safety resources and information to educate apartment residents. AAGO hopes this fire prevention campaign will increase resident awareness about fire safety, which will potentially lead to fewer preventable fires in apartment homes across central Florida.

For all the good they do – documenting contact information, ensuring consistency for fair housing, keeping track of follow up attempts – they don’t provide much in the way of helping to establish an emotional connection with a prospect. In an earlier post, I mentioned there is a two-part strategy to securing more leases. Part 1 – the prospect has to like you. Part 2 – the prospect has to like what they see. No one is going to give money to someONE they don’t like…for someTHING they don’t like.
What do you like least about apartment living?
The questions asked should be well thought out and delivered with genuine interest. Here are 5 questions beyond the standard guestcard to help ease the way to leasing success:
Another good one – I’d bet my money most answers will have something to do with neighbors, safety, or rent increases. Whatever the response, your prospect has just told you their #1 objection and you must be prepared for whatever is thrown your way. A confident, ready answer that addresses the objection head on and showcases the best of what you have to offer is the way to go. And whatever you do, please do not respond to safety concerns by saying “crime has no address”. If you do, you might as well drive your prospect Uber-style to your nearest competitor.

4. What makes YOU a good resident?
This question gets right to the point and provides a bit of insight regarding the prospect’s experience with the touring process. If the prospect has visited other communities, then you know s/he understands the drill. That means you’ll have to switch it up – think about showing the apartment home FIRST, then the other features of the community. If an experienced prospect is given a generic, cookie cutter tour, they might lose interest. Been there, done that…this place is nothing special. Notice the question is different than asking “what other communities have you visited?”; a loaded question which could conjure up a positive memory of a competitor.
2. What do you like most about apartment living?
Good one – let’s say the prospect goes on and on about worry-free maintenance. If that’s the case, be sure to emphasize how your community provides just that and more. Instead of the usual “we have 24-hour emergency maintenance” or “same day service requests”, provide hardcore facts. “Our goal is to complete service requests same-day whenever possible…in fact 82% of all service requests last week were completed within 4 hours – yeah, we like to outdo ourselves 24

Getting the prospect to talk about themselves will leave a lasting impression. So after they tell you all about how quiet they are, how clean they keep their home, or even how they try not to bug management with every little issue, respond by saying, “You sound like you’d make an awesome addition to our community. There’s no way we’re going to let you leave today without filling out an application!”

What do WE need to do to prove we are the right community for you?
Go ahead, put it out there. Ask the question and act on the answer. Prospects will not be expecting this one; you may even have to repeat it. But this is an important question to ask. It speaks to your confidence in your team’s abilities and that your focus is squarely on resident satisfaction. Your wish is our command, Mr. Prospect…bring it! Remember, the prospect is not interviewing for the position of resident, you are interviewing for the position of apartment community. Asking the right questions and being prepared for the answers shows a prospect you are the most qualified candidate for the job.

AMSTR Trends The 1st Quarter 2016 Central Florida Apartment Market Survey & Trend Report (“AMSTR”) has once again hit the streets! 2016 marks the sixth consecutive year of bi-annual publication for this information packed report utilizing the award winning, US Patented, MyRentComps Market Survey System.
pop equates to a 5.4% increase in just 6 months. In comparison: Orange County rents rose $18; Osceola’s climbed $22; Seminole’s creped up $15; and Volusia’s increased by $20. The AMSTR covers the entire AAGO Market and goes in to great detail with regional, county, and submarket level reporting. The report contains an aging analysis of the apartment rental inventory, analysis of rents and occupancies for “all units” as well as all of the individual unit types within each of the reportable areas (region, county, and submarket), and much, much more.. As we have in years past, we’ll share with you in this article some of the latest numbers for “all units” at the county level. AAGO Area County Rent Trends For the fourth report cycle in a row (reports are published after 1st and 3rd quarters each year), all counties experienced rent growth. For Seminole County it was the sixth consecutive report cycle of rent growth. During that 3 year run, average rents for all units in Seminole rose from $838 to $943 for a 12.3% increase . Orange County continues to set the pace for highest rents as the average rent for “All Units” climbed to $1055. Meanwhile, Lake County experienced the highest dollar increase in average rent from last report. Lake’s rents bolted from $888 to $936. That $48

The answer to the earlier question regarding how much longer the rent increase streak will continue could possibly be answered by the AAGO Area Occupancy Trends depicted below. The average occupancy for all units slipped slightly in 4 of the 5 counties in central Florida since our last report. The highest Occupancy loss was experienced in Seminole County where occupancy slipped 1.5% in the past 6 months. That said, 95.95% occupancy is still historically high. To compare this loss to the rest of the counties over the past six months: Lake County, despite its strong rent growth, held virtually steady at 96.98% occupancy; Orange County’s occupancy dipped by 0.22%; Osceola County’s decrease was minuscule: (0.03%); Volusia County, the outlier of the group, saw an occupancy increase of 0.62%. Some of the decrease in occupancy experienced in our region is almost certainly due to, in part, new apartment construction as the AAGO Online Market Survey includes new properties in lease up. It’s also possible that our market might be starting to cool off a little and so it will be interesting to see if occupancies continue to slip and what that will mean for the average rents in our region. We will revisit these numbers again come October.

FALLING OBJECTS AND POTHOLESA LANDLORD’S WORST NIGHTMARE? In this article, we’ll consider a few cases involving fallen objects and potholes and reason a conclusion on whether they make the “top five” list of bad things a landlord doesn’t want to encounter. ALVAREZ VS. HATT ENTERPRISES, et al., Pinellas County Circuit Court Case (July 2015): FACTS: the Plaintiff was a tenant in her early 30s who was injured when a large section of the ceiling in her bathroom fell while she was taking a shower. She had complained to the landlord about leaks and the landlord had repaired the existing drywall before the tenant was injured. At trial, the Plaintiff offered the testimony of an engineering expert who opined that the drywall should have been replaced rather than repaired. The tenant also testified that the piece of the ceiling that fell hit her head, neck and shoulders. As a result of her injuries, the tenant claimed that she suffered a cervical herniation. The landlord asserted that it was highly likely that only small pieces of the ceiling fell and that the tenant’s contention that a large sheet fell was suspect. The landlord also offered evidence that the repairs had been done properly. The landlord also pointed out that the tenant had prior neck complaints as evidenced by the fact that she had undergone a cervical MRI prior to the accident. VERDICT: Apparently, the tenant was less than convincing; the jury entered a verdict in favor the landlord. SANDOVAL VS. SHERMAN DEVELOPMENT COMPANY LLC D/B/ A TROPICANA FLEE MARKET, Miami-Dade County Circuit Court (December 2015): FACTS: Plaintiff, a 60 year old female, tripped and fell in the parking lot and claimed it was a result of the defendant’s failure to repair potholes. Defendant denied that it was
negligent and asserted that the plaintiff failed to watch where she was walking. During the trial, Plaintiff offered evidence that there were a series of large eroded areas, or potholes, in the asphalt surface parking area. Plaintiff stated that her foot went into one of the holes and this caused her to fall. As a result of the fall, Plaintiff was required to undergo a total knee replacement. Defendant asserted that holes in the asphalt were open and obvious and that the Plaintiff didn’t use reasonable care in walking. Defendant further argued that the Plaintiff had knee issues from arthritis which predated the accident. VERDICT: The jury found Plaintiff 20% at fault and Defendant 80% at fault and awarded a gross verdict of $136,632. This included $111,032 in past medical expenses; $15,600 In past loss of earnings and $10,000 in past pain and suffering. The jury did not award any future damages. The total figure was reduced by 20% due to Plaintiff’s fault. Interestingly, the parties had agreed to a “high/low” agreement before the trial which would give the Plaintiff a recovery of at least “X” on the low end regardless of how low the jury verdict was and a recovery of “Y” on the high end regardless of how high the jury verdict reached. The “X” and “Y” figures were not disclosed. CONCLUSION: These cases illustrate the three requirements to be being a successful landlord who avoids the courtroom with tenants: (1) hire good maintenance personnel; (2) have “big ears” and listen to tenants’ complaints and requests for repairs; and (3) inspect, detect and reject/fix any issues with your apartment building, common areas and grounds. Assuming you follow the three requirements, the odds are fairly good that you’ll not see the word “defendant” after your name in any court documents.

Dear Aware, The standard Drug and Crime Free Addendum only applies to criminal acts that occur on or near the property. Many years ago, the addendum was created to deal with drug activity on subsidized properties. Residents would be able to deal drugs on the street corners or outside the apartment property line and get away with it. The Drug and Crime Free Addendum is now recommended to be used for all properties, but it will not allow you to evict someone for a criminal act they committed a significant distance from the property. On top of that, the resident is innocent until proven guilty, so this would be an additional impediment to evicting the resident. There is a good chance a lease clause that attempts to create termination rights for an arrest well off the property will not hold up in court.
Dear Seeking, You made a couple serious mistakes. A sample lease should always be provided to an applicant and all charges detailed and set out in writing before you even take any money from a prospect and begin the screening process. You cannot hold someone to a contract that person has not seen. Your lease is a contract. Additionally, the administrative fee should have been disclosed to him before he signed anything or even gave you the screening fee. Most applicants and residents do not even read the lease or blink an eye at an administrative fee, but this does not make your procedure correct. I would refund all money paid, first making sure any money he paid you has cleared the bank, and move on to the next prospect. It is crucial to do this correctly and not rely on how you have been doing something for years. Speak to your regional manager about this, so the whole company can benefit from the advice you are reading now. Always disclose all fees and charges at first contact with a prospect, be it by phone or in your office. A fee, rent, and charge information sheet should be created for each and every transaction you may be involved in.
Dear Harry, We went through the full application and approval process with one of our applicants. We required and he paid a holding deposit of $200, which would have been applied to his security deposit once everything was signed. Once he saw the lease and we told him there was an administrative fee of $150, he blew a fuse and said he will not rent from us. We think he simply found a cheaper place and is changing his mind. Dear Cleaning, Every month our office deals with water damage and the legal issues which arise from that damage. Water damage is the most common and costly problem in multi-family housing. Nothing causes more economic loss than water leaks, hose, supply line, water heater and pipe failures. You MUST take action immediately. All your supply lines should be replaced with steel braided ones. Yes, they cost more, but it is money well spent. There are rubber and plastic supply lines in use all over, from the dishwasher, the toilet, the sinks, the ice maker to the washing machine which you are dealing with right now. These lines fail all day long. Residents most likely will use a washing machine with their own hoses, hoses that could be many years old. Most water damage can be avoided by taking the time to inspect and replace all supply lines and require all residents who bring their own washing machine to use the steel braided hoses, and make sure they do. Every day, an apartment community is a day older. Many of the supply lines are 10 to 30 years old. They can and will eventually fail. Most likely your apartment community was built with the cheapest supply lines available at the time. You MUST take action and spend some money to prevent this from happening. Some things in life just cannot be avoided. You may never be able to prevent a resident from having a kitchen fire, for example, but flooding and water damage is almost always caused by the failure of the apartment community to spend the extra time and money to replace supply lines with braided stainless steel lines.

Criminal Background Checks Under Scrutiny Apartment Industry Advocates, Nearly 50 years ago, President Lyndon Johnson signed into law the Civil Rights Act of 1968. Title VIII of the Act contains what we commonly refer to as the Fair Housing Act. This law, along with amendments passed in 1988 and 1990, protects individuals from housing discrimination based on race, color, religion, sex, national origin, disability or familial status. As a result of this legislation, industry training and education, the federal government’s support and housing professionals’ hard work, systematic and intentional discrimination in housing has been all but eliminated. Federal fair housing enforcement today is focused on the much more nuanced area of law involving unintentional discrimination or disparate impact liability. The 2015 Supreme Court decision in Texas Department of Housing and Community Affairs v. The Inclusive Communities Project, Inc. confirmed this concept as a legitimate extension of fair housing and paved the way for expanded investigative activity. One of the highest priority areas for these investigations is resident screening, especially criminal background checks. Events this April illustrate exactly how fine a point has been placed on this aspect of the rental housing application process. The Lawyers Committee for Civil Rights Under Law, according to an April 4 news release, has “…opened a nationwide inquiry into owners who impose blanket bans upon applicants who have had contact with the criminal justice system.” Thirteen housing providers across 12 states have been targeted in particular by the Committee in this “phase 1” action for allegedly using screening policies that bar anyone with a criminal history from obtaining housing. The Lawyers Committee is a nonprofit entity and not a government regulatory or enforcement agency. The second and more significant event in April related to fair housing and resident screening is new guidance issued by HUD’s Office of General Counsel entitled, Application of Fair Housing Act Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions. This guidance, which has the effect of law, places specific parameters around how housing providers can utilize criminal histories in their resident screening processes. NAA, along with our partners at the National Multifamily Housing Council, will issue explanatory material in the coming weeks to help owners and operators navigate the guidance.

In general, the HUD guidance seeks to end blanket exclusions of prospective residents based on criminal history in favor of a more individualized approach. Specifically, it prohibits the use of arrest records to deny residency and denials based on convictions must consider the nature and severity of the incident. Evaluation of resident screening policies will follow the “burden-shifting” test HUD created in its 2013 Final Rule on the “Implementation of the Fair Housing Act’s Discriminatory Effects Standard.” It’s important to note that while the guidance may be new, the position of HUD is not. They have long espoused the positions now codified by this guidance. Not surprisingly, the HUD guidance raises a number of questions and concerns about how apartment owners and operators will be able to maintain the critical balance between meeting the goals of fair housing and adequately protecting their residents, employees and property from criminal activity. This is complicated by state and local laws which in some cases create strong disincentives for owners to rent to those with criminal histories. Moreover, the guidance is not specific about which policies will pass muster and it gives no examples of how owners should construct their policies appropriately. Still, successfully navigating this guidance could be as much about process and documentation as it is about specific standards. More to come on that. Changes to long-held understanding of how an apartment owner and operator should design their policies to comply with fair housing rules is not isolated to resident screening. Preconceived ideas are being challenged in the areas of familial status, occupancy standards, source of income and many others. NAA, our affiliated associations and our members are all grappling with these changes and trying to draw a clear picture of this new world. I suspect it will be some time before that clarity emerges.
