irst and foremost, I hope you will join me in thanking our current President, Kimberly Hackett-Maggard (Royal American), for her dedicated service to AAGO. She’s served the association in countless ways throughout the years and created a culture of association involvement in her company that inspires others to do the same. Under Kim’s leadership, the association has grown in size, thrived in political advocacy, and enhanced member services. As the 2017 Incoming President, I would like to thank you for giving me the opportunity to serve the association in this unique capacity. I look forward to helping AAGO continue to break strides and set new records in the year ahead.

I’d also like to share an overview of what AAGO has in store for next year. As always, the association has a full education schedule packed with valuable learning opportunities for every member of your team. Foundation Corner Time to Celebrate Those Who Dedicate Their Own Time and Energy with the Goal of Helping Others

t’s that time of year again to thank everyone who lends a hand and gets involved to make this world a better place. We love to celebrate those in the industry who volunteer their time and try to make a difference in the lives of those who need it. Time is one our most precious resources. People who offer their time to help others are amazing and worthy of being recognized for their efforts. The scheduled speaker at the Luncheon will be our own AAGO Foundation President, Sean Bailey who will have the privilege to share the strides made by the AAGO Foundation and their Friends of the Foundation Committee over the past several months. AAGO Advocacy at Work By: Amanda

As you may know from the monsoon of political advertisements in your mailbox and the candidate yard signs scattered throughout your community, Election Day is Tuesday, November 8th! For more information regarding the Election and the candidates/issues on your ballot, please contact your county’s Supervisor of Elections office or visit the Florida Division of Elections website at: http://dos.myflorida.com/elections.

LOCAL Local governments have been very active in the last few months of 2016. Many local bodies are wrapping up strategic goals for the year and exploring potential policy initiatives for 2017. Below is a brief summary of AAGO’s ongoing advocacy efforts in central Florida. If you have any questions or would like to bring a particular policy issue to AAGO’s attention, please contact Chip Tatum at Chip@AAGO.org. Orlando’s energy benchmarking ordinance, also known as Building Energy & Water Efficiency Strategy (BEWES), had it’s first reading in front of the Orlando City Council on September 15th. This ordinance will mandate annual energy and water benchmarking using Energy Star Portfolio Manager® for buildings that are 50,000 sq. ft. or greater in size. The proposed policy must receive a second reading before it can be approved and signed into law. As you may know, AAGO worked closely with city staff to share the apartment industry’s concerns with the proposal in the early policymaking stages. As a result, AAGO was given a seat at the table during stakeholder roundtables that the city used to refine and edit the ordinance language before presenting the final product to City Council this fall. In our previous issue of the Key (Sep/Oct, Advocacy at Work on page 14, which is available online at www.AAGO.org), we shared how AAGO’s advocacy efforts have made a positive impact during the redraft of this ordinance. A copy of the BEWES ordinance and more information about the policy is available online at www.AAGO.org, under the Advocacy tab (Local). Since this new policy is a high priority for Mayer Buddy Dyer’s Green Works initiative, we expect it will 14

pass when put before the City Council for a vote. AAGO will continue to monitor this ordinance and keep you updated as it progresses through the approval process. In addition, the City of Orlando recently established a park impact fee to develop and fund public parks. The proposal was approved (Ordinance No. 2016-65) on Second Reading on September 15th. As a result, home builders will be assessed $966 per new single-family home and developers will be required to pay $825 per multifamily unit for a park impact fee on new developments. The Ordinance was drafted based on a study the City of Orlando conducted to review the city’s rapid growth and the need for more public parks. It has also come to AAGO’s attention that Orange County is conducting a study to explore solutions for enhancing affordability in the single and multifamily housing markets. One of the solutions they are considering at this time is Inclusionary Zoning (IZ). Examples of IZ policies in other parts of the nation mandate all new developments set aside 10 percent of the total number of units for affordable housing purposes. These mandates often place caps on rent prices and limit rent growth to the rate of inflation. Unfortunately, IZ policies have failed to deliver tangible results and often hinder housing development. It is important to note that although IZ is being considered by the Orange County government at this time, other local governments in central Florida could follow suit if a policy is approved in Orange County. Please know AAGO will continue to monitor this issue and will keep members informed of developments as they arise.

STATE As you may know, Florida’s legislative session is one of the shortest in the nation, with only 60 days from start to finish. The 2017 legislative session will begin on March 7th and conclude on May 5th. The November Election could shake up the composition of the Legislature, which will have an impact on the initiatives that will see action on the House and Senate floor next session. The Florida Apartment Association’s Legislative Days will be held on February 7th and 8th in Tallahassee. As in years past, AAGO members plan to travel to the state Capitol to meet with lawmakers and discuss the pressing policy issues impacting the multifamily

The National Apartment Association (NAA) is also gearing up for its annual advocacy event in Washington, D.C. on March 7th and 8th. Registration for this event will open in early November online at www.NAAHQ.org. Similar to FAA Legislative Days, AAGO is proud to send a group of members to the halls of Congress to meet with federal policymakers. During these meetings, members discuss federal legislative issues and concerns from the apartment industry’s perspective. As we have done in the past, we wanted to share some information about the student housing market in the UCF area. To get some local knowledge about this topic, we talked with Mr. Paul M. Guyet, a Student Housing Specialist from Smith Equities Real Estate Investment Advisors, Orlando Florida. Mr. Guyet has been active in the student markets since the late 1990’s and produces annual reports on various student housing markets throughout Florida including the University of Central Florida (UCF). Based on Mr. Guyet’s latest report, we have created the tables below that summarize the student housing market in the UCF area.

• Currently there are 7,094 bedrooms On-Campus and 100% occupancy. • Approximately only 75 bedrooms remain vacant in Off Campus student housing.

• UCF enrollment for the 2016-17 school year sits at approximately 62,000 students. • This school year’s enrollment is down slightly from last year’s record setting year of over 63,000 students. UCF 2016-2017 School Year Lease-Up Report According to Mr. Guyet, the 2016-2017 school year lease-up was very positive. Nearly all off-campus housing was fully leased by the end of July and rents increased over last year. For the second year in a row the student housing market didn’t have any new product come to market for the school year. UCF New Housing Construction News for the 2016-2017 School Year Mr. Guyet indicated that at UCF there are no new off-campus or on-campus housing properties scheduled to come on line in the next year. So UCF should continue with another successful leasing year in 2017-2018. New Downtown Orlando Campus Proposed Both UCF and Valencia College are planning to build a new downtown campus in Orlando. It will be located in what is currently known as “Creative Village” (the location of the original Orlando Magic basketball arena) and it will have about 7,700 students. Plans call for the new campus to come on line for the 2019-20 school year at the corner of Terry and Livingston streets. 2016 has been a very exciting year for the Membership Committee. Our committee was focused on creating and achieving few goals that will help AAGO continue to grow. Some of the things we concentrated on was reducing the number of drops, increasing the engagement/participation of our members and promoting the effectiveness of AAGO for our industry. AAGO started the year with 144,105 units, 185 management companies and 249 supplier members. Currently, we are at 154,206 units, 189 management companies and 281 suppliers. We are pleased to say, with increases in unit numbers, management companies and supplier members, we have achieved this goal. In addition to increasing our footprint in the central Florida area, we also wanted to get more feedback from our members. This year, our committee helped create a new member and renewal member survey. This new tool will allow the association to get a better understanding on the various ways it can enhance its services for members.

This year, the Membership Committee wanted to create a promotional piece to highlight the impact AAGO makes in the lives of members and the industry as a whole. The committee decided to use a mouse pad that was split into four quadrants to communicate the value of AAGO. Each quadrant on the mouse pad provided information regarding specific AAGO member benefits. These quadrants included networking, education, engagement/involvement and advocacy. Members of the Membership Committee visited each property to thank them for their membership and gave the member a mouse pad for their office. The Membership Committee meets the third Friday of every month at the AAGO office at 9:00am. We are always looking for new faces and fresh ideas to help us continue to grow. White House Toolkit Points to Local Barriers to Affordability Crisis Apartment Industry Advocates, Last month the Obama Administration weighed in on one of the seminal issues impacting local communities and one with which our industry finds itself struggling again – housing affordability. What might surprise you is that the message from the White House was not directed at property owners. The Housing Development Toolkit (available on the whitehouse.gov website) opens with this: Over the past three decades, local barriers to housing development have intensified ...The accumulation of such barriers – including zoning, other land use regulations, and lengthy development approval processes – has reduced the ability of many housing markets to respond to growing demand. The toolkit discusses in specific detail the costs that these barriers impose on local households, the economies and even the environment as well as their role in exacerbating gentrification and income inequality. This is a welcome message from the Administration. As many of you are experiencing firsthand, the issue of housing affordability increasingly dominates local news and policymaker debates. Beyond the statistics, low- and moderate-income families struggle to find housing that meets their needs at a price they can afford. This is an issue in the usual suspect markets on the coasts, but also in places like Austin, Texas, Nashville, Tenn., and Colorado Springs, Colo. While this current crisis is not breaking news, the scale and scope of the problem seem greater than in previous cycles as does the intensity of the advocacy efforts by tenant-rights’ organizations. Last month a few NAA affiliate offices and events were picketed by protesters and in one case, an Association Executive was personally the target of an advocacy campaign. The White House efforts could not come at a better time. What many advocates seem unwilling to acknowledge is that the seeds for our current crisis were sown long ago in local land development and use policies. As the Housing Development Toolkit notes, when the recovery from the 2008 recession began, many communities were not positioned to take advantage:

The toolkit goes on to describe a number of excellent policy options available to local governments to streamline the development process and increase apartment housing supply. Nearly all are positioned as incentives to development and even mandatory inclusionary zoning is described in both mandatory and voluntary terms but the toolkit’s recommendation tilts more towards voluntary incentive for IZ like density bonuses or streamlined approval processes. Rent control is not on the list of policy recommendations. While not on the list of policy recommendations, the toolkit does make a case of sorts for source-of-income protection for Section 8 voucher holders, characterizing a property owner’s choice not to participate in the Section 8 program as “discrimination.” We will continue to respectfully disagree with the Administration on this and stand in support of the freedom of a private owner to take on the responsibilities, and burdens, that come with accepting Section 8 vouchers. NAA has been a vocal, aggressive champion of this program for decades, including its voluntary nature. Also missing from the toolkit is a strategy for fighting NIMBYism (Not in My Back Yard) that pervades in so many jurisdictions. Truth-be-told, many of the hurdles put in the place of apartment development were put there by NIMBYists who would sacrifice anything to prevent more supply of apartments. More and more local governments, with help from private sector employers, nonprofit organizations and others, are standing up to these forces. Those efforts must be replicated around the nation if we are ever to make a dent in this affordability challenge. Nothing in the toolkit is earth-shattering, however, the focus and emphasis it places on local governments and their central role in the affordability crisis are extremely important. Our hope is that local governments listen and future Administrations make the same commitment. Make sure to mark your calendars for the 2017 NAA Capitol Conference and Lobby Day on March 7 – 8. Our goal is to create another record-breaking event, bringing in more advocates to reach all 535 members of Congress. Registration opens in early November.

In a growing number of metropolitan areas, the returning health of the housing market and vibrant job growth haven’t led to resurgent construction industries and expanding housing options for working families, due to state and local rules inhibiting new housing development that have proliferated in recent decades.

There is also of course the added complicating factor of stagnant wages. No- or low-wage growth is hard enough in markets where demand is “normal.” It is downright dangerous in the growing list of markets where exorbitant development costs and red-hot demand accelerate rent increases.

THREE RECENT VERDICTS This article reviews three recent verdicts involving issues that frequently arise in landlord/tenant scenarios. The results give some insight on the “climate” facing landlords in Florida’s court system.

Gallardo was a 60 year old male who was walking in the defendants’ parking lot on September 25, 2010, when he stepped on a banana peel, slipped, and fell to his knees. Gallardo was treated by para¬medics at the scene, but declined transport to the emergency room. Gallardo was later determined to have a left medial meniscus tear and underwent arthroscopic knee surgery. Gallardo contended the injury and the surgery were caused by the fall.

Brastates Import and Export, Inc. vs. B. Tetrault, Inc., et al. Miami-Dade County Circuit Court Case No. 1110662-CA (/2/2/16) Brastates was a business that sold various products to foreign markets and the defendant was a warehouse owner/landlord who rented space to Brastates. Brastates leased the property located in North Miami Beach from the defendant beginning in 1998.

In July, 2010, Brastates told that landlord that Brastates wanted to end the lease agreement. Brastates’ principal was leaving the country and requested that the landlord provided an additional two weeks to remove his personal property. He contended that the landlord agreed and asked the plaintiff to move everything into the adjacent ware¬house. Brastates’ principal testified that he moved his property into the adjacent warehouse and left for Brazil. After Brastates lease was terminated, Brastates contends that its landlord agreed that Brastates could move various belongings into an adjacent warehouse. After Brastates accomplished the relocation of their property, the landlord disposed of the property. On Au¬gust 26, 2010, when Brastates’ principal returned from his trip, he called the landlord to make ar¬rangements to pick up his personal property only to learn that the landlord had “thrown everything out.” Brastates’ principal contended that the landlord never provided any notice that the landlord intended to enter the premises or provide an opportunity for Brastates to remove his belongs. Brastates claimed approximately $56,000 in damages for loss of construction materials, food pro¬cessing devices, display cases, office furniture, com¬puter components, cash register, freezer, filing cabinet, forklift and a motorcycle. He also sought treble damages and attorney fees. The landlord maintained that some of Brastates’ items claimed were never present, others were taken by Brastates’ principal’s nephew (who was left in charge when Brastates’ principal was in Brazil) and the remaining items had no value and were thrown out. The plaintiff sued the landlord company and its manager for conversion and civil theft. In response, the defendants asserted that they were within their rights to throw away the broken and discarded items which Brastates had left behind after terminating the lease. JURY VERDICT: The jury found that the landlord unlawfully converted Brastates’ property and awarded $5,000 on the con¬version claim. The jury found that the landlord had not committed civil theft. Gallardo sued for negligence and the property owner argued that it had no notice of the condi¬tion and no opportunity to correct it prior to Gallardo’s fall. The owners also argued that no banana peel had been dropped. Finally, the owners disputed that Gallardo’s knee condition and surgery were causally related to the fall. In particular, the owners contended that Gallardo had preexisting left knee issues.

JURY VERDICT: In closing, Gallardo’s attorney requested an award of $500,000. Obviously, the jury disagreed since they found no negligence on the owners’ part. The owners have filed motions for costs and attorney fees pursuant to a proposal for settlement and Gallardo has filed a motion for a new trial. Cabrera vs. Wal-Mart Stores, Inc., Case No. 14-CV-24447 (S.D.Fla. 3/23/16) Cabrera was shopping in the defendant’s Wal-Mart Store and he slipped and fell as a result of a foreign substance on the floor, which Cabrera claimed should have been cleaned up by Walmart. Cabrera claimed that he didn’t see the spill on the floor prior to stepping in it and falling. Walmart asserted that it had no notice of the spill and disputed that Cabrera was injured as a result of the fall. Cabrera testified that the fall caused disc bulges in his lumbar spine and an injury to his right knee. Cabrera’s injuries caused him ongoing pain and limitation of motion. Cabrera also stated that he had never injured his back and right knee prior to this fall. Walmart asserted that the spill had just occurred and an employee was on the way to clean up the spill seconds before Cabrera fell. Walmart also noted that Cabrera had a similar slip and fall four years before at a local mall, which Cabrera failed to disclose. In the prior fall Cabrera had complained of the same injuries according to Walmart. As such, Walmart maintained that Cabrera’s conditions and issues preexisted the date of the subject fall. Walmart had even obtained the report of a physician hired by Cabrera’s prior attorney which documented permanent injuries to Cabrera’s knee and back. JURY VERDICT: The jury apparently didn’t like Cabrera’s failure to disclose the prior accident and found no negligence on Walmart’s part. CLOSING: These three cases suggest that a tenant who sues a landlord asserting that the landlord has been negligent does not have a “lock” on the outcome. This is especially the case if the tenant or injured party has been less than candid about their prior injuries or treatment for the same or similar injuries.
