AAGO Advocacy at Work By: Amanda

Since learning of Orlando’s interest in mandating energy benchmarking, AAGO has worked closely with city staff for more than a year and half to express the apartment industry’s concerns. Although the industry fully supports the goal of reducing energy consumption, AAGO members had a variety of concerns with a mandatory energy benchmarking and reporting policy. For example, apartment communities currently lack the ability to access whole-building utility data. This data is not currently available due to technology issues and resident privacy concerns. This fact makes an annual energy-consumption reporting requirement difficult to comply with until the appropriate technology is available.

The apartment industry is seeing a myriad of drastic changes You might be thinking, “What has advocacy done for me lately?” The answer is more than you know! I’d like to take this opportunity to share some exciting advocacy developments for the multifamily industry with you and how they will impact your business. A case and point of our advocacy success is the City Energy Project in Orlando. As a result of AAGO’s proactive efforts to build a positive working relationship with the City of Orlando and our ongoing engagement in the policymaking process, many of the apartment industry’s concerns were addressed in the ordinance that will be presented to the City Council.

The City of Orlando presented the original ordinance draft to AAGO and other stakeholders in March 2016. Upon receiving the draft of the ordinance, AAGO collected feedback from owners and operators regarding the potential impact of the new policy. This feedback was compiled in a report that AAGO shared with city staff on behalf of the apartment industry.

As you may remember, Orlando is part of the City Energy Project (CEP), which seeks to reduce energy consumption for large buildings in cities across the country. Generally speaking, this policy requires large-scale buildings to report energy consumption to the city on an annual basis using the federal Environmental Protection Agency’s (EPA) Energy Star Portfolio Manager tool.

After reviewing the feedback from AAGO and other stakeholder groups, the city made several changes to the ordinance. Below is a summary of the industry concerns and how they were addressed in the new ordinance draft (Draft 2). Noteworthy changes include increasing the building threshold size from 40,000 sq. ft. to 50,000 sq. ft., adding an exemption for multifamily properties that cannot access whole-building utility data and eliminating the retrocommissioning requirement that was in the previous ordinance (Draft 1). While these changes may seem small in nature, their positive impact on the apartment industry is significant.

This tool provides each building with a score on a 0-100 scale so building owners can compare their property with similar buildings to benchmark energy consumption. Supporters of this policy hope this practice will encourage energy efficient improvements for private properties. This reform is part of the Orlando’s Green Works initiative, which aspires to make Orlando an example on the national and world stage for sustainability.

Moving the date for the data to be made available to the public to 2019 will also provide the industry with additional time to plan for how this could impact apartment communities. It is important to note that, 50 is the national average based on Energy Star data. By lowering this figure to 50 or below, we were able to reduce the number of properties that Buildings under Energy Star Score of 50 will be required to conduct an audit or retro-­‐commission the building. 2019

This year is a major election year and it’s not just a question of Donald Trump or Hillary Clinton. Members of Congress will be on the ballot along with many state House and Senate races. In addition, depending on your city or county, several local candidates, who influence everything from impact fees to fair housing will be decided by voters. Last but certainly not least, Florida voters will be making key decisions on constitutional ballot questions such as solar energy, medical marijuana, the homestead property tax credit and a tax exemption for disabled First Responders. Florida makes it very easy for citizens to vote. You have the option of voting early (dates/times vary by county), voting by mail ballot or voting in person on Election Day. As a resident, I thought management teams had the easiest jobs in the world. Planning parties, answering the phone, maybe showing an apartment here and there, how hard could that be? You can only imagine how quickly and dramatically that theory was eviscerated the day I began working onsite. Management teams are a special breed. At its core, teams do their very best to make sure residents are happy where they live. Aside from putting in long hours, dealing with a multitude of different resident personalities and watching the bottom line to ensure owners are profiting from their investments, teams also have to contend with notso-nice things being said about their performance in online forums. Reputation management has become prominent and prevalent in recent years. Back in the day when I was leasing, very rarely would a prospect mention that our online reviews were the reason we were chosen over a competitor. Nowadays, it’s commonplace for a prospect to outright take a community out of contention or sign on the dotted line purely based on what they read online. Just as a community’s reputation is vital to its success, a resident’s own reputation can determine where they call the next year “home”. Our most recent analysis, suggests that residents are becoming increasingly aware of how their community makes them look in the eyes of those closest to them. “Do people think I’m an idiot for living here? Am I proud to invite friends over to my apartment?” Questions such as these are being asked by residents – they believe what you do and don’t do impacts the way they are viewed by the world. So aside from all of the other tasks management teams must conquer on a daily basis, residents have added yet another to the list: manage my personal brand. A parent of a successful offspring, let’s use a doctor for example, makes sure at every opportunity to drop that little factoid into any conversation, even if it doesn’t pertain to the subject at hand. “My son John, the pediatrician, made the best lasagna the other evening.” Huh? What does lasagna have to do with taking care of sick children? To the parent, it doesn’t matter if the connection is nonexistent; they believe the perception others have of them is enhanced by the success of their child. People care about what others think of them. We all do. Here are 5 things management teams can do to elevate the personal brand of its residents and improve the community’s reputation in the process.

Make them famous – if you want them to brag, let it be about them. Ask residents to share their hobbies/expertise with others; that’ll get tongues wagging. “You won’t believe this – I was asked to share my homemade ice cream recipe in the next newsletter!” or “The manager asked me to conduct a class on balcony decorating because they said I have one of the nicest balconies in the community!”

3. Let them win – why not?

Put next season’s landscaping colors to a community wide vote. Those who helped choose the winning colors will post photos with captions like “Check out the new flowers – my choice was the winner!” Even those who voted for another option will talk about it too. “Yeah, the purple pansies are nice but I voted for the orange chrysanthemums.” Wait, you guys get to vote on that stuff? And so goes the conversation.

Make them laugh – show them you’re human.

A joke of the day or funny pic posted to social media will have them in a good mood; and sharing the content. Sharing your content means sharing your community’s page. You never know who is in the market or knows someone in the market for a new place to call home.

Ask them to help – if you build it, they will talk.

Create an environment where residents are engaged, and willing to collaborate. A resident advisory panel is a great idea and those who participate will definitely share their experiences with friends and family. “Last week at our resident meeting, we decided to have a community team for the March of Dimes walk.” To keep things fair, rotate the panel every other month to allow multiple residents an opportunity to participate. When residents are talking about where they live, the conversation is either positive or negative. The same is true for online reviews. Rarely is the story somewhere in between – it’s either one extreme or the other. If the story is negative, friends and family are sure to respond “Why are you still living there?” or “You are crazy for putting up with that”, detracting from the resident’s personal brand. No longer does the negative solely make the community look bad, it affects the resident. And the last thing a resident wants to do is pay good money for a tarnished reputation. But when residents are proud, like that parent of the pediatrician, they will make every effort to name drop the community as much as possible, whenever possible. Give them something good to talk about it!

1st Qtr 2016 Apartment Market Survey & Trend Reports: Comparing the Orlando, Tampa, and Jacksonville Markets This month, we thought it would be fun to compare a few snippets of data we collected from this year’s 1st Quarter Apartment Market Survey & Trend Reports, or “AMSTR”, for the Orlando, Tampa, and Jacksonville markets. During this particular report cycle, we had more than 360,000 units participate out of the ±436,000 units (about 83%) that met the reporting criteria. A Look at Average Rents Trends The rent trends shown in the table below are the overall average rents for “All Units” in each the 3 regions studied. The data shows all three markets have enjoyed a long successful run of increasing rents. The Orlando market has commanded the highest rents in each of the last 7 report cycles. From 1st Quarter 2013 to 1st Quarter 2016, Orlando’s average rents rose $130 to top out at $1,022 (up 14.57%). During the same time period, Tampa saw the highest gains as rents increased by $135 to reach $1,010 (up 15.43%). Jacksonville’s rents moved up $84 over the past three years and came in at $892 (up 10.40%).

This new inventory can adversely affect occupancies in the short term as the newly opened communities go through the lease up process. This may be the reason as to why both Orlando and Jacksonville saw slight decreases to the overall occupancy in their respective markets. It will be interesting to see what the 3rd Quarter 2016 AMSTRs will show in regards to these trends. About the AMSTR

The occupancies in the Occupancy Trend Chart below represent the physical occupancy for “All Units” in each the 3 regions studied. The Orlando market had the highest overall occupancy in each of the last 7 reports cycles. Meanwhile, Tampa and Jacksonville have swapped the 2nd and 3rd place positions several times over the past three years. From early 2013 to early 2016, Orlando saw occupancy move to the upside from 94.49% to 96.63%. Tampa ascended from 94.04% to 96.16% and Jacksonville climbed from 92.75% to 95.49% during the 3 year study period.

With a huge increase in sustainable participation, the YP Committee is able to double down on its efforts to give back to the community. In May, our Young professionals came together to support those in need. Raising money and donating supplies to a local community who suffered a tragic fire and had numerous families that lost everything. Thousands of dollars in gift cards, numerous bags of clothes, toys, formula, cleaning supplies and basic toiletries were just a few of the items donated. On July 1st, the Young Professionals, along with the AAGO Foundation, helped a local Non-Profit put on a BBQ for the surrounding community. From the sizzling grill to the arts and crafts, all who participated had a satisfying and humbling experience giving back to the community. With the BBQ smell still fresh in the air, the YP committee also extended a helping hand for the second annual successful Apartment Industry Job Shadow day. For the second year in a row, the Apartment Association of Greater Orlando (AAGO) and the AAGO Foundation, Inc. partnered with

Goodwill of Central Florida, Community Based Care of Central Florida and the City of Life to provide a hands-on job shadow experience for central Florida foster youth. Our Young Professionals were on the front lines, volunteering to work directly with the youth side by side, sharing their experiences, daily duties and how our suppliers and management teams work together. In addition to working side by side with on site management, some of the youth were able to experience some pretty cool marketing techniques like trying out the new virtual tour goggles from ForRent. Others were able to meet with Affinity Waste solutions and design a sales presentation for a manager. Within two weeks, we already have a success story with one of the youths, Kamisha, who is starting as a leasing agent with BG Staffing this week! While giving back to the Community is a vital part of our mission, we also value the need to enhance the professional development of our youth in the industry. Through hosting monthly networking events, bi-annual speakers, and encouragement of association participation we have helped many achieve their professional goals. We encourage all to come and engage in our lively meetings and mingle with the committee members. You just may surprise yourself and exit with some insight that will continue to keep the association going strong. We’ll leave you saying “I’m with them!”

Dear Harry, We have a resident who comes into our office on occasion and literally screams at us. Nothing will make her happy, and she complains about everything. Recently, she did this in front of two prospects who were so shaken up by her that they hastily left the office, never to return. We certainly have dealt with irate residents in the past, but this situation is different, and we expect it to continue. Can we prevent her from coming into the office? This is seriously interfering with our business. Signed: “Bullied in Bartow” Dear Bullied, Under Florida Statutes Section 810, you are able to have a trespass warning served upon this resident, prohibiting her from entering your office. Call law enforcement in your area, either the sheriff’s department or the local police, if applicable, and have them come and meet with you in person. Explain to them the severity of the situation, and how you do not wish that this resident step foot in your office. The resident will receive what is called a “trespass warning”. This instructs the resident not to come back into the office, and if she does, you can have her arrested or charged with actual trespassing. Trespassing your own resident is a pretty radical move, but sometimes necessary. In addition to trespassing the resident or prior to trespassing the resident if you want to hold off on the trespass warning process, make sure you serve the resident with a proper Seven Day Notice to Cure with wording assistance by your attorney to make sure it is correct. If the resident is to pay rent to the office, make sure that this trespass warning does not affect the ability of the resident to pay the rent. Unless the rent payments are usually made online, you may have to allow this resident to pay the rent in an alternate fashion, such as by mail, if you indeed trespass the resident from the office. Dear Harry, We have a fairly large pond on our property that does have alligators and has for years. In fact, many of our residents like this and often go out and observe them. If we spot a really large alligator, we call the city and they will come out and remove it, as a clear danger is presented. In light of

the recent tragedy at Disney, should we be doing anything differently to warn our residents of the dangers? Are there any laws regarding this? Signed, “Wary in Winter Haven” Dear Wary, There is currently no specific law or legal requirement for signage or warnings concerning the dangers of alligators. We recommend that you begin taking some action by creating a notification to all of your residents of the presence and dangers of alligators in your pond, hand delivering the notification in person, or posting on residents’ doors in their absence. Feeding the alligators and swimming should be clearly prohibited in your pond, with fishing allowed only if there is a safe dock provided for the residents. Signage needs to be posted around the pond in areas accessible and visible to the residents, and in some cases even fencing is advisable. Contact your attorney, insurance carrier and the local authorities for guidance with this issue. There may come a time when there is a legal obligation to inspect and guard against the presence of all alligators in your ponds. In the meantime, make every effort to warn of the dangers, and if you see a resident or occupant not heeding your warnings, take swift action against that person to show your serious efforts at gaining compliance. Many apartment communities have immediately begun the signage process. Dear Harry, If we have an applicant that has poor credit or no credit at all, such as occurs with some students, our company requires a guarantor of the lease. We run a background check on the guarantor, and everything checks out, we allow that person to be the guarantor. This has never become an issue until just recently. Upon renewal of one of our resident’s lease, a guarantor called and emailed us stating that he is revoking the guaranty of the lease and will not guaranty the renewal. The only thing different about the renewal lease is that there is a change in one of the residents and a rent increase. Our guaranty agreement states that the agreement applies to the lease and “any renewals”. Can the guarantor do this? Signed, “Renewing in Eustis” LegaLine

Dear Renewing, Most lease guaranty agreements have a clause in the document stating that the guaranty applies to the lease and “any renewals”. Therefore you would assume that you don’t need to do anything with the guarantor other than to maybe notify him that the lease has been renewed. Some courts have held that the guaranty agreement only applies to the very first lease and not to renewals unless a new guaranty agreement is signed. Additionally, if you have new or different residents on the renewal lease, or any terms or conditions have changed, the guaranty agreement may not be enforceable. Prior to renewing any resident’s lease when there is a guarantor in place, make sure you notify the resident that the lease renewal is conditioned upon having a new guaranty of lease document being signed, as was true at the outset of the tenancy. Do not rely upon the guaranty agreement signed at the initial move-in of the resident, particularly if terms have changed. If you do have a guarantor in place, make sure he is provided with a full copy of the lease, rules and regulations, as you do not want the guarantor to claim that he did not know what obligations were in fact being guaranteed. Dear Harry, Occasionally, when a resident moves out, we find extensive damage due to small unreported leaks, particularly water damage under the sinks. The damage is usually caused by a small leak in a drain or water supply line, or sometimes is due to the resident allowing too much water to accumulate on the counter around the sink, where it makes its way to the cabinet below. We just had one situation where it cost us over $2000.00, as not only did we have water damage, but mold had grown and spread behind the cabinets in the kitchen. Never have we been able to recover the cost from the resident despite all our efforts. Is there any solution to how we can get them to pay? Signed, “Dealing with Leaks in Deland” Dear Dealing, The real problem is your inspection procedures or lack thereof. Rarely does this damage occur quickly. Rather, it happens over time, and is either unnoticed or goes unreported. Typically when a unit inspection is periodically undertaken, the inspection is cursory, as you are looking for obvious damage or housekeeping issues. You need to go deeper, and inspecting under each cabinet is crucial. In addition, this is a good time to check each and every water supply line and drain for leaks or the need for replacement. Overall, water damage is the most common costly item, and most of this damage is preventable. As for making

the resident pay, good luck. The resident will state that it is not her fault, she was not aware of it, and you most likely will not be able to prove how long the damage has been occurring or when the leak initially started. Sit down with your maintenance staff, discuss these often overlooked items, and be proactive and thorough in your inspections. Dear Harry, We require our residents to get renter’s insurance, and most do. Recently one of our residents fell asleep with the bathtub filling, causing thousands of dollars in damages to his unit and the two below. It turns out that his renter’s insurance only covered the damage or loss to his own personal property. The resident has no savings, and we are lucky we even get the rent each month from him. What good is renter’s insurance? Signed, “Cleaning up in Clermont” Dear Cleaning Up, You simply are not requiring the proper type of renter’s insurance. The most common and cheapest renter’s insurance only covers loss or damage to the contents of the resident’s unit. While this insurance is a step in the right direction, it is by no means sufficient to protect you. Your company probably has insurance for incidents and damages such as this, but most likely the policy is subject to an incredibly high deductible, so that typically the first $25,000.00 to $50,000.00 of any insurable event has to be paid by your company. If you require renter’s insurance of your residents, you need to specify what kind of insurance you want them to get. The kind you want them to get also covers liability. This coverage would apply if they or a guest is injured in the unit, or if they do something negligently and cause damage to your property. Floods and kitchen fires are a common source of damage. Without liability insurance, the residents will not have any coverage for the damage that they cause, and you are correct that collecting from residents in this type of situation is usually next to impossible. Provide your residents with flyers and information from various insurance companies, tell them in writing what type of coverage they must get, and most importantly, make sure they not only obtain the insurance initially and prove this to you before you release the keys to them, but that they maintain the coverage throughout their tenancy. Many will pay for the first quarter or month and then stop paying. You will most likely not be notified, and even if they had the proper insurance when they moved in, there will end up being no coverage at all. Revised 7/29

June 28th was certainly a night to remember as the Legislative Committee hosted its 3rd annual APAC/NAAPAC Fundraiser. The event was held in the unforgettable Dinosaur Exhibit at the Orlando Science Center. Guests thoroughly enjoyed heavy hors d’oeuvres, music, and the exhibit itself. Attendees also had the opportunity to meet our special guest State Senator Darren Soto (candidate for Congress). Together we raised nearly $10,000 for APAC and NAAPAC combined at this year’s fundraiser. In addition, we had over 90 attendees that supported the PACs and over 45 wine bottles donated! AAGO was the first association to pull off a joint fundraiser benefitting both APAC and NAAPAC. The overall goal for the PACs is to support candidates who understand the challenges we face in the multifamily industry and ensure our interests are being represented. A tremendous thank you goes to our sponsors and host committee for helping us make this event come to life. Of course, we would not have had the success of our event without our attendees. Thank you all! We look forward to seeing you at our legislative committee meetings (4th Tuesday each month at 9:30 AM).

An Incredible Year for Grassroots Advocacy Apartment Industry Advocates,

estate intended to generate fee settlements rather than address a genuine ADA design deficiency. The legislation preserves the goals of the ADA while providing owners 120 days to correct any deficiency before litigation can begin. Thanks to strong advocacy efforts, this bipartisan legislation passed out of the House Judiciary Committee with the support of Republicans and Democrats. This is a critical step that increases the chances of final action before the end of the year.

We’ve reached the mid-point of the second session of the 114th Congress, but in many ways it feels like the end of the session. Most of the heavy legislative lifting that can get done before the elections has been completed. The campaign for the White House and 435 public service jobs in the House and 34 in the Senate has taken every bit of oxygen in the room. There are only a handful of legislative days left in the year during which only the redlabel tasks will get accomplished. In March, NAA hosted another recordbreaking Capitol Conference, drawing more than 700 attendees to Washington, D.C., to advocate on Section 8 Housing Choice Vouchers, Flood Insurance and Americans with Disabilities Act (ADA) litigation. More than 500 advocates went to Capitol Hill sharing our perspective and pressing our case for action in these areas. The work at the Capitol Conference and follow up grassroots outreach later in the spring has generated real results in all areas. In July Congress passed and sent to the President’s desk the “Housing Opportunity through Modernization Act.” Top among this legislation’s key components is a reform of the inspection process for apartment homes to be rented by someone using a Section 8 voucher. Now, units that have been inspected in the previous 24 months do not have to be inspected again before a voucher holder moves in. This will eliminate weeks of delay for low- and moderate-income families trying to find a home and thousands of dollars of lost revenue for apartment owners and operators. Reform of the ADA litigation process also made significant progress during the first half of 2016. The “ADA Education and Reform Act of 2015” would address a growing trend of “driveby” lawsuits against owners of commercial and residential real

Finally, legislation to expand private market flood insurance coverage options is halfway towards passage by the Congress. The “Flood Insurance Market Parity and Modernization Act” would help address the limited – and typically expensive – sources of flood coverage in the private marketplace. Most importantly, it would increase the protection of apartment communities across different markets and whenever it is needed. The bill passed the House of Representatives unanimously and is now in the hands of the Senate. Based on our experience with Section 8 voucher reform, such a strong bipartisan showing in the House dramatically increases our chances of positive action in the Senate. As you can see, this year has been marked by strong advocacy performance by ourselves as advocates on reasonable, targeted and bipartisan policy initiatives. But our work is not over. There are many more policy concerns for us to tackle both this year and when the new Congress and Administration arrives in 2017. And speaking of 2017: Make sure to mark your calendars for the 2017 Capitol Conference and Lobby Day on March 7 – 8. Our goal is to create another record-breaking event, bringing in more advocates to reach all 535 members of Congress. Registration opens in early November. Thanks for reading. A FEW OUT OF STATE VERDICTS REINFORCE WHY IT’S GOOD TO BE A FLORIDA LANDLORD… Florida may be hot and sometimes the rains become “monsoons.” These issues, however, pale in comparison to some of the issues that out of state, “up north” landlords face. This article will examine a few jury verdicts involving out of state landlords. Case: Santana vs. AMB Property Corporation, et. al. Passaic County NJ Case No: PAS-L-0123-13 (10-2815):

Plaintiff sued both the apartment owner and the manager. The apartment owner and manager argued that they acted reasonably in treating the sidewalk the night before the fall, and also continuing their treatment again the next morning. They also pointed out that the plaintiff was aware of the icy conditions. As such, the plaintiff was comparatively negligent in causing the fall.

The Barnes Verdict: The jury was sympathetic to The Santana Facts: The plaintiff was a female who Barnes and found the defendants 90% negligent and By: Kevin Knight asserted that the defendant (landlord of her employer) Barnes 10% comparatively negligent. Ironically, the was negligent in failing to properly plow and salt the employer’s jury found that Barnes’ comparative negligence did not cause parking lot during a major snow and ice storm that lasted almost her injury. As such, the jury didn’t reduce the amount of the three days. The plaintiff was a mail handler and normally came to verdict for Barnes’ comparative negligence. Barnes was awarded work after midnight and before her 1 a.m. shift. On the date of $847,362 in damages. This award was reduced to $575,000 her accident, she parked, got out of her car and fell on black ice. because the parties had agreed pre verdict to a high/low of $250,000/$575,000. As a result of her fall, plaintiff suffered a tear of the medial meniscus and two lumbar bulges with radiculopathy. She Case: Jack Aguilar a minor by William Aguilar vs. 214-7 CVP claimed that the defendant landlord was negligent, as was the Holdings, LLC, dba City View Place Apartments, Harris County, snow removal company hired by the landlord. Texas Case No. 13-20015 (10-23-15): Both the landlord and the snow removal company disputed their negligence. They pointed out that the parking lot had been plowed and salted several times in the last few days prior to the snow and ice. They also contended that the extensive amount of snow and ice and the presence of black ice did not constitute negligence on their part. The plaintiff pointed out that the invoices for the snow removal did not reflect such an extensive amount of work being done both in terms of the hours work or workers involved. The Santana Verdict: The jury was sympathetic to Santana and found the landlord 70% at fault and the snow removal company 30% at fault. They awarded Santana $2.225 million. Case: Barnes vs. Campus Apartments, Philadelphia County Case No: 13-102109 (11-20-14): The Barnes Facts: the plaintiff was a female who was injured leaving the defendant’s apartment building. She slipped and fell on an icy sidewalk and asserted that the defendant was negligent for failing to treat the sidewalk for safety. As a result of her slip and fall, plaintiff suffered a dislocated right ankle fracture which required surgery (i.e., an open reduction and internal fixation of the fracture with casting). Plaintiff’s past medical expenses were $47,362. 40

The Aguilar Facts: plaintiff was a minor male who gained access to the defendant’s pool area and nearly drowned. Plaintiff’s parents sued the property owner based on negligence for failing to properly cordon off the pool with adequate fencing. Plaintiff’s parents asserted that as a result of the near drowning, the minor plaintiff suffered an anoxic cerebral injury that affects his speech, short-term memory and cognitive function. He has learning and behavioral issues allegedly as a result of the incident. The defendants denied that they were negligent. The Aguilar Settlement: prior to going to trial, the parties settled plaintiff’s claim for $1,450,000. CONCLUSION: While Florida landlords don’t have to deal with snow claims, they do encounter slip and fall claims, especially with mold and other naturally growing plants, etc. Additionally, Florida landlords with pools and natural bodies of water also have to deal with drownings and near drowning claims. The key to avoiding these types of claims involves: (1) anticipating and envisioning the type of claims that might occur; (2) taking preventative measures; and (3) being consistent in routinely and regularly evaluating hazards and taking remedial measures.
